<p><em><strong>Sub: Clarification regarding Travelling allowance (TA) rules after the implementation of 7th CPC.</strong></em></p>
<p>Sir,<br />
The undersigned is directed to refer to your letter dated 25.07.2018 on the above mentioned subject. In this regard, the following is clarified:-</p>
<p>(i) As per rule position as mentioned in SR-71 of FRSR part-II TA rules, TA for a local journey shall be admissible if the temporary place of duty is beyond 8 km from the normal place of duty irrespective of whether the journey is performed by the Government servant from his residence or from the normal place duty. Further, for local journeys, a Government servant will draw, for journey involved, mileage allowance and in addition draw 50% of daily allowance as per OM dated 13 07.2017</p>
<p>(ii). After the recommendations of 7th CPC on Allowances, OM dated 13 07.2017 regarding TA rules has been issued by this Department wherein Daily Allowance on tour comprises 3 components i.e. Hotel accommodation, travel within the city and food charges. For local journey beyond 8 kms, the following may be admissible:-</p>
<blockquote><p>a. Hotel accommodation:- Not Applicable.<br />
b. Travel within the city/Mileage Allowance:- As per para 2 (E) (i) of OM dated 13.07.2017.<br />
c. Food charges &#8211; 50 % of amount payable on tour as mentioned in pare 2 (E) (v) of OM dated 13.07.2017as follows:-</p></blockquote>

<p>Ref: (i) Railway Board&#8217;s letter No. F(E)1/2017/AL-28/40 dated 08/08/2017(PC-VII-31 &amp; RBE No. 84/2017).<br />
(ii) Railway Board&#8217;s letter No. F(E)I/2017/AL-28/41 dated 24/08/2017(PC-VII-45 &amp; RBE No. 103/2017).<br />
(iii) NFIR&#8217;s letter No.1/5 (F) dated 22/06/2018.<br />
(iv) Railway Board&#8217;s letter No.F(E)l/2017/AL-28/40 dated 31/07/2018.</p>
<p>While appreciating the prompt reply of the Railway Board not agreeing with the proposal made by the Federation through its letter dated 22/6/2018, NFIR reiterates again the following facts:</p>
<p>• There are many places where there is no rest house at all,<br />
• Wherever there are rest houses for subordinate staff, their accommodation is totally inadequate and the employees do not get even Cot/Bed,<br />
• The condition of rest houses is very bad so much so, the bed sheets, pillow covers etc., are not even washed regularly (i.e. the condition is unhygienic),<br />
• Mattresses in the rest houses are very dirty and not fit for use.</p>
<p>The Railway Board&#8217;s contention for denying the legitimate entitlement, citing 7th CPC recommendation and Government of India’s approval thereon is not only illogical but also highly improper. It needs to be appreciated that when employee is ordered to undertake tour on duty, he is rightly entitled for facilities as well Daily Allowance / Travelling Allowance. The case cited by NFIR is that in those cases where the staff proceed on duty to other places where the rest house facility is not available or condition of rest house is so bad that no human being can live, in such situations the reimbursement of hotel charges has to be ensured by the employer. Therefore the simple reply in one paragraph given by the Railway Board not agreeing the legitimate demand of NFIR is unacceptable to the Federation and we surmise that the Railway Board never wanted to take the ground situation into consideration for extending legitimate benefit to the staff. It is also unfortunate that while the Central Government has allowed reimbursement charges towards hotel accommodation to its employees when they undertake tour on duty, the Railway Board is unwilling to adopt Government of India’s rules probably with an intention to deny the legitimate benefit%to railwaymen deliberately.</p>
<p>Federation therefore urges upon the Railway Board to review the matter with judicious intention and issue instructions to the GMs etc., for ensuring reimbursement of accommodation/rest house/hotel charges in those cases where the resting facilities or either inadequate or not provided or not available.</p>

<p>Dear sir,</p>
<p>Sub: <strong>Salary and Travelling Allowance to retired Railway Staff re-engaged in Railways &#8211; reg.</strong></p>
<p>vide Railway Board’s instructions under letter No.E(NG)II/2007/RC-4/CORE/I dated 16/10/2017 [Item (vii) of para 2], it has been stipulated that the monthly remuneration of a retired employee being re-engaged be determined by reducing pension from his/her last pay drawn (i.e Basic Pay + DA). also vide Board’s letter dated 12/12/2017, the maximum age limit for re-engagement of retired hands has been enhanced to 65 years from 62 years.</p>
<p>Federation received grievances from the re-engaged retired hands with regard to non-payment of their legitimate dues as mentioned below:-</p>
<p>The re-engaged retired employees, when they work on continuous duty roster under HOER, they are denied payment of salary for performing extra hours of work beyond duty roster hours (i.e. 12 hours duty against duty hours of 8 hours).</p>
<p>When the retired employee is sent out of his headquarter station for performing duties at out station, he is denied payment of TA (daily allowance) on the plea that the Railway Board has not given any direction for payment of T.A., in such eventualities while payment of remuneration only is allowed as per Railway Board’s letter dated 16/10/2017.</p>
<p>perusal of above two points reveal that even the re-engaged retired hands, like other Railway staff, are required to be governed by the provision of HOER and when they are made to perform 12 hours duty against the rostered 8 hours, they should be paid additional wages as Over Time Allowance Similar;y, when these retired staff are sent out of their headquarters for performing duties, they should be paid Travelling Allowance (Daily Allowance) similar to the serving staff based on the rate of last basic pay drawn.</p>
<p>NFIR, therefore, requests the Railway Board to consider the above valid points and issue instructions to the zonal Railway etc., for payment of Over Time Allowance and the Travelling Allowance (daily allowance) to the retired re-engaged staff similar to serving staff.</p>
<p>A copy of the instructions issued may be endorsed to the Federation.</p>

<p><strong>Subject : Travel entitlements of Government employees for the purpose of LTC post Seventh Central Pay Commission-clarification reg.</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 31011/4/2008-Estt.A-IV dated 23.09.2008, which inter-alia provides that travel entitlements for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.</p>
<p>2. Consequent upon the decisions taken by Government on the recommendations of Seventh CPC relating to Travelling Allowance entitlements of Central Government employees, TA Rules have undergone changes vide Ministry of Finance&#8217;s O.M. No. 19030/1/2017-E.IV dated 13.07.2017.</p>
<p>3. In this regard, it is clarified that the travel entitlements of Government servants for the purpose of LTC shall be the same as TA entitlements as notified vide Ministry of Finance&#8217;s O.M. dated 13.07.2017, <strong>except the air travel entitlement for Level 6 to Level 8 of the Pay Matrix,</strong> which is allowed in respect of TA only and not for LTC.</p>
<p>4. Further, the following conditions may also be noted:</p>
<blockquote><p>i. No daily allowance shall be admissible for travel on LTC.</p>
<p>ii. Any incidental expenses and the expenditure incurred on local journeys shall not be admissible.</p>
<p>iii. Reimbursement for the purpose of LTC shall be admissible in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.</p>
<p>iv. In case of journey between the places not connected by any public/Government means of transport, the Government servant shall be allowed reimbursement as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/personal transport based on a self-certification from the Government servant. Beyond this, the expenditure shall be borne by the Government servant.</p>
<p>v. Travel by Premium trains/Premium Tatkal trains/Suvidha trains is now allowed on LTC. Further, reimbursement of tatkal charges or premium tatkal charges shall also be admissible for the purpose of LTC.</p>
<p>vi. Flexi fare (dynamic fare) applicable in Rajdhani/Shatabdi/Duronto trains shall be admissible for the journey(s) performed by these trains on LTC. This dynamic fare component shall not be admissible in cases where a non-entitled Government servant travels by air and claims reimbursement for the entitled class of Rajdhani/Shatabdi/Duronto trains.</p></blockquote>
<p>5. This O.M. will take effect from July 1, 2017.</p>

										<content:encoded><![CDATA[<p><strong>TA Rules in 7th CPC: Air Travel is Allowed for Central Government Employees from Level 6 and Above</strong></p>
<p>Now the Air Travel is allowed for Central Government employees those who are in Level 6 (Pre Revised Rs.4200 Grade Pay) and above. It is Good News for those who are in Level 6 to 8, as the Travel entitlement for them so far is AC II by Train only. Now they are entitled to Travel By Air in Economy Class.</p>
<p>The Central Government published Gazette Notification for 7th CPC Allowances on 6th July 2017. The 7th CPC has recommended that 53 allowances be abolished and 37 be subsumed in an existing or a newly proposed allowances. But the Government has decided to retain 12 Allowances from that 53 Allowances and allowed 3 Allowances to continue as separate allowance from these 37 Allowances recommended to be subsumed. Finally the Committee on Allowances and ECoS after the discussion with stakeholders, recommended to Modify 34 Allowances</p>
<p>The 7th CPC has recommended that Travelling Allowances can be continued without any changes. But the Government has decided to extend the Air Travel Entitlement to Govt Servants those who are in Level As per the Gazette Notification issued by Government of India, the Travelling allowance is rationalised to enable the Central Staffs from Level 6 to 8 to Travel by Air . The Official concerned clarified that, this Modified Travel Entitlement will be extended to LTC also.<br />
