OFFICE MEMORANDUM

Allowances

Department of Personnel & Training has issued various instructions from time to time on various Allowances applicable to Central Government Employees. The essence of these instructions has been summarized in the following paras for guidance and better understanding.

1. Children Education Allowance (CEA)

Consequent upon the decisions taken by Government to implement the recommendation of 7th CPC, this department has issued an OM No. A-27012/01/2017-Estt.(AL) dated 17.07.2018. The salient features of CEA are:

• (i) CEA/Hostel Subsidy can be claimed only for the two eldest surviving children.
• (ii) The amount of CEA will be Rs. 2250/- per month per child.
• (iii) The amount of hostel subsidy is Rs. 6750/- per month.
• (iv) The reimbursement of CEA for Divyang Children of Government servant shall be payable at double the normal rate of CEA i.e. Rs. 4500/- per month.
• (v) The rate of CEA would be raised by 25% every time the DA on the revised pay structure goes up by 50%.
• (vi) The CEA and Hostel subsidy is admissible in respect of children studying from two class before class one to 12th standard.

2. Risk Allowance

• (i) As per decision taken by the Government on the recommendation of 7th CPC rates of Risk Allowance were revised.
• (ii) Risk Allowance is presently given to Central Government employees engaged in hazardous duties or whose work will have a deleterious effect on health over a period of time.
• (iii) The Risk Allowance will not be treated as “Pay” for any purpose.

3. Night Duty Allowance (NDA)

Consequent upon the decision taken by Government on the recommendations made by 7th CPC on the subject following guidelines has been issued:

• (i) Night duty will be defined as duty performed between 22:00 hours and 6:00 hours.
• (ii) A uniform weightage of 10 minutes shall be given for every hour of night duty performed.
• (iii) The ceiling of basic pay for entitlement of NDA shall be Rs 43600/- per month.
• (iv) The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.
• (v) The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty.

4. Over Time Allowance (OTA)

Consequent upon the recommendations of 7th CPC as accepted by the Government, it has been decided that:

• (i) “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff’. Rates of Overtime Allowance not to be revised upwards”.
• (ii) The following definition has been used to define Operational Staff: “All non-ministerial, non-gazetted Central Government Servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.”
• (iii) The concerned Administration Wing of the Ministries/ Departments will prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of JS(Admn.) and Financial Adviser of the concerned Ministry/ Department.
• (iv) The grant of OTA may be linked to biometric attendance.

5. Special Allowance Payable to Parliament Assistants

• (i) As per the decision taken by the Government on 7th CPC recommendations to enhance the rates of Special Allowance payable to those wholly engaged in Parliament work during Parliament session by 50% from the existing levels of Rs. 1500/- and Rs. 1200/- payable to Assistants and UDCs respectively to the level of Rs. 2250/- and Rs 1800/-.
• (ii) The allowance will be admissible at full rates for every calendar month in which the Parliament is in session for at least 15 days in that month. For month with shorter period, the allowance will be admissible half the rates prescribed for the full month.
• (iii) No OTA shall be paid to Parliament Assistants for the calendar months in which the Parliament is in session.

6. Special Allowance for Child Care for Women with Disabilities

• (i) For providing extra benefits to women employees with disabilities especially when they have young children and children with disabilities, it has been decided that women with disabilities shall be paid Rs. 3000/- per month on Special Allowance for child care. The allowance shall be payable from the time of the child’s birth till the child is two years old.
• (ii) The above limit would be raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%.

Subject:- Methodology of fixation of pay on promotion to SO(A/c) AAO on account of passing SAS Part-II / Appendix-II Examinations which involves Special Allowance.

The undersigned is directed to refer to this Ministry/ Department’s Letter No. 27023(41)/74-EG-I dated 03.01.1975 and Defence Account Department/ Ministry of Finance (Defence)’s Letter No.11323/ Accts/AN dated 20.02.1972 regarding incentives for passing SAS Examination as Special Pay wherein it was stipulated that the Special Pay would be taken into account for Fixation of Pay on promotion under the relevant orders issued by the Government in this regard. Pursuant to recommendation of Fifth Central Pay Commission, as per DOPT vide OM No. 4/4/97-Estt(Pay-ll) dated 22.4.1998, the Special Pay henceforth termed as Special Allowance and would be granted hithertofore subject to same conditions as are stipulated in FR 9(25).

2. It has been observed that due to no further instructions/guidelines has been issued by this Department or DOPT with regard to the treatment of Special Allowance on fixation of pay on promotion to next higher post prior to 7th CPC regime, different accounts cadres has been following the practice of taking into Special Allowance for fixation of pay on promotion, in previous CPC regime (5th and 6th CPC and in switching over to 7th CPC regime) as per MOF/ DOE/ DAD’s earlier instruction issued in 3rd CPC vide letters dated 03.01.1975 & 20.02.1975, as stated above.
3. Since 7th CPC did not recommend Dearness Allowance on Qualification Pay/Special Allowance, the grant of DA, HRA etc. on Special Allowance/Qualification Pay granted to Account Cadres is not admissible. The practice of adding of Special Allowance (on passing SAS Examination) in the basic pay and fixing the pay at the next higher cell would mean treating this Allowance as pay for all purposes which would not only dilute the very principle of fixed monetary benefit instead it would lead to an additional increment. This is also not in consonance with the recommendation of at para 8.9.45 of 7th CPC that Dearness Allowance is not admissible on the Qualification Pay/ Special Allowance.
4. In view of above, it has been decided to adopt the following instructions/guidelines, with prospective effect, for treatment of Special Allowance on passing SAS Examination on promotion to next higher post:

• (i) the element of Special Allowance granted on passing SAS Examination may be treated as standalone element i.e. Special Allowance of Rs. 360 for 1st year and Rs. 630 from 2nd year onwards.
• (ii) Dearness Allowance and other allowances on Special Allowance will not be admissible.
• (iii) Special Allowance will be admissible till the government servant is not promoted to the next higher post/grade on passing SAS Examination.
• (iv) On promotion to next higher post after passing SAS examination, the element of Special Allowance shall not be taken into account for fixation of pay on promotion to the next higher post.
• (v) On such promotion, the pay of such GS will be fixed as per Rule 13 of CCS(RP) Rules 2016.

5. This issues with the approval of the competent authority.

This allowance is not admissible to non-teaching staff.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

During discussions with the Financial Commissioner (Railways) at Rail Bhavan, New Delhi, following pending issues were brought to her notice by NFIR for taking immediate action:-

• Payment of Special Allowance to Stock Verifiers who were posted from the cadre of JAA on passing Appendix IV A (IREM Examination) – NFIR’s PNM Item No. 22/2012
• Grant of one time relaxation for promotion against DR quota Vacancies of Accounts clerks to the eligible erstwhile Group ‘D’ staff of Accounts Department – NFIR PNM Item No. 30/2012.
• Implementation of commitment given to the Federation on NFIR’s PNM Item No. 15/2013 during separate meeting held with the Member Staff and FC for granting stepping up of pay to the SSOs (Accounts) w.e.f. 01/01/2006 at par with their Junior (non-qualified)
• Implementation of 7th CPC recommendations for grant of GP 5400 to SSOs w.e.f. 01/01/2016. Correspondence between Railway Ministry and DoP&T/ MoF and back references continued – Accounts staff disappointed over abnormal delay.

After discussion on the above, FC has assured to take action on each item for quick finalization. She also assured to discuss with MoF /DoP&T on items (iii) and (iv).

The Federation also met Member Staff today at 9th December, 2019 and explained the necessity to take personal initiative for securing clearance for upgradation of 75% posts of Supervisors to GP 4800/Pay Level-8. Member Staff has assured to personally pursue even by reaching North Block (DoP&T/MoF).

The undersigned is directed to refer to your letter No. 1/5(g)/2019 dated 10.10.2019 on the subject noted above. In this regard it is stated that the issue regarding extending the benefit of LC Gate Allowance to Gatemen (now Track Maintainers) manning the Traffic Gates at par with the Gatemen (now Track Maintainers) manning the Engg. Gates is under consideration in Board’s office in consultation with Ministry of Finance. A consolidated proposal in respect of payment of Special Allowance to the traffic Gatemen deployed to work on Level Crossing Gates (LC Gate) alongwith an another proposal has been sent to Ministry of Finance (MoF) vide U.O. dated 16.08.2019. However, no reply has since been received from Ministry of Finance so far.

Revision of Allowances as per 7th CPC to University and College Teachers, equivalent academic cadre, Registrars, Finance Officers and Controller of Examinations

MHRD issues orders for revision of allowances of teachers, equivalent academic cadre, Registrars, Finance Officers and Controller of Examinations in the Universities and Colleges as per the Recommendations of Seventh Central Pay Commission

The much awaited orders on revision of allowances and special allowances for teachers and equivalent academic cadre, Registrars, Finance Officers and Controller of Examinations in Central Universities and Colleges there under have been issued by the Ministry of Human Resource Development. This also includes centrally funded Deemed to be Universities.The orders come into force with immediate effect.

The revised special allowance per month for Vice Chancellor, Pro-Vice Chancellor, Principal in PG College and Principal in UG College are Rs. 11,250/-, Rs. 9,000/-, Rs. 6,750/- & Rs. 4,500/- respectively.

This is likely to benefit 30000 teaching and equivalent staff in Central Universities and 5500 in Deemed to be Universities.

This will serve as a bench mark for 7 lakh teachers in State Universities.

Federation desires to invite attention of the Railway Board to the letters cited under reference relating to the NFIR’s PNM agenda Item No.1-B/2012.

During NFIR’s PNM meeting held with the Railway Board on 13/14-11-2017, the Official Side through Action Taken Statement on the agenda item conveyed that the advice of Ministry of Health & Family Welfare in the matter was still awaited and reminders have also been sent on 26/04/2017 and 11/10/2017 to ascertain the date of enhancement of the Allowance to Rs. 360/-p.m. from Rs. 120/- p.m.

Federation is surprised to note that though the instructions have since been issued by the Board revising the rate of Special Allowance, renamed as Operation Theater Allowance to the Nursing Personnel working in the specialized areas in the Railway Hospitals under the Ministry of Railways to Rs.540/- p.m. w.e.f. 1st July 2017, vide Board’s letter dated 27/12/2017, unfortunately the said letter does not mention NFIR’s PNM agenda Item. There is, therefore necessity to issue amendment to Board’s letter dated 27/12/2017.

Further to above, Federation desires to mention that the question relating to enhancement of Special Allowance from Rs.120/- p.m. to Rs.360/-p.m. pursuant to implementation of 6th CPC recommendations, is still unanswered and payment not arranged with back date.

NFIR,therefore, requests the Railway Board to issue corrigendum to Board’s letter dated 27-12-2017 for enhancement of Operation Theater Allowance from Rs.120/-p.m to Rs.360/- p.m also with retrospective effect, duly citing NFIR’s PNM agenda item.

Federation may be kept advised of the action taken in the matter.

Subject: Revision of rates of Operation Theatre allowance (Special allowance) to the Nursing Personnel working in Central Government Hospitals as per recommendations of  the 7th CPC – regarding.

Consequent upon the decision taken by the Government of India on the recommendations of the 7th Pay Commission, the President is pleased to revise the rate of Operation Theatre allowance (Special allowance renamed as Operation Theatre allowance) from Rs.360/-per month to Rs.540/- per month to the Nursing Personnel working in the following specialized areas in Central Government Hospitals / Institutions under the Ministry of Health &Family welfare

a. All Major Operation Theatres.
b. All Intensive Care Units / Intensive Care Treatment areas
c. Coronary Care Units /Cardiac Catheterization Laboratories
d. Dialysis Unit/ Ward and Transplant Units/ Wards
e. Intensive Care Units for Burns
f. Tetanus Wards and Rabies Wards
g. Paediatric Nursery/ Neonatal Units

Operation Theatre allowance admissible to nursing personnel is subject to the following conditions:

i. The allowance shall be paid to the nursing personnel for such period only when the concerned staff is actually working in the specified areas. The minimum period for working in the specialized areas will be two to three years.

ii. No Nursing Officer with less than one year of service is to be posted. for duty in these areas.

iii. This allowance is restricted to 35% of  the total staff strength of nursing staff of any hospital/ Institution.

3. The revised rates of allowances shall be admissible with effect from the 1st of July, 2017.

4. This issues with the approval of Deptt of Expenditure vide ID No.A.27023/1/2017/E.II.B(7th CPC)/Pt. dated 14.09.2017.
