Subject: Revised sanctioned strength of Staff Car Drivers- regarding.

Sir/Madam,

This is regarding revised sanctioned strength of Staff Car Drivers among the four grades, viz. Ordinary Grade, Grade-II, Grade-I and Special Grade in terms of ratio i.e. 30:30:35:5 respectively as per guidelines issued by DoP&T vide OM no. 43019/54 /96-Estt(D) dated 15th February, 2001.

2. While reconciling the sanctioned strength of Staff Car Drivers, it is noticed that Circles have not apportioned the sanctioned strength of Drivers in 30:30:35:5 among the four grades (Ordinary Grade, Grade-II, Grade-I and Special Grade) correctly. The information received from some Circles showed variation in sanctioned strength of Staff Car Drivers.

3. Hence, re-calculation has been done on the basis of information provided by Circles following by guidelines issued by DoP&T vide OM no. 43019/54/96-Estt(D) dated 15th February, 2001. The revised sanctioned strength of Staff car Drivers is placed at Annexure-I.

4. Guidelines issued by Department of Expenditure vide OM no. 752985/2018 /E.Coord. I dated 13.04.2018 (copy enclosed as Annexure-II) must be followed. Whenever dispensation for down-gradation of posts is exercised, the total number of sanctioned posts in the feeder and higher grade should not exceed the combined sanctioned strength of the two grades. All the Circles may start the process of promotion to the post of Staff Car Driver (Special Garde). Further, A.P., Assam, Maharashtra and Telangana Circle may continue the recruitment to the post of Staff car Drivers (Ordinary Grade).

New Delhi, the 10th July 2020

No. A-12(11)10/2015-Estt. I. – In exercise of the powers conferred by sub-section (1) of section 97 read with clause(xxi) of sub-section (2) and sub-section (2A) of that section and sub-section (2) of section 17 of the Employees’ State Insurance Act, 1948 (34 of 1948) the Employees’ State Insurance Corporation hereby makes, with the approval of the Central Government and in consultation with the Union Public Service Commission, the following regulations regulating the method of recruitment to the posts of Staff Car Driver (Special Grade) in the Employees State Insurance Corporation, namely:

1. Short title and commencement. – (1) These regulations may be called the Employees’ State Insurance Corporation Staff Car Driver (Special Grade) Recruitment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and level in the pay matrix. – The number of the said post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.

3. The method of recruitment, age-limit, qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. No person, – (a) who has entered into or contracted a marriage with a person having spouse living; or(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Director General of the Employees State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.

5. Power to relax. Where the Director General of the Employees State Insurance Corporation is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing and with the prior approval of the Central Government and in consultation with the Union Public Service Commission, relax any of the provisions of these regulations, with respect to any class or category of persons.

6. Savings. Nothing in these regulations shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard:

1. Short title and commencement.– (1) These regulations may be called the Employees’ State Insurance Corporation, Lower Division Clerk (Group ‘C’ Post) Recruitment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix. The number of the said post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.

Promotion: (i) Multi-tasking Staff possessing minimum qualification of Matriculation or equivalent and rendered not less than three years regular service in the Multi-tasking Staff cadre in level-1 in the pay matrix (Rs. 18,000-56,900) are eligible for consideration for promotion on the basis of seniority cum- fitness.(ii) Promotion shall be subject to completion of training for promotion to the post of Lower Division Clerk as devised by the Employees State Insurance Corporation. (iii) Those persons who are due to retire within two years will be exempted from completion of such training for promotion: Provided that those persons who have not completed training for promotion before the date of meeting of Departmental Promotion Committee will also be considered subject to the condition that the required training will be completed within one year of the date of meeting of Departmental Promotion Committee. Note : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service. Limited Departmental Competitive Examination: Group ‘C’ Staff in level-1 in the pay matrix (Rs. 18,000- 56,900) possessing minimum educational qualification of Higher Secondary (12th standard) pass from recognised Board or equivalent who have rendered not less than three years’ service in the cadre on regular basis shall be eligible to appear for the Limited Departmental Competitive Examination.	Group ‘C’ Departmental Promotion Committee (for considering promotion) consisting of: 1. Sub: Admissibility of Daily Allowance to Staff Car Drivers.

It has been decided by the Board, after discussions with both the Federations, to modify the provisions regarding admissibility of Daily Allowance to Staff Car Drivers contained-in para 2 of Board’s letter No. F(E)I/2006/AL-28/15 dt. 12.03.2008. Accordingly, para 2 of the said letter, is partially modified to read as under:

“2. As per the provisions contained in Supplementary Rule 186 and Government of India’s order (l) there under, read with Note 8 under Rule 26 of Staff Car Rules, Staff Car Drivers who perform a ‘local journey’ or journey on touring on the official vehicle in his charge, may draw travelling allowance under the ordinary rules as admissible to other Railway employees even if the journeys does not involve the absence of at least one night from his Headquarters. When they perform local journeys for distance exceeding 8 Kms. beyond prescribed hours of duty and such journeys involve absence of a night from head quarters, they are entitled to draw D.A. under ordinary rules admissible to other employees, for the period beyond duty hours, in addition to OTA. In case the journey does not/involve their absence of one night from their headquarters, they are entitled to draw D.A. for the period beyond duty hours subject to the condition that DA shall be payable for the period with reference to which D.A. has been drawn. In such cases, they have the option to draw either OTA or DA on any day on which such journeys have been undertaken.”

2. This would be applicable to all Drivers irrespective of the type of vehicle they drive.

3. These orders will take effect from the date of issue. Past cases, will, however, continue to be dealt with under provisions of letter No. F(E)l/2006/AL-28/15 dt. 12.03.08.
