<p><strong>G.S.R. 810(E).</strong>&#8211; In exercise of the powers conferred by clauses (ca) and (cb) of sub-section (2) of section 27 of Right to Information Act, 2005 (22 of 2005), the Central Government hereby makes the following rules, namely:-</p>



<p style="text-align:center"><strong>CHAPTER I</strong></p>



<p style="text-align:center"><strong>PRELIMINARY</strong></p>



<p><strong>Short title and commencement</strong>.- (1) These rules may be called The Right to Information (Term of Office, Salaries, Allowances and Other Terms and Conditions of Service of Chief Information Commissioner,<br /> Information Commissioners in the Central Information Commission, State Chief Information Commissioner and State Information Commissioners in the State Information Commission) Rules, 2019.<br /> (2) They shall come into force on the date of their publication in the Official Gazette.</p>

<p style="text-align:center"><strong> CHAPTER II</strong></p>



<p>2. <strong>Definitions</strong>.- (1) In these rules, unless the context otherwise requires, &#8211;</p>



<p>(a) “Act” means the Right to Information Act, 2005 (22 of 2005);<br />(b) “Central Information Commission” shall have the same meaning assigned to it under clause (b) of section 2 of the Act ;<br />(c) “Chief Information Commissioner” and “Information Commissioner” shall have the same meaning assigned to it under clause (d) of section 2 of the Act;<br />(d) “State Chief Information Commissioner” and “State Information Commissioner” shall have the same meaning assigned to it under clause (l) of section 2 of the Act;<br />(e) “State Information Commission” shall have the same meaning assigned to it under clause (k) of section 2 of the Act.<br /> (2) The words and expressions used and not defined under these rules, but defined in the Act shall have the same meaning as respectively assigned to them in the Act.</p>



<p style="text-align:center"><strong>CHAPTER III</strong></p>



<p><strong>TERM OF OFFICE, SALARIES, ALLOWANCES AND OTHER TERMS AND CONDITIONS OF SERVICE OF THE CHIEF INFORMATION COMMISSIONER AND INFORMATION COMMISSIONER IN THE CENTRAL INFORMATION COMMISSION</strong></p>



<p>3. <strong>Term of office</strong>.- The Chief Information Commissioner, or Information Commissioners, as the case may be, shall hold office for a period of three years from the date on which he enters upon his office.</p>



<p>4. <strong>Retirement from parent service on appointment</strong>.- The Chief Information Commissioner or Information Commissioners, as the case may be, who on the date of his appointment to the Commission, was in the service of the Central or a State Government, shall be deemed to have retired from such service with effect from the date of his appointment as Chief Information Commissioner or an Information Commissioner in the Central Information Commission.</p>



<p>5. <strong>Pay</strong>.- (1) The Chief Information Commissioner shall receive a pay of Rs. 2,50,000 (Rupees two lakh and fifty thousand)(fixed) per mensem.<br />(2) An Information Commissioner shall receive a pay of Rs. 2,25,000 (Rupees two lakh and twenty five thousand) (fixed) per mensem.<br />(3) In case the Chief Information Commissioner or Information Commissioners, as the case may be, at the time of his appointment is, in receipt of any pension, the pay of such Chief Information Commissioner or<br /> Information Commissioners, as the case may be, shall be reduced by the amount of that pension including any portion of pension which was commuted and pension equivalent of other forms of retirement benefits<br /> excluding pension equivalent of retirement gratuity;<br />(4) In case the Chief Information Commissioner or Information Commissioners, as the case may be, at the time of his appointment, is in receipt of retirement benefits in respect of any previous service rendered in<br /> Corporation established by or under any Central Act or State Act or a Government company owned or controlled by the Central Government or the State Government, his pay in respect of the service as the Chief<br /> Information Commissioner or Information Commissioners, as the case may be, shall be reduced by the amount of pension equivalent to the retirement benefits.</p>



<p>6. <strong>Dearness Allowance.</strong> &#8211; The Chief Information Commissioner or Information Commissioners, as the case may be, shall be entitled to draw dearness allowance at the rate admissible to an officer holding a post<br /> carrying the same pay in the Central Government, as revised from time to time.</p>



<p>7. <strong>Leave</strong>.- (1) The Chief Information Commissioner or Information Commissioners, as the case may be, shall be entitled to rights of leave as per admissibility to an officer holding a post carrying the same pay in the<br /> Central Government, as revised from time to time.<br />(2) In case the Chief Information Commissioner, the competent authority to sanction the leave shall be the President of India and in case of the Information Commissioners, the Chief Information Commissioner shall<br /> be the competent authority.</p>



<p>8. <strong>Cash Payment in lieu of unutilised Earned Leave</strong>.- The Chief Information Commissioner or Information Commissioners, as the case may be, shall be entitled to encashment of fifty per cent. of earned leave to his credit at the time of completion of tenure:</p>



<p>Provided that for a Chief Information Commissioner or an Information Commissioner, as the case may be, who had retired from the service of the Central or a State Government prior to appointment as a Chief Information Commissioner and Information Commissioner, as the case may be, the aggregate period for which the encashment of unutilised earned leave shall be entitled shall be subject to a maximum period as per admissibility to an officer holding a post carrying the same pay in the Central Government or the State Government, as the case may be, as revised from time to time. </p>



<p>9. <strong>Medical Facilities</strong>.- The Chief Information Commissioner and Information Commissioners, as the case may be, shall be entitled to medical treatment and Hospital facilities as provided in the Central Government Health Scheme and at places where the Central Government Health Scheme is not in operation, the Chief Information Commissioner and Information Commissioner shall be entitled to medical facilities as provided in the Central Service (Medical Attendance) Rules, 1944.</p>



<p>10. <strong>Accommodation</strong>.- (1) The Chief Information Commissioner or Information Commissioners, as the case may be, shall be eligible subject to availability, to the use of official residence from the general pool accommodation of the type as admissible to an officer holding a post carrying the same pay in the Central Government on the payment of the license fee at the rates prescribed by Central Government from time to time.<br /> (2) Where Chief Information Commissioner or an Information Commissioner is not provided with or does not avail himself of the general pool accommodation referred to in sub-rule (1), he may be paid House Rent Allowance at the rate admissible to an officer holding a post carrying the same pay in the Central Government.</p>



<p>11. <strong>Leave Travel Concession, Travelling Allowance, Daily Allowance</strong>.- The Chief Information Commissioner or Information Commissioners, as the case may be, shall be entitled to leave travel concession, travelling allowance and daily allowance as admissible to an officer holding a post carrying the same pay in the Central Government as far as may be, apply to the Chief Information Commissioner and Information Commissioner, as the case may be. </p>

<p><strong>G.S.R. 548(E)</strong> : In exercise of the powers conferred by sub-section (2) of section 13 read with clause (b) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985) and in supersession of the Central Administrative Tribunal [Staff] (Conditions of Service) Rules, 1985, except as respects things done</p>
<p>or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the salaries and allowances and conditions of service of the officers and other employees of the Central Administrative Tribunal, namely:-<br />
<strong>1. Short title and commencement.</strong></p>
<p>(1) These rules may be called the Central Administrative Tribunal (salaries, allowances and conditions of service of the officers and employees) Rules, 2015.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p><strong>2. Definitions.</strong> (1) In these rules, unless the context otherwise requires,</p>
<blockquote><p>(a) &#8220;Act&#8221; means the Administrative Tribunals Act, 1985 (13 of 1985);</p>
<p>(b) &#8220;Schedule&#8221; means the Schedule annexed to these rules;</p>
<p>(c) &#8220;Tribunal&#8221; means the Central Administrative Tribunal established under sub-section (1) of section 4 of the Act.</p></blockquote>
<p>(2) The words and expression used and not defined in these rules, but defined in the Act shall have the same meanings respectively assigned to them in the Act.</p>
<p>3. <strong>Number of posts, classification, pay band and grade pay or pay scale</strong>. The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in the Schedule annexed to these rules.<br />
4. <strong>Conditions of Service</strong>. The conditions of service of the officers and employees of the Tribunal in the matters of pay, allowances, leave, joining time, joining time pay, provident fund, age of superannuation, travelling allowance and leave travel concession, pension and retirement benefits, medical facilities and other conditions of service shall be regulated in accordance with such rules and regulations as are from time to time applicable to officers and employees of the Central Government belonging to Group &#8216;A&#8217;, Group &#8216;B&#8217; and Group &#8216;C&#8217;, as the case may be, of the corresponding pay band and grade pay or pay scale</p>
<p>of officers and employees of the Central Government.</p>
<p>5. <strong>Residuary provision.</strong> Matters relating to the terms and conditions of service of the officers and employees of the Tribunal with respect to which no express provision has been made in these rules, shall be referred by the Tribunal to the Central Government for its decision.</p>
<p>6. <strong>Power to relax</strong>. The Central Government shall have power to relax the provisions of any of these rules in respect of any class or category of persons.</p>

<p>New Delhi: BJP today sought to distance itself from a parliamentary panel’s recommendation for a 100 per cent hike in MPs’ salary besides a number of perks, saying it was for the government to take a call on it.</p>
<p>“We have nothing to say. It is our government at the Centre and the panel is headed by a senior member of our party. But the Centre has apparently put the report in cold storage. It is finally for the government to take a call on it,” a party leader said.</p>
<p>The fact that the parliamentary panel is headed by BJP MP Yogi Aditynanath has forced the party to maintain a distance.</p>
<p>The panel has pitched for 100 per cent hike in salary and daily allowances of MPs and 75 per cent raise in pension of ex-MPs apart from facilities for their “companions” in place of “spouses”.</p>
<p>In far-reaching recommendations, it also has sought the doubling of the existing Rs 50,000 salary of MPs and favoured increasing the pension of former parliamentarians from Rs 20,000 to Rs 35,000.</p>
<p>While the government has expressed its readiness to consider their demand for a hike in salary, constituency and office allowances and raising the expenditure limit on furniture, it is not in favour of the other recommendations, official sources said.</p>
<p>The panel is likely to meet on July 13 and prepare a final report taking into account the government’s stand.</p>

<p>Shimla: The National Conference of chairpersons of state public service commissions has arrived at consensus on introduction of online examination system Computer Based Recruitment Tests (CBRT) and raising the retirement age and uniformity in pay scales and perks of chairpersons and members of UPSC and state PSCs.</p>

<p>The conference which concluded here today elected K S Tomar, Chairman Himachal PSC as chairman of standing committee of state PSC chairpersons and authorised him to take up these issues with Prime Minister Narendra Modi.</p>
<p>“Introduction of online examination system/Computer Based Recruitment Tests was discussed in detail and consensus emerged on the CBRT, an online test for selection of candidates for recruitment by various State service candidates in a phased manner, as adhering to IT reforms and keeping pace with changing trends was inevitable,” Tomar said.</p>
<p>The members were unanimous that the retirement age of State Commission members be raised from 62 to 65 years and there should be Uniformity in salary, perks and other incentives and facilities provided to members.</p>
<p>The conference also sought financial autonomy for PSCs and Constitutional protection on the pattern of Supreme Court and High Court Judges to check political interference by State Governments in functioning of PSCs and he would also take up this matter with Prime minister, Tomar said.</p>
<p>The UPSC chairman Deepak Gupta and the Chairperson of all the PSC agreed to introduce new system in a phased manner after creating suitable infrastructures which will protect the secrecy and sanctity of various written competition examinations.</p>
<p>The UPSC had introduced CBRT/Online test as a Pilot Project in 2011 and conducted 22 online tests in nine cities and “with technological advancements, in the field of Hardware, Networking, internet speed etc., the possibility of conducting CBRT in normal examinations would also be explored,” Deepak Gupta informed state PSC chairpersons.</p>
<p>Regarding the various interim orders being passed by High Courts/ Administrative tribunals in favour of the candidates who fail to qualify for interviews, Maharashtra PSC circulated a paper to Chairpersons.</p>

<p>New Delhi: The officers of all departments have been asked to do due diligence while processing Leave Travel Concession (LTC) claims of employees as part of fresh set of guidelines issued by the Centre.</p>
<p>“As per LTC rules, a government servant may travel only by vehicles operated by central or state government or local bodies or by any corporation in the public sector owned or controlled by central or state government.Journey on LTC by taxi, auto-rickshaw etc, are permissible only between places not connected by rail,” the Department of Personnel and Training (DoPT) said in its order <i>F. No. 31011/3/2015-Estt (A-IV) dated April 1</i>.</p>
<p>The move comes after the DoPT received a large number of recommendations for relaxation of some or the other provision of the LTC rules in individual cases.</p>
<p>It is seen that, in most cases the situation arises as due care had not been exercised by the government servant or the administrative authority in claiming LTC or in examination, the order issued to secretaries of all departments said.</p>
<p>“In this connection it may please be noted that the primary responsibility for ensuring compliance with the rules is that of the government servant. The of-repeated plea of ignorance of rules cannot be a valid ground for relaxation of rules.</p>
<p>“At the same time it has also been noticed that the administrative authorities have also shown laxity and due diligence on their part could have prevented such situations from arising,” the DoPT said.</p>
<p>Government servants travelling by air under LTC are required to book their tickets either directly from the airline or through the approved agencies viz: Balmer Lawrie &amp; Co Ltd, Ashok Tours &amp; Travels Ltd or IRCTC. “Booking through any other agency is not permissible,” it said.</p>
<p>The Centre has been taking many steps to check instances of any irregularity in LTC claims.</p>
<p>CBI is also probing fake travel bills scam (also known as LTC scam) allegedly involving certain government employees.</p>
<p>There are about 48 lakh central government employees.</p>

<p>The Government has received representation/memorandum from employees of nationalized banks and Government Insurance Companies regarding their salaries, pension and other emoluments due to the employees/officers.</p>
<p>The wage revision exercise in respect of employees of PSBs is undertaken through a bipartite negotiation process between Indian Banks’ Association (IBA), representing management of banks who have mandated it to negotiate on their behalf and the Unions/Associations of bank employees. The last meeting between IBA and Unions/Associations took place on 13.6.2014.</p>
<p>In respect of the current wage revision of insurance companies, Central Government has already requested Life Insurance Corporation (LIC) and General Insurers’ (Public Sector) Association of India (GIPSA), coordination body of four public sector general insurance companies and General Insurance Corporation (GIC) to start wage revision consultation with their employee’s unions/associations.<br />
This information was given by the Minister of State for Finance, Smt. Nirmala Sitharaman in written reply to a question in Lok Sabha today.</p>
