<p>Dear Sir,</p>



<p>The undersigned is directed to refer to NFIR&#8217;s letter No. II/1/2019 dated 29.01.2019 on the above subject and to state that there is no ban in place against recruitment of female candidates to Track Maintainers Category though admittedly the nature of the job and working conditions are strenuous/tough. Notifications for Level-1 recruitment are underway in which a significant portion is for Track Maintainers. With finalization of above 2 recruitments ( CEN 02/2018 &amp; CEN1/RRC/2019), position should ease and transfers of eligible Trackmen to other department as provided for in rules  should be able to be effected without problems.</p>

<p>Sub: <strong>Recommendations of 7th CPC &#8211; Payment of Risk &amp; Hardship Allowance for Track Maintainers working in construction s organization &#8211; Reg.</strong></p>
<p>Ref: (i) Railway Board&#8217;s letter No.87/2017) No. PC-VIII/ 2017/I7/5/4 dated 1/08/2017 (RBE (P), E.C. Railway vide letter</p>
<p>(ii) Railway Board&#8217;s clarification issued to GM No. PC-VII/ 2017/I7/5/4 dated 25/10/2018.</p>
<p>Federation desires to bring to the kind notice of Railway Board that consequent to the acceptance of recommendations of 7th CPC relating to grant of Risk &amp; Hardship Allowance to Track Maintainers, the Railway Board vide letter dated 10/0812017 (RBE No. 87/2017) issued instructions to the GMs of Zonal Railways to grant Risk &amp; Hardship Allowance to the Track Maintainers of Indian Railways as per Cell R3 H2 of Risk and Hardship Matrix @ Rs 2700/- p.m. per person. The 7th CPC in its ;eport mentioned that the &#8220;Track Maintainers-I, II, III and IV of lndian Railways should be granted Risk &amp; Hardship Allowance in view of hardship faced by these categories of employees&#8221;.</p>
<p>It has however been brought to the notice ofthe Federation that on a reference received from GM (p), E.C. Railway, thelailway Board vide letter dated25ll0l2018 addressed to GM (p), E.C. Railway, has clarified that the Track Maintainers working in Construction Oiganizations are not eligible for grant of Risk and Hardship Allowance. Federation does not agiee with the unjustifieJ view taken by the Railway Board and the same is unacceptable to NFIR due to the following reasons:-</p>
<ul>
<li>Track Maintainer is essentially required to work on Rail tracks, whether under Open line or in the Constructions Organizations.</li>
<li>In the Construction Organization, the Track Maintainers are required to perform duties of laying of rails, sleeper, points, and crossing in a programmed way and for completing work within targeted periods. Hardship and Risk is involved in their duties.</li>
<li>It needs to be appreciated that the Track Maintainer by designation, has been granted Risk and Hardship Allowance, therefore denying Risk and Hardship Allowance to the desisnated Track Maintainers working in Construction Organizations is improper.</li>
</ul>
<p>The duties performed by the Track Maintainers working in Construction organization as mentioned above justify payment of Risk and Hardship Allowance in accordance with Board&#8217;s instructions dated 10/0812017 (RBE No. 87/2017). The erroneous clarification of the Railway Board vide letter dated 25/10/2018 therefore needs to be withdrawn immediately.</p>
<p>NFIR, therefore, requests the Railway Board to review the case and withdraw Board&#8217;s letter dated 25110/2018. Action taken in the matter may be apprised to the Federation.</p>

<p>Attention is invited to provisions contained in item (f) of Board&#8217;s letter of even number dated 14.10.2014, which is reproduced below: Track Maintainers Promotion</p>
<p>The pay of the staff promoted against the vacancies from the date of restructuring orders will be fixed on profarma basis as per Rule 13 of RSRP Rules with the benefit of one increment @ 3% of the basic with the usual option for pay fixation as per extant rules. The actual payments will be made from the date of taking over charge of the higher grade post.</p>
<p>Reports have been received that the above provision is not being implemented in its proper perspective on some of the Zonal Railways.</p>
<p>The aforesaid provision is hereby reiterated. Necessary action may please be taken for proper implementation of the instructions.</p>

<p>NFIR has raised the issue of revision of amount being given to the Track Maintainers deputed for track patrolling duties during night for purchase of dry cell battery. The matter has been considered by Board (MEW &amp; FC) and it has been decided that all track maintainers deputed for night patrolling shall be paid @ Rs 150 per month alongwith their salary towards purchase of dry cell, wherever rechargeable torches have not been provided.</p>
<p>2. This issues with concurrence of the Finance Directorate of the Ministry of Railways.</p>

<li>Railway Board&#8217;s letter No. 2010/CE-1(Spl)/GNS/15 (Pt.) dated 17/08/2012, E(NG)I-2012/PM5/1 dated 13/08/2013, No. 2012/CE-1/GNS/20 dated 01/04/2014 &amp; No. E(NG) I-2012/PM/1 dated 14/10/2014.</li>
<li>NFIR&#8217;s letter No. IV/Committee/Track Maintainer/Pt. <strong>III </strong>dated 12/04/2016, 10/08/2016, 01/11/2016 &amp; 28/11/2016.</li>
</ul>
<p>During NFIR&#8217;s PNM meeting held with the Railway Board on 22/23-12-2016, while discussing the subject matter, Official Side conveyed that the matter has been examined in the Pay Commission Directorate and full facts of the case have been put up for decision on modalities of implementation to Civil Engineering Directorate.</p>
<p>In this connection, Federation reminds the Railway Board that the subject relating to revision of percentages in the Track Maintainer category to 10 : 20 : 20 : 50 in VI CPC GP 2800, 2400, 1900 &amp; 1800 respectively was discussed between the Federations and the Board (MS &amp; FC) on 27/09/2013 when Shri Subodh Jain, Member Staff/Member Engineering was present. During the meeting, it was agreed to revise the percentage distribution of the Track Maintainers in the ratio of 6 : 12 : 22 : 60 in lieu of existing 3 : 6 : 20 : 71 and further upward revision would again be decided later on. In the further meeting held between the Federations and the full Board on 07/02/2014 an agreement was reached (vide Item No. 4) and in this connection extract of minutes of meeting is re­produced below:-</p>
<p><strong>&#8220;It was agreed that the percentage distribution of posts in the ratio of 6 : 12 : 20 : 60 as </strong><strong>per minutes of the separate meeting held on 27/09/2013 would be implemented for </strong><strong>which matching surrender would not necessarily be from the Trackmen cadre only. </strong><strong>Further, improvement in cadre structure could be considered after reasonable period </strong><strong>of residency has elapsed. However, the matching surrender shall be needed&#8221;.</strong></p>
<p>Federation is disappointed to notice that the Railway Board instead of fulfilling its commitment has conveyed (citing DC/JCM Item No. 15/2012) that the &#8220;Board had decided to keep the existing percentage distribution of posts of Track Maintainer as 6 : 12 : 22 : 60 in the Track Maintainer category Grade-I, II, III &amp; IV respectively&#8221; without caring to give cognizance to its commitment dated 27/09/2013 and 07/02/2014. The Board&#8217;s status report amounts to breach of agreement.</p>
<p>NFIR, therefore, requests the Railway Board (MS) to kindly see that the commitment given to the Federations is fulfilled duly revising the percentage distribution of Track Maintainers to 10 : 20 : 20 : 50 in VI CPC GP 2800/-, 2400/-, 1900/- &amp; 1800/- respectively with retrospective effect. Federation also demands meeting at the level of CRB.</p>
