<p>Sub: <strong>Circulation of Revised Check-List for forwarding the disciplinary proceedings proposals / cases to Department of Personnel &amp; Training against IAS Officers under Single Window System prescribed vide OM No.142/16/2013-AVD &#8211; I dated 10th February 2014 &#8211; reg.</strong></p>



<p>Sir/ Madam,</p>



<p>The Department of Personnel &amp; Training (<strong>DoPT</strong>) deals with the disciplinary matters of the officers of the Indian Administrative Services (<strong>IAS</strong>), being their cadre controlling department. It receives the proposals for disciplinary proceedings against the IAS officers working in connection with the affairs of the State, from the State Government; and against the IAS officers working under various Ministries/ Departments in the Central Government, from the Central Ministries/ Departments of the Government of India; under the All India Services (Discipline &amp; Appeal) Rules, 1969 and All India Services (Death-cum-Retirement Benefits) Rules, 1958. Besides, it is also entrusted with dealing with the Appeals/ Memorials and Revision/ Review under the said Rules.</p>



<h2 class="has-text-align-center wp-block-heading">IAS Officers under Single Window System</h2>



<ol class="wp-block-list" start="2"><li>It is the responsibility of the Disciplinary Authorities concerned to lead the departmental proceedings to their logical conclusion. Inordinate and inexplicable delay in conclusion of the disciplinary proceedings vitiates the proceedings and sometimes leads to litigations. This delay is mainly attributed to the documentary and procedural deficiencies and a lot of time is consumed in avoidable protracted correspondence with the State Government or the Ministry/ Department concerned, for furnishing requisite documents/ case-records or fulfilling the procedural deficiencies.</li><li>Accordingly, a proforma check list was prescribed vide this Department&#8217;s OM No.142/16/2013 -AVD.l dated 10th February 2014 for referring disciplinary proceedings proposals/cases against IAS officers to Department of Personnel &amp; Training under Single Window System. However, pursuant to OM No. 39011/08/2016 &#8211; Estt. (B) dated 28th December 2018 and to align with the requirements prescribed for submission of cases to UPSC for referring the disciplinary cases to <a href="https://centralgovernmentnews.com/tag/upsc/" target="_blank" rel="noreferrer noopener">UPSC</a>, it has been felt necessary to revise the checklists for submission of disciplinary proceedings proposals/ cases to DaRT for onward reference to UPSC for its statutory advice.</li><li>Therefore, it has now been decided to prescribe new checklists as per enclosed Appendices I &amp; II in supersession of the checklists prescribed vide the Appendices to this Department&#8217;s OM No.142/16/201 3-AVD.l dated 10th February 2014.</li><li>Submission of a disciplinary cases against an IAS officer and requisite case records will be checked against these new checklists through the single window system in DoPT. Appendix I to be followed hereafter; has 4 different checklists catering to 4 different situations (as described in the following table) in which a proposal of disciplinary proceeding against an IAS officer is to be submitted to DOPT by the concerned State Government / Central Ministry /Department. Appendix II contains list of documents and folders which need to be submitted while submitting the disciplinary case through Single Window System. Another Appendix III has been enclosed which contains the Model letters for forwarding the proposals to Government of India, for each of the 4 situations of Appendix I.</li><li>Therefore, it is requested to submit the proposals of disciplinary cases against IAS officers to DoPT as per the appropriate Appendix that may be applicable in light of the situation for the case at hand with following details to ensure proper submission of proposals by various State Governments /Ministries/ Departments as per the requirement of UPSC.</li></ol>

<ol class="wp-block-list" start="7"><li>Further, it is also expected that the complete reference is received in this Department at least six months (180 days) prior to the retirement of the charged officer for complete examination of the proposal. Wherever the time of submission of case to this Department is less than six months (<strong>180 days</strong>) from the date of retirement of the officer, cogent reasons justifying late submission of case to this Department are also required to be submitted.</li><li>The operation of <a href="https://centralgovernmentnews.com/tag/single-window-system/" target="_blank" rel="noreferrer noopener">Single Window System</a> requires the representatives of the State Government/ Ministries/ Departments of the Government of India seek prior appointment from concerned Under Secretary. During the appointed time, complete verification/ scrutiny of documents will be done and only such cases which are reckoned and found complete in all respects shall be accepted for processing. Cases found deficient vis-a-vis the mandated check-list will be returned therewith, and the case would not be deemed to have been received until it is received in complete form as per the check-list.</li><li>The State Governments/ Ministries/ Departments of Government of India will be required to depute an officer not below the rank of the Under Secretary with his/her official seal and who is well conversant with the case to submit the records of the disciplinary case as per the check-list, in this Department. In the DoPT, Under Secretary (AVD-l.B), Room No.268B, North Block (through Gate No.4, Tele No. 011-2309-2298) will receive the Disciplinary cases referred to by the State Government and Under Secretary (AVD-l.C.l), Room No.270, North Block (through Gate No.4, Tele No.: 011-23092957) will receive the disciplinary cases referred to by the Ministries/Departments in Central Government from 11.00 a.m. to 1.00 p.m. and 2.30 to 4.00 p.m. on all working days.<br /><br />Also check: &nbsp;<strong><a href="https://centralgovernmentnews.com/launch-of-epratiniyukti-a-single-window-online-deputation-module-for-receipt-and-processing-of-deputation-applications-cadre-clearance-of-irs-cce-officers/" target="_blank" rel="noreferrer noopener">Launch of ePratiniyukti – a single window, online Deputation Module for receipt and processing of deputation applications / Cadre Clearance of IRS (C&amp;CE) Officers</a></strong><br /></li><li>Finally, Rule 6(1) (b)(ii) of AIS(DCRB) Rules,1958 stipulate time-limit for instituting disciplinary proceedings against a pensioner. Therefore, a proposal where time available for Disciplinary Authority for according sanction under said Rule is less than six months from the date of submission of the proposal to DoPT by Ministry/Department/State, the proposal will not be accepted on same day. In such case, DoPT would be afforded a time-limit of up to five working days to analyse the proposal before accepting or returning in case there is requirement of any information/clarification /document.</li><li>It is requested that the above instructions are strictly followed with immediate effect while submitting the proposals of disciplinary proceedings against IAS officers, with a view to streamline and expedite the processing.</li></ol>

										<content:encoded><![CDATA[<p><strong>Engineering Services Examination, 2012 </strong></p>
<p>The <em>UPSC</em> has announced the results of the written part of the Engineering Services Examination, 2012 held by <em>U.P.S.C</em>. in June, 2012, the candidates with the under mentioned Roll Numbers have qualified for Interview/ Personality Test:</p>
<p>2. The candidature of these candidates is provisional subject to their being found eligible in all respects.  The candidates would be required to produce the original certificates in support of their claims relating to age, educational qualifications, community, physical disability etc. at the time of the Personality Test.  They are, therefore, advised to keep their certificates ready and check before hand the requirement of certificates in accordance with the important instructions before appearance in the PT boards available on the website of the Commission.</p>
<p>3. In accordance with the Rules of examination all these candidates are required to fill up the Detailed Application Form (DAF), which is available on the Commission’s Website http://www.upsc.gov.in and submit the same ONLINE.  The DAF will be available on the website of the Commission upto 05.04.20133 till 11.59 P.M.  Important instructions regarding filling up of the DAF and submitting the same ONLINE to the Commission are also available on the website.  The candidates who have been declared successful have to first get themselves registered on the relevant page of the website before filling up the ONLINE Detailed Application Form.  The qualified candidates are further advised to refer to the Rules of the Engineering Services Examination, 2012 published in the Gazette of India, dated 10.03.2012, which is also available on the website of the Commission.</p>
<p>4. After submitting the DAF duly filled in ONLINE, the candidates are required to take out a print out of the finally submitted DAF separately and will have to send the printed copy of the DAF duly signed (by the candidate) alongwith all relevant documents to the Under Secretary (Engineering), Union Public Service Commission, Dholpur House, Shahjahan Road, New Delhi-110069, so as to reach the Commission’s Office latest by 12.04.2013. The envelope containing the print out of the DAF submitted ONLINE should be superscribed “DAF for Engineering Services Examination, 2012”.   It can also be delivered at UPSC by hand till 12.04.2013 (5.00 P.M.).  In the event of non receipt of ink signed copy of the DAF, the candidature will be cancelled without any further notice.</p>
<p>5. The candidates are also required to bring the printed copy of the DAF duly signed (by the candidate) along with original documents and a photocopy each thereof at the time of Interview. The instructions for filling up DAF available on the Website along with the Rules of the Engineering Services Examination, 2012, must be read carefully with regard to the certificates that will be produced at the time of Interview. The candidate will be solely responsible for not producing sufficient proof in support of his/her age, date of birth, educational qualification, caste (SC/ST/OBC) and Physically disability status.</p>
<p>6. Interview of candidates who have qualified for the Personality Test are likely to be held in the month of April &amp; May, 2013.  The exact date of interview will, however, be intimated to the candidates through Interview Letter.  Roll Number wise Interview Schedule will also be made available on Commission’s Website by second week of April, 2013.</p>
<p>7. No request for change in the date and time of the Personality Test intimated to the candidates will be entertained under any circumstances.</p>
<p>8.      The mark-sheets of candidates who have not qualified, will be put on the Commission’s Website within 15 days from the date of publication of the final result (after conducting Personality Test) and will remain available on the Website  for a period of 60 days.</p>
<p>9.      The candidates can access the marks-sheets after keying in their Roll Numbers and date of birth.  The printed/hard copies of the marks-sheet would, however, be issued by UPSC to candidates based on specific request accompanied by a self addressed stamped envelope.  Candidates desirous of obtaining printed/hard copies of the marks sheets should make the request within thirty days of the display of the marks on the Commission’s Website, beyond which such requests would not be entertained.</p>
<p>10.       The result will also be available on the <em>U.P.S.C.</em>’s Website <a href="http://www.upsc.gov.in/">http://www.upsc.gov.in</a>.</p>
<p>11.       Union Public Service Commission have a Facilitation Counter at its campus.  Candidate may obtain any information/clarification regarding their examination/result on working days between 10.00 A.M. to 5.00 P.M. in person or over Telephone Nos.(011)-23385271/23381125/23098543 from this counter.</p>

The undersigned is directed to say that in order to reduce delay in finalizing recruitment proposals due to short </p>
<p>comings/discrepancies in requisition, the Union Public Service Commission (UPSC) has decided to switch over </p>
<p>to Single Window System for accepting requisitions(in UPSC-33 proforma) henceforth for direct recruitment </p>
<p>posts to be filled by Selection through interview. In this context, the UPSC had already organized work shop </p>
<p>apprising the indenting Ministries / Departments about certain discrepancies/shortcomings found in the </p>
<p>requisitions.</p></div>

2. Under this new system. the requisitioning Ministries/Departments shall now be required to bring their </p>
<p>complete proposals (requisitions) along with following documents by hand for on the spot scrutiny by the </p>
<p>designated officer in UPSC in terms of the Checklist annexed: &#8211;</p></div>

Henceforth, the All Ministries/Departments are required to authorize a representative not below the level of </p>
<p>Under Secretary to appear in the Commission’s office in person with a prior appointment (Ph No. 011-</p>
<p>23098591, Extn-4784) and hand over the requisition, complete in all respect, with all the relevant documents/ </p>
<p>records to Under Secretary (IFC). The requisition received at the window would initially be scrutinized in terms </p>
<p>of the information sought in the proforma and in consonance with the checklist. In complete cases would be </p>
<p>returned at the counter itself after pointing out deficiencies. Only cases, which are complete in all respect as per </p>
<p>the checklist, would only be accepted for further detailed scrutiny and examination.</p></div>

4. All Ministries/Departments are requested to take note of above new system being introduced by the UPSC </p>
<p>and bring the same to the notice of all requisitioning Departments. It may also be ensured that whenever a </p>
<p>requisition for direct recruitment by Selection through Interview is to be referred by there questioning </p>
<p>Ministries/Departments to the Commission, an officer not below the level of Under Secretary may be deputed in </p>
<p>the Commission’s office alongwith the complete case records and duly tilled in proforma/check-list as indicated </p>
