<p><strong>Updation of Seniority List(s) Roster(s) for various posts.</strong></p>



<p>A circular bearing No.प्रशा/xi/1221/ विविध/2017, dated 31.01.2018 was issued to PCsDA / CsDA for requisite data/ details in respect of officers and staff for up-dation of Seniority list/ Rosters of various posts/ cadre. But the requisite data/details of Auditors, Sr. Auditors, Clerks, MTS, Steno-II were not provided by certain Controllers along with Year of Examination and All India Rank etc. The details already received from the Controllers become irrelevant due to Appointment, Retirement Superannuation, Resignation, Death etc of the above posts.</p>



<p>In view of the above, it has been decided by the Competent Authority that the process of revision/ updation of Seniority List(s) Roster(s). It Is requested that fresh data as per the enclosed format as on 01.07.2020 in respect of the following cadre, held on the strength of the office including Deputaion/ Proforma Strength be sent to HQrs office through soft copy in Excel format and signed report in PDF Format as per schedule mentioned in front of respective posts. The report to be mailed at email id adminx.cgda@nic.in with the subject line reading as Employees data for the post of ……. (mentioned below) as on 01.07.2020.</p>

To ensure smooth consolidation of data and to ensure uniformity of data, it may please be ensured that the formal of Excel Sheet is NOT tampered with and the dates mentioned in the data are strictly as per DD-MM-YYYY” “format only. This is a onetime activity, hence due diligence and check and balance strategy is to be adopted. Main basic data is to be fetched from Tulip and balance data is to be fed from Service Record / Office Records. Report is to be sent with the approval of PCA/ PCDA /CDA.</p>

<p>Sub : <strong>Selection procedure for promotion to Selection Posts &#8211; Formation of panel in the order of seniority amongst those securing qualifying marks.</strong></p>
<p>Ref: PNM/NFIR item No.2/2012.</p>
<p>Railway Board, vide letter of even‘number dated 06.02.2014, have issued certain clarification with respect to selection procedure for promotion to Selection Posts. Some of the Zonal Railways have raised some doubts in conducting selection from erstwhile Group ’D’ to Group ’C’ posts.</p>
<p>2. The matter has been re-examined in consultation with both the Federation, viz., AIRF and NFIR and as a sequel to Railway Board’s letter of even number dated 06.02.2014 on the above subject, it is clarified that while conducting selection against 33 1/3% promotion quota from erstwhile Group ’D’ (G.P. Rs.1800) to Group &#8216;C’ (G.P.1900/2000) posts, panel is required to be drawn in the order of their seniority amongst the qualified staff as per the provisions of para 189 of IREM, Vol-l and ACS No.154 &amp; 155.</p>

<p>Subject: <strong>Inter se seniority of direct recruits and promotees &#8211; instructions thereof</strong></p>
<p>The undersigned is directed to refer to the subject mentioned above and to say that the fundamental principles of inter se seniority of direct recruits and promotees in Central Civil Services/posts were laid down in the Department of Personnel &amp; Training (DOPT) O.M. No. 9/11/55-RPS dated 29.12.1959 which provided, Inter alia, that the relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacancies between direct recruits and promotees, which shall be based on the quotas of vacancies reserved for direct recruitment and promotion respectively, in the Recruitment Rules.</p>
<p>2. The carrying forward of unfilled slots of a vacancy year, for being filled up by direct recruits of later years, was dispensed with through modified instructions contained in D0PT 0.M. No.35014/2/80-Estt.(D) dated 7.2.1986 which provides that rotation of quotas for purpose of determining seniority would take place only to the extent of the available direct recruits and the promotees. The unfilled direct recruitment/promotion quota vacancies would be carried forward andadded to the corresponding direct recruitment/promotion quota vacancies of the next year (and to subsequent years where necessary) for taking action for the total number of direct recruitment/promotioal according to the usual practice. Thereafter, in that year, while seniority will be determined between direct recruits and promotees, to the extent of the number of vacancies for direct recruits and promotees, as determined according to the quota for that year, the additional direct recruits/promotees selected against the carried forward vacancies of the previous year, would be placed en-bloc below the last promotee/direct recruit, asthe case may be, in the seniority list, based on the rotation of vacancies for that year.</p>
<p>3. All the existing instructions on seniority were consolidated by DOPT through a single OM. No. 22011/7/86 Estt(D) dated 03.07.1986.</p>
<p>4. In view of divergent stance taken by different Ministries/Departments on interpretation of ‘available direct recruits and promotees’ in the context of OM dated 7.2.86, the DoPT had issued O.M. No. 20011/1/2006-Estt.(D) dated 3.3.2008 which provided that the actual year of appointment, both in the case of direct/recruits and prornotees, would be reckoned as the year of availability for the purpose of rotation and fixation of inter se seniority.</p>
<p>5. The matter has been examined in pursuance of Hon’ble Supreme Court Judgment on 27.11.2012, in Civil Appeal No. 7514-7515/2005 in the case of N.R.Parmar vs. UOl &amp; Ors in consultation with the Department of Legal Affairs and it has been decided, that the manner of determination of Inter-se-seniority of directrecruits and promotes would be as under:</p>
<blockquote><p>a) DoPT OM No. 20011/1/2006Æstt.(D) dated 3.3.2008 is treated as non-existent/withdrawn ab initio;</p>
<p>b) The rotation of quota based on the available direct recruits and promotees appointed against the vacancies of a Recruitment Year, as provided In DOPT O.M. dated 7.2.1986/3.07.1986, would continue to operate for determination of inter se seniority between direct recruits and promotees;</p>
<p>c) The available direct recruits and promotees, for assignment of inter se seniority, would refer to the direct recruits and promotees who are appointed against the vacancies of a Recruitment Year;</p>
<p>d) Recruitment Year would be the year of initiating the recruitment process against a vacancy year;</p>
<p>e) Initiation of recruitment process against a vacancy year would be the date of sending of requisition for filling up of vacancies to the recruiting agency in the case of direct recruits; in the case of promotees the date on which a proposal, complete In all respects, is sent to UPSC/Chairmarn-DPC for convening of DPC to fill up the vacancies through promotion would be the relevant date.</p>
<p>f) The initiation of recruitment process for any of the modes viz, direct recruitment or promotion would be deemed to be the Initiation of recruitment process for the other mode as well;</p>
<p>g) Carry forward of vacancies against direct recruitment or promotion quota would be determined from the appointments made against the first attempt for filling up of the vacancies for a Recruitment Year;</p>
<p>h) The above principles for determination of inter se seniority of direct recruits and promotees would be effective from 27.11.2012, the date of Supreme Court Judgment in Civil Appeal No. 7514-7515/2005 In thecase of N.R. Parmar Vs. UOl &amp; Ors</p>
<p>I) The cases of seniority already settled with reference to the applicable interpretation of the term availability, as contained in DoPT O.M. dated 7.2.86/3.7.86 may not be reopened.</p></blockquote>
<p>7. As the conferment of seniority would be against the Recruitment Year in which the recruitment process is initiated for filling up of the vacancies, It is incumbent upon all administrative authorities to ensure that the recruitment process is initiated during the vacancy year itself. While requisition for filling up the vacancies for direct recruitment should be sent to the recruiting agency, complete in all respects, during the vacancy year itself, the timelines specified in the Model Calendar for DPCs contained in DoPT O.M. No.22011/9/98-Estt(D)dated 8.9.98 and the Consolidated Instructions on DPCs contained In O.M.No.22011/S/86-Estt(D) dated April 10, 1989 should be scrupulously adhered to, for filling up the vacancies against promotion quota.</p>

<p>Subject: <strong><em>Zone of Consideration for inclusion in Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota-Regarding.</em></strong></p>
<p>The undersigned is directed to refer to Department of Personnel and Training’s 0M of even number dated 25th September, 2013 vide which Zone of Consideration for inclusion in Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota was issued. All the care units were requested to conduct the DPC in respect of all the officers covered in the zone and intimate their fitness or otherwise to Department of Personnel and Training by 15th October, 2013. A reminder was also issued on th January, 2014 to all the cadre units to expedite DPCs. However, till date information has been received from few cadre units only.</p>
<p>2. Some Doubts have been raised by cadre units on some of the issues pertaining to Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota. Also, some discrepancies have been found in the information furnished by some of the cadre units. The clarification on these issues is as under:</p>
<p>Issue 1 : <em>Whether DPC is to be conducted in respect of officers not clear front Vigilance angle.</em></p>
<blockquote><p>Clarification: As per DOPTs 0M No 22011/5/86-Estt(D) dated 10th April, 1989 (Consolidated Guidelines on DPC), DPC in all such cases should be held and sealed cover procedure should be adopted as laid down in the O.M.</p></blockquote>
<p>Issue 2 : Whether DPC is to be conducted in respect of officers who are in the zone of promotion but have retired/taken VRS/expired/resigned from service as on date before conduct of DPC</p>
<blockquote><p>Clarification : As per DOPTs 0M No 22011/4/98-Estt(D) dated 12th October, 1998, DPC in respect of such officers should be held but as they have retired/left the service before the conduct of DPC, their order/notification for promotion need not be issued. Many Ministries/Departments have issued notification/orders in respect of such officers, which is not as per the 0M mentioned above.  Such Ministries/Departments are requested to issue necessary corrigendum in this regard. Only the fitness of these employees is to be informed to CS.I Division for finalization of Select List.</p></blockquote>
<p>Issue 3 : What should be the date of effect of promotion in respect of persons included in the zone of promotion for inclusion in the Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota</p>
<blockquote><p>Clarification: Promotion orders/notification should be issued from prospective effect only not prior to the date of DPC. Many Ministries/Departments have issued promotion order w.e.f. 1.7.2009, 1.7.2010 and 1.7.2010 for the respective Select Lists, which is not as per DPC guidelines. Such Ministries/Departments are requested to issue necessary corrigendum in this regard.</p></blockquote>
<p>Issue 4: If a person whose name appeared in the zone of promotion for inclusion in the Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota had retired from a deputation post. Who will conduct the DPC in such cases- borrowing department or Parent department?</p>
<blockquote><p>Clarification: DPC in such cases is to be conducted by the parent department.</p></blockquote>
<p>Issue 5: What is the action on the part of Ministries/Departments if they found an officer in the zone who has already left the service prior to the crucial date i.e. 1.7.2009. 1.7.2010 and 1.7.2010 for the respective Select Lists?</p>
<blockquote><p>Clarification: The concerned Ministry/Department will forward the name of such officers to CS.I Division, DOPT so that necessary corrections may be carried Out in the Select List. One such instance has come to the notice of this department that notification has been issued in respect of person for the Select List Year 2011 who had taken VRS w. e. f. 1.4.2011 i.e. prior to the crucial date of promotion. The mistake may be rectified by issuing of a corrigendum.</p></blockquote>
<p>Issue 6: Many Ministries/Departments have not conducted DPCs in respect of many persons on the pretext that ACRs for these officers are incomplete</p>
<blockquote><p>Clarification: Ministry/Departments may refer to para 6.2.1 of DOPTs 0M No 22011/5/86-Estt(D) dated 10th April, 1989 (Consolidated Guidelines on DPC).</p></blockquote>

<p>Is there any ratio in which the Promotee Assistants and Direct Recruit Assistants were being promoted to the Section Officer Grade prior to Cadre restructuring undertaken during early 1990s..? and Whether the Committee of Secretaries, while considering Cadre restructuring of <a href="http://centralgovernmentnews.com/category/css/">CSS</a>, had recommended promotion of Promotee Assistants and Direct Recruit Assistants to the Section Officer Grade in the ratio of 75:25..?</p>
<p>The Minister of State in the Ministry of Personnel, Public Grievances and <a href="http://centralgovernmentnews.com/category/pension/" target="_blank">Pensions</a> Shri.V.Narayanasamy replied to the above questions in Lok Sabha on 13th March, 2013 as follows:</p>
<p>&#8220;No ratio has been prescribed for either Promotee or Direct Recruit category Assistants for <a href="http://centralgovernmentnews.com/category/promotion/">promotion</a> to the grade of Section Officer.</p>
<p><strong>Promotions to the grade of Section Officer are made through two streams, viz.,</strong></p>
<blockquote><p>(i) by seniority and</p>
<p>(ii) by holding Limited Departmental Competitive Examination (LDCE). In both the streams, all eligible Assistants, whether direct recruit or promotee are participating.</p></blockquote>
<p>No such recommendation has been made by Committee of Secretaries&#8221;.</p>

<p>3. The issue of seniority of merged MTS Grae (erstwhile Group &#8216;D&#8217; post) has been examined in consultation with UPSC. The post(s) in the erstwhile Group &#8216;D&#8217; for the purpose of determination of seniority, can be grouped into five different categories as under :</p>

The determination of seniority of merged grade will be regulated as per following guidelines:</div>
<div></div>
<div>I. As on 29.08.2008, holders of posts in Category-I will be enbloc senior to the holder of posts in Category-</p>
<p>II, similarly holder of the posts in Category-II will be senior to holder of the posts in Category-III and so on.</p></div>
<div></div>
<div>II. While merging the different grade(s), the inter se seniority in a post which existed as on 29.08.2008 is to be maintained.</div>
<div></div>
<div>III. Within same category, where different stand alone posts have been merged, inter se seniority will be determined based on length of continuous officiation in the post.</div>
<div></div>
<div>IV. Only the regular service in the grade is to be counted for determination of service and ad-hoc service, if any, is to be ignored.</div>
<div></div>
<div>V. Seniority is to be determined based on the substantive post held by the employee irrespective of the fact that such employee has been allowed financial upgradation to the next higher grade under ACP Scheme or any other scheme.</div>
<div></div>
<div>VI. In case of employees who joined a erstwhile Group ‘D’ post either by promotion or direct recruitment between 01.01.2006 to 29.08.2008, inter-se seniority will be determined as per guidelines laid down in this</div>
<div>Department’s O.M. of even number dated 13.09.2012.</div>

<div>Subject : <strong>Seniority of officers holding posts/grades in grades merged in pursuance of recommendations of Sixth Central Pay Commission.</strong></div>
<div></div>
<div>The undersigned is directed to invite reference to para 2 (i) of this Department’s O.M. No.AB-14017/66/2008-Estt. (RR) dated 9th March, 2009, which provides that where all the posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay / pay scale, the suitability of the incumbents need not be assessed for granting them the higher replacement scale / grade pay / pay scale, there is also no need for the incumbents to complete any minimum eligibility service in the earlier scale of pay. There will be no change in the inter se seniority of the incumbents in the merged scale which shall be decided based on the general instructions on the subject.</div>

<div>2. The 6th CPC in its recommendation contained in sub para (vi) of Para 2.2.13 has stated that the seniority of government servant will depend on the grade pay drawn. This will invariably be more for a higher level post. References have been received from Ministry of Railways/Ministry of Defence etc. regarding fixation of seniority of officers after merger of pay scales in pursuance to recommendation of Sixth Central Pay Commission. The recommendation of 6th CPC has been accepted on 29.08.2008 and the merger of pay scale(s) of the post has been made effective w.e.f. 01.01.2006. The issue of seniority has been further examined and it has been decided in consultation with UPSC and Department of Legal Affair that seniority of</div>
<div>officers holding post in grades which have been merged in pursuance to recommendation of Sixth Centrai Pay Commission will be determined as follows :-</div>
<div></div>
<div>I. The status of a government servant as on 29.08.2008 including those who have earned promotion between 01.01.2006 to 29.08.2008 will be protected as appointment/promotions are made as per the provisions of statutory recruitment rules applicable to the post/grade. The merger of the pay scale(s) of the post(s) as recommended by 6th CPC have been made effective w.e.f. 01.01.2006; the seniority of government servant which existed on 29.08.2008 (date of acceptance of recommendation of 6th CPC) will be maintained i.e. the holder of post having higher pay scale or post which constituted promotion post for the posts in the feeder grade, will rank enbloc senior to those holding post having lower pay scale or the posts in feeder grade.</div>

<div>II. Where posts having different pay scales prior to 6th CPC recommendation and now after merger have come to lie in the same Pay Band with saine Grade Pay, the inter-se seniority of all the employees will be fully maintained with employee in a higher pre-revised pay scale being placed higher vis-a-vis an employee in a lower pay scale. Within the same pre-revised pay scale, seniority which existed prior to revision would continue.</div>

<div>III. Where recruitment for the posts in different pre-reviscd pay scale(s) was initiated separately for each posts, prior to acceptance of recommendation of 6th CPC i.e. prior to 29.08.2008 but selected individual joined duty on or after 30.08.2008 in the revised pay scale(s) against the posts which have been granted same Grade pay, such officers will be assigned seniority enbloc below those officers who were in position as on 29.08.2008.</div>

<div>IV. The availability of officers nominated on the basis of panel of promotion given by DPC or selection list given by selecting Authority will be decided as on 29,08.2008. In case a officer from the panel given by DPC or selection list given by selecting Authority has joined on or prior to 29.08.2008, then status of all the officers included in panel given by DPC or selection list will be protected and all officer will be considered available and their seniority determined by following the basic principle of seniority i.e. order of panel given by DPC or merit list given by selecting Authority. in case all the officers included in the panel given by DPC or selection list given by selecting Authority joins after 29.08.2008, then the seniority of such officers within a grade, will be determined by placing them below all available officers as on 29.08.2008 but maintaining their interse seniority in order of panel of DPC or merit list given by selecting authority.</div>

<div>3. All the cases of determination of seniority except merged MTS posts will be decided accordingly. The issue of determination of seniority of merged MTS (erstwhile Group D) posts would be taken up separately.</div>

<div>Minister of Persmin Shri.V.Narayanasamy informed in Lok Sabha on 22nd August, 2012 regarding the subject of seniority of gazetted officers in Central Services and Central Paramilitary Forces.</div>
<div></div>
<div>Written reply was submitted by the Minister to the above question, The seniority of officers in Central services is fixed as per provisions of statutory recruitment rules applicable to the post. In other cases instructions issued vide this Department’s O.M. dated 11.11.2010 will apply.</div>

<p><a name="more"></a></p>
<div>1. In central para military forces, the relative seniority of all direct recruits is determined by the order of merit in which they are selected for such appointment on the recommendation of the UPSC or other selecting authority; persons appointed as a result of an earlier selection being senior to those appointed as a result of a subsequent selection.</div>
<div></div>
<div>2. The seniority of Assistant Commandants(Direct entry) is being fixed as per the following norms:-</div>
<div></div>
<div>i. Inter-se seniority of directly appointed Assistant Commandants is determined by adding together the marks obtained by them in the recruitment test and the basic professional courses in the ratio of 50:50.</div>
<div></div>
<div>ii. Where promotions are made on the basis of selection by a DPC, the seniority of such promote shall be in the order in which they are recommended for such promotion by the Departmental Promotion Committee.</div>
<div></div>
<div>iii. Seniority of Assistant Commandants appointed through Limited Departmental Competitive Examination (LDCE) is as per the merit given by selecting authority.</div>
