<p><strong>Sub: &#8211; Memorandum on GDS issues,</strong></p>
<p><strong>With due respects and regards, we submit the following for your kind consideration and favourable recommendations to the Govt.</strong></p>
<ol>
<li><strong>Departmentalization of GDS by declaring them as Civil Servants and grant all benefits of regular employees on</strong><strong> </strong><strong><em>pro rata</em></strong><strong> </strong><strong>basis.</strong></li>
</ol>
<ol start="2">
<li><strong>Change the nomenclature of GDS as “Gramin Dak Karmachari” or “Rural Postal Employees”</strong></li>
</ol>
<ol start="3">
<li><strong>Considering the need and requirement of Rural Post Offices after modernization viz., Core Banking Solutions (CBS), Core Insurance Solution (CIS) and introduction of handheld computers at BOs and additional responsibilities, the working hours of all BOs may be extended to 8 hours and all GDS may be granted full time Civil Servant status. There should no combination of duties. The illegal condition that GDS shall not on duty for more than five hours should be removed.</strong></li>
</ol>
<ol start="4">
<li><strong>Minimum five hour wages should be paid even if the work load is less than 5 hours and if work load is more than five hours wages for full time (8hours) should be paid. Nomenclature of TRCA should be changed and it should be called as ‘Pay’. There should not be any reduction in wages under any circumstances.</strong></li>
</ol>
<ol start="5">
<li><strong>The Branch Postmaster shall be paid at the pro rata wages of Postal Assistants; GDSMD/GDSSV shall be paid equal to Postmen; and all other categories with the comparison of MTS. GDS shall be appointed and not engaged and the word ‘engagement’ shall be deleted in the existing rules.</strong></li>
</ol>
<ol start="6">
<li><strong>Time bound promotion (ACP) to higher pay scale on completion of 10 years, 20 years and 30 years may be granted to GDS. Point to Point fixation is requested for senior GDS. The pay shall be fixed to the seniors in the revised pay based on the number of years of service rendered to that extent by granting notional annual increments. The percentage of annual increment shall be at par with regular employees to whom the comparison is being made. The nomenclature of increment shall be introduced in the place of ‘future entitlement’.</strong></li>
</ol>
<ol start="7">
<li><strong>The GDS may be considered for grant of HRA, Transport Allowance, Split duty Allowance on pro rata basis at par with regular departmental employees whom we are comparing for wage fixation. The rent of the building in which BO is housed may be paid by the department.</strong></li>
</ol>
<ol start="8">
<li><strong>TA/DA may be granted to GDS if ordered in the interest of service and all other Allowance like Boat Allowance, SDA, may be extended to GDS.</strong></li>
</ol>
<ol start="9">
<li><strong>The GDS shall be covered with the Children Education Allowance and hostel subsidy at par with regular employees.</strong></li>
</ol>
<ol start="10">
<li><strong>The GDS shall be covered under the CS (MA) Rules or a new set of rules equal to that which provide full reimbursement of medical expenses to the GDS and their families.</strong></li>
</ol>
<ol start="11">
<li><strong>The GDS may be granted leave on the following norms.</strong></li>
</ol>
<p><strong>(i)</strong><strong>          </strong><strong> </strong><strong>E.L – One Day for each completed calendar month with accumulation.</strong></p>
<p><strong>(ii)</strong><strong>         </strong><strong> </strong><strong>HPL – 20 days per year, with accumulation facility.</strong></p>
<p><strong>(iii)</strong><strong>       </strong><strong> </strong><strong>Commuted leave may be introduced.</strong></p>
<p><strong>(iv)</strong><strong>        </strong><strong> </strong><strong>Maternity leave – 180 days at par with regular employees with full pay &amp; allowances. Pay shall be made from salary head and not from the welfare fund of GDS.</strong></p>
<p><strong>(v)</strong><strong>         </strong><strong> </strong><strong>Child care leave shall be granted at par with regular employees.</strong></p>
<p><strong>(vi)</strong><strong>        </strong><strong> </strong><strong>Special Disability Leave – As applicable to regular employees.</strong></p>
<ol start="12">
<li><strong>Notwithstanding our claim of introduction of pension scheme at par with regular employees prior to 01-01-2004, we request to modify the S.D.B.S scheme to the extent of 10% recovery from the officials; 20% from the department. Ex-gratia gratuity shall be granted on completion 10 years service. Family pension shall also be introduced.</strong></li>
</ol>
<ol start="13">
<li><strong>All vacancies in the departmental posts viz. MTS, Postmen, shall be filled only by GDS and there shall be no other open market direct recruitment. In respect of PA cadre, the GDS possessing Qualifications and computer knowledge shall be permitted to write the competitive exam along with postman &amp; MTS for the Departmental Quota vacancies.</strong></li>
</ol>
<ol start="14">
<li><strong>The GDS Conduct &amp; Engagement rules 2011 shall be scrapped and CCS (Conduct) Rules 1964 may be made applicable to GDS also. It shall be covered under Article 309 of the Union Constitution.</strong></li>
</ol>
<ol start="15">
<li><strong>50% of the past services of GDS shall be counted as regular service on promotion for pensionary benefits including gratuity.</strong></li>
</ol>
<ol start="16">
<li><strong>GDS shall also be covered under LTC Scheme to have recreation in life.</strong></li>
</ol>
<ol start="17">
<li><strong>GDS may be provided with uniforms and also grant of Washing Allowance.</strong></li>
</ol>
<ol start="18">
<li><strong>All advances like festival, medical, LTC, Tour TA, scooter, HBA, Motor Cycle Advance shall be extended to the GDS. All incentives, honorariums shall be introduced for the excess work performed by GDS.</strong></li>
</ol>
<ol start="19">
<li><strong>Furnishing of security band shall be dropped. Similarly the residential condition may also be dropped in the recruitment rules.</strong></li>
</ol>
<ol start="20">
<li><strong>Transfer facilities may further be liberalized; there shall be no loss of service or pay on transfer. Identity cards to GDSs are a must and that shall be supplied to GDS free of cost of the Department.</strong></li>
</ol>
<ol start="21">
<li><strong>Compassionate appointment may be granted to the dependents of deceased GDS, removing the existing conditions.</strong></li>
</ol>
<ol start="22">
<li><strong>GDS may be granted all Trade Union rights at par with regular employees.</strong></li>
</ol>
<ol start="23">
<li><strong>The amount payable under Group Insurance Scheme may be enhanced to five lakhs.</strong></li>
</ol>
<ol start="24">
<li><strong>The 50 years age limit for appearing for departmental examination may be removed.</strong></li>
</ol>
<ol start="25">
<li><strong>One point may be granted for Rs.4000- of cash handling in BOs.</strong></li>
</ol>
<p><strong>We submit that these poor and down trodden 2.76 lakhs of Gramin Dak Sevaks should not be neglected and shall be extended with all benefits applicable to departmental employees. As Justice Talwar Quoted that ‘the weak and downtrodden need protection’. We hope that the respected Chairman, GDS Committee will look in to the prayers made by the All India Postal employees Union GDS (NFPE) also we made in the pre paras and render justice to this down-trodden section of the Postal employees.</strong></p>

<div align="justify">The Committee constituted by the Department on cadre restructuring of Group<br />
&#8216;C&#8217; employees vide No. 25-04/2012-PE I dated 23&#8242; Oct 2013 held its final discussions on 28 April 2014 at 1100 hours under the Chairmanship of Shri V.P. Singh, DDG (Personnel). The following were present:-</div>

<p>2. The Committee had earlier met on 27<sup>th</sup> Nov 2013, 04th &amp; 05th Feb 2014 and had detailed discussions.</p>
<div align="justify">3. The representatives of the Staff side informed that Postal Assistant cadre officials are getting promotions in promotional hierarchy to Grade Pay of Rs. 2800/- [PB-1] in Lower Selection Grade at a time when they are already placed in the Grade Pays&#8217; of Rs. 4200/- [PB-2] or Rs. 4600/-[PB-2] on award of financial upgradation(s) under MACPS. Taking note of this factual position and detailed discussions, the following recommendations in respect to the cadre restructuring of Group &#8216;C&#8217; employees were agreed to:-</div>
<div align="justify"></div>
<blockquote>
<div align="justify">(a) The post of SPMs in Single Handed Post Offices and Double Handed Post Offices will be placed in the Grade Pay of Rs.2800/- in the Pay Band PB-I.</div>
<div align="justify">
<p>(b) The post of Sub Postmasters in Triple Handed Post Offices and all other existing norm based HSG Posts in Post Offices will be placed in the Grade Pay of Rs. 4200/- in the Pay Band PB-II.</p>
</div>
<div align="justify">
<p>(c) All existing posts in HSG-II will be placed in the Grade Pay of Rs.4600/- in the Pay Band PB-II along with the existing HSG 1 Posts.</p>
</div>
<div align="justify">
<p>(d) After the implementation of the above restructuring/the officials in the Grade Pay of Rs. 4600/-, who have completed 2 years of regular service, will be granted the Grade Pay of Rs. 4800/- in the Pay Band -II on non-functional basis after following the usual procedure of non-functional upgradation(s).</p>
</div>
<div align="justify">
<p>(e) Cadre ratio as per the agreed position mentioned at (a) to (d) above, will be worked out and the ratio so worked out will be replicated to the SA cadre of RMS, PA cadre of Circle &amp; Administrative Offices as also to the PA cadre of SBCO.</p>
</div>
<div align="justify">
<p>(f) In respect of Postmaster Grade I, Grade II and Grade III Posts, once the recommendations of this Committee are implemented; the matter will be examined in the light of the same.</p>
</div>
<div align="justify">
<p>(g) In the light of peculiar situation of Postman/Mail Guard cadre where the work for bulk of the cadre continues to remain the same; as a special case the Committee recommends the ratios as worked out in pursuance of (e) above may be considered for implementation for these cadres as well and that the cadre so restructured may concurrently get the benefit of MACP also.</p>

<div style="text-align: justify;">At last after several round of protracted negotiations with the administration, JCM Staff side, Departmental council ( NFPE &amp; FNPO) has signed the cadre restructuring proposal. The staff side has tried to the best of its ability to make maximum improvement in the proposal. In spite of our hard bargaining we could not achieve 100 percent success. Our demand for separate higher pay scale for PO&amp; RMS Accountants, Creation of separate cadre for System Administrators or grant of special pay/allowance, bringing MTS also under cadre restructuring etc is not accepted by the administration. Regarding Postmaster Cadre after much bargaining, it is agreed to examine our claim for higher pay scale after the present proposal is approved by the government.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">As Govt has already appointed 7th CPC and the Pay Commission has already published the questionnaire, any further delay in completing the cadre restructuring will adversely affect the interest of Postal employees. We will take up the remaining issues, which are not agreed by the administration in the cadre restructuring committee with the 7thCPC in our memorandum and make one more effort to get a favourable recommendation.</div>
<p>&nbsp;</p>
<div style="text-align: justify;">Taking into consideration all the above aspects and also keeping in mind the larger interest of the employees, we have decided to sign the agreement</div>
<p>Copy of the agreement is published below (**Text of agreement reproduced  &#8211; see above**)</p>
<p>The Salient features of the agreement are as follows :</p>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>1. Number of LSG posts will increase from 8 % to 22 %</strong></span></p></blockquote>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>2. Number of HSG II posts will increase from 2 % to 12 %</strong></span></p></blockquote>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>3. Number of HSG I posts will increase from 1.5 % to 4 %</strong></span></p></blockquote>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>4. After completion of 2 years in HSG I the official will be promoted to 4800 GP (Non-functional Basis)</strong></span></p></blockquote>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>5. The above proposal will be applicable to RMS, Circle Office and SBCO in the same ratio</strong></span></p></blockquote>
<blockquote class="tr_bq"><p><span style="color: red;"><strong>6. Postman/Mail guard will get the same ratio of promotion.</strong></span></p></blockquote>
<p>The present proposal is to be approved by Postal Board, DoPT &amp; Finance Ministry. We will make all out effort to get the proposal implemented at an early date.</p>

<p><strong> 1. Revision of HSG I Recruitment Rules &#8212; On the Way:</strong><br />
It is informed that the Revised HSG-I Recruitment Rules has been approved by the DoPT. Now the clearance of Law Ministry is pending. As per the DoPT instructions, minimum 5 years service is required for promotion from HSG II to HSG I. All Circle Secretaries /Divisional Secretaries are instructed to take immediate action to fill up all the HSG I vacancies as per the existing HSG I Recruitment Rules if not already done especially before notification of revised rules.</p>
<p><strong>2.  Cadre Restructuring Committee— Present Stage:</strong><br />
The DDG(P) &amp; Chairman, Cadre Restructuring Committee intimated that the current Proposal submitted by the Staff side is to be put for discussion under internal meeting of the official side (Govt.side). Thereafter formal Cadre Restructuring Committee Meeting with the Staff side (Union side) will be convened shortly to finalize our current proposal.</p>

<p>Dear Sir,</p>
<p>Sub: &#8211;  <strong>Terms of Reference of the 7th Central Pay Commission.</strong></p>
<p>We have gone through the Terms of Reference of 7th Central Pay Commission approved and notified by the Government on 28.02.2014. We find that the Terms of Reference finalized by the Government is at variance in many respects to the Draft Terms of Reference the Staff Side had submitted to you on 25.10.2013 after holding in-house discussion on 24.10.2013.</p>
<p>At the conclusion of the meeting held on 24.10.2013, it was agreed that the Government would consider our suggestions in the matter and will convene another meeting with the presence of the Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter.</p>
<p>We regret to inform you that no such meeting was convened and no attempt was made by the Official Side to arrive at an agreed Terms of Reference. We find that the Government has rejected the suggestions of Staff Side for either taking a decision in the matter of Interim Relief, Merger of DA, representation of labour nominee in the Commission itself, inclusion of the Grameen Dak Sewaks within the purview of the 7th CPC, bringing parity in pension between the past and present pensioners, covering the employees appointed on or after 01.01.2004 within the ambit of the Defined Benefit Pension Scheme, date of effect, settlement of the pending items in the National Anomaly Committee etc. or referring those issues to the Commission itself for an Interim Report.</p>
<p>Besides, we are to state that the existing Productivity Linked Bonus (PLB) Scheme, being a bilateral agreement, cannot be subjected to scrutiny and examination by the 7th CPC.</p>
<p>We, therefore request you to kindly convene a meeting of the Standing Committee of National Council (JCM) to discuss the issue, so as to make amendments to the Terms of Reference finalized by the Government arbitrarily.<br />

<p>Dear Comrade,</p>
<p>The Govt. of India have always kept Gramin Dak Sevaks (GDS) of the Postal Department numbering more than 3 lakhs outside the purview of the Pay Commission. It is a deliberate attempt to deprive them of their rights. This has been the policy all along. The Govt. have been confusing the issue of legal status of GDS as Govt. servants and taking negative stand. After sustained agitation by GDS, a Committee headed by justice Talwar was constituted by the Govt. The Committee came to the conclusion that GDS are Central Govt. employees and Recommended accordingly. This was also earlier the view of the First and Fourth Pay Commissions. In fact first CPC considered their claims &amp; made recommendations accordingly. Disregarding bureaucratic attempts at confusing the legal status of GDS, both these commissions refused to toe the official line and took an independent view that GDS are Central Govt. employees. The following points need specific attention.</p>
<p>The GDS have always been counted &amp; treated as part &amp; parcel of total Postal workforce. In fact they are more than 55% of the total postal workforce and are running more than 80% post offices in the country, whereas regular Postal employees are only 45%. Justice Talwar committee was firmly of the view Commission. The most important recommendation which Justice Talwar Committee made was that in future these employees should be included within the purview of the Pay Commissions, keeping in view their number, their work profile, effectiveness to the postal system and the services rendered to the public.</p>
<p>Attention is also invited to the landmark judgement of the Hon’ble Supreme Court in Gokulananda Dass case decided on 22.4.77 wherein it has categorically been held that GDS are holders of civil post under the union which means they are Central Govt. employees. Recently Central Administrative Tribunal Bench in Tamilnadu and Chandigarh have also held that GDS are Central Govt. employees.</p>
<p>The Gramin Dak Sevaks of the Postal Deptt. have made representation to the Govt. that their claims regarding revision of their pay scales and service conditions may be included in the Terms of Reference of Seventh Pay Commission and Commission may be asked to make recommendations as in the case of other Central Govt. employees. We are soliciting your kind support to our Demand with the request that you may kindly raise our demand when Govt. invites you for discussion to finalise Terms of Reference.</p>

<p>1. Labor resolutions and History of NFPE- Com. Sri. Venkatesh</p>
<p>2. RTI Act and protection against contributory negligence cases &#8211; Com. S. Sundaramoorthy</p>
<p>3. Postal department and its dynamic changes, cop up with its changes by the Postal employees &#8211; Com. J. Ramamurthy</p>
<p>4. CCS-CCA conduct rules, safeguard <a href="http://centralgovernmentnews.com/" target="_blank">Central Government Employees</a> against victimization by the atrocity administration &#8211; Com. K.V. Sridharan</p>
<p>The study camp prolonged from morning 10AM to evening 6PM which was very useful among the upcoming generations of India post.</p>
