Annexure

Terms and Conditions for engagement as Consultant in the Directorate General of Health Services.

1. The consultant shall perform the services as assigned to him / her by his / her controlling officer / Administration Division.
2. The normal working hours would be from 9.30 a.m. to 6.00 p.m. with a lunch break of 30 minutes from 1.30 p.m. to 2.00 p.m. from Monday to Friday. The consultant will mark his/her attendance in Aadhar Enabled Biometric Attendance System.
3. In special circumstances, the Consultant could be called for services on holidays or beyond normal working hours for which no compensatory leave will be granted.
4. The consultancy will start from the date he/she join initially for a period of one year.
5. The consultant shall be paid a remuneration as per the formula of last pay drawn minus pension plus DA on existing rate. Mandatory deduction, if any, will be made. The remuneration for services rendered in a month shall be payable in subsequent month.
6. Directorate General of Health Services shall have the right to examine/ review the services provided by him/her at any time.
7. The consultant shall perform his/her obligations under his/her consultancy with all necessary skills, diligence, efficiency and economy.
8. No other facility whatsoever except remuneration shall be provided to him /her by the Directorate General of Health Services in his /her capacity as Consultant.
9. The Directorate shall not be responsible for any loss, accident, damages /injury suffered by him/her whatsoever arising in or out of the execution of his /her work, including travel.
10. During the terms of the consultancy, he/she shall not be engaged in any private business or professional activity which could conflict with the interest of the Government.
11. The Consultant shall treat all official information as confidential and use the same only for purpose of the performance of the services.
12. The consultancy can be terminated by either side by giving at least 15 days prior notice.
13. He /She will be allowed a day’s absence per month with remuneration. If this is not availed in a particular month the same shall be carried forward and can be availed in the next or subsequent month, but not more than three days absence in a single spell shall be allowed.
14. No typing assistance shall be provided

CIRCULAR

It is proposed to engage retired Government employees to work as Retainers against the vacant posts of Section Officer (SO) in the Department of Drinking Water & Sanitation as per the following criteria:

(a) Must have retired from Central Government Ministries / Departments.
(b) Must have retired as SO or above and well acquainted with functioning of Government Ministries.
(c) Should have good communication and interpersonal skills and excellent knowledge of Computer usage.
(d) Work profile and responsibility would be similar to post in the Central Government.

The engagement of retainers shall be subject to the following conditions:

(i) Persons must be below 64 years of age as on the last date of application.
(ii) Engagement shall initially be for a period of six months or until regular incumbents are available, whichever is earlier.
(iii) Extension of engagement, if any, shall be at the sole discretion of competent authority.
(iv) Working hours shall be from 9.00 a.m. to 5.30 p.m. during working days including half an hour lunch break in between. However, in exigencies of work, he/she may be required to sit late and may be called on Saturdays/Sundays and other Gazetted Holidays.
(v) Individual will be required to mark his attendance in Biometric Attendance System (BAS).
(vi) Shall be entitled to 4 days leave in six calendar months. The un-availed leave cannot be carried forward or encashed. (vii) Individual will give one month notice for leaving the services of the Ministry.
(viii) Engagement may be terminated at any time by the Government without assigning any reason \without any notice.
(ix) Ministry of Drinking Water and Sanitation shall not be responsible for any loss, accident, damage or injury suffered by the individual arising out of execution of his/her official duty.
(x) The selected officers will be paid a consolidated fee (TDS as applicable). He/She shall not be entitled for any allowances such as Dearness Allowance, residential, telephone, transport, etc.
(xi) He/She will not be allowed any foreign travel at Government Expenses.
(xii) Individual engaged shall not directly or indirectly communicate or reveal to any person or persons any matter collected for the purpose of his/her assignment or during the course of his/her assignment, without the express written consent of the office.
(xiii) Individual engaged shall not represent or give opinion or advice in any matter which is adverse to the interest of this Office. He/She is not permitted to take up any other assignment during his period of engagement.
(xiv) Preference would be given to those retired in the last one year.

Various reference has been received from different Controllers regarding grant of benefit of ACP/MACP after passing of SAS-ll examination on the basis of CAG Circular No. 23 staff Wing/2016 No. 39 staff(Ent-1) 184-2014 dated 20/06/2016.

In this connection, attention is invited to’ Para 1 and 9 of Annexure of DOP&T OM No.3534/3/2008-Estt.(D) dated 19th May 2009, which stipulates that
“…..
1) There shall be three financial upgradations under the MACPS, counted from the direct entry grade on completion off 10, 20 and 30 years service respectively. Financial upgradation under this scheme will be admissible Whenever a person has spent 10 years continuously in the same grade pay.

9) Regular service for the purpose of the MACPS shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption/re-employment basis. Service rendered on adhoc/contract basis before regular appointment on pre-appointment training shall not be taken into reckoning. However, past continuous regular service in another Government Department in a post carrying same grade pay prior to regular appointment in a new Department, without a break shall also be counted towards qualifying regular service for the purpose of MACPs only( and not for the regular promotions). However, benefits under the MACPS in such cases shall be considered till the satisfactory completion of the probation period.

Further, it is also intimated that the matter was referred to DoPT, for treating AAO as fresh recruits after passing of SAS Part II Exams and it has been clarified by DOP&T that Departmental Examination is one of the fast track mode of promotion and the appointment on the base of Limited Departmental Examination cannot be treated as direct recruitment and the orders of C & AG dated 20.06.2016 is not consistent with the instructions of the Government. Further, DoPT has opined that treating AAO as a fresh recruits for the purpose of benefit of MACP will be violative of the provisions of RR.

G.S.R. — In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Company Law Board (Group IV posts) Recruitment Rules, 1999, in so far as they relate to the post of Section Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group ‘B’ post — Section Officer in the Company Law Board, Ministry of Corporate Affairs, namely:-

2. Short title and commencement.– (1) These Rules may be called the Company Law Board (Group ‘B’ Post — Section Officer) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay .– The number of posts, their classification and Pay Band and Grade Pay attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications .– The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in column (5) to (13) of the aforesaid Schedule.

4. Disqualification – No person —
(a) who, has entered into or contracted a marriage with a person having spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Note 2: For the purpose of appointment on deputation, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended), shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scales of pay into one grade with a common Grade Pay or Pay Scale and where this benefit will extend only for the post (s) for which that Grade Pay or Pay Scale is the normal replacement grade without any up- gradation.
