<p><strong>EPFO Issues Revised Instructions to Facilitate PF Members to Rectify their Birth Records</strong></p>



<p class="has-text-align-right">05 APR 2020</p>



<p>In a move to extend the availability and reach of online services in the wake of the COVID-19 pandemic, <a href="https://centralgovernmentnews.com/category/epfo/" target="_blank" rel="noreferrer noopener"><strong>EPFO</strong></a> has issued revised instructions to its field offices to facilitate PF members to rectify their date of birth in EPFO records, thus ensuring that their UAN is KYC compliant.</p>



<p>The date of birth recorded in &#8216;Aadhaar&#8217; will now be accepted as valid proof of date of birth for the purpose of rectification, provided that the difference in the two dates is less than 3 years. The PF subscribers can submit the correction requests online.</p>



<p>This will enable EPFO to validate the date of birth of members online with UIDAI instantaneously, thus authenticating and reducing the processing time of change requests.</p>



<p>EPFO has instructed field offices to expedite disposal of online requests, enabling PF members in financial distress, to apply online for availing non refundable advance from their PF accumulations to tide over the <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> pandemic.</p>

<p><strong>Unique Identification Authority of India (Appointment of Officers and Employees) Rules</strong></p>

<p>No. A-12013/13/RR/2016-UIDAI (No 1 of 2020). In exercise of the powers conferred by sub-section (1) of Section 21 read with sub-section (1) of section 54 and clause (x) of sub-section (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), as amended vide the Aadhaar and Other Laws (Amendment) Act, 2019 (14 of 2019), the Unique Identification Authority of India hereby makes the following regulations governing appointment of officers and other employees of the Authority, namely:‒</p>

<p class="has-text-align-center"><strong>Chapter I</strong></p>



<p><strong>Preliminary</strong></p>



<p><strong>Short title and commencement.</strong> (1) These regulations may be called the Unique Identification Authority of India (Appointment of Officers and Employees) Regulations, 2020.</p>



<p>(2) These regulations shall come into force on the date of their publication in the Official Gazette.</p>



<p>Definitions.- (1) In these regulations unless the context otherwise requires, ‒</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) “Act” means the <a href="https://centralgovernmentnews.com/tag/aadhar/" target="_blank" rel="noreferrer noopener" aria-label="Aadhaar (opens in a new tab)">Aadhaar</a> (Targeted Delivery of Financial and Other Subsidies, Benefits and Services)Act, 2016 (18 of 2016), as amended vide the Aadhaar and Other Laws (Amendment) Act, 2019 (14 of 2019);</p><p>(b) “Appointing Authority” means Chief Executive Officer or such other officer to whom such powers and functions have been delegated by the Authority by general or special order;</p><p>(c) “Authority” means Unique Identification Authority of India established under sub-section (1) of Section 11 of the Act;</p><p>(d) “Chairperson” means the Chairperson of the Authority appointed on full-time or part-time basis under Section 12 of the Act;</p><p>(e) “Chief Executive Officer” means Chief Executive Officer of the Authority appointed under Section 18 of the Act by the Central Government;</p><p>(f) “Post” means any post in a grade whether permanent or temporary mentioned in the Schedule annexed to these regulations;</p><p>(g) “Selection Committee” means a committee constituted to consider selection for appointment, absorption, promotion and deputation of officers and other employees in any grade in accordance with the Schedule to these regulations.</p></blockquote>



<p>(2) The words and expressions used in these regulations, but not defined, shall have the same meaning as respectively assigned to them under the Act.</p>



<p>(3) For the purposes of these regulations, the terms ‘he’, ‘him’, ‘his’ and ‘himself shall also refer to ‘she’, ‘her’ and ‘herself’ wherever the context warrants and singular will also include plural.</p>



<p><strong>Power to implement. </strong></p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(1) The power to implement these regulations vests in the Chief Executive Officer or with such officer to whom powers have been delegated by the Authority.</p><p>(2) The powers exercisable under sub-regulation (1) shall also be exercisable by any superior entity including officer higher in precedence.</p><p>(3) The Chief Executive Officer or the officer to whom such powers have been vested shall be responsible for deciding on all complaints, grievances, disputes and other similar matters arising in the course of implementation of these regulations:</p></blockquote>



<p>Provided that any officer or employee aggrieved of the decision may institute an appeal against such decision within forty five days of the issue of order conveying the decision before :</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) the Chief Executive Officer where such orders have been passed by an officer subordinate to him, or</p><p>(b) the Authority where such orders have been passed by the Chief Executive Officer: Provided further that the Chief Executive Officer shall not participate in the meeting of the Authority where an appeal on his decision is decided.</p></blockquote>



<p><strong>Constitution of Officers and Employees Cadre.</strong></p>



<p>(1) The officers and employees cadre shall consist of:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) any person absorbed at the time of initial constitution of the cadre of the Authority under regulation 5; and</p><p>(b) any person appointed to a post under regulations 7, 8 and 9 after initial constitution of the cadre.</p></blockquote>



<p>(2) Any person appointed under clause (a) of sub-regulation (1) of this regulation shall on such appointment be deemed to be a member of the cadre in the appropriate grade applicable to him from the date of his initial appointment with the Authority or the twelfth date of July 2016, whichever is later.</p>



<p>(3) The pay, on appointment in the Authority under this regulation, shall normally be fixed as per the relevant rules, regulations or instructions of the Central Government as applicable on the appointee or at the minimum of the pay in the respective level in the pay matrix. The Authority may, however, fix it at a higher point in the level keeping in view the seniority and pay already being drawn, higher academic qualifications or special experience of value to the Authority, by granting additional increments, not exceeding four in the pay matrix level fixed for the grade in which the appointment is made, on the recommendation of the Selection Committee.</p>

<p>In a major move aimed at making Aadhaar making people friendly, the Union Cabinet, chaired by the Prime Minister Narendra Modi has approved “The Aadhaar and Other Laws (Amendment) Bill, 2019” to replace the Aadhaar and Other Laws (Amendment) Ordinance, 2019. The amendments proposed are the same as those contained in the Ordinance promulgated by President on 2nd March, 2019.  The Bill will be introduced in ensuing session of Parliament.</p>



<p>The decision is expected to go a long way in meeting the people friendly and citizen centric nature of Aadhaar.</p>



<p><strong>Impact</strong>:</p>



<p>The decision would enable UIDAI to have a more robust mechanism to serve the public interest and restrain the misuse of Aadhar. <br /> Subsequent to this amendment, no individual shall be compelled to provide proof of possession of Aadhaar number or undergo authentication for the purpose of establishing his identity unless it is so provided by a law made by Parliament. </p>



<p>For the convenience of general public in opening of bank accounts, the proposed amendments would allow the use of Aadhaar number for authentication on voluntary basis as acceptable KYC document under the Telegraph Act, 1885 and the Prevention of Money Laundering Act, 2002.<br /> Details:</p>



<p>The salient features of the amendments are as follows :</p>



<ul class="wp-block-list"><li>Provides for voluntary use of Aadhaar number in physical or electronic form by authentication or offline verification with the consent of Aadhaar  number holder;</li><li> Provides for use of twelve-digit Aadhaar number and its alternative virtual identity to conceal the actual Aadhaar number of an individual;</li><li> Gives an option to children who are Aadhaar number holders to cancel their Aadhaar number on attaining the age of eighteen years;</li><li> Permits the entities to perform authentication only when they are compliant with the standards of privacy and security specified by the Authority; and the authentication is permitted under any law made by Parliament or is prescribed to be in the interest of State by the Central Government;</li><li> Allows the use of Aadhaar number for authentication on voluntary basis as acceptable KYC document under the Telegraph Act, 1885 and the Prevention of Money-laundering Act, 2002;</li><li> Proposes deletion of section 57 of the Aadhaar Act relating to use of Aadhaar by private entities;</li><li> Prevents denial of services for refusing to, or being unable to, undergo authentication;</li><li> Provides for establishment of Unique Identification Authority of India Fund;</li><li> Provides for civil penalties, its adjudication, appeal thereof in regard to violations of Aadhaar Act and provisions by entities in the Aadhaar ecosystem.</li></ul>



<p><strong>Background</strong>:</p>



<p>The Aadhaar and Other Laws (Amendment) Ordinance, 2019 was considered by the Cabinet in its meeting held on 28th February, 2019 and the Ordinance was promulgated by the President on 2nd March, 2019.</p>



<p>The Aadhaar and Other Laws (Amendment) Ordinance, 2019 amongst other things envisaged strengthening of the Aadhaar Act as per the directions of the Supreme Court and recommendations of Justice B.N.Srikrishna(Retd)  Committee.</p>

<p><strong>2. Period and other terms and conditions of deputation:</strong></p>



<p>The initial period of deputation shall be for three years extendable by a further period of two years, as per Department of Personnel &amp; Training O.M.No 6/8/2009-Estt. (Pay-II) dated 17.06.2010. The terms and conditions of deputation will be governed by the DOP&amp;T&#8217;s aforementioned O.M. of 17.6.2010 and Government of India&#8217;s instructions issued from time to time on the subject.</p>



<p><strong>Age Limit</strong></p>



<p>The maximum age limit for appointment on deputation shall not exceed 56 years as on the closing date of receipt of application</p>



<p><strong>Eligibility for Government Accommodation</strong></p>



<p>As per the ongoing arrangement (further continuity of which is subject to approval of Ministry of Urban Development), the officers appointed in the UIDAI will be eligible for General Pool Residential Accommodation at par with Central Government employees.</p>



<p>3. Eligible and willing candidate may apply through proper channel in prescribed format Annexure I Cadre authorities / Head of Departments are requested to forward applications of eligible and willing candidates whose services can be spared on deputation immediately on their selection. The applications of only such officers would be considered that are routed through proper channel and are accompanied by following documents:</p>



<ol class="wp-block-list"><li>Application in prescribed proforma &#8211; Annexure I</li><li>Cadre Clearance Certificate from the Controlling Authority.</li><li>Statement giving detail of Major/ Minor penalties, imposed upon the Officer, if any, during the last ten (10) years Annexure II.</li><li>Vigilance Clearance / Integrity Certificate (Annexure II)</li><li>Photocopies of the ACRs/APARs for the last five (5) years duly attested on each page by an officer not below the level of Under Secretary or equivalent (Annexure II).</li></ol>



<p>4. While forwarding the application it may also be verified and certified by the cadre controlling authority that the particulars furnished by the applicant are correct (Annexure II).</p>



<p>5. The applications of suitable and eligible officers complete in all respect, in the prescribed format (Annexure-I), along with documents listed in para 3 and 4 above may be forwarded to Deputy Director (HR), Unique Identification Authority of India (UIDAI). <p><strong>Background:</strong></p>



<p>The Supreme Court in its judgement dated 26.9.2018 in W.P (civil) No.494 of 2012 and other tagged petitions held Aadhaar to be constitutionally valid. However, it read down/struck down few sections of the Aadhaar Act and Regulations and gave several other directions in the interest of protecting the fundamental rights to privacy.</p>



<p>Consequently it was proposed to amend the Aadhaar Act, Indian Telegraph Act and the Prevention of Money Laundering Act in line with the Supreme Court directives and the report of Justice B.N.Srikrishna (Retd.) committee on data protection, in order to ensure that personal data of Aadhaar holder remains protected against any misuse and Aadhaar scheme remains in conformity with the Constitution. Towards this, the Aadhaar and Other Laws (Amendment) Bill, 2018 was passed by the Lok Sabha in its sitting held on 4th January, 2019. However, before the same could be considered and passed in the Rajya Sabha, the Rajya Sabha was adjourned sine die. </p>

<p>(a) and (b): Department of Post, as Registrar of UIDAI, has been mandated to set up Aadhaar enrolment and update facility in designated post offices throughout the country. In addition, banks have also been mandated under Regulation 12A of the Aadhaar (Enrolment and Update) (Second Amendment) Regulations, 2017 (No. 2 of 2017) and the Aadhaar (Enrolment and Update) (Third Amendment) (No. 3 of 2017) to set up Aadhaar enrolment and update facility in a minimum one out of every ten bank branches.</p>

										<content:encoded><![CDATA[<p><strong>Aadhaar Data is Never Breached or Leaked: UIDAI</strong></p>
<p>The Unique Identification Authority of India (UIDAI) responding to a news report, appeared in certain section of media on &#8220;210 Government sites made Aadhaar info public&#8221; as if Aadhaar data is leaked or breached, has said that such report is a skewed presentation of the facts and poses as if the Aadhaar data is breached or leaked which is not the true presentation. UIDAI said in a statement here that the Aadhaar data is fully safe and secure and there has been no data leak or breach at UIDAI.</p>
<p>UIDAI said that this said data on these websites was placed in public domain as a measure of proactive disclosure under RTI Act by these government and institutional websites which included beneficiaries’ name, address, bank account, and other details including Aadhaar number and was collected from the third party/users for various welfare schemes. It was this collected info which had been displayed in the public domain under RTI Act. There was no breach or leakage of Aadhaar data from UIDAI database or server as has been aired by the said report.</p>
<p>UIDAI said that acting promptly on this, UIDAI and Ministry of Electronics &amp; IT had directed the concerned Government departments/ministries to immediately remove it from their websites and ensure that such violation do not occur in future. Certain other measures were also taken at various levels to ensure that such incidents of display of Aadhaar numbers do not take place. Following UIDAI’s action such data were removed from these websites immediately. However, the news presented the facts in a skewed manner and misleads readers as if Aadhaar data has been leaked or breached at 210 websites posing Aadhaar security is vulnerable.</p>
<p>UIDAI reiterated that Aadhaar security systems are best of the international standards and Aadhaar data is fully secure. There has been no breach or leakage of Aadhaar data at UIDAI. Also, the Aadhaar numbers which were made public on the said websites do not pose any real threat to the people as biometric information is never shared and is fully secure with highest encryption at UIDAI and mere display of demographic information cannot be misused without biometrics.</p>
<p>UIDAI clarified that Aadhaar number is not a secret number. It is to be shared with authorized agencies when an Aadhaarholder wishes to avail a certain service or benefit of government welfare scheme/s or other services. But that does not mean that the proper use of Aadhaar number poses a security or financial threat. Also, mere availability of Aadhaar number will not be a security threat or will not lead to financial/other fraud, as for a successful authentication fingerprint or iris of individual is also required. Further all authentications happen in presence of personnel of respective service provider which further add to the security of the system.</p>
<p>Furthermore, UIDAI security system has people&#8217;s participatory security system like Biometric Lock facility available at UIDAI portal which any Aadhaarholder can use to put his/her own lock on one’s biometric by visiting UIDAI’s official website www.uidai.gov.in.</p>

<p><strong>Ministry of Railways permits m-Aadhar as one of the prescribed proofs of Identity for Rail Travel Purpose.</strong></p>
<p>Ministry of Railways has decided to permit m- Aadhar (Aadhar card on mobile app namely m- Aadhar launched by UIDAI) as one of the prescribed proofs of Identity for Rail Travel purpose in any reserved class.</p>
<p>m- Aadhar is a mobile app launched by UIDAI on which a person can download his/her Aadhar Card. It can be done only on the mobile number to which Aadhar has been linked. For showing Aadhar, the person has to open the app and enter his/ her password to show the Aadhar Card.</p>
<p>m- Aadhar when shown by the passenger on his/her mobile after entering the password should be accepted as proof of identity for undertaking journey in any reserved class over Indian Railways.</p>

										<content:encoded><![CDATA[<p><strong>Income Tax department launches new facility to link Aadhaar with PAN</strong></p>
<p>New Delhi: The Income Tax department has launched a new e-facility to link a person&#8217;s Aadhaar with the Permanent Account Number (PAN), a mandatory procedure for filing IT returns now.</p>
<p>The department&#8217;s e-filing website https://incometaxindiaefiling.gov.in/ has created a new link on its homepage making it easy&#8221; to link the two unique identities of an individual.</p>
<p>The link requires a person to punch in his PAN number, Aadhaar number and the exact name as given in the Aadhaar card&#8221;.</p>
<p>After verification from the UIDAI (Unique Identification Authority of India), the linking will be confirmed. In case of any minor mismatch in Aadhaar name provided, Aadhaar OTP (one time password) will be required,&#8221; the department said in its advisory to taxpayers and individuals.</p>
<p>The OTP will be sent on the registered mobile number and email of the individual.</p>
<p>It urged them to ensure that the date of birth and gender in PAN and Aadhaar are exactly the same, to ensure linking without failure.</p>
<p>There is no need to login or be registered on e-filing website (of the I-T department). This facility can be used by anyone to link their Aadhaar with PAN,&#8221; it said.</p>
<p>The government, under the Finance Act 2017, has made it mandatory for taxpayers to quote Aadhaar or enrolment ID of Aadhaar application form for filing of income tax returns (ITR).</p>
<p>Also, Aadhaar has been made mandatory for applying for permanent account number with effect from July 1, 2017.</p>
<p>The department, till now, has linked over 1.18 Aadhaar with its PAN database.</p>
<p>While Aadhaar is issued by the UIDAI to a resident of India, PAN is a ten-digit alphanumeric number issued in the form of a laminated card by the IT department to any person, firm or entity.</p>
