<h3 class="wp-block-heading">Subject: Payment of TRCA on Sunday/Holidays to the GDS working against vacancies in Postman/ Mail Guard/MTS Cadre.</h3>



<p>It has come to notice that payment of TRCA to persons working substitute of regular GDS for <strong>National Holidays</strong> are being paid, whereas para 1 and para 4(ii) of Directorate OM No. No. 23-01/2019-GDS dated 23.10.2019 stipulates “that no extra payment on account of National Holiday will be made to persons working substitute of GDS in view of fact that payment of remuneration to GDS is made on monthly basis”. Resultantly, this has been objected by C&amp;AG Audit and recovery of overpayment of wages to substitutes for Gramin Dak Sevaks raised.</p>



<p>2. In this context, however, it is clarified that, the persons working substitute of GDS may be paid&nbsp;<strong>TRCA</strong>&nbsp;for Sunday, if he/she continuously works for 6 days. But, no extra payment on account of&nbsp;<strong>National Holidays</strong>&nbsp;will be made to persons working substitute of GDS in view of fact that payment of remuneration to GDS is made on monthly basis.</p>



<p>3. This issues with the approval of the Competent Authority.</p>

<p>Sir/Madam,</p>



<p>Consequent upon revision in the rates of Dearness Allowance with effect from 1st July 2021 to the Central Government Employees vide Government of India, Ministry of Finance, Department of Expenditure&#8217;s o.M. No. l/l/2020-E-II (B) dated 20th July 2021, duly endorsed vide this Department&#8217;s letters No. PP-8/2/2021-PAP dated 20th July 2021, the Gramin Dak Sevaks (GDS) have also become entitled to the payment of Dearness Allowances on basic Time Related Continuity Allowance (TRCA) at the same rates as applicable to Central Government Employees with effect from 01.07.2021. It has, therefore, been decided that the <strong>Dearness Allowance payable to the Gramin Dak Sevaks shall be at the same rates as payable to Central Government Employees i.e. @ 28% (percent) with effect from the 1st July 2021.</strong></p>



<ol class="wp-block-list" start="2"><li>In view of the unprecedented situation which arose due to the COVID-19 pandemic, three additional instalments of Dearness Allowance (DA) which were due from 01.01.2020, 01.07.2020 and 01.01.2021 had been frozen. The increase subsumes the additional instalments arising on 01.01.2020, 01.07.2020 and 01.01.2021. The rate of Dearness Allowance for the period 01.01.2020 to 30.06.2021 shall remain at 17%.</li><li>The expenditure on this account shall be debited to the Head &#8220;Salaries&#8221; under the relevant head of account and should be met from the sanctioned grant.</li><li>This issues with the concurrence of Integrated Finance wing vide their Diary No.63/2021-22/FA -CS(P) dated 26.07.2021.</li></ol>

<p>Sub:- <strong>Payment of TRCA on Sundays /Holidays to the GDS working against  Leave vacancies/Vacant posts in Postman/ Mail Guard /MTS Cadre.</strong></p>



<p>In the present set up, Gramin Dak Sevaks are working against the  leave vacancy /vacant posts of Postman /Mail Guard /MTS Cadre in  departmental Post Offices. As per Directorate order no. 47-19/90-SPB-II  dated 23.04.1992 regarding grant of paid National Holidays to GDS  employees when appointed against the Postman/ Mail Guard/MTS Cadre  against leave vacancy/vacant posts, these GDS are getting salary for  Sunday if they continuously works for 6 days. Similarly, GDS are also  getting 3 National Holidays if it falls on working day, provided he/she  works on both the preceding/succeeding working days to the National  Holidays. However, no extra payment on account of National Holidays will  be made to persons working substitutes of <a href="https://centralgovernmentnews.com/tag/gds-latest-news/" target="_blank" rel="noreferrer noopener" aria-label="GDS (opens in a new tab)">GDS</a> in view of fact that  payment of remuneration to GDS is made on monthly basis.</p>



<p>2. Similarly, GDS substituting in leave vacancy/ Vacant posts of  Postman / Mail Guard / MTS Cadre are deprived of Productivity Linked Bonus  for the period of officiating as Postman/ MTS is on the pretext that  they are on Leave Without Allowance.</p>

<p>3. For substitutes, as per As per Directorate orders vide  no.17-07/2019-GDS dated 09.10.2019, substitutes of GDS who have worked  in leave vacancies/ Vacant Post in Postman/ Mail Guard /MTS Cadre are also  paid on the basis of minimum of revised TRCA level of that post of GDS.</p>



<p>4. In view of above, in supersession of this office memo of even no.  dated 23.10.2019, following orders are issued with the approval of the  Competent Authority:-</p>

<ul class="wp-block-list"><li><strong>Gramin Dak Sevaks</strong> when appointed against the leave vacancy/vacant  post of regular Postman/MTS, these GDS will get salary for all the  Postal Holidays if the Postal Holidays falls on working day, provided  he/she works on both the preceding/succeeding working days to the <a rel="noreferrer noopener" aria-label="Postal  (opens in a new tab)" href="https://centralgovernmentnews.com/category/postal-department/" target="_blank">Postal </a>Holidays. However, no extra payment on account of <a href="https://centralgovernmentnews.com/list-of-gazetted-holidays-during-the-year-2020-for-administrative-offices-of-central-government-located-in-chennai/" target="_blank" rel="noreferrer noopener" aria-label="Postal Holidays (opens in a new tab)">Postal Holidays</a>  will be made to persons working substitutes of GDS in view of fact that  payment of remuneration to GDS is made on monthly basis.</li><li><strong>GDS </strong>are when appointed against the leave vacancy / vacant post of  regular Postman/ MTS, have to apply for leave without allowance as GDS.  There is a difference in Leave Without Allowance for personal reasons  and Leave Without Allowance for officiating as Postman/MTS. In this  case, the GDS is on official duty and is contributing to the  productivity. Hence GDS while on LWA for official duty, there is no  question of deducting this period for PLB.</li></ul>

<p><strong>Subject:
 Payment of revised TRCA to the substitutes of Gramin Dak Sevaks who 
worked in leave vacancies from 01.07.2018 and onwards.</strong></p>



<p>Consequent upon implementation of GDS Committee report, the matter regarding payment of revised TRCA to the substitutes of <strong>Gramin Dak Sevaks</strong> who have worked in leave vacancies from 01.07.2018 has been reviewed.</p>



<p>2.
 Now, it has been decided by the Competent Authority that the payment to
 the substitutes of Gramin Dak Sevaks who have worked in leave vacancies
 from 01.07.2018 may be paid on the basis of minimum of revised <strong>TRCA level of that post of Gramin Dak Sevak</strong>.</p>



<p>3.
 The amount of revised TRCA admissible as per extant rules may be paid 
to the genuine substitutes. There should not be any double payment. 
Before making payment, the DDO or paying authority should take 
precaution in this regard.</p>



<p>4. The above instructions will come into effect from 01.07.2018 with reference to Directorate O.M. of even number <strong>dated 25th June, 2018.</strong></p>

Sub: <strong>Payment of revised waves Oct the outsider/substitute GDS who are working in short-term vacancies of regular GDS posts.</strong></p>
<p>A kind reference is invited to the above mentioned subject where the substitute GDS are still drawing their TRCA in old scales. As per the recommendation of Sri.Nataraja Murthy committee orders were issued for payment of arrears to outsider/substitute GDS on revised TRCA, but up to this date nothing is heard so far. This issue was debated in our last All India Working Committee meeting held at Champawat, Uttrakhand. Hence it is requested to cause orders for payment of TRCA to the outsider/substitute GDS in the revised TRCA, including arrears w.e.f 1.01.2016.</p>
<p>An early orders in this regard would be highly appreciated at this end.</p>

The resolution deals in detail as to how the lowest paid Gramin Dak Sevaks have been dealt grave injustice in fixation of TRCA and payment of arrears.</p>

<li>The revision in the wage structure would entail an estimated expenditure of Rs 1257.75 crore (Non-recurring expenditure &#8211; Rs 860.95 crore and Recurring expenditure of Rs.396.80 crare) during 2018-19. 3.07 lakh Gramin Dak Sevaks will be benefitted by this wage revision.</li>
</ul>
<p><strong>Details:</strong></p>
<ul>
<li>Time Related Continuity allowance (TRCA) structure and slabs have been rationalised. The total GDSs have been brought under two categories viz. Branch Postmasters (BPMs) and other thanBranch Postmasters namely Assistant Branch Postmaster (ABPMs).</li>
<li>The present 11 TRCA slabs will be merged into only three TRCA Slabs with two levels each for BPMs and other than BPMs.</li>
<li>Introduction of new Time Related Continuity Allowance (TRCA) will be as below:</li>

<h1>Cabinet approves Revision in the wage structure and allowances of Gramin Dak Sevaks (GDS) of the Department of Posts (2/2)</h1>
<ul>
<li>It is decided to continue the calculation of the ex-gratia bonus by applying the calculation ceiling of Rs.7000 as basic TRCA + DA till such time a new scheme is devised.</li>
<li>Arrears for the period 1.1.2016 to the date of implementation will be paid by increasing the basic TRCA drawn during the period by a factor of 2.57. The arrears will be paid in one instalment.</li>
<li>Annual increase at the rate of 3% and the same may be given on 1st January or 1st July of every year as the case may be based on the one time written request of GDSs.</li>
<li>Dearness Allowance will continue to be paid as a separate component, and also revised from time to time whenever it is revised for Central Government Servants.</li>
<li>A new Riskand hardship Allowance has been introduced. Other allowances Viz. Office maintenance allowance, Combined duty allowance, Cash conveyance charges, Cycle maintenance allowance, Boat allowance and Fixed Stationery Charges have been revised.</li>
</ul>
<p><strong>Implementation strategy and targets:</strong></p>
<p>The revision would result in improving the wages, allowances and discharge benefits of Gramin Dak Sevaks resulting in providing efficient &amp; cost-effective basic postal facilities in the rural area. The proposed increased emoluments will enable him to improve his socio-economic standing.</p>
<p><strong>Impact:</strong></p>
<p>The Branch Post Offices are the fulcrum for provision of Communications and financial services in the village and are located in remote areas. The Post Master has to deal with large sums while making payments to customers; hence accountability is already built into his work. The enhanced remuneration will increase the sense of responsibility. Moreover, with the roll out of the India Post Payment Bank (IPPB), the CDS network is expected to play a key role in the process of financial inclusion of the rural population.</p>
<p><strong>Background:</strong></p>
<p>The Extra Departmental system in the Department of Posts was established more than150 years ago to provide basic, economical and efficient postal services in the rural areas where there was no justification for engaging full time regular employees. One Lakh Twenty-Nine Thousand Three Hundred forty-six (1,29,346) Extra-departmental Branch post offices are primarily manned by Gramin Dak Sevak Branch Postmasters. In addition, Gramin Dak Sevaks other than Branch Postmasters are also working in Branch, Sub and Head Post offices. The main features of the engagement of Gramin Dak Sevaks are that they work for part time ranging from 3 to 5 hours per day and supplement their income from other vocations so as to have adequate means of livelihood for themselves and their families. They remain in service up to the age of 65 years.</p>

Sub:- <strong>Payment of arrears to the substitutes of Gramin Dak Sevaks who worked in leave vacancies from 01-01-2006 to 09-10-2009.</strong></p>
<p>Consequent upon the implementation of One Man Committee recommendations, the matter regarding payment of arrears to the substitutes of Gramin Dak Sevaks who worked in leave vacancies from 01-01-2006 has been reviewed.</p>
<p>2. It has now been decided that the arrears of allowances of the substitutes of Gamin Dak Sevaks who worked in leave vacancies from 01-01-2006 to 09-10-2009 may be paid on the basis of minimum of TRCA.</p>
<p>3. The amount of arrears admissible as per extent rules may be paid to the genuine substitute. There should not be any double payment. Before making payment, the DDo or paying authority should take very precaution in this regard.</p>
<p>4. Necessary provision in budget should be made at appropriate stage and availability of funds will have to be ensured before incurring the proposed expenditure.</p>
<p>5. The actual expenditure incurred may be informed to this office immediately after payment of arrears.</p>
<p>6. This issues with the concurrence of Internal Finance Advice (Postal) vide their Dy. No.150/FA/12/CS dated 30-05-2012.</p>

<p>Sub:- Guidelines for regulating substitute / provisional arrangements made in place of regular Gramin Dak Sevaks.</p>
<p>Sir,</p>
<p>References are received from Circles for regularizing the employment of substitutes provided by regular GDSs during their periods of leave/absence on the ground that they have been functioning in that capacity “for a longer period”. A number of cases also stand filed in the Tribunals and Courts on this issue. Apparently instructions issued from time to time are not followed rationally by competent authorities in allowing substitutes to continue indefinitely or for long periods.</p>
<p>2. In this context, I am directed to draw your attention to the DG (Posts)’s instructions given below Rule 5 of the P&amp;T ED agents (Conduct &amp; Services) Rules, 1964 corresponding to Rule 7 of the Gramin Dak Sevaks (Conduct&amp; Employment) Rules, 2001 which, inter alia, stipulate the following.</p>
<p>“During leave, every GDS should arrange for his work being carried on by a substitute who should be a person approved by the authority competent to sanction leave to him. Such approval should be obtained in writing” and that:</p>
<p>“It is necessary for the appointing authority to ensure that such a substitute is not allowed to work indefinitely. If the absence from duty of the regular GDS likely to last indefinitely, the appointing authority should take immediate steps to make appointment and the person so appointed need not necessarily be the substitute.</p>
<p>3. Instructions issued vide, this office letter No. 18-37/92-ED &amp; TRG, dated 25/11 enjoined all Divisional Heads to ensure that long leave beyond 180 days is not granted to GDS as a matter of routine to avoid substitutes continuing in place of regular incumbents for long periods.</p>
<p>4. Subsequently, vide letter No. 19-6/2000-ED &amp; TRG, dated 29-12-2000, the decision of the large bench of CAT Bangalore on the issue of whether weightage should be given to persons who have rendered past employment on provisional basis or in the capacity of substitute or GDS, was circulated. Recently, vide letter dated 19.02.2002 the judgment of the larger bench of CAT Bangalore mentioned above, has also been circulated. The said judgment clearly reiterates the position that the substitutes have not legal right as far as regularization in the Department is concerned. It also takes note that the Department’s Recruitment Rules for Gramin Dak Sevaks do not provide for recognization of past service that may have been rendered by them against any post.</p>
<p>5. In the case of Deviks Guha v/s Union of India, the Supreme Court has also not recognized the right of the substitutes for regularization. On the other hand the Apex court has maintained that substitutes have no legal claim in the basis of having worked continuously and if there are cases where the substitutes have worked for a “longer period” it is for the Department to consider the same as to whether there was a proper case for absorption or not, and pass appropriate orders.</p>
<p>6. The matter has been examined in consultation with Ministry of Law. Since the Apex Court has hold that substitutes have not legal claim there can be no definition of the term “longer period” as absorption of substitutes per se on regular vacancies without following prescribed procedures of recruitment could lead to nepotism.</p>
<p>7. Thus, it has become necessary to review and reiterate the existing guidelines relating to “substitute” arrangement of GDSs. This would also involve clarification of the status of the substitute, who is provided at the risk and responsibility of the regular incumbent, vis-a-vis provisional appointees, who are appointed by the Department to meet an interim need.</p>
<p>8. As per extent orders, a regular GDS is required to provide a substitute at his own risk and responsibility but subject to approved by the appointing authority. Hence it is the duty of the appointing authority to ensure that any ineligible person is not approved as a substitute and any “substitute” arrangement is not allowed to continue for long periods. Accordingly, the following guidelines may inevitably be kept in view while dealing with matters relating to “substitute arrangements” or their continuance”.</p>
<p>(i) Before resorting of substitute arrangement the following options may be explored:</p>
<blockquote><p>(a) In case of short-term arrangements, as far as possible, work will be managed, by combining duties and “substitutes” will not be provided in leave arrangements. In single handed BOs, the work shall be managed by giving combined duty to GDS Mail Deliver/Mail Carrier (Gramin Dak Vitaraka/Vahak) of the neighbouring BO/SO in whose beat the BO falls.</p>
<p>(b) Even in long term arrangements, the combination of duties as in a) above will restricted to; substitutes will be allowed only if work load of the BO as well as its financial position justifies which engagement or filling of the post on regular basis.</p>
<p>(c) In towns and cities, where departmental officials are also available in the same office, the possibility of managing the work by regular staff by combination of duties or by grant of OTA beyond normal working hours may be explored.</p></blockquote>
<p>(ii) If substitute arrangement is found to be unavoidable then it should be ensured that</p>
<blockquote><p>(a) No substitute will be allowed to take over charge unless the competent leave-sanctioning/appointing authority is fully satisfied that the substitute possesses all the qualification prescribed for that appointment and has been provided under the risk and responsibility of the regular incumbent.</p>
<p>(b) Drawing&amp; Disbursing authorities shall not draw allowance of a substitute unless the claim is accompanied by a certificate from the competent authority about the possession of requisite qualification by the substitutes and their approval for making continuing the arrangement.</p>
<p>(c) Continuation of substitute arrangements beyond 180 days at a stretch may only be allowed by the authority next higher to the appointing authority and only in exceptional cases where action has been initiated for regular appointment, if justified by work load and financial norms.</p>
<p>(d) No substitute arrangement shall continue beyond one year. Hence regular/alternative arrangements must be made during the period beyond 180 days to ensure this. If for any unavoidable reasons a substitute arrangement is required to be continued beyond one year, specific approval of the Head of Circle will be necessary for reasons to be recorded by the concerned authority.</p></blockquote>
<p>9. In the case of provisional appointments, it is clarified that such appointment should be resorted to only in case where the GDS is unable, quite unexpectedly, to undertake his duties due to his own action (unauthorized absence, fraud, misappropriation etc.). Due to circumstances beyond his control like sudden serious illness/accident/death or because the department does not want him/her to continue (due to reasons of misconduct/dismissal/removal/put off duty etc.) in all other cases, action should be taken well in advance to fill the post on a regular basis. Even where the post falls vacant unexpectedly, efforts should be made to manage the work through combination of duties as spelt out in Para 8 (i) (a) &amp; (c). Similarly even in case of long term deputation of GDS to APS, action may be taken to full up the post on regular basis and the GDS, on return from deputation may be suitably adjusted against vacancies in existence at that given time.</p>
<p><strong>10. Where provisional appointment becomes unavoidable, action may be initiated to all the posts following all the formalities prescribed for regular appointment, but clearly stipulating that the appointment is on a provisional basis. On no account should a provisional appointment be made without following every formality that is prescribed for regular appointment. Since the whole process will take a period not exceeding 60-90 days, stop gap arrangement may preferably made at the local level in the interim through combination of duties or by allowing the GDS from a neighbouring office to function, or by deploying a Mail Overseer to look after the work. Under no circumstances should such local arrangement exceed 90 days, approval of the next higher authority is to be taken on a one time basis for reasons to be recorded in writing.</strong></p>
<p>11. In cases where the incumbent dies in harness there is no objection to a dependent being allowed to function on interim basis provided the dependent fulfills the qualification/relaxed qualification applicable for post fallen vacant? This may only be resorted to if arrangement by combination of duties is not feasible. However, in such case also such interim appointment should not exceed one year and every effort should be made to take a final view within that time frame. It also needs to be clearly stipulated that such provisional appointment does not entitle the dependent to claim for the post unless his/her case for compassionate appointment is approved by the Circle Relaxation Committee.</p>
<p>12. The extent provisions provide for a provisional appointee to be placed on a waiting list for being considered for a regular appointment after he/she has completed three years of continuous employment. To avoid prolongation of such provisional appointments, approval of the next higher authority should be taken in respect of all provisional appointment exceeding 180 and where the period exceeds one year express approval of the Head of the Region/circle, as the case may be, would be necessary. Where the regular incumbent is not reinstated, immediate action must be taken to regularize the regularly selected provisional appointee against the said post without resorting to fresh recruitment.</p>
<p>13. The above instructions may kindly be brought to the notice of all appointing authorities of GDSs for strict compliance. Any violation of the above instructions will be viewed seriously and action would be required to be taken against officials who allow substitute/provisional arrangements to continue beyond the prescribed limits in contravention of the above instruction.</p>
<p>14. If any previous instructions on the issues of ‘substitute’ and‘provisional appointment’ are found contrary to these provisions, the same will stand superseded by the latter.</p>
<p>15. Receipt of this letter may please be acknowledged to the undersigned.</p>

<li>Revise the wages of the Central Government employees including Gramin Dak Sewaks with effect from 1.1.2011 and every five years thereafter by setting up the 7th CPC.</li>
<li>Merge DA with Pay for all purposes with effect from 1.1.2011 including for Gramin Dak Sweaks.</li>
<li> Remove restriction imposed on compassionate appointments and the discrimination on such appointments between the Railway workers and other Central Government Employees.</li>
<li>[a] Departmentalise all Gramin Dak Sweaks and grant them all benefits of regular employees; End Bonus discrimination and enhance bonus ceiling to 3500/-; Withdraw open market recruitment in Postman / MTS cadre; Revise cash handling norms; Grant full protection of TRCA; Grant Time Bound Promotion and Medical Reimbursement facility etc.</li>
</ol>
<p><strong>[b] Regularise the daily rated, contingent, casual workers and introduce a permanent scheme for periodical regularization. Pending regularization, provide them with pro-rata salary at 6th CPC rates.</strong></p>
<ol>
<li>(a) Revive the functioning of the JCM. Convene the meeting of the Departmental Councils in all Ministries/Departments. Settle the anomalies raised in the National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National Council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP Scheme.(c) Grant recognition to all Associations/Federations, which have complied with the formalities and conditions stipulated in the CCS(RSA) Rules.</li>
<li>Fill up all vacant posts and creates posts n functional requirements.</li>
<li>Stop downsizing outsourcing, contractorization, corporatization and privatization of Government functions.</li>
<li> Stop Price rise; Strengthen the PDS.</li>
<li> (a) Stop the proposal to introduce the productivity linked wage system; (b) discard the performance related pay structure;<br />
(c) introduce PLB in all Departments;<br />
(d) remove the ceiling on emoluments for bonus computation.</li>
<li>Revise the OTA, Night duty allowance and clothing rates.</li>
<li>Implement all arbitration awards.</li>
<li>Make the right to strike a legal and fundamental right of the Government employees on par with the other section of the working class.</li>
<li> Grant Five promotions to all employees as is provided for in the case of Group-A services.</li>
<li> (a) Withdraw the PFRDA Bill.<br />
(b) Rescind the decision to allow FDI in pension sector;<br />
(c) Scrap the new contributory pension scheme<br />
(d) Extend the existing statutory defined pension scheme to all Central Government employees irrespective of their date of entry in Government service.</li>
<li>Vacate all Trade Union victimisation, and more specifically in the Indian Audit and Accounts Department.</li>
