<p><strong>MINUTES OF THE MEETING WITH STAFF SIDE, NATIONAL COUNCIL (JCM) ON THE SUBMITTED AGENDA ITEMS, HELD ON 09.07.2020 UNDER THE CHAIRPERSONSHIP OF SECRETARY (HFW)</strong></p>



<p>A meeting was convened under the chairpersonship of Secretary (HFW) with Staff Side, National Council (JCM) on 09.07.2020 at 11:30 am, in Committee Room No. 155-A, Nirman Bhawan, New Delhi, on the agenda items pertaining to COVID-19 and other related matters of Staff welfare in respect of Central Government Health Scheme (CGHS) and Central Services (Medical Attendance) [CS(MA)] Rules, 1944.</p>



<p><strong>List of participants is enclosed at Annexure &#8211; ‘A’.</strong></p>



<p>2. The Chairperson welcomed all the participants. Opening the discussions, Secretary (HFW) thanked all central government employees who have been working tirelessly during the ongoing COVID pandemic to keep moving the work of Government. She also outlined the steps taken by the Ministry of Health &amp; Family Welfare (MoHFW) regarding treatment and care of both Non-COVID and COVID positive patients during the pandemic period. After a brief round of introduction, Joint Secretary (CGHS) briefed about the agenda items raised by Staff Side and these items were taken up one by one for discussion.</p>



<p>At the outset, Shri Shiva Gopal Mishra, Secretary, National Council expressed his gratitude towards Secretary (HEW) for holding this Meeting at a short notice as well as proactively taking decisions for the benefit of central government employees. He also brought out the problems being faced by government employees.</p>



<p>Thereafter, discussion on the agenda began and action taken thereon is as under:</p>



<figure class="wp-block-table"><table><thead><tr><th>Agenda No.</th><th>Issue</th><th>Action Taken</th></tr></thead><tbody><tr><td>i</td><td>FIXATION OF PACKAGE RATE FOR each patient.<br />Since there is no package rate prescribed by the<br />Ministry of Health and Family Welfare for the<br />COVID-19 infection treatment, the Hospitals are<br />abnormally charging from the CGHS beneficiaries.<br />Such incidences have been brought to our notice<br />from the Central Govt. Employees working in Chennai<br />and Hyderabad.To avoid such type of abnormal charges being<br />levied by the CGHS Empanelled Hospitals,<br />itis essential that the Ministry of Health may<br />finalize a package rate of the treatment of<br />COVID-19 infection. Considering the urgency<br />in the matter a favorable decision may be<br />taken at the earliest.</td><td>The proposal regarding fixation<br />of rates for COVID-19 treatment<br />at private hospitals empanelled<br />under CGHS is already under<br />process.<br />Secretary (HFW) directed that<br />ordermay be issued<br />immediately.</td></tr><tr><td>ii.</td><td>REIMBURSEMENT OF COVID -19 TEST<br />CAHRGES LEVIED BY CGHS EMPANELLED<br />HOSPITALS.<br />This is to inform you that in spite of your<br />instructions to all the Chief Secretaries<br />of the State Governments, even now some<br />of the Private hospitals, especially CGHS<br />empanelled private hospitals are refusing<br />to give medical treatment to the Central Govt.<br />employees. The CGHS empanelled Hospital<br />whichever is at present giving treatment for<br />other diseases is insisting that before admitting<br />the patient for treatment, the patient have to<br />undergo COVID-19 tests and for that purpose<br />the hospital are charging almost Rs.10,000, which<br />include the testing charges and the PPE charges<br />both for the patients and for the care taker.<br />At present, there is no provision for reimbursement<br />of this COVID-19 test charges either under the<br />CS (MA) Rules or under CGHS Rules.</td><td>In case of CGHS beneficiaries,<br />orders regarding CGHS rates applicable<br />for COVID -19 test is already notified<br />vide OM Z.15025/18/2020/DIR/CGHS<br />dated 10.06.2020( Annexure-I).<br />Joint Secretary (CGHS) informed that<br />similar order for COVID-19 test will be<br />issued shortly for CS (MA) beneficiaries.</td></tr><tr><td>iii</td><td>REIMBURSEMNET OF OPD MEDICINES TO CS (MA) BENEFICIARIES IN VIEW OF COVID-19.<br />The Ministry of Health and Family<br />Welfare vide its OM Dated 27th March 2020 have issued instructions that<br />Considering the guidelines for<br />maintaining social distancing between<br />individuals, the CGHS beneficiaries are<br />permitted to purchase medicines based<br />on the prescription already with them.<br />However this benefit has not been<br />extended to CS (MA) beneficiaries.<br />Majority of the Defence Civilian Employees<br />are governed under CS (MA) Rules. Therefore it is requested that the CS (MA)<br />beneficiaries also may be permitted to procure medicine from the local Pharmacy and to reimburse the same with the existing prescription and for new cases by not insisting for AMA’s prescription. Medicines<br />purchased based on the prescription from a Registered Medical Practitioner may be allowed<br />to be reimbursed till the COVID-19 Pandemic<br />is down.</td><td>MoHFW vide OM No. S.11011/12/2020 &#8211; EHS dated 01.04.2020 (Annexure-II) has issued instructions that CS (MA) beneficiaries getting medicines for chronic diseases may purchase medicines from the local pharmacy till 30.04.2020, based on the prescription of Authorized Medical Attendant, already held by the beneficiaries. The medical claim for reimbursement shall be submitted by the beneficiary to the concerned Ministry / Department/ Organization for further processing. This special sanction was further extended by OMs dated 05.05.2020 and 03.06.2020 (Annexure-II) and this special sanction of local purchase is allowed upto 31.07.2020.</td></tr><tr><td>iv</td><td>REFUSAL OF TREATMENT /<br />CASHLESS TREATMENT BY CGHS<br />EMAPNELLED HSOPITAL<br />Instances have come to our notice from<br />different cities that after the declaration of<br />Nationwide lockdown as a preventive<br />measure against the spread of COVID-19 Virus some of the CGHS recognized the hospitals are refusing for giving treatment<br />to the Central Govt. Employees including<br />Defence Civilian employees. Some of the Hospitals are admitting the patients with the<br />conditions that they will not be given cashless treatment and that they should<br />deposit the treatment charges in advance, in case they want medical attention.<br />You will appreciate when the whole country<br />is in crisis and the medical community is<br />struggling to save human beings from the COVID-19 Virus, we fail to understand how these corporate hospitals are refusing to treat<br />the Govt. Employees and their families.<br />Therefore it is requested that you may kindly<br />intervene in the matter and necessary instructions<br />may please be issued to all the CGHS empanelled<br />hospitals to compulsorily give medical treatment to<br />all the central government employees and pensioners<br />by extending the Cashless treatment facilities.</td><td>Joint Secretary (CGHS) stated<br />that Advisory to CGHS empanelled hospitals is already in place and notified vide OM No. 15025/18/2020 /DIR/CGHS dated 09.06.2020 (Annexure-III).It was assured by the chair that advisory will be reiterated.</td></tr></tbody></table></figure>



<p>In addition to above, some other issues were also taken up for discussion, which are summarized below:-</p>



<p>(a) Provision of immunity boosting drugs/ medicines</p>



<p>Staff Side requested the Ministry to make arrangement for the supply of immunity boosting drugs/ medicines to the beneficiaries.</p>



<p>JS(CGHS) informed the Staff side that there are number of AYUSH dispensaries under CGHS and the beneficiaries may avail the services of these dispensaries to obtain such immunity boosting Homeopathy / Ayurveda formulations.</p>

<p>(b) Extension of Health Insurance facility under <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong> to all central government employees.</p>



<p>Staff side requested that the insurance scheme under COVID-19 provided to Health Care workers by the Ministry of Health &amp; Family Welfare be extended to all central government employees.</p>



<p>On this, the chairperson apprised the Staff side that this is beyond the purview/ mandate of this Ministry.</p>



<p>(c) Different food charges levied by Railways empanelled hospitals</p>



<p>Staff side members raised the issue of different food charges being levied by Railways empanelled hospitals.</p>



<p>On this, the chair assured Staff side members that this issue would be forwarded to Ministry of Railways for action as deemed fit.</p>

<p>The meeting of the 7 CPC National Anomaly Committee was held today (17/7/2018). Shri Chandramouli, Secretary(P), DOPT presided over this meeting. The Department of personnel had identified the following six items only for discussion:</p>
<p>1.Item No.3 &#8211; Removal of Condition of 3% stipulated to grant bunching benefit<br />
2.Item No.4 &#8211; Fixation of pay on promotion<br />
3.Item No.5 &#8211; Removal of Anomaly in pay matrix<br />
4.Item No.8 &#8211; Lesser pay in higher level of pay matrix<br />
5.Item No.9 &#8211; Bunching of steps in the revised pay structure<br />
6.Item No.14 &#8211; Grant of GP 5400 to Sr section officer of Railways and AAOs of IA&amp;AD and Organised Accounts (Civil Accounts, Postal Accounts and Defence Accounts)</p>
<p>After completing discussions on the above items the Staff Side insisted that the following remaining items may also be given up for discussion.</p>
<p>Item No.1 Anomaly will computation of Minimum Wage<br />
Item No.2. 3 % increment at all stages<br />
Item No.6 Anomaly due to index rationalization<br />
Item No.7 Anomaly arising from the decision to reject option No. I in pension fixation<br />
Item No.10 Minimum Pension<br />
Item No.11 Date of Effect of Allowances &#8211; HRA Transport Allowance, CEA etc.<br />
Item No.18 Anomaly in the grant of D.A. installment w.e.f. 1.1.2016</p>
<p>After discussion on the above items, the official side informed that the DOPT had already examined those issues and have come to the conclusion that those items will not come under the ambit of the definition of Anomaly. The Staff Side contested this. It was decided that the DOPT will convey the reasoning to the staff side and hold meeting with the Staff Side to sort out the differences.</p>
<p>The following items has been referred to Departmental Anomaly Committee of the respective Department/Ministries.</p>
<p>Item No.15. Technical Supervisors of Railways</p>
<p>Item No.16 Anomaly in the assignment of replacement of Levels of pay in the Ministry of Defence, Railways, Mines etc in the case of Store Keepers</p>
<p>Item No. 17 Anomaly in the assignment of pay Levels in the case of Research Assistants in Ministry of AYUSH, Homeopathic Department.</p>
<p><strong>The staff side then raised the following other issues.</strong></p>
<p>1. Central Govt employees may bc granted one more option to switch over to 7 CPC from a date subsequent to 251h of July 2016 &#8211; the official side in formed that the matter is under consideration and a decision would be taken shortly.</p>
<p>2, The issue of pay fixation of ex-servicemen in the Last pay drawn by them before retirement from armed forces is remaining unsettled &#8211; the official side informed that the matter has been referred to Min. of Defence by DOPT lor their comments. Decision Would be taken after receipt of comments from MOD.</p>
<p>3. The Staff side raised the issue of not convening meetings of the National Council, JCM and Standing Committee.</p>
<p>4. The Staff Side also informed of the decision taken by the NJCA in its meeting held on 3-7-2018 of the revival of the deferred indefinite strike by the Central Govt Employees if no settlement is brought about on major demands like upward revision of minimum pay, fitment factor and NPS before 7-8-2018.</p>

Kindly refer to Para No. 8.1 of the Minutes of the Meeting of the 6 th CPC National Anomaly Committee held on 17th July, 2012. This is with regard to Item No. 1, 2, 3 and 4 i.e. fixation of pay in revised Pay Scale. The Staff Side in the meeting has reiterated their demand that the pay in the incumbents holding the merged Pay Scale of Rs. 5000-8000 and Rs. 5500-9000 should have been fixed by applying the multiplication factor of 1.86 at Rs. 6500 w.e.f. 01.01.2006 implying thereby that the commencement point of the Pay Band-2 should be at Rs. 12090/- based on 6500 x 1.863 = 12090 instead of Rs. 9300/- computed by multiplying Rs. 5000 x 1.86. The Official Side has rejected the demand of the Staff Side and after discussion it was decided that on this issue a disagreement may have to be recorded for referring the same to arbitration. Even though it is more than 5 years after the above decision we are not aware that what action has been taken to implement the decision taken in the National Anomaly Committee Meeting.</p>
<p>In this situation the affected Central Government Employees working in different Ministries have approached Court of Law for getting justice. Recently the CAT Ernakulum Bench in its Order OA No. 180/00569/2014 delivered on 03rd of April, 2018 has upheld the demand of the Staff Side and has given the following direction to the Government of India. The relevant portion of the Judgment is given below for your kind information.</p>
<blockquote><p>14. It has to be borne in mind that CCS (RP) Rules, 2008 is a Rule notified under the proviso to Article 309 of the Constitution of India made by the President and hence it has a statutory status in the eye of law. Therefore, any interpretation of the provisions in the said Rules has to be in terms of the Rules itself. Any O.M. issued by way of clarification, explanation or prescribing the modalities for fixation of initial pay of the Government Employees as per the revised pay structure can be only in terms of what is stated in the Rules.</p>
<p>15. As observed above, going by the definitions of the terms &#8216;<strong>existing basic pay</strong>&#8216; and &#8216;existing scale&#8217; in the CDS (RP) Rules, 2008, Rule 7 fixation can be only in accordance with the afore-mentioned definitions of <strong>&#8216;existing basic pay</strong>&#8216; and &#8216;<strong>existing scale</strong>&#8216; only and not by way of administrative O.Ms and instructions contained in Annexure A-1 and Annexure A-2 communications. Therefore, we are inclined to quash and set aside Annexure A-1 and Annexure A-2 communications. We do so. We hold that the applicants are entitled to the declaration as prayed for and that the respondents should be directed to fix the initial pay of the applicants including all the members of Applicant No. 1 association in the revised pay structure by fixing their salary in the revised pay scale of Rs. 6500-10500 treating Rs. 6500/- as the existing basic pay as on 01.01.2006 with all consequential benefits. We order accordingly. This order shall be complied within 3 months from the date of receipt of copy of this order.&#8221;</p></blockquote>
<p>In view of the above Judgement it is requested that without further prolonging the matter the above Judgment may be implemented by issuing a general instructions extending the benefit to all the similarly place Employees.</p>

<p>Item no. 15,16,17&amp;21:- Parity/ Modified Parity in pension/revised pension/family pension of all pre-1996 retirees with those who retired on or after 01.01.2006 .</p>
<p>In accordance with an Office Memorandum dated 01.09.2008, for revision of the pension of the pre-2006 pensioners, the pension/family pension of existing pre-2006 pensioners/family pensioners was to be consolidated with effect from 01.01.2006 by adding together (i) The existing pension/family pension (ii) Dearness Pension, where applicable (iii) Dearness relief upto AICPI (IW) average index 536 (Base year 19823100) i.e. @ 24% of Basic Pension/Basic family pension plus dearness pension as admissible and (iv) fitment weightage @ 40% of the existing pension/family pension. Para 4.2 of the Office Memorandum dated 01.09.2008 provided that the fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty per cent of the minimum of the pay in the Pay Band plus the Grade Pay corresponding to the pre-revised Pay Scale from which the pensioner had retired and in the case of HAG+ and above scales, this will be fifty per cent of the minimum of the revised Pay Scale.</p>
<p>2. Clarification on various provisions of the OM dated 1.9.2008 were issued vide Department of Pension and PW OM No.38/37/08-P&amp;PW(A) pt. 1 dated 3.10.2008. In regard to Para 4.2 of the OM dated 1.9.2008 the following clarification was issued:-</p>
<p>&#8220;The pension calculated at 50% of the minimum of pay in the pay band plus grade pay would be calculated at the minimum of the pay in the pay band (irrespective of the pre-revised scale of pay) plus the grade pay corresponding to the pre-revised pay scale. For example, if a pensioner had retired in the pro-revised scale of pay of Rs.18400-22400, the corresponding pay band being Rs. 37400-67000 and the corresponding grade pay being Rs. 10,000/- p.m., his minimum guaranteed pension would be 50% of Rs. 37,4001 Rs. 10,000 (i.e. Rs. 23,700).</p>
<p>The pension will be reduced pro-rata, where the pensioner had less than the required service for full pension as per rule 49 of the CCS(Pension) Rules, 1972 as applicable on 01.01.2006 and in no case it will be less than Rs. 3500/- p.m.</p>
<p>In case the pension consolidated as per para 4.1 of OM.No.38/37/08-P&amp;PW(A) dated 1.9.2008 is higher than the pension calculated in the manner indicated above, the same (higher consolidated pension) will be treated as Basic Pension.&#8221;</p>
<p>3. In the Agenda item, the JCM (Staff side) claimed that the revised pension/family pension of all pic-2006 pensioners/family pensioners would not be less than 50% of the minimum of the pay band l grade pay, corresponding to the pre-revised pay scale from which pensioner had retired, as arrived at with reference to the fitment tables annexed to Ministry of Finance, Department of Expenditure&#8217;s O.M. No. l/l/2008-IC dated 30.8.2008.</p>
<p>4. In the last meeting of the Anomaly Committee the staff side argued that a reading of the recommendation of the Sixth Pay Commission on the matter indicated that the intent of the Pay Commission was to grant modified parity to pro-01.01.2006 pensioners by allowing the same fitment benefit as is being recommended to the existing Government employees subject to the provision that revised pension shall not be lower than 50% of the minimum of the pay in the pay band prescribed for the grade pay and the sum of the grade pay with reference to the minimum of the pay band plus the grade pay which is not consistent with the recommendation of the Sixth CPC. Officer of Department of Expenditure stated that this was not the intent of me recommendation of the Pay Commission. After some discussion, the Staff Side request the Official Side to examine the matter once again.</p>
<p>5. After the above meeting of the Anomaly Committee, the following decisions have been taken by the Government:</p>
<blockquote><p>(i) Orders were issued vide this Department&#8217;s OM of even number dated 28.1.2013 for stepping up of pension of pre-2006 pensioners w.e.f. 24.9.2012 to 50% of the minimum of pay in the pay band and grade pay corresponding to pre-revised pay scale from which the pensioner retired. Para 5 of this OM provides that in case the consolidated pension/family pension calculated as per para 4.1 of OM. No.38/37/08-P&amp;PW (A) dated 192008 is higher than the pension/family pension calculated in the manner indicated in the OM. dated 28.1.2013, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/family pension.</p>
<p>(ii) Subsequently, in compliance of an order dated 1.11.2oll of the Hon&#8217;ble CAT, Principal Bench in OA No. 655/2010, order dated 29.4.2013 of Hon&#8217;ble, High Court of Delhi in WP (C) No. 1535/2012 and order dated 17.3.2015 of Hon&#8217;ble Supreme Court in SLP (C) No. 36148/2013, order were issued vide this Department&#8217;s 4 O.M. No.38/37/O8-P&amp;PW(A) dated 30.7.2015 that the pension/family pension of all pre ~ 2006 pensioners/family pensioners may be revised in accordance with this Department&#8217;s O.M. No.38/3 7/08-P&amp;PW(A) dated 28.1.2013 with effect from 1.1.2006 instead of24.9.2012.</p>
<p>(iii) Vide OM. No.38/37/08-P&amp;PW(A) dated 6.4.2016, it was decided that the revised consolidated pension of pre-2006 pensioners shall not be lower than 50% of the minimum of the pay in the Pay Band and the grade pay (wherever applicable) corresponding to the pre-revised pay scale as per fitment table without pro-rata reduction of pension even if they had qualifying service of less than 33 years at the time of retirement.</p></blockquote>
<p>6. With the issue of the aforesaid orders, the demand of the staff side in regard to modified parity to pre-2006 pensioners has been accepted and implemented.</p>

<p>I have discussed the issues creating mental agony in the minds of the Central Government Employees many a times and once again want to draw your kind attention for resolution of many long pending demands of the Central Government Employees.</p>
<p>National Pension System (NPS) has been raised by the Staff Side (JCM) many a times, the committee set up by the Government of India for reviewing NPS has also submitted its report, but we are not aware about the outcome of the same. Staff Side(JCM) has been of the firm view that there must be &#8220;<strong>Guaranteed Pension</strong>&#8221; for the employees recruited on or after 01.01.2004, and in case of their death/permanent disablement, their families should get Pension as per Old Pension Scheme.</p>
<p>All the Central Government Employees are anxiously waiting for recommendations of the Government of India for increasing Minimum Wage and improving Fitment Formula and inordinate delay in this regard is creating lot of frustration amongst them.</p>
<p>It is, therefore, requested that, you may please intervene in the above-mentioned issues and the same should be resolved in an amicable manner to avoid mental agony of the Central Government Employees.</p>

<p>The Cabinet Secretary said that, he is aware of the problems of the Staff Side (JCM) from time to time and particularly to this issue and will definitely try to resolve them.</p>
<p>Particularly on the issue of National Pension System (NPS) he said that, the issue is under active consideration of the Government of India and we are trying to find out some solution to the problems arisen because of the NPS.</p>

<p>Subject: <strong>Extension of time limit for forwarding of 7th CPC-related anomalies by the Staff-Side, NC JCM and for their disposal by the National Anomaly Committee &#8211; regarding</strong></p>
<p>The undersigned is directed to refer to the aforementioned subject and to say that in further partial modification of this Department’s O.M. of even no.dated 5th May, 2017, it has been decided to extend the time limits for both receipt and disposal of the 7th CPC-related anomalies, as per the following details:</p>
<blockquote><p>(i) The time limit for receipt of anomalies will stand extended by three months from 15.05.2017(as notified vide OM. referred to above) to 15.08.2017; and</p>
<p>(ii) The time limit for disposal of anomalies will stand extended by three months from 15.11.2017 (as notified vide QM. referred to above) to 15.02.2018.</p></blockquote>
<p>2. This issues with the concurrence of Department of Expenditure, Ministry of Finance.</p>

<p>Sub: <strong>Inordinate delay in implementation of the report of the Committee on Allowances </strong></p>
<p>It is a matter of regret that, in spite of all the persuasions made by the Staff Side(JCM) there is inordinate delay in finalization of recommendations of the Ashok Lavasa Committee on Allowances. More than one year and three months have passed after implementation of the report of the VII CPC, but the employees are still getting allowances at the old rates as had been recommended by the VI CPC.</p>
<p>The Committee on Allowances took longer time while finalizing its recommendations, but it is a matter of deep regret that, even after submission of the report by the said committee, the same has not been made available to the Staff Side(JCM), therefore, we do not know what recommendations have been made by the said committee.</p>
<p>Staff Side(JCM), therefore, requests that the recommendations of the Allowances Committee should be made available to the Staff Side(JCM).</p>
<p>Moreover, it would be highly appreciated that, the Allowances should be implemented without any further delay, and the date of the implementation should be w.e.f. 01.01.2016.</p>

<p>Dear Comrades!</p>
<p>Sub: <strong>Proceedings of the meeting of the Standing Committee meeting of the National Council(JCM held on 03.05.2017 under the Chairmanship of Secretary (DoP&amp;T)</strong></p>
<p>Immediately after Introductory Remark of the Secretary(DoP&amp;T), the Staff Side raised the following issues:-</p>
<p>For more than 7 years now the National Council(JCM) has not met. Functioning of the JCM is completely diluted by the Government Departments are also not holding meeting. The grievances on service matter of the employees are getting accumulated. The JCM Machinery needs to be strengthened and meeting with the Staff Side should take place regularly.</p>
<p>2.It is now more than 10 months after proposed &#8220;Indefinite Strike&#8221; was deferred by the Central Government Employees; based on the assurance given by the Group of Ministers. None of the demands is settled. &#8220;The Staff Side is in dark about the recommendations of the Allowance Committee&#8221;. &#8220;While Pay Commission&#8217;s report is put on the Public Domain after its submission to the government, why these reports are kept secret&#8221;, the Staff Side asked.Since Allowances Committee report is considerably delayed the date of effect of the revised allowances should be w.e.f. 01.01.2016. <strong>The Staff Side has demanded that, Minimum Wage should be raised, Pay Matrix should also be revised, to recommend at least Minimum Guaranteed Pension of 50% of the last pay drawn, Family Pension, and Disability Pension and GPF to all the Central Government Employees.</strong> It is unfortunate that, Option No.1, recommended by the 7th CPC for pre-01.01.2016 Pensioners, is also rejected. The Central Government Employees are very much agitated and there is going to be an uncontrollable unrest, hence the Chairman is requested to convey our feelings to the government to avoid a confrontation</p>
<p>(Chairman intervened and assured that he would convey the feelings of the Staff Side to the government).</p>
<p>In spite of the Government orders many autonomous bodies have not revised the pay scale of the employees as per 7th CPC and no order is yet issued for revising the pension of the pensioners who retired from these autonomous bodies. These issues needs to be settled by the government.</p>
<p>4.Staff Side demanded to fill-up all the vacant posts and also to sanction additional posts to man additional assets and additional workload without insisting on Matching Saving.</p>
<p>Thereafter, Action Taken Report on the progress/decisions taken on the Agenda Points discussed during last Standing Committee Meeting was taken for discussion. Details are given below-</p>
<p><strong>DISCUSSION ON ACTION TAKEN REPORT</strong></p>
<p><strong>1.No privatization PPP or FDI in Railways and Defence Establishment</strong></p>
<p>The issue will be separately discussed by the Railways and Defence Ministry with the Recognized Federations.</p>
<p><strong>2. No Corporatization of Postal Services</strong></p>
<p>Department of Post informed that there is no proposal of Corporatization / privatization at this juncture.</p>
<p><strong>3.Scrap PFRDA Act and reintroduce the Defined Benefit Statutory Pension Scheme</strong></p>
<p>The Chairman stated that, we have to wait for the report of the NPS Committee. However, the Staff Side insisted that, there should be at least Guaranteed Minimum Pension of 50% of the last pay drawn, Family Pension, and Disability Pension.</p>
<p><strong>4.Regularize the existing daily rated/casual and contract workers, and absorb trained apprentices. No labour reforms should be carried out which are not in the interest of workers.</strong></p>
<p>After discussion it was decided that, specific cases, if referred to the DoP&amp;T by the Department/ Staff Side, may be considered. The issue of Gun and Shell Factory Casual Employees would be considered in consultation with the MoD.</p>
<p><strong>5.Revive JCM functioning at all levels as an effective negotiating forum for settlement of demands of the central government employees.</strong></p>
<p>It was assured that JCM Machinery would be activated.</p>
<p><strong>6.Remove the arbitrary ceiling on compassionate appointments.</strong></p>
<p>The Staff Side demanded the following:-</p>
<ul>
<li>The arbitrary and artificial 5% ceiling may be removed.</li>
<li>Pending the same the 5% vacancies should be calculated on the overall vacancies and not in the vacancies of the particular year.</li>
<li>For calculation of vacancies Group B posts also should be taken into account.</li>
<li>In the Defence Ministry wards of service personnel are given Compassionate Appointment in the 5% of Civilian Vacancies. However while calculating 5% vacancies, the vacancies of service personnel are not taken in to account. This anomaly may be rectified.</li>
<li>Defence Ministry has proposed a onetime relaxation of 5% ceiling considering the large number of pending applications. TheDoP&amp;T has rejected the same. The issue may be reconsidered by the DoP&amp;T</li>
</ul>
<p>After discussion on the above issues SecretaryDoP&amp;T assured that he would reconsider the whole matter.</p>
<p><strong>7.Ensuring Five Promotions in the Service Career</strong></p>
<p>The Staff Side insisted that MACP should be in the promotional hierarchy and the condition of &#8220;Very Good&#8221; grading should be removed for granting of MACP.</p>
<p><strong>8.Non-implementation of the decision taken in the 46th National Council (JCM) Meeting held on 15th May 2010 with regard to Item No. 20.</strong></p>
<p>The Staff Side stated that in spite of the DoP&amp;T&#8217;s direction not to recognize Associations of &#8220;Workers&#8221;, the Defence Ministry is not implementing the same. After discussion Secretary DoP&amp;T assured that he would discuss the matter with the Defence Secretary and settle the same.</p>
<p><strong>9.Reduction of one day Productivity Linked Bonus (PLB) to the employees of OFB &amp; DGQA under Department of Defence Production against Cabinet decision and Government orders.</strong></p>
<p>Staff Side protested against the arbitrary recovery of PLB days in the case of employees of Ordnance Factories, DGQA, DGAQA and EME. After discussion Secretary DoP&amp;T directed the Department of Expenditure to reconsider the matter and if necessary to put up the case to the Finance Minister for his consideration.</p>
<p><strong>10.Grant of one time relaxation to the Central Government employees who have availed LTC-80 and travelled by air by purchasing Ticket from other than authorized agent.</strong></p>
<p>The Staff Side insisted that the employees who are otherwise not eligible for entitlement of air traveling, have purchased flight tickets from other than authorized agents due to their ignorance of rule position should not be punished by imposing recovery of the entire LTC amount etc. Therefore to settle the matter once for all a onetime relaxation may be given to such employees. After discussion it was decided that DoP&amp;T may reconsider the whole matter.</p>
<p><strong>11.Grant of House Rent Allowance to the employees who have vacated government quarters.</strong></p>
<p>The Staff Side insisted that NAC should not be a pre condition for grant of HRA to those employees who vacate the government quarters. After discussion it was decided that the Directorate of Estate and Department of Expenditure would consider the matter.</p>
<p><strong>12.Restoration of interest-free advances withdrawn by the Government based on 7th CPC recommendations.</strong></p>
<p>The Official Side assured that, the demand of the Staff Side would be conveyed to the government.</p>
<p><strong>13.Grant of entry pay recommended by 6th CPC to the promotees under the provisions of CCS(RP) Rules- 2008.</strong></p>
<p>The Staff Side stated that the decision taken in the National Anomaly Committee meeting in this regard was not accepted by the finance ministry and at present the Principle Bench CAT New Delhi and the CAT Madras Bench has given judgment in favour of the employees and hence the Department of Expenditure may reconsider the matter. After discussion it was decided that the Department of Expenditure would reconsider the matter.</p>
<p><strong>14.Grant of 3rd MACP in GP Rs.4600 to the Master Craftsmen (MCM) of Defence Ministry who were holding the post of MCM in the pre-revised pay scale of Rs.4500- 7000 as on 31/12/2005.</strong></p>
<p>After discussion it was decided that DoP&amp;T will refer the matter to Department of Expenditure recommending to reconsider their earlier decision of rejection since the demand is in conformity with the rules on ACP/MACP.</p>
<p><strong>15.Carrying forward of Earned Leave by Defence Industrial Employees on transfer/ appointment from non Industrial to Industrial Establishment.</strong></p>
<p>DOPT has agreed with the demand and their decision would be conveyed to MOD after receipt of the proposal from Defence Ministry in this regard.</p>
<p><strong>16.Reimbursement of actual medical expenditure incurred by the employees in recognized hospitals.</strong></p>
<p>CGHS rates are under revision and the same would be issued soon.</p>
<p><strong>17.Dental Treatment in private hospitals recognized under CGHS / CS(MA) Rules, 1944 for CS(MA) beneficiaries.</strong></p>
<p>CGHS vide their OM dated 5th April 2017 has informed that the requirement of no objection certificate has been dispensed with vide OM No. S.14025/41/2015-MS dated 7.12.2016.</p>
<p><strong>18.Removal of ambiguity in fixation of pay of re-employed Ex-Servicemen and grant of the same benefit extended to Commissioned officers to personnel below officers rank also</strong></p>
<p>The demand is under consideration ofDoP&amp;T in consultation with the Department of Expenditure.</p>
<p><strong>19.Permission to opt for pay fixation in the revised pay structure on a date after the date of issue of CCS(RP) rules 2016 notification (25.7.2016) in case of employees whose promotion becomes due after 25.7.2006.</strong></p>
<p>The issue is under consideration of Department of Expenditure and a decision would be taken soon.</p>
<p><strong>20.Fill up all vacant posts including promotional posts in a time bound manner.</strong></p>
<p>DOPT is framing a fresh calendar for holding DPC and effecting promotions which will enable to fill up the promotional Posts in a time bound manner. Instructions will be issued very soon.</p>
<p><strong>21.Abolish and upgrade all posts of Lower Division Clerks (LDCs) to Upper Division Clerks(UDCs)</strong></p>
<p>The Staff Side demanded that the LDC post may be merged with UDC and MTS may be promoted directly to UDC. DoP&amp;T agreed to consider the demand.</p>
<p>Due to paucity of time, new agenda points, given by the Staff Side, was not taken up for discussion. It was decided that the Action Taken on the New Agenda Points would be communicated to the Staff Side and a meeting would be thereafter convened to discuss these items.</p>
<p><strong>Cabinet approves revision of pension to pre 2016 pensioners</strong></p>
<p>The Cabinet approved modifications in the recommendations of the 7th CPC relating to method of revision of pension of pre-2016 Pensioners and Family Pensioners based on the suggestions made by the Committee, chaired by Secretary(Pensions), constituted with the approval of the Cabinet. While approving implementation of the 7th CPC recommendations on 29th June, 2016, the Cabinet had approved the changed method of pension revision recommended by the 7th CPC for pre-2016 pensioners, comprising of two alternative formulations, subject to the feasibility of the first formulation which was to be examined by the Committee. In terms of the Cabinet decision, pensions of pre-2016 pensioners were revised as per the second formulation multiplying existing pension by a fitment factor of 2.57, though the pensioners were to be given the option of choosing the more beneficial of the two formulations as per the 7th CPC recommendations. In order to provide more beneficial option to the pensioners, Cabinet has accepted the recommendations of the Committee, which has suggested revision of pension based on the information contained in the Pension Payment Order (PPO) issued to every pensioner. The modified formulation will be beneficial to more pensioners than the first formulation recommended by the 7th CPC, which was not found to be feasible to implement on account of non-availability of records in a large number of cases and was also found to be prone to several anomalies.</p>

<p>Ref: NFIR’s letter No.IV/NC/JCM/Part IV dated 19.01.2017.</p>
<p>Ministry of Personnel, Public &amp;Grievances and Pensions (Department of Personnel &amp; Training) vide their O.M.No.1/3/2008-JCA-1 dated 27.02.2017has since conveyed the approval of the Competent Authority to the nominations/re-nominations of the following representatives of National Federation of Indian. Railwaymen as Staff Side members of National Council(JCM) on behalf of NFIR for a period of three(3) years with effect from 27.2.2017:</p>
