Briefing about the guidelines issued by the Department of Personnel and Training (DoPT) in the wake of the third wave of the pandemic, Union Minister of State (Independent Charge) Science & Technology; Minister of State (Independent Charge) Earth Sciences; MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh today said that pregnant women employees and Divyang employees have been exempted from attending office. However, they will be required to remain available and work from home.

All officials and staff living in the Containment Zone shall also be exempted from coming to office till the time Containment Zone is denotified, he added.

The Minister further informed that the physical attendance of government servants below the level of Under Secretary has been restricted to 50% of the actual strength and the remaining 50% shall work from home. Roster will be prepared accordingly by all the departments concerned, he added.

However, the Minister said, the officials/staff who are not attending the office and are working from home shall remain available on telephone and other electronic means of communications at all times.

In view of the rapid spread of the Virus infection, Dr Jitendra Singh said that a DoPT O.M. has been issued with the advice that the official meetings shall be conducted as far as possible through video conferencing. Similarly, personal meetings with visitors are to be avoided, unless absolutely necessary, he said.

In order to avoid overcrowding in the office premises, the Minister said, the officials/staff shall follow staggered timings i.e., (a) 9 am to 5.30 p.m. and (b) 10 am to 6.30 p.m.

Meanwhile, DoPT has advised all the officers/staff to ensure strict compliance of COVID-appropriate behaviour i.e. frequent washing of hands/sanitisation, wearing face mask/face cover and observing social distancing all the time.

Proper cleaning and sanitisation of the workplace, particularly frequently touched surfaces, may also be ensured.

Dr Jitendra Singh said that the guidelines issued as per the DoPT O.M. will remain in force till 31st January 2022. In the meantime, regular review will be carried out from time to time and the guidelines may be revised accordingly depending on the situation.

PCDA and its subordinate offices in Lucknow will operate at 50% capacity (within the office), with the remaining 50% required to work from home. The officers in charge of different sections and sub offices will inform the PCDA (CC) of the details of their rosters prior to implementing the roster system. The roster system will be in effect until April 30, 2021.

Ref: This office even no. circular dated: 14/09/2020 and 20.11.2020.

1. The office of PCDA (CC) had been issuing various circulars from time to time in order to contain the spread of the COVID-19, and in compliance of various orders/ guidelines issued from MHA, MoHFW and state Govt. issued from time to time.

2. As a result of coordinated efforts of all the personnel and sub-offices we have been successful in containing the spread of COVID-19 cases within the office of the PCDA (CC) and other sub-offices under its jurisdiction. However, a fresh surge in COVID 19 cases is a matter of concern and an active and concorded cooperation is essential to fight against the spread of new COVID-19 wave.

3. Following instructions are being issued with an immense hope that all the employees shall not only follow them but will also extend full cooperation in the fight against COVID-19 in order to safeguard peers and that of families:-

• i) In case any employee experiences any symptoms (like cold, cough, fever, respiratory ailments, etc.), he/she will immediately inform the same to his reporting officer, who in turn will promptly report it to administration. He/she will thus obtain permission to work from home without reporting to the office.
• ii) Anyone who suspects contamination should immediately get themselves tested and in case found (+)Ve shall report to the office only after a quarantine period after obtaining a negative report.
• iii) Those who have come in contact or got exposed to infected people, should immediately isolate themselves and maintain social distancing at the workplace.
• iv) Wearing a face mask is compulsory at all time.
• v) Social distancing shall be religiously followed.
• vi) Spitting is strictly prohibited as it leaves the premise vulnerable to infection
• vii) Those suffering from co-morbidities and are vulnerable to infection shall be allowed to work from home, after obtaining the permission, on case to case basis.
• viii) All the employees shall cooperate with the security at the main gate in screening and sanitizing the hands.
• ix) The office and sub-offices shall be sanitized twice a day.

4) Apart from the above instructions the PCDA (CC) and the sub offices located at Lucknow, Varanasi, Prayagraj and Kanpur under its jurisdiction shall work at 50% strength (within the office), and the remaining 50% shall be allowed to work from home. The reporting officers shall ensure that the work is not adversely influenced, accountability and discipline maintained and those allowed to work from home shall report to office whenever called upon. Before implementing the roster system, the officer in-charge of various section and sub offices will intimate to the PCDA (CC), the detail of their rosters. The roster system shall be effective till 30/04/2021.

5) It is also called upon that various instructions issued by MHA, MoHFW and state govt. be strictly followed within and outside the premises, as the same are enforceable under section 144 CrPC, Section 51-60 of Disaster management Act, besides legal action under 188 of IPC.

6) It is thus the professional and moral responsibility of all of us to follow the above instructions in letter and spirit, without exception and ensure the safety at work place and at home. It is also needed to underscore that a very judicious balance is to be made between the safety of all concern and overall performance, accountability and discipline within the organisation.

Subject: Clarification regarding admissibility of Transport Allowance during Nation- wide Lockdown due to Covid-19 Pandemic.

Sir,

We have for reference the letter cited under reference and submit the following:

An unprecedented situation arose due to Covid-19 due to which the Government took a very thoughtful decision to impose a Nation-wide lockdown w.e.f. 23/03/2020. Guidelines were thereafter issued from time to time on the matter.

As part of the Government decisions/guidelines, Government employees were directed to remain at home and continue rendering their services through the Work-From-Home mode.

In view of the above, the subject clarification is not only distasteful, contrary to existing rules, and contrary to Supreme Court Orders, but is a glaring example of non application of mind and therefore needs to be quashed.

We submit that extant orders on non admissibility are restricted to the following situation only in case of “Employees during absence from duty for a full calendar month due to Leave under any leave rules/Training/Tour etc…” implying due to personal reasons only.

In the instant case the employees were not absent but were “directed by the authorities” to work from home.

Without prejudice to the above, we draw your attention to the Judgement of the Hon’ble Supreme Court in CA No.11527 of 2014 (arising out of SLP (C) No.11684 of 2012 in State of Punjab and Others etc vs Rafiq Masih (White Washer) etc., and DOP&T Letter No.18/03/2015 Estt. (Pay-I) dated 02/03/2016 on the subject issue.

It may be pertinent to note that the Para 5 of the above cited DOP&T Instructions clearly mentions that the decision about recoveries has been taken after “express approval of the Department of Expenditure” on their OM dt. 06/02/2014.

In view of the above, it is requested that the subject letter may be withdrawn immediately.

Subject: Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19) – Attendance regarding.

The undersigned is directed to refer to OM of even number dated 23rd April, 2020 on the above-mentioned subject. Ministry of Home Affairs, vide its Order dated 17.5.2020, has since directed that lockdown measures to contain the spread of COVID-19 shall continue for a period up to 31.5.2020 and has prescribed guidelines on the measures to be taken by various authorities for containment of COVID-19 in the country.

2. In Annexure II of the guidelines, specific measures, in the form of National Directives for COVID-19 management and Additional directives for Work Places have been prescribed (copy enclosed). In accordance with these guidelines, and with a view to enabling implementation of social distancing norms, it has been decided that the attendance in Central Government offices shall be regulated as follows:

(a) All officers of the level of Deputy Secretary and above shall attend office on all working days.

(b) For regulating the attendance of officers and staff below the level of Deputy Secretary, all Heads of the Department shall prepare a roster so as to ensure that 50 percent of officers and staff attend office on every alternate day. Those officers/ staff who are not required to attend office on a particular day, shall work from home and should be available on telephone and electronic means of communications at all times.

(C) All Heads of the Department shall also ensure that the 50 percent of officers and staff who attend office observe staggered timings, as under:-

1st shift: 9 AM to 5.30 PM
2nd shift: 9.30 AM to 6 PM
3rd shift: 10 AM to 6.30 PM

3. The above instructions shall be in force with immediate effect and until further orders. Bio-metric attendance shall continue to be suspended until further orders. The Heads of the Department may kindly ensure strict compliance of these instructions as well as the directives of Ministry of Home Affairs.

Annexure II

National Directives for COVID 19 Management

i. Wearing of face cover is compulsory in all public and work places.

ii. Spitting in public & work places shall be punishable with fine, as may be prescribed in accordance with its laws, rules or regulations by the State/ UT local authority.

iii. Social distancing shall be followed by all persons in public places and in transport.

iv. Marriage related gathering shall ensure social distancing, and the maximum number of guests allowed shall not be more than 50.

v. Funeral/ last rites related gathering shall ensure social distancing, and the maximum numbers allowed shall not be more than 20.

Vi. Consumption of liquor, paan, gutka, tobacco etc. in public places is not allowed.

vii. Shops will ensure minimum six feet distance (2 gaz ki doors) among customers and shall not allow more than 5 persons at the shop.

Additional directives for Work Places

viii. As far as possible, the practice of work from home should be followed.

ix. Staggering of work/ business hours shall be followed in offices, work places. shops, markets and industrial & commercial establishments.

x. Provision for thermal scanning, hand wash and sanitizer will be made at all entry and exit points and common areas.

xi. Frequent sanitization of entire workplace, common facilities and all points which come into human contact e.g door handles etc., shall be ensured, including between shifts.

xii. All persons in charge of work places shall ensure social distancing through adequate distance between workers, adequate gaps between shifts. staggering the lunch breaks of staff, etc.

Central Government Employees with an option for work from home for 15 days per year

As a matter of policy, the Department of Personnel and Training (DoPT) may provide the qualifying officers / staff with the opportunity for work from home for 15 days in a year.

The Expenditure Department may consider reimbursement of data uses for domestic officers and, if necessary, may issue separate guidelines in this regard, “said the draft guidelines.

It proposed an additional protocol for all matters relating to the VIP and Parliament which require utmost attention.

Therefore SMS alerts are sent to the next officer in the channel for all such receipts and files, “he said.

The draft guidelines specified that the ministries / departments concerned, which are not yet using the e-office module, should make “time-bound” efforts to incorporate it promptly in their secretariat, attached and subordinate offices.

Roughly 75 ministries / departments are currently actively using e-office platforms, 57 of which have achieved more than 80 per cent of their work. E-office refers to the digitisation / computerisation of the work of the office.

“Secret papers / files” can not however be accessed from home when working.

Government Employees National Confederation – Changes of Labour Laws by several States

No classified information shall be handled via e-office according to the instructions of the Ministry of Home Affairs. Therefore, confidential files during work from home are not to be stored in e-office, “it said.

In consultation with Home Ministry, the NIC may evaluate the current security protocol for remote access to classified file / information, and recommend acceptable guidelines and standard operating procedures for handling classified information in e-office, the guidelines said.

Until the time confidential files are processed on standalone computers only as stated in the Manual of Office Procedure of the Central Secretariat (CSMOP),’ he said.

The Ministry of Personnel has said that the officers to whom official laptops are provided must ensure that they do the official work only in official device.

NIC must ensure its computers are well protected from malware and malicious websites. Officers working on their personal computers / lap tops will ensure that they install regular updates, run antivirus scans, block malicious sites, etc. with the help of NIC to ensure their device’s security against information theft, “the guidelines said.

Officers who operate from home need to be available on the phone according to their officers’ specifications and instructions, it said.

To facilitate inter-ministerial consultations, there may be seamless exchange of files between ministries in e-office, the guidelines said.

The video conference facility of the NIC is used to arrange important meetings when working from home. Officers and staff will attend the meetings by activating the VC link sent to them by NIC at the formal meeting established. VCs shall also be used as far as possible in office environment to maintain social distancing during COVID 19 pandemic,” it said.

The NIC was asked to reinforce the VC to make it more facilitative.

“All office environment standards shall be adhered to by officials working from home while attending VC meetings,” the guidelines said.

“All central government departments were asked to send their comments by 21 May, in the absence of which the ministry / department would be presumed to comply with the proposed draft,” it said.
