<p>What are all the regulations, Guidelines and instructions in the case of Husband and Wife both working for Central Government in the situations such as applying for House Building Advance, Medical Attendance Rules, Children Education Allowance, Leave Travel Concession Etc ?</p>
<p><strong>How a married couple is treated in various Central Government service matters when both Husband and Wife are serving in Central Government?</strong></p>
<p>The need to have a clarity on this subject gains much significance because treatment of them could differ in each law as each one would treat them according to the intention of the particular law.</p>
<p>For example, both are entitled to draw HRA even if they work in the same station, and live together but not provided with Government accommodation.</p>
<p>But when comes to Allotment of Quarters maintained by Government, only one residence will be provided to them except in the case of Judicial separation.</p>
<p>This article is a compilation of regulations in various service matters in respect of Husband and Wife when both are Central Government Employees.</p>
<p>HBA can be claimed by either of them. As per Rule 2 of HBA Rules, for the purpose of eligibility based on cost-ceiling of the house to be constructed, pay of both of them can be taken in to account. However, for the purpose of calculating the maximum amount of advance eligible under HBA, only the pay of the employee who prefers to avail HBA can be taken in to account.</p>
<h3>Medical Attendance Rules</h3>
<p>In non-CGHS areas, central government employees are covered by CS(MA) Rules which provide reimbursement of medical expenses incurred by the Central Government Employees. In the case of Both husband and wife working central government, to avoid double claim for same medical expenses, either Husband or Wife is permitted to make claims for self and entire family. The person who prefers to make claims under Medical Attendance Rules should be clearly mentioned in the joint declaration given by Both Husband and Wife in this regard. In the event of promotion, transfer, retirement, etc this declaration can be revised at any time. In the case of wife prefers to avail this concession for the entire family, she can either choose her parents or parents-in-law as dependents and prefer medical claim for them.</p>
<h3>Children Education Allowance</h3>
<p>As far as reimbursement of payment of tuition fees and hostel fees are concerned, either Husband or Wife can avail the benefit.<br />
Family Planning Allowance</p>
<p>Either Husband or Wife may prefer to receive Family Planning Allowance. Since FPA is based on pay in pay band and grade pay, it will be beneficial if the employee drawing higher pay prefers to receive the same. In that case, there is no condition specified with regard to the employee who undergone family planning.</p>
<h3>Leave Travel Concession</h3>

<p>The above mentioned provision relating to family members can be separately declared and LTC for those members can be separately claimed by both Husband and Wife, subject to conditions that children will be eligible for the benefit in one particular block as members of the family of one of the parents only and that if husband or wife avails the facility as a member of the family of the other, he or she is not entitled for claiming the concession for self independently.</p>
<h3>
Travelling Allowance</h3>
<p>Travelling Allowance allowed in the event of transfer of one or both of them simultaneously one of the spouses can prefer the claim and the other will be treated as member of family. In such situations only one lumpsum grant can be claimed.</p>
<p>If a husband or wife is transfered after 60 days of transfer of the spouse, but within 6 months, 50% of transfer grant is admissible. However, if both are entitled for reimbursement of cost of travel by personal car, if required they can travel seperatey and claim both of such travel expenses.</p>
<h3>
Family Pension</h3>
<p>Either Husband or Wife is entitled for family pension in addition to own pay or pension, if the spouse dies.</p>
<p>In the case of demise of such husband /wife also, who was receiving family pension for the demise of his/her spouse, the child / children of the deceased parents should be granted two family pensions subject to certain limits prescribed. Please refer to Rule 54 (11), CCS (Pension) Rules in this regard.</p>
<h3>
House Rent Allowance</h3>
<p>HRA will be paid to both husband and wife even if they work in the same station and did not avail Government Quarters. Even if one of them avails the Government residence in the same station where the other spouse is working, he/she will not be entitled for HRA.</p>
<h3>
Central Government Health Scheme</h3>
<p>While both alongwith their family members will be eligible for medical treatement under CGHS, the spouse drawing higher pay will contribute to the Scheme. The scheme does not cover the Parents of the non-contributing employee.</p>
<p>However, women employees can prefer to include her parents-in-law, instead of her parents, in the family for availing CGHS.</p>
<p>If both Husband and Wife prefer to contribute for CGHS, parents of both will be entitled for medical benefits under CGHS.</p>
<h3>
Allotment of Residence</h3>
<p>For the purpose of allotment of residence status of each of Husband and Wife such as designation, pay/grade pay drawn, service experience etc will be considered independently. In other words, higher status of either of two can be taken into account for priority, higher grade of residence etc. In any case both Husband and wife are entitled for allotment of one residence only except in the event of judicial separation.</p>

<p>The undersigned is directed to invite a reference to this office OM No.C-11021/63/15/CGA/CVO/Office Guidelines/ 1419 dated 15.12.2015 vide which it was advised to ensure strict compliance of the Central Vigilance Commission’s Circular No. 03/09/13 issued under file No. 004/VGL/090/225553 dated 11.09.2015 dated 11.09.2015 and a list of officials rotated/transferred out of sensitive posts may be furnished to this office latest by 31.01.2016.</p>
<p>2. Compliance/Action taken report from your office yet to be received.</p>
<p>3. You are once again requested to ensure strict compliance to the Central Vigilance Commission’s guidelines and implement the same in letter and spirit immediately and submit a list of officials rotated/transferred out of sensitive posts at the earliest. A compliance report as well reasons for non-compliance by due date may be submitted to this office latest by 29.04.2016.</p>

<p align="center"><strong>Sub: Rotation of Officials working in sensitive posts – Reg.</strong></p>
<p>Attention is invited to Central vigilance Commission’s Circular No. 03/09/2013 issued under file No 004/VGL/ 090/ 225553 dated 11.09.2015 on the subject mentioned above. As per Commission’s instructions issued vide letter Nos 98/VGL/60/dated l5/4/l999. 02/11/2001 and 004/VGL/90 dated 1/5/2008 on the issue. it is prescribed that Ministries/Departments and CVOs are to identify the sensitive poets and staff working in these posts and also ensure that they are strictly rotated alter every two/three years to avoid developing vested interests.</p>
<p>It has also been observed in the Circular that such rotational transfers are not effected in many organisations due to which officials continue to remain in the same posts for long periods. Such overstay and continuous postings afford scope for indulging in corrupt activities. developing vested interests etc. which may not be in the interest of the organisation. The Commission had therefore emphasised for periodical rotation of officials holding sensitive posts/jobs.</p>
<p>In order to implement the guidelines of CVC’s circular; the following sections in the various Pay and Account Office: under the administrative control of Pr. CCAs/CCAs/CAs have been identified as sensitive:</p>
<p><strong>l. Administration including Cash.</strong></p>
<p><strong>2. Pro Check.</strong></p>
<p><strong>3. Procurement/Paradise.</strong></p>
<p><strong>4. Sections dealing with banks.</strong></p>
<p><strong>5. Loans and Grants.</strong></p>
<p><strong>6. Any other section (as decided by respective Pr. CCAs/CCAs/CAs</strong>)</p>
<p>Further. the tenure of Sr. AOs/AOs/AAOs posted in these sections has been fixed as two years and the tenure for Sr. Accountants/Accounants has been fixed as three Years.</p>
<p>Rotation/transfers of all officers/officials who hove completed their tenures as per above cited guidelines they be considered. Also, while considering rotation/transfer of officials who have completed their tenures in the sensitive sections it may be ensured that they an posted to other sensitive sections only after a gap of minimum of two years. While considering rotation/transfer of officials posted in sensitive posts. officials working in non sensitive posts may also he considered for rotation/transfers after completion of six years on regular basis to improve overall efficiency of the organisation.</p>
<p>In cases. where AAOs are considered for promotion as AOs in the same office/Department due to administrative reasons. their services rendered in sensitive sections may be taken in to account while posting them as AOs.</p>
<p>All Pr. CCAs/CCAs/CAs are advised to amuse strict compliance of the Commission’s guidelines and implement me some in letter and spirit. A list of official rotated/transferred out of sensitive posts may be furnished to this office latest by 31/01/2016</p>

<p>It is to bring to the notice of all employees concerned that Annual Transfer of teaching/non-teaching employee is in process as per Transfer Guidelines. Grievance related to transfer (below Vice-Principal and section Officer) for modification, cancellation etc. are to be sent through controlling officer through E-mail address. i.e. kvstransfer@gmail.com.</p>
<p>Accordingly, employees concerned are advised to send their grievances through controlling officer i.e. KV/ RO/ ZIET via E-mail only. Grievances received other than E-mail from KV/ RO/ ZIET will not be entertained.</p>
<p>The following instructions are placed hereunder for perusal by D.Cs KVS, RO. Concerned.</p>
<p>1. All grievances/ representations are to be sent after scanning through their respective controlling officers of RO/ ZIET/ KV within 07 days from the date of issue of Transfer Orders through E-mail address only i.e. kvstransfer@gmail.com</p>
<p>2. The controlling officers must ensure before sending the grievances/representations that content given therein is correct, genuine and not contrary to the KVS Transfer Guidelines. Efforts should be made to redress the grievance/ representation by the controlling officer then and there, if possible to avoid unwanted correspondence</p>
<p>3. After compliance as above, at Serial No. 2, the representations/grievances are to be sent to KVS HQ through RO/ ZIET/KV via E-mail and facts must be verified on the face of the representation.</p>
<p>4. The employees visiting to KVS (HQ) will be allowed only with prior permission of his/her controlling officer. He/ She should bring the copy of representation sent through E-mail to the KVS (HQ)</p>
<p>5. The visit of the employee concerned without permission will not be entertained by KVS (HQ).</p>
<p>6. Application forwarded directly to KVS (HQ)/ advance copies other than the KVS employee will not be entertained except in exceptional cases.</p>
<p>All the DCs KVS, RO/Directions, ZIET, KVS are advised to bring this notice to their staff members and to all the KV concerned running under their jurisdiction with the instructions to the Principal of the KV concerned to bring this notice to all staff members of KV under limitation to this office.</p>
