Sub: Instructions regarding Payment of VRS dues – Validation & Compliance

In continuation of even numbered letters issued on the cited subject, following instructions are issued for strict compliance:

• Notwithstanding the position that the amount of ex-gratia and leave encashment payable to the retirees of BSNL VRS – 2019 scheme, has been verified by the circles, it is requested to do the checking of the master data of the employees towards eligible service, eligible number of leaves, their vigilance clearance status etc once again duly keeping in view the PPOs issued by CCA and underlying information thereto.
• It is required to prepare (and keep in records) a proper statement of the amount recoverable, and recovery made on account of dues (towards Loans, advances, Pay and allowances recoveries, other recoveries etc) from the BSNL VRS-2019 retirees against the Ex-gratia, and Leave Encashment payout. The amount recoverable and recovered should be duly validated for any errors and omissions.
• Establishment section has already communicated the SOP for BSNL VRS 2019, with the format of report to be submitted to DoT on Ex-Gratia. Kindly ensure that the reports / compliances in the Format given in Annexure A, B & C of the DOT letter No. 1/VRS/BSNL/2019/Accounts/TA-I/170-198, dated 16.01.2020 are duly submitted to the respective CCA.
• The second / subsequent instalment of the Ex-Gratia shall be paid as and when further funds and instructions are received from DoT. Therefore, you may please do the necessary preparations, well in advance so that the payout can happen without delay, as and when the funds are received in this regard.
• May kindly note that the activity needs to be completed by 14.04.2020.

Subject: Grant of vigilance clearance for obtaining passport.

The undersigned is directed to say that matter regarding guidelines for granting vigilance clearance to members of the Central Civil Service holding Central Civil Posts have been reviewed and it has been decided to lay down guidelines for grant of vigilance clearance to the Government servant for obtaining Indian Passport.

2. Ministry of External Affairs (MEA) has issued the guidelines for issuance of ordinary Passport to the Government servant vide O.M. No. VI/401/01/05/2014 dated 26.05.2015 in connection with procedures to be the followed in case of passport to be issued to Government servant.

3. In view of the above, it is mandatory for the administrative Department/Controlling Authority to check whether any provision of the Section 6(2) of the Passport Act, 1967 are attracted in the case of employee, who are working under them, while obtaining Indian Passport. As such, it is required to check the vigilance clearance of such Government servant.

4. Accordingly, it has been decided that vigilance clearance can be withheld only under the following circumstances:

(i) The officer is under suspension;
(ii) A charge sheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending.
(iii) Charge sheet has been filed in a Court by the investigating Agency in a criminal case and the case is pending.
(iv) Sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter.
(v) An FIR has been filed or a case has been registered by any Government entity against the officer, after a preliminary fact finding inquiry.
(vi) The officer is involved in a trap/ raid case on charges of corruption and investigation is pending.

5. Vigilance clearance shall not be withheld due to an FIR filed on the basis of a private complaint unless a charge-sheet has been filed by the investigating agency provided that there are no directions to the contrary by a competent court of law. However, the information regarding FIR may be provided to the Passport Office. The final decision will be taken by the concerned Passport Issuing Authority.

6. There may be situations wherein wards and relatives of the civil servants residing abroad (for education and other purposes) could be having medical emergencies or family events. The officer himself/ herself may require to visit abroad for medical reasons. Therefore, as a policy, ordinarily, a passport will not be granted if a disciplinary proceeding is pending against the officer. However, the competent authority can take a view wherein a foreign travel is necessitated due to extreme urgent situation like medical emergencies etc. on case to case basis.

7. All Ministries/ Departments/Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control.

The undersigned is directed to refer to this Department’s OM of even number dated 16.03.2016 on the subject mentioned above and to circulate herewith the latest position regarding availability of ACRs/APARs, Vigilance Clearance, Major/Minor penalty certificate and disclosure certificate in respect of PPS of CSSS who are likely to be considered for promotion to the grade of Sr. PPS for SLY 2016.

2. The cadre units are requested to check at their end the details of the non-availability of the documents of the officers working in their cadre unit and make available the records to this Division immediately. A copy of the Vigilance Clearance certificate may also be sent to Ms. Gracy Varghese, US, AVD-I, DoP&T, North Block, New Delhi to enable her to furnish consolidated Vigilance Clearance etc.

3. The officers concerned are also requested to take necessary action, in their own interest, in expediting the requisite information urgently. The cadre units are also requested to upload the data (ACRs/APARs etc.) in the web based system at cscms.nic.in before submitting the same to this Department.

The undersigned is directed to refer to this Department’s O.M. of even number dated 31.03.2015 on the subject mentioned above (uploaded on web-site www.persmin.nic.in –> DoPT –> Central Secretariat –> CSS –> Promotions –> Promotion (Regular) –> SO to US), and to say that Ministries/ Departments concerned were requested to furnish (i) complete CR dossiers, (ii) vigilance status, (iii) status of imposition of penalty, if any, (iv) ACRs! APARs disclosure certificate and (iv) personal information in respect of the officers as mentioned in Annexures I & II of the abovementioned O.M.

2. CR dossier and other requisite information in respect of large number of officers as mentioned in Annexure have not yet been received. It may be appreciated that this Department will be able to finalize DPC proposal only after information in respect of all officers has been received. To avoid any further delay, it is imperative that CR dossier and the requisite information is furnished urgently.

3. Ministries/ Departments concerned are therefore, once again requested to furnish complete and upto date CR dossier and other requisite information in respect of the officers as mentioned in Annexure in enclosed Proformae latest by 12.06.2015.

The undersigned is directed to refer to Central Board of Direct Taxes, Department of Revenue I.D. No 114847/Ad-VI(A) dated 16.08.2013 and a OM of even no dated 20.09.2013 on the subject mentioned above and to say that as per Rule 17 of the CCS(Leave) Rules, 1972, leave shall not to be granted to a Government Servant whom a competent punishing authority has decided to dismiss, remove or compulsorily retire from service. Leave sanctioning authority shall get prior approval before sanctioning leave for “going abroad” as per O.M. No. 11013/7/94-Esn.(A) dated 18.05.1994 and O.M. No.11013/7/2004-Estt.(A) dated 01.09.2008 (copy enclosed).

2. It is also stated that a blanket order exempting requirement of examination from vigilance angle as proposed in DGIT(Vig.) letter dated 13.05.2013 is not advisable.

Subject: Requirement of taking prior permission by Government servants for leaving station headquarters for going abroad while on leave.

The undersigned is directed to refer to Department of Personnel and Training’s O.M. No. 11013/8/2000-Estt. (A) dated the 7th November, 2000 on the above mentioned subject and to say that in para 2 thereof, it was conveyed that while granting leave the sanctioning authority shall take prior approval , if required, for permitting the officer to go abroad as per the existing instructions.

2. References are being received regarding the competent authority whose permission is to be taken by the leave sanctioning authority before sanctioning leave to a Government servant to go abroad. It is clarified that the competent authority as per the aforesaid Office Memorandum dated the 7th November, 2000 is to the competent authority in terms of the instructions, if any, issued by the Cadre Authority or the administrative Ministries/Departments themselves. Department of Personnel and Training has not issued any instructions in this regard in respect of the Central Government servants. In the absence of any such instructions, the approval of the leave sanctioning authority would imply approval to the visit abroad also. It may be ensured that the leave applications in such cases invariably mention the purpose of going abroad.

Subject : Comprehensive review of instructions pertaining to vigilance clearance for promotion – clarifications – regarding

The undersigned is directed to refer to the Department of Personnel & Training O.M. of even number dated 2.11.2012 on ‘Comprehensive review of instructions pertaining to vigilance clearance for promotion’, wherein, inter alia, it has been laid down in Para 9, as under:

“For the purpose of vigilance clearance for Review DPC, instructions exist in O.M. No.22011/2/99-Estt(A) dated 21.11.2002 that review DPC will take into consideration the circumstances obtaining at the time of original DPC and any subsequent situation arising thereafter will not stand in the way of vigilance clearance for review DPC. However, before the officer is actually promoted it needs to be ensured that he/she is clear from vigilance angle and the provision of para 7 of O.M. No.22011/4/91- Estt.(A) dated 14.09.1992 are not attracted”.

2. This Department has been receiving references seeking clarification on grant of promotion in case of review DPC with regard to the official who is clear from vigilance angle on the date of promotion of the junior in the original DPC but subsequently attracts the provisions contained in para 2 of DoPT OM dated 14.09.92.

3. The matter has been examined in consultation with the Department of Legal Affairs and it is further clarified that, in the case of a review DPC, where a junior has been promoted on the recommendations of the original DPC, the official would be considered for promotion if he/she is clear from vigilance angle on the date of promotion of the junior, even if the provisions of para 2 of DoPT OM dated 14.9.92 get attracted on the date the actual promotion is considered, as provided in DoPT O.M. No.22011/2/99-Estt (A) dated 21.11.2002.

4. In cases, where the junior is not promoted, it is to be ensured that the provisions of para 7 of OM dated 14.9.1992 are not attracted on the date the official is being actually promoted.

The undersigned is directed to refer lo DoPT’s O.M of even number dated 18.10.2013 and subsequent reminder dated 01.11.2013 on the subject mentioned above (available in the web site of this Department at persmin.nic.in -> DoPT -> central secretariat ->CSS -> promotion -> regular -> SO to US) and to say that fresh vigilance status of officers whose names figure in Annexure have not yet been received Out of 406 officers in the zone of consideration, fresh vigilance status has been received only in respect of 158 officers. For want of vigilance status forwarding of proposal to UPSC is getting delayed.

2. Ministries/ Departments concerned are, therefore, once again requested to furnish vigilance status of the officers indicated in Annexure to this OM afresh so that the proposal for preparation cl USSL 2012 may be sent to UPSC at the earliest. The information should reach this Department by 22.11.2013. Vigilance status in respect of retired officers and who are in the zone of promotion is also required to be furnished.

3. All Officers concerned, in their own interest are also requested to pursue with the Administration Division concerned to ensure that the said documents/information in their respect are furnished to this Department urgently.

4. Vigilance status of the officers is also required to be updated in the vigilance module of Web Based Cadre Management System hosted at http://10.21.145.125

Subject : Guidelines regarding grant of vigilance clearance to members of the Central Civil Services/Central Civil Posts.

The undersigned is directed to refer to this Department’s O.M. of even number dated 14.12.2007 on the above subject and to say that it has been decided to modify Para 2(c) thereof as under:

(c) Vigilance clearance shall not be withheld unles

(i) the officer is under suspension

(ii) the officer is on the Agreed List, provided that in all such cases the position shall be mandatorily revisited after a period of one year

(iii) a chargesheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending

(iv) orders for instituting disciplinary proceeding against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of passing such order

(v) chargesheet has been filed in a Court by the Investigating Agency in a criminal case and the case is pending

(vi) orders for instituting a criminal case against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of initiating proceedings

(vii) sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter

(viii) an FIR has been filed or a case registered by the concerned Department against the officer provided that the chargesheet is served within three months from the date of filing / registering the FIR / case

(ix) the officer is involved in a trap / raid case on charges of corruption and investigation is pending.
