<h3 class="wp-block-heading">Subject: Entitlement on voluntary retirement from Government service in respect of Central Government servant covered under the National Pension System.</h3>



<p>The undersigned is directed to say that the Department of Pension and Pensioners’ Welfare has notified the Central Civil Services (Implementation of National Pension System) Rules, 2021 to govern the service related matters of Central Government civil employees covered under the National Pension System.</p>



<p>2. Rule 12 of the Central Civil Services (Implementation of NPS) Rules, 2021 provides for voluntary retirement from service and entitlement on voluntary retirement from Government service in respect of a Central Government servant covered under National Pension System. The rule provides that at any time after a Central Government employee covered under NPS has completed twenty years’ regular service, he may, by giving notice of not less than three months in writing to the appointing authority, retire from service.</p>



<p>3. The notice of voluntary retirement given under sub-rule (1) shall require acceptance by the appointing authority. However, where the appointing authority does not refuse to grant the permission for retirement before the expiry of the period specified in the said notice, the retirement shall become effective from the date of expiry of the said period.</p>



<p>4. Government servant may make a request in writing to the appointing authority to accept notice of voluntary retirement of less than three months giving reasons therefore. The appointing authority, on receipt of such a request, may consider the request for curtailment of the period of notice of three months on merits and if he is satisfied that the curtailment of the period of notice will not cause any administrative inconvenience, the appointing authority may relax the requirement of notice of three months.</p>



<p>5. Government servant who has chosen to retire under this rule and has given the necessary notice to that effect to the appointing authority, shall be precluded from withdrawing his notice except with the specific approval of such authority. However, the request for withdrawal shall be made at least fifteen days before the intended date of his retirement.</p>



<p>6. This rule shall not apply to a Government servant who, &#8211;</p>



<ul class="wp-block-list">
<li>(a) retires under the Special Voluntary retirement Scheme of Department of Personnel and Training relating to voluntary retirement of surplus employees as notified by their Office Memorandum No. 25013/6/2001-Fstt. (A) dated the 28th February, 2002 as amended from time to time; or</li>



<li>(b) retires from Government service for being absorbed in an autonomous body or a public sector undertaking.</li>
</ul>



<p>7. Government servant, on voluntary retirement from service, shall be entitled to benefits admissible under the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015 to the Subscriber retiring on superannuation.</p>

<p>8. If the Government servant intends to continue his Individual Pension Account or to defer payment of benefits under the National Pension System beyond the date of retirement, he shall exercise an option in this regard in accordance with the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015.</p>



<p>9. All Ministries/ Departments are requested that the above provisions regarding entitlement on voluntary retirement from Government service in respect of a Central Government servant covered under the National Pension System may be brought to the notice of the personnel dealing with the NPS matters of employees in the Ministry/ Department and attached/ subordinate offices thereunder, for strict implementation</p>

<p>Dear Sirs,</p>



<p>The undersigned is directed to refer to Item No. 12/2011 raised by the staff side in DC.JCM meeting. This item could not be discussed during the last DC/JCM meeting held on 05-06 October 2021 due to paucity of time. However, the matter has been examined in consulation with Concerned Directorates. Instructions for considering Compassionate Appointment to the wards of partially, medically de-categorized staff who seek voluntary retirement are in existence vide Board’s letter No. E(NG)II/1995/RC/1/94 dated 14.06.2006. subject to conditions mentioned therein.</p>



<p>As regards the issue of settlement dues to such staff, position has been clarified to the Railways vide Item (ii) of-Board’s letter No. E(NG)I/2001/RE-3/9 dated 18.09.2002. The demand raised by the Staff side already stands covered under the extant instructions.</p>



<p>Therefore, the item may be treated as closed.</p>



<p>It is hoped that the Federations will appreciate the above position.</p>

<p><strong>VR = Voluntary retirement, R= Resignation</strong></p>



<p>The number of resignation and voluntary retirement cases vary from year to year and no trend in this regard has been observed.</p>



<p class="has-text-align-center"><strong><a href="https://centralgovernmentnews.com/voluntary-retirement-scheme-for-central-government-employees-2/" target="_blank" rel="noreferrer noopener">Voluntary Retirement Scheme for Central Government Employees</a></strong></p>



<p>No specific study for ascertaining the reasons for voluntary retirement/resignation by Force personnel has been conducted. However, an analysis carried out by the Forces indicates that personal and domestic reasons including children/family issues, health issues of self or family members, social/family obligations and commitments, better career opportunities are some of the major reasons for voluntary retirement/resignation.</p>



<p>This was stated by the Minister of State for Home Affairs, Shri Nityanand Rai in a written reply to question in the Rajya Sabha today.</p>

<p>In the light of Section 20 of Rights of Persons with Disabilities Act, 2016, and the Hon&#8217;ble Supreme Court judgment in the case of Shri Bhagwan Dass and Anr Vs Punjab State Electricity Board (2008),  SCC579, Ministry of Personnel, Public Grievances and Pensions (Department of Personnel &amp; Training) vide their Office Memorandum No.25012/1/2015-Estt.A-IV dated 07.09.2020 have issued clarification regarding the requests received for voluntary retirement from service (<strong><a href="https://centralgovernmentnews.com/tag/VRS/" target="_blank" rel="noreferrer noopener">VRS</a></strong>) from Persons With Disabilities. A copy of the same is enclosed herewith for necessary action and compliance. The instructions/ guidelines contained therein will apply mutatis mutandis on Zonal Railways also.</p>

<p>Sub : <strong>Timely submission of the cases for approval of voluntary retirement / resignation.</strong></p>



<p>It is observed that cases requiring approval of appointing authority for voluntary retirement and relaxation regarding curtailment of 3 months notice period in terms of Rule 48, 48-A of CCS (Pension) Rules and under FR 56(k) and 56(m) are received in this office incomplete and late at the fag end of the expiry of the prescribed notice period of three months. Further, the cases so received are devoid of the requisite documents, i.e., no dues Certificate and certificate regarding length of qualifying service rendered and vigilance clearance certificate. As a result, this office is left with a very short period for processing the request for seeking approval of the competent authority resulting in delay in obtaining the approval.</p>



<p>2. To facilitate timely processing of such cases by the field offices a proforma check list has been prepared. All Principal Accounts Offices are requested that, henceforth, the notice for voluntary retirement must reach to this office invariably with the annexed proforma enclosed herewith duly filled in, within ten working days of receipt of the notice for voluntary retirement from the officer concerned.</p>



<p>3. PrCCAs/ CCAs/ CAs are requested to direct their Principal Accounts Offices for compliance of the same.</p>

<p>Subject: <strong>Grant of time bound financial up-gradation under EPP/NEPP in respect of the VRS- 2019 retirees, which was due before their voluntary retirement on 31.01.2020.</strong></p>



<p>Sir,</p>



<p>Attention is invited to Para 2 (j) of VRS Scheme circulated vide letter No.1-15/2019-PAT (BSNL) dated 4th November, 2019, which stipulates that “salary” means Basic Pay plus Dearness Allowance thereon as applicable on the effective date of voluntary retirement. Para 6.1(a) of the Scheme further stipulates that ex-gratia compensation will be payable on the basis of salary i.e. Basic Pay plus Dearness Allowance drawn by the employees on the effective date of voluntary retirement. It was expected that time bound financial up-gradation under EPP/NEPP in respect of the VRS-2019 retirees were granted from the dates on which it was due. However, it has come to notice of the Corporate Office that time bound financial up-gradation in respect of some of the VRS-2019 retirees, which was due before their voluntary retirement on 31.01.2020, have not been granted so far. This will have a bearing on the pension and terminal benefits including Ex-Gratia of such VRS retirees. As you are already aware, the amount of Ex-Gratia is to be paid by DOT, Govt. of India and the fourth installment of Ex-Gratia is also to be released by DOT shortly.</p>



<ol class="wp-block-list" start="2"><li>As a one-time measure, time bound financial upgradation under the EPP /NEPP, which was due to VRS retirees before their retirement, may be completed latest by 30th August, 2020. It may also be ensured that no case of upgradation under EPP/NEPP in respect of VRS optees is left out. The Circles are required to furnish a certificate signed by CGM, GM(HR) and IFA that all such cases have been completed. Any case of time bound upgradation of VRS retirees being reported later on will be viewed seriously and the concerned officers / official will be held personally responsible for any short payment received from DOT.</li><li>This issues with the approval of Competent Authority,</li></ol>

I am directed to invite your kind attention to this office letter no. 1-15/2009-PAT (BSNL) dated 04.11.2019 regarding introduction and implementation of BSNL Voluntary Retirement Scheme, 2019.</p>



<p>As per the said scheme, employees aged 50 years or above are eligible to opt for voluntary retirement w.e.f. 31.01.2020 and it is expected that a sizable number of eligible employees would be opting for voluntary retirement under the scheme. Consequently, the workload of the pension settlement units in circles and other administrative units are expected to increase manifold. Moreover, some of the eligible employees who are presently posted in pension settlement units may also opt for voluntary retirement under the scheme. It would, therefore, be necessary to arrange for suitable substitutes for such employees for maintaining continuity</p>



<p>In view of above, you are requested to ensure posting of suitable and sufficient number of Executives/ Non-Executives in sections handling pension settlement in Circle/ SSA at the earliest, so that the newly posted employees could be accustomed with the nature of work and pension cases can be processed and settled in timely manner.</p>

<p>1. <strong>Eligibility Criteria</strong> :-</p>



<p>All regular employees, both absorbed and directly recruited, of BSNL who attains 50 years or above as on effective date of VRS, ie 31/01/2020, are eligible.</p>



<p><strong>2. Important Dates :-</strong></p>



<ul class="wp-block-list"><li>Start of option : 04/11/2019</li><li>Closing of option : 03/12/2019 up to 1730 hrs.</li></ul>



<p>3. <strong>Benefits</strong> :-</p>



<ul class="wp-block-list"><li>Ex-gratia- <strong>35 days</strong> salary for each completed year of service+<strong>25 days</strong> salary for each year of service left, until superannuation, provided further ex-gratia shall not exceed the salary he/she would have drawn at the existing level for the service period left.</li><li>For employees absorbed in BSNL under Rule 37A, ex-gratia shall be restricted to the amount which taken together with the pension that the employee would be drawing for the balance period left till superannuation. Provided further that the ex-gratia shall not exceed 125% of the salary of the employee would have drawn at the existing level for service period left.</li></ul>



<p>4. <strong>Employees opting VRS are entitled for the terminal &amp; other benefits under existing rules as below:-</strong></p>



<p>i. <strong>For Absorbed employees</strong> :-</p>



<p>» Pension /Family Pension from the next day of effective date of VRS</p>



<p>» <strong>Retirement Gratuity</strong> :-</p>



<ul class="wp-block-list"><li>For employees above 59 years- within one month from the date of attaining 60 years</li><li>For employees 55 and below &#8211; in February 2025.</li></ul>



<p>» Incase of death of the retired employee before due date of payment of gratuity , the amount shall be released immediately to family along with interest.</p>



<p>» Simple interest @GPF rates (currently 7.9%) will be paid till the date of release of gratuity</p>



<p>ii. For BSNL Recruited employees and those appointed under Rule 37, gratuity shall be paid without deferment.</p>



<p>iii. <strong>Commutation of Pension</strong> :-</p>



<p>Full pension will be paid till the employee opt for commutation as below:-</p>



<p>» For employees above 50 years- on attaining 60 years<br />» For employees 59 and below- on 01/02/2025.</p>



<p>iv. Encashment of EL /HPL, TA/DA to place of settlement after VRS, Retention of staff quarters, RTC, Post-retirement medical facilities allowed as per existing rules and procedures, amended from time to time.</p>



<p>5. The eligible employees are required to login to the ERP / ESS portal for exercising his option for seeking voluntary retirement under the BSNL Voluntary Retirement Scheme -2019. Physical copies in triplicate signed in blue ink by the employee concerned shall be submitted to the administrative office concerned, within three days of giving option in ESS.</p>



<p>The option once exercised under this Scheme shall be final and decision of the competent authority shall be binding on the employee(s). Provided that the employee(s) will be allowed to withdraw the option only once at any time till the closing time and date of option.</p>



<p>6. A help desk has been opened in Circle Office at 6 floor, C wing with CAO(FA). Eligible and interested employees can contact the help desk at 022-49780294, during normal office hours for assistance.</p>

<div style="text-align: center;"><b>PERSONNEL OF PARAMILITARY FORCES TAKING VOLUNTARY RETIREMENT</b></div>
<p>Minister of State for Home Affairs replied in Parliament(Rajya Sabha) on 27.12.2017 regarding Voluntary Retirement in Paramilitary Forces.</p>
<p>“As per information provided by Central Armed Police Forces and Assam Rifles (CAPFs &amp; AR), 19239 personnel have taken voluntary retirement from service since January, 2016.</p>
<p>Improvement in service conditions/ amenities and welfare of the force personnel is a continuous endeavour. A study was got conducted through Bureau of Police Research &amp; Development (BPR&amp;D) into the factors causing stress and suggest remedial measures and another similar study was got conducted though Indian Institute of Management, Ahmedabad (IIMA) for BSF &amp; CRPF”. Based on the above study report, the measures, which have been taken to boost the morale and improve the working conditions and reduce stress among the force personnel, are at Annexure-‘A’.</p>

<p><b>Measures taken to improve the working conditions and reduce stress among the force personnel</b></p>
<p>(i) Transparent policies pertaining to transfer and leave of CAPFs and AR personnel. The hospitalization period due to injuries while on duty is treated as on duty. Choice posting is considered to the extent possible after the personnel served in hard area.</p>
<p>(ii) Regular interaction of officers with troops to find out and redress their grievances.</p>
<p>(iii) Ensuring adequate rest and relief by regulating the duty hours.</p>
<p>(iv) Improving living conditions for troops, providing adequate recreational/ entertainment, sports, communication facilities etc. Crèche facility is also provided at various establishments (where feasible) to facilitate the female employees.</p>
<p>(v) Facility of retention of government accommodation at the place of last posting (for keeping the family) while posted in NE State, J&amp;K and LWE affected areas (except State Capitals).</p>
<p>(vi) Providing better medical facilities, also organizing talks with specialists to address their personal and psychological concerns and organizing Meditation &amp; Yoga routinely for better stress management.</p>
<p>(vii) Adequately compensating the troops deployed in difficult areas.</p>
<p>(viii) Other welfare measures like facility of Central Police Canteen (CPC), scholarship for wards etc. Also air courier service has been provided to CAPF personnel deployed in NE States, J&amp;K and LWE affected areas as welfare measure.</p>
<p>(ix) Designating retired CAPF personnel as ex-CAPF personnel for better identity and community recognition.</p>
<p>(x) Promotions are released regularly to eligible personnel as &amp; when the vacancies arise. Financial benefits under Modified Assured Career Progression (MACP) are given in case promotion does not take place for want of vacancies at 10, 20 &amp; 30 years of service.</p>
<p>Besides above, implementation of suitable model for improvement of working conditions of CAPFs &amp; AR is a continuous process and instructions in this regard are issued from time to time by this Ministry.</p>

<p>I am directed to forward herewith a copy of letter No. 40-27/2017-Pen(T) dated- 04/12/2017 received from Under Secretary, DoT alongwith a copy of notification dated 21/ 12/2012 issued by DOP&amp;PW.</p>
<p>&nbsp;</p>
<p>2. DoT in their above referred letter has clarified that Rule 5 (2) of CCS (Pension) Rules, 1972 previously included a proviso as per which the date of retirement in case of a Government Servant who is retired prematurely or who retires voluntarily, shall be treated as a non-working day has been amended by DoP&amp;PW and omitted the proviso with effect from 01/01/1996 by a notification dated 21/ 12/2012 issued by DOP&amp;PW. Consequently, for all cases of retirement, the last day shall be treated as a working day.</p>
<p>&nbsp;</p>
<p>3. Accordingly, the modifications issued by DOP&amp;PW notified on 21/ 12/2012 may be considered while issuing orders of voluntary retirements.</p>

<p>Will the Minister of TEXTILES be pleased to state:-</p>
<p>(a) whether the Government has revised the pay, wages and other service benefits available to the employees working in the mills under the National Textile Corporation (NTC) time to time and if so, the details thereof;</p>
<p>(b) whether the Government has implemented VRS and MVRS scheme for the employees working in the mills under the NTC and if so, the details thereof;</p>
<p>(c) whether the Government proposes to extend the benefit of MVRS scheme implemented for the employees of Minarva Mills for the similarly placed other mills and if so, the details thereof;</p>
<p>(d) whether the Government proposes to implement the MVRS scheme implemented in Minarva Mills to the employees of Parvathi Mills, Kollam and if so,the details thereof; and</p>
<p>(e) the details regarding the proposals pending with the Government for the welfare of employees in Parvathi Mills, Kollam?</p>

<p>(a): Pay, wages and other benefits has been revised by NTC Ltd. of the on roll employees of the working mills from time to time i.e. during the year 1992, 1997 and 2007 to the employees governed by Industrial Dearness Allowance pay pattern and during the year 1986, 1996 and 2006 to the employees governed by Central Dearness Allowance pay pattern.</p>
<p>(b): VRS and MVRS has been implemented by NTC to the employees in the units identified for closure and surplus employees of working units, Head Office, Regional Offices and Retailed Marketing Division of NTC. So far NTC has given MVRS to 63297 employees at a total cost of Rs.2373.86 crores, details as given in Annexure – I.</p>
<p>(c): Modified Voluntary Retirement Scheme (MVRS) has been uniformly applied for similarly placed mills. A copy of the scheme is at Annexure – II.</p>
<p>(d): Modified Voluntary Retirement Scheme (MVRS) has been uniformly applied to the employees of Parvathi Mills, Kollam and so far 644 employees has availed the benefit at a total cost of Rs.16.81 crores.</p>
<p>(e): No such proposal is pending.</p>
