<p>Subject : <strong>Treatment of strike period in reepect of Gramin Dak Sevaks.</strong></p>



<p>The Postal Service Board, in its 3rd Meeting held on 11th February, 2019 reviewed the existing guidelines of treatment of strike in case of violation of Rule 23 of GDS (Conduct and Engagement) Rules-2011.</p>



<p>2. The Postal Service Board, in its 3rd Meeting held on 11th February, 2019 reviewed the existing guidelines of treatment of strike in case of violation of Rule 23 of GDS (Conduct and Engagement) Rules-2011. The Postal Services Board has approved following guidelines in supersession of all previous orders regarding treatment of strike period :-</p>



<ul class="wp-block-list"><li>The period of strike will not only result in deduction of TRCA for the period of absence during the strike but also break in engagement on account of incitement, violence and sabotage. GDS who resort to action of the above kind violate Rule 23 of GDS (Conduct and Engagement) Rules, 2011 and disciplinary action can also be taken against them. It may be noted that the list of activities which are covered under the definition of strike as enumerated above is only illustrative and not exhaustive. It only clarifies the position in respect of practices which are often resorted to at present.</li><li>GDS who is absent from engagement hours for participating in the strike shall not be entitled to draw TRCA, DA, bonus, Paid leave TRCA etc.</li><li>The strike period shall not be adjusted or regularised by grant of any kind of leave.</li><li>If, it is specifically ordered by the competent authority after show cause notice on account of incitement, violence and sabotage, the strike period would also result in break in engagement.</li><li>The strike period would not qualify towards engagement period for payment of GDS Gratuity, Severance amount at the time of discharge from engagement.</li><li>The strike period would not qualify towards engagement period for absorption of GDS against Multi-Tasking Staff (MTS) posts, which is done on seniority basis.</li><li>The strike period would not qualify towards engagement period of GDS to appear at the LDCE for the cadre of Postal Assistant/ Sorting Assistant/Postmen /Mail Guard/ Multi-Tasking Staff etc.</li><li>The above action as per para (i) to (vii) may also be taken without prejudice to any disciplinary action that may be taken against such GDS.</li></ul>



<p>4. These instructions will come into effect from the date of issue.</p>

<h1 style="text-align: center;"><strong>CHARTER OF DEMANDS</strong></h1>
<p>1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit pension scheme (OPS) to all employees.</p>
<p>2. Settle 7th CPC related issues including increase in Minimum Pay and Fitment formula, HRA arrears from 01-01-2016, MACP Bench Mark, promotional hierarchy and date of effect of MACP from 01-01-2006. Implement Option-1 for pensioners and settle all anomalies arising out of implementation of 7th CPC recommendations.</p>
<p>3. Fill up all vacant posts. Reintroduce Regional Recruitment for Group B &amp; C posts. Withdraw orders for abolishing posts lying vacant for more than five years. Revive all posts abolished during 2001 to 2008 under Annual Direct Recruitment Plan (ADR) as per May 2001 orders of the former NDA Government.</p>
<p>4. (a) Regularisation of Gramin Dak Sevaks and grant of Civil Servant Status. Implement remaining positive recommendations of Kamlesh Chandra Committee report.<br />
(b) Regularise all casual and contract workers including those appointed on or after 01-09-1993.</p>
<p>5. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.</p>
<p>6. Stop closure of Government establishments and outsourcing of Government functions. Withdraw closure orders of Govt. of India Printing Presses. Stop proposed move to close down salt department. Stop Foreign Direct Investment (FDI) in Railways and Defence departments.</p>
<p>7. Implement 7th CPC Wage revision and pension revision of Autonomous body employees and pensioners. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.</p>
<p>8. Remove 5% condition imposed on compassionate appointments and grant appointment in all deserving cases. Rejected cases for want of 5% quota vacancies may be reviewed and appointment to dependents may be granted.</p>
<p>9. Grant five time bound promotions to all Group C &amp; B employees on completion of 8,7,6,5 and 4 years of service respectively. Complete Cadre Reviews in all departments within a time frame.</p>
<p>10. (a) Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under JCM scheme at all levels.<br />
(b) Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972</p>

<p><strong>1.Urgent measures for containing price rise through universalization of public distribution system and banning speculative trade in commodity market.</strong></p>
<p><strong>2.Containing unemployment through concrete measures for employment generation.</strong></p>
<p><strong>3.Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.</strong></p>
<p><strong>4.Universal social security cover for all workers.</strong></p>
<p><strong>5.Minimum wage of not less than 18000/- per month with provisions of indexation (for unskilled worker).</strong></p>
<p><strong>6.Assured enhanced pension not less than 3000 p.m for the entire working population (including unorganized sector workers).</strong></p>

<p><strong>10.Compulsory registration of trade unions within a period of 45 days from the date of submitting application and immediate ratification of ILO conventions C-87 and C-98.</strong></p>
<p><strong>11.No FDI in Railways, Defence and other strategic sectors.</strong></p>
<p><strong>12.No unilateral amendment to labour laws.</strong></p>

<p><strong>1.Avoid delay in implementing the assurances given by Group of Ministers to NJCA on 30thJune 2016, especially increase in minimum pay a fitment formula. Implement the assurance in a time bound manner.</strong></p>
<p><strong>2.Settle issues raised by the NJCA, regarding modifications of the 7th CPC recommendations, submitted to Cabinet Secretary on 10th December 2015.</strong></p>
<p><strong>3. Scrap PFRDA Act and New Pension System (NPS) and grant Pension/Family Pension to all Central Government employees under CCS (Pension) Rules 1972.</strong></p>
<p><strong>4. No privatization, outsourcing, contractorisation of Government functions.</strong></p>
<p><strong>5.(i) Treat Gramin Dak Sevaks as Civil Servants and extend all benefits on pay, pension and allownaces of departmental employees.</strong></p>
<p><strong>(ii) Regularise casual, contract, contingent and daily rated workers and grant equal pay and other benefits.</strong></p>
<p><strong>6.Fill up all vacant posts by special recruitment. Lift ban on creation of new posts.</strong></p>

<p><strong>8. Extend benefit of Bonus Act amendment 2015 on enhancement of payment ceiling to the Adhoc bonus/PLB of Central Govt. employees with effect from the financial years 2014-15. Ensure payment of revised bonus before Pooja holidays.</strong></p>

<p>The constituent Federation/Associations of National Council (JCM) have jointly submitted 11 point Charter of Demands to the Cabinet Secretary during July 2015 demanding him to settle the 11 point Charter of Demands (Enclosed as Annexure ‘A’).</p>
<p>Further, after submission of 7th CPC recommendations to the Finance Minister on 19.11.2015, on behalf of National Joint Council of Action (NJCA) submitted a memorandum to Cabinet Secretary vide letter No.NJC/2015/7th CPC are retrograde and the Central Government employees are very much agitated due to meagre increase of 14% wages.</p>
<p>The Charter of Demands on the recommendations of the 7th CPC, we demanded that the Government of India to settle the demands by holding a bilateral negotiations within February 2016.  It has been also intimated that if the desired settlement through bilateral discussions is not brought about by the first week of February 2016, NJCA will be constrained to go indefinite strike in the First week o March 2016.</p>
<p>Since, there was no settlement reached through bilateral negotiations, INDWF being one of the constituent of NJCA, it was jointly decided to go for an indefinite strike w.e.f.11.04.2016 and accordingly we have decided and directed all the affiliated union in Defence to conduct Strike Ballot on 12.02.2016 and serve the Strike notice on 11.03.2015.</p>
<p>After meeting the High Power Committee under the Chairmanship of Cabinet Secretary, Government of India, on 01.03.2016, as mentioned by him to the National Joint Counci9l of Action representative to give some more time to consider the demands, we have decided to defer serving of Strike notice to 09.06.2016 and to go on Indefinite Strike w.e.f. 11.07.2016.  Since there was no progress/development by holding a meeting to discuss the charter of Demands the constituent organisations of Central Government employees met on 03.06.2016 at Delhi and decided to serve Strike Notice on 09.06.2016 and to go on Indefinite Strike w.e.f.11.07.2016 0600 Hrs in order to achieve the demands both common as well as the demands pertaining to Defence Civilian Employees.</p>
<p>We are hereby informing the Government of India, Ministry of Defence all the affiliated unions of INDWF after serving the notices to their respective head of the establishments in all the Directorates under M of D, will proceed to Indefinite Strike w.e.f.11.07.2016 demanding the Government of India to settle the demands.</p>

<p style="text-align: center;"><strong>CHARTER OF DEMANDS</strong></p>
<p>&nbsp;</p>
<p>1. Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.</p>
<p>&nbsp;</p>
<p>2. (a) Containing unemployment through concrete measures for employment generation.</p>
<p>(b) No ban on creation of new posts. Fill up all vacant posts.</p>
<p>&nbsp;</p>
<p>3. (a) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measure for violation for labour laws. Withdraw the anti-worker Labour Law Amendments</p>
<p>(b) No labour reforms which are inimical to the interest of the workers.</p>
<p>&nbsp;</p>
<p>4. (a) Universal social security cover for all workers</p>
<p>(b) Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.</p>
<p>&nbsp;</p>
<p>5. (a) Fix minium wage with provisions of indexation.</p>
<p>(b) Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.</p>

<p>6. (a) Stoppage of disinvestment in Central/State PSUs. Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.</p>
<p>(b) No outsourcing, contractorisation, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.</p>
<p>&nbsp;</p>
<p>7. Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.</p>
<p>&nbsp;</p>
<p>8. (a) Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.</p>
<p>(b) Revive the JCM functioning at all level as an effective negotiating forum for settlement of the demands of the Central Government Employees.</p>

<p>9. (a) Against FDI in Railways, Insurance and Defence.</p>
<p>(b) No Privatisation, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.</p>

The Confederation of Central Government employees and workers is the apex level organisation of all Federations/Associations/Unions of CGEs other than in the Railways and Defence establishments.  In our last National Executive meeting, we were constrained to decide to call upon our members to organise TWO DAYSs strike on 12th and 13th February, 2014 in pursuance of our charter of demands.</p>
<p>It was in the wake of a strike action in 1960s by the Central Govt. Employees, the Govt. of India set up the permanent negotiating machinery called JCM so that the employees will be able to raise their demands and grievances and seek settlement thereof through dialogue.  This machinery has now come to a standstill as the Govt. does not convene the meetings of the councils at the Departmental levels on one pretext or the other.</p>
<p>A new set of rules were promulgated in 1993 to grant recognition to Service Associations.  Many Ministries, despite the employees organizations abiding by the stipulated conditions, have not afforded recognition to the Associations/Federations, thereby closing all channels of communication.  The JCM had the facility of referring the issues on which the Government could not agree upon to the Board of Arbitration.</p>
<p>The decision/award of the Board was binding on all parties.  However, of late the Government had been rejecting the awards in favour of the employees on the specious plea of adverse impact on national economy by presenting resolutions in the Parliament.  We need not emphasise the unethical character of this approach which undermines the confidence of the employees in the fairness of the system.</p>
<p>The new contributory pension scheme was introduced by the Government on the plea that the pension liability has become unbearable and is a drag on the exchequer.  In our Memorandum to the Prime Minister, we had raised several issues and had pointed out that the financial outflow on account of the new scheme will be much more than the existing defined benefit scheme. We had indicated in our memorandum quite a number of aspects which would be detrimental to the interest of workers. In the debate on PFRDA Bill in the last session of Parliament. We could notice that quite number of MPs had demanded for the withdrawal of the bill itself as it only benefits the Stock market operators and entrepreneurs. Even the Standing Committee’s suggestion for incorporation of a minimum return to the employees was turned down by the Government. We are certain that the new contributory pension scheme shall be a drag on the exchequer and the scheme will turn out to be a conduct for the flow of the poor employees’ savings to the corporate houses. We appeal to you to raise your voice in the Parliament against the new contributory Pension Scheme for its anti employee and anti national characteristic.  The real purport of the bill is reflected in the decision to allow FDI to the extent of 40% in this sector. The said decision has facilities outflow of Indian savings for investment outside the country.</p>
<p>The 6th CPC recommendations and its implementation had given rise to various anomalies.  The employees genuinely felt that the said anomalies would be removed through discussions for which the Government had set up a committee.  The Committee despite meeting on four occasions had not been able to settle the issues; nor could it be referred to the Arbitrator. The 6th CPC recommendations were implemented with effect from 1.1.2006.  The revision of wages was due on 1.1.2011. The Government has not so far come forward to set up the 7th CPC.</p>
<p>It had been the age- old   practice to revise the wages of Central Government employees as and when substantial erosion takes place in the real value of wages. The 5th CPC opined that as and when the DA Component in wages crosses over 50% such revision must take place and the said Component of DA must be merged with pay. Accordingly the 6th CPC was set up and wages revised in 2006. On 1st January 2011 the Dearness allowance component in the emoluments of the employees had   reached 51%   The Government had been dilly dallying the wage revision and merger of DA with Pay which would have helped the employees to combat the soaring price rise. On 12th December 2012, the employees went on a day’s strike which received magnificent response from the rank and fill of the workers. The unbridled inflation and the consequent Price rise has made the existing Pay and allowances   incapable of making both ends meet. The Government announced its intention of setting up 7th CPC thereafter but no follow-up action ensued, leaving the employees with no alternative but to declare a 48 hours strike on 12th and 13th February 2014. As on 1.1.2014 the DA component has crossed   over 100%. The Government attitude has become untenable. On the request of the Government, the Staff side had submitted the draft terms of reference for 7th CPC.   They had also raised     the grant of interim Relief, which normally precedes the notification of any CPC. The Staff Side of the National Council had demanded the inclusion of Gramin Dak Sevaks within the ambit of the 7th CPOC, an issue which was at the core of discussion earlier in 2006. The Government has not indicated its approach on this vital issue so far as a result of which about three lakh GDS employees are in anxiety and desperation.</p>
<p>The Neo-liberal policies brought in its wake the unethical practice of contract labour system and  employing casual workers for perennial and permanent jobs, which is strictly prohibited by the law of the land. Government departments witnessed an overdose of this policy in the period between 2004-2014. More than one third of the work force in Govt. Sector is now composed   of such a informal workers. They are provided with pittance of wages and the huge gap in wages of the regular and the informal employees has been the root cause of inter-personnel tension and many fraudulent ventures.  Government functions are supported supposed to have an element of security and accountability. The removal of this ill- advised system had been a cry often falling on deaf ears. Besides there are quite a number of casual workers employed to carry out perennial and permanent jobs. They are to be regularised. In the postal department alone they number about 3 lakhs called as GDS. Enclosed is a brief note on Charter of demands, the non-settlement of which has resulted in the loss of confidence in the system itself and consequent compulsion to tread the path of straggle. Many of these issues are incorporated   in the agenda of National Council for not less than ten years back, begging settlement.  . The Government has made procrastination an art in itself and allow the issues longer on for years.</p>

<p>On the call of All India Railwaymen’s Federation (AIRF) more than one million railwaymen are likely to participate in strike ballot on 20 &amp; 21 December 2013 all over Indian Railways.</p>
<p>Giving details here Comrade Shiva Gopal Mishra, General Secretary, All India Railwaymen’s Federation said since Railway Ministry as well as Government of India is quite in different and had not resolved our long pending demands, we have no other alternative except to resort to strike ballot. The result of strike ballot will be available on 23rd December, 2013 based on that All India Railwaymen’s Federation will chalk out further strategy.</p>
