The undersigned is directed to refer to DoP&T’s OM of even number dated 30.12.2021, 18.01.2022 and 28.01.2022 on the subject mentioned above wherein all the Ministries/ Departments concerned were requested to furnish the information as per the attached format immediately clearly indicating the number and names of all the officers who have been granted stepping up of pay and whose case has been reviewed or qualify for review as per OM dated 20.05.2014. Information has not been received from most of the Ministries/ Departments yet. Since the status of the matter has to be apprised to the Standing Audit Committee urgently, it is also proposed to hold a meeting with the concerned Ministries/ Departments shortly in this regard.

2. Accordingly, it is requested that the above-mentioned information may be sent immediately without further delay.

Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers’ Grade than their juniors – OM No.18/2/2007-CS-I dated 20.05.2014 – Writ Petitions filed in the matter – regarding.

The undersigned is directed to refer to this Department’s OM No.18/2/2014-CS-I(S) dated 01.07.2019 and OM of even number dated 18.10.2019 (copy enclosed) wherein instructions were issued to all the Ministries/ Departments participating in CSS for handling of Writ Petitions filed/being filed in the above matter.

2. These instructions provided that the first WP No.1225/2019 filed in the matter was being defended by this Department and the remaining WPs were to be defended by the administrative Ministry/ Department concerned based on inputs made available by this Department (reply filed in WP No.1225/2019) in consultation with Government Counsel after ensuring factual accuracy of the case.

3. These instructions further provided that all fresh cases filed in Delhi High Court in the matter might be duly reported to this Department by the Ministry/ Department concerned as and when the WPs were received at their end and the counter replies filed immediately in these matters, under intimation to this Department. The Ministries/ Departments had also been requested to get their cases tagged/ connected with WP No.1225/2019 so that all the cases containing similar cause of action could be heard together. A list of WPs filed in the matter, as per the information available in this Department, is attached as Annexure.

4. Accordingly, the Ministries/Departments concerned are requested to confirm that counter replies have already been filed by them in these matters and action has been taken to get these cases tagged with WP No.1225/2019. A copy of the counter reply so filed may be forwarded to this Department for records.  The matter is likely to be heard on 02.12.2021. If there is any other WP filed besides the above, the status with respect to the same may also be intimated to this Department.

5. This may please be treated as Most Immediate and the information as sought in para 4 above may be furnished to this Department immediately but not later than 25.10.2021.

STEPPING UP OF PAY – REGARDING

1. Consolidated Guidelines on Stepping Up of Pay was issued vide GoI, MoP, PG&P OM No 4/3/2017-Estt(Pay-I) dated 26/10/2018 which have since been made applicable to Indian Armed Forces Personnel vide MoD, New Delhi ID Note No 1(12)/2020/D(Pay/Services) dated 19/11/2020, which interalia stipulates that cases where Senior Army Officers draws less pay than the Junior Army Officer, the Pay of the Senior Army Officer will be stepped up with effect from the date of Promotion of the Junior Officer.
2. Consequent upon implementation of GoI, MoD, New Delhi OM No 1(20)/2017/D(Pay/ services)-Part-I dated 02/11/2020 read in conjunction with MoF, New Delhi OM No. 4-21/2017-IC/E/IIIA dated 28/11/2019, under which first increment after fixation of pay on Promotion is to be granted after successful completion of Six (6) months qualifying service in the promoted grade, anomaly in Pay has arisen wherein Senior Army Officers are drawing less pay than the Junior Officers from the date of next increment earned by the Junior Army Officer after fixation of Pay in the promoted grade.
3. In absence of any Specific/Special orders for Stepping Up of Pay from a date other than date of Promotion of Junior Officer, the matter has been referred by the CGDA, New Delhi to MoD, New Delhi for seeking clarification. Hence such cases for Stepping Up of Pay may be referred to the O/o the PCDA (O), Pune only after receipt of clarification from MoD, New Delhi in this regard.
4. This has been put up for the kind information of the Indian Army Officers, so that queries on the above issue are avoided.

Stepping up of pay of Loco Inspectors, inducted prior to 01/01/2006 on six and half zones

Sub: Implementation of negotiated settlement reached with the Federations – stepping up of pay of Loco Inspectors, inducted prior to 01/01/2006 on six and half zones-reg.

Ref: (i) NFIR’s DC/JCM Item No. 10/2012.
(ii) NFIR’s letter No. II/95/Part X dated 05/10/2017.
(iii) Railway Board’s letter No. E(P&A)II-2008/RS-37 dated 16/11/2017.
(iv) NFIR’s letter No. II/95/Part X dated 25/11/2017.

NFIR desires to remind the CRB that the Railway Board has unfortunately failed to implement quite a few number of agreements reached with the Federations. One such agreement is “stepping up of pay of Loco Inspectors inducted prior to 01/01/2006” on 6 ½ Zonal Railways.

In this connection, NFIR desires to reiterate that in a full Board meeting held with both the Federations on 07/02/2014, the Railway Board Chairman had given written assurance for implementation of stepping up of pay to the Sr.Loco Inspectors inducted prior to 01/01/2006 (on the remaining 6 ½ Zones), similar to 10 Zones where stepping up of pay to Sr.Loco Inspector had already been granted. The issue thereafter has been discussed very many times by the undersigned with the CRB-latest on 06/06/2018 wherein assurance was again given for quick finalization. On 13th July, 2018, the GS/NFIR has also mentioned to CRB while handing over list of important items pending since long.

Federation also conveys that the Railway Board have lost about a dozen SLPs in the Apex Court as the same, have been dismissed. Similarly, the SLP No. 14746/2018, operative portion of the order is reproduced below:-

“We grant a period of eight weeks to the petitioners to implement the orders. We make it clear that in case the orders are not implemented within eight weeks from today, the arrears will carry interest at the rate of 18% and the officer(s) responsible for the same shall be personally liable for the same.
Pending interlocutory application(s) is/are disposed of”.

Apart from above, Federation also brings to the notice of the CRB that there are about 23 Court cases pending in various Courts on the same subject at Jabalpur, Jaipur, Mumbai, Kolkata, Ernakulam (17 in cases CAT and 6 cases in High Court) where these Courts cannot take a different view than that of orders passed by the Hon’ble Supreme Court. The litigation pursued by the Railway Administration needs to be halted in the interest of Railways and its employees.

Incidentally, it is mentioned that the Federation vide its letter No. II/95/Part X dated 05/10/2017 had apprised the estimated financial implications as a result of allowing stepping up of pay of Chief Loco Inspectors (on remaining 6 ½ Zones). NFIR has also given constructive and workable suggestion during the meeting in the chamber of Addl. Member (Staff) with regard to modification of extant policy for filling the posts of Loco Inspectors so as to avoid further grievances. AM (Elec), AM (Budget) etc., were present in the meeting. If the issue is settled as proposed by the Federation, the above type of problem will not arise in future and there may not be Court cases.

NFIR, therefore, once again requests the CRB to kindly see theat immediate action is taken for granting stepping up of pay to the Loco Inspectors (inducted prior to 01/01/2006 on the remaining 6 ½ Zones) as agreed to already. Federation also requests to see that the Railway Board send reply indicating the progress made for implementation of agreement.

Subject: Stepping up of pay of senior of CSS promotion in the Officers Grade than juniors – reg.

Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT 0M 20.05.2014, requesting withdrawal of the OMs referred above.

2. It is once again clarified that 0M No.5/16/80-CS.l dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay at an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of officer than his junior recruited through a letter examination, up to a level equal to the pay of such junior Sexton Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer, Vide OM No.5/21/192-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to Assistants only). OM NO.5/1/96-CS.l dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List/Assistants Grade Examination, as the case may be in accordance with OA No.365/90 (Shri K.C.Sehgal Vs UOI and OA No .869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon’ble Supreme Court.

3. That there are general guidelines of stepping up of pay issued by the Ministry Of Finance vide 0M No.F.2(78)-E.III(A) dated 04.02.1966 and this Department vide 0M dated 04.11.1993. One Of the conditions of the general guidelines for allowing stepping up of pay to a Senior Govt. servant with reference to a junior in the lower grade also.

Sub: Stepping up of pay of Seniors drawing less pay than the Juniors consequent on fixation of pay due to implementation of 6th CPC recommendations between Direct Recruits and Promotees – item no. 8 and para no. 20 & 21 of the Record Note of the meeting of the Standing Committee of National Council JCM held on 7th May 2014.

NFIR’s letter No. IV/NFIR/6th CPC/Main10/Pt. 11 dated 10/11/2014 addressed to Secretary/DoP&T and copies endorsed to Secretary (Pers), Department of Expenditure, Ministry of Finance and Secretary (E), Railway Board.

(ii) DoP&T’s O.M. No. 1046768/2015-Estt(Pay-1) dated 9th March, 2015 addressed to Railway Ministry and copy endorsed to NFIR.

(iii) NFIR’s letter No. IV/NFIR/6th CPC/Main10/Part 11 dated 15/04/2015 & 02/03/2016.

(iv) Railway Board’ s letter No.PC-VI/2010/I/RSRP/1 daIed 22/03/2016.

The’reply vide Board’s letter dated, 22/03/2016, in response to NFIR’s letter dated 02/03/2016, is disappointing as the Railway Board have failed to appreciate the situation narrated by the Federation to the Secretary, DoP&T in its letter dated 10/11/2014, to which the DoP&T responded as under:-

“Department of Expenditure had, after the meeting of the National Anomaly Committee, allowed stepping up of pay to promotees with reference to Direct Recruits subject to certain conditions, including there being an element of direct recruitment, an actual junior receiving more pay etc. They’ however, decided that no general order be issued. Accordingly, Ministry of Railways may take up the matter with the Department of Expenditure for issuing of instructions, if any”.

It is needless to mention that the action as mentioned above is needed to be taken at the level of Railway Ministry (Railway Board) for which reference needs to be made to the Department of Expenditure for the purpose of issuing instructions in favour of Railway employees. This is also clear from the fact that the issue was raised in the Standing Committee meeting of NC/JCM held on 07th May 2014 refer Item No. 8 (Para 20 & 21) of the record note of the meeting. Federation is sad to point out that the Railway Board instead of taking action as per the minutes of Standing Committee meeting of NC/JCM has acted differently and have sent a copy of Board’s instructions dated 17/02/2010 to the Federation, which are not at all related to the issue involved. however without examining the issue in consultation with the Department of Expenditure.

Federation once again desires to re-iterate that already a period of more than one year has passed, unfortunately, the action needed to be taken in the matter at Board’s level has not been taken yet.

NFIR, therefore, once again requests the Railway Board to take action as indicated by the DoP&T and formulate a proposal to the Department of Expenditure (Ministry of Finance) in consultation with the Federation.

Subject: Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors.

The undersigned is directed to say that several references have been received in this Department from Ministries/Departments seeking advice as to whether the pay of the senior PAs can be stepped up at par with that of their junior Shri Jai Bhagwan, PA of Department Commerce (Supply Division) (now in Ministry of Information & Broadcasting). It has also come to the notice of this Department that many Ministries/Departments have already granted stepping up of pay to their PAs at par with the pay of Shri Jai Bhagwan.

2. The issue of fixation of pay of Shri Jai ghagwan, PA has been examined in this Department. As per DoP&T’s O.M.No.35034/1/97-Estt.(D) dated 04th October, 2012, stepping up of pay is allowed to those officials who got their ACPS benefit prior no 1.1.2006 but are drawing less pay than their juniors, who got it after 1.1.2006 subject to certain conditions. Therefore, in all similar cases, the stepping up of pay of a particular senior who got the ACPS benefit before 1.1.2006 could only be allowed with direct reference to a particular junior who got it after 1.1.2006 and got his pay fixed in terrns of para 2(c) of Department of Expenditilre’s U.O. note No.10/1/2009-IC dated 14.12.2009. Any stepping up of pay is not allowable in a chain-like manner. Shri. Jai Bhagwall got ACP on 01.07.2005 and as such, para 2(c) of Department of Expenditure’s U.O. note No.10/1/2009-IC dated 14.12.2009 would apparently not apply in his case. As such, the pay fixation order No.G-12014/1/2008-Admn dated 09.02.2011 of Shri Jai Bhagwan, PA issued by the Department of Commerce (Supply Division) is not in order.

3. Ministry of I&B were requested to explore the possibility of allowing stepping up of pay to Shri Jai Bhagwan, in case his case is covered under the O.M. dated 04.10.2012. Accordingly, DAVP, Mintstry of I&B, re-examined his case and re-fixed his pay w.e.f. 01.07.2006 by granting stepping up of pay with reference to his junior namely Smt. Promila Bandooni. A copy of DAVP, M/o I&B’s Office Order No.A.20012/07/2012-Admn.l dated 15.07.201.5 regarding re-fixation of pay of Shri Jai Bhagwan, PA of CSSS enclosed herewith.

4. In view of the above, all Ministries/Departments are advised to take further necessary action to accordingly review the stepping up of pay already granted to their PAs in comparison to Shri Jai Bhagwan, PA, CSSS and necessary recoveries of excess amount, if any, be effected. in this regard, from the concerned officials.

Sub: Joint letter of AIRF and NFIR -reg.

The Federations seriously disappointed over non-finalisation of issues in spite of discussion held at lower level on a number of occasions. Even he agreed issues in the full Board Meeting held on 7th February 2014, have not been implemented (eg stepping up of pay of Loco Inspectors appointed prior to 01/01/2006 and upgradation of Apex level Group ‘C’ posts to Group ‘B’ Gazetted- 3335 posts).

While conveying unhappiness over procrastination of matters, we list below the issues which are needed to be settled at the earliest. Incidentally, it is mentioned that a few issues agreed to during
discussions in the Fast Track Committee Meetings are yet to be complied with:-

Issues:

• Induction of Course Completed Act Apprentices against erstwhile Group ‘D’ vacancies in Safety and other categories.
• Exemption of Railways from New Pension Scheme – Hon‘ble Minister for Railways sent proposal to Finance Minister on 29’h March 2014 and thereafter the Railway Board has sent reminder to the MoF,
• Absorption of Quasi-Administrative Units staff against erstwhile Group ‘D‘ vacancies Railway Board have arbitrarily cancelled the policy decision issued in 1973 and 1977, Since then the Federations have been pressing for restoration of policy. The subject has been dealt with in the DC/NCM meeting also vide item No. 27/2006 & 12/2012. Also the subject was discussed in the meeting held by the Full Board on 7th Feb. 2014. Unfortunately. there has been no satisfactory finalisation of this item.
• Upgradation of Apex level Group ‘C‘ posts to Group ‘B‘ Gazetted (3335 posts) – implementation of agreement dated 7th Feb 2014 is yet to be ensured.
• Stepping up of pay of Loco Inspectors appointed prior to 01/01/2006. Although agreed in the Full Board meeting. the decision has not been implemented yet.
• Though instructions have been issued by the Railway Board for inclusion of a few additional categories of safety categories of staff in GP 1800 under LARSGESS vide Railway Board‘s letter No. E(P&A)I-2010/RT-2 dated 24/03/2014, but unwarranted conditions like “working on tracks” have been shown even though these staff by virtue of working conditions perform Safety job.
• Federations. therefore. urge upon the Member Staff to kindly fix Joint meeting at the earliest for frank discussions.
