<p>Sir/Madam,</p>



<p>I am directed to refer to&nbsp;<strong>CVC latest circular</strong>&nbsp;No.&nbsp;<strong>22/10/22 dated 25.10.2022 and 03/09/13 dated 11.09.2013&nbsp;</strong>regarding mandatory compliance of rotational transfer of officials from identified sensitive seats to non-sensitive seats without any exception ( copy enclosed).</p>



<p>In CGHS, the identification of sensitive seats have already been done, the same has been duly circulated to all AD,CGHS cities vide <strong>GHS OM No. 34-7/2016-CGHS/Estt(NG) dated 13.06.2016 and also as mentioned underpara 3(e) “Rotational transfer” covered in SoP issued vide OM No. A-22012/01/2021-CGHS-I dated 21.09.2021, circulated to all AD, CGHS Cities ( copies enclosed).</strong></p>



<p>In the matter, it has been decided by the competent authority that Additional Directors of all CGHS cities may be issued directives to comply with above referred guidelines of CVC/DoPT and also existing instructions for rotational transfer of officers/officials from sensitive postings to non-sensitive postings. In view of this, all Additional Directors, CGHS cities are required to take immediate necessary action to <strong>transfer out all the officers/ officials/ clercical/ para medical staff dealing with sensitive posting as mentioned in the enclosed OM and SoP. This exercise to be done twice in a year in June and December month and compliance report ensuring the relieving from the particular post to be submitted by the end of June and December every year.</strong></p>

<p style="text-align:center"><span style="text-decoration: underline;">ORDER</span></p>



<p>This Department&#8217;s order of even number dated 09.08.2019 directed the concerned Ministries/ Departments to relieve the officers(s) concerned by 13.08.2019 under Rotational transfer policy so that the officers could join the allocated Ministry/ Department. However, it has been observed that not all the officers have been relieved so far</p>

<p>Apart from this, there have been request from Ministries/ Departments for retention of officers. The matter has been examined in the Department. However, it has been decided not to accede to request for retention of any officer.</p>



<p>According, all the Under Secretaries who have not yet been relieved, are hereby deemed relieved from their respeclive Ministries/ Departments w.e.f. 09.2019(AN) with the direction to report for duty to their allotted Ministries/ Departments. The only exception will be in respect of Officers who are Presently undergoing mandatory E Level Training till 04.10.2019. They will join the new Ministries/ Departments on completion of training.</p>



<p>The concerned cadre units as well as the officers concerned are requested to comply with the order. The onus to join the allocated Ministry/ Department on the basis of order dated 09.08.2019 issued by this Department will be on the officer concerned and failure to do so may attract punitive action. It will also be incumbent upon the Ministry/ Department and the officer concerned not to draw salary beyond the stipulated date.</p>

<p>Sir/Madam,</p>



<p>I am directed to refer to transfer policy guidelines for regulating transfer of Group ‘C’, Group ‘B’ (non-gazetted) and Assistant Superintendent of Posts issued vide Directorate’s communication no. 141-141/2013-SPN-II dated 17.01.2019. As per para 5 (i) if ibid communication, Post tenure of an employee shall be 3 years and station tenure shall be 6 years. However, an employee may be transferred before completion of post/station tenure on administrative grounds for reasons to be recorded in writing by an authority who is superior to the authority competent to order such transfer. The Authority Competent to approve the rotational transfer in normal course will initiate the proposal with proper justification for approval of the Superior Authority.</p>



<p>Various references have been received from service Unions/Associations requesting to exempt RMS officials from the provision of 6 years of Station tenure. The matter has been examined and found that most of the posts in RMS held by Group ‘C’ officials are non sensitive posts. Therefore, it has been decided to exempt Group ‘C’ RMS officials from the provision of 6 years of station tenure. However, the provision of post tenure of 3 years will continue to be in force.</p>

<p>Subject: <strong>Exemption from the routine exercise of transfer/ rotational transfer.</strong></p>
<p>Considering that transfer of a Government employee who serves as the main care giver of persons with disability would have a bearing on the systematic rehabilitation of persons with disabilities, the Government issued OM of even number dated June 6, 2014 to exempt such employee from routine exercise of transfer/rotational transfer, subject to administrative constraints.</p>
<p>2. The scope of disability initially had covered (i) blindness or low vision (ii) hearing impairment (iii) locomotor disability or cerebral Palsy (iv) leprosy cured (v) mental retardation (vi) mental illness and (vii) multiple disabilities, which subsequently, vide OMs of even number dated November 17, 2014 and January 5, 2016, was further extended to include &#8216;Autism&#8217;, &#8216;Thalassemia&#8217; and &#8216;Haemophilia&#8217;.</p>
<p>3. With the enactment of the Rights of Persons with Disabilities Act, 2016 on April 17, 2017, the following instructions are issued in supersession of the above-mentioned OMs of even number dated June 6, 2014, November 17, 2014 and January 5, 2016 with regard to the eligibility for seeking exemption from routine exercise of transfer/rotational transfer:</p>
<blockquote><p>(i) A Government employee who is a care-giver of dependent daughter/son/parents/spouse/brother/sister with Specified Disability, as certified by the certifying authority as a Person with Benchmark Disability as defined under Section 2(r) of the Rights of Persons with Disabilities Act, 2016 may be exempted from the routine exercise of transfer/rotational transfer subject to the administrative constratints.</p>
<p>(ii) The term &#8220;Specified Disability&#8221; as defined in the Schedule to the Rights of Persons with Disabilities Act, 2016, covers (i) Locomotor disability including leprosy cured person, cerebral palsy, dwarfism, muscular dystrophy and Acid attack victims (ii) Blindness (iii) Low-vision (iv) Deaf (v) Hard of hearing (vi) Speech and language disabilities (vii) Intellectual disability including specific learning disabilities and autism spectrum disorder (viii) Mental illness (ix) Disability caused due to: (a) Neurological conditions such as Multiple sclerosis and Parkinson’s disease (b) Blood disorder- Haemophilia, Thalassemia and Sickle cell-disease and (x) Multiple disabilities (more than one of the above specified disabilities) including deaf blindness and any other category of disabilities as may be notified by the Central Government.</p>
<p>(iii) The term &#8216;Specified Disability&#8217; as defined herein is applicable as grounds only for the purpose of seeking exemption from routine transfer/ rotational transfer by a Government employee, who is a care-giver of dependent daughter/son/parents/spouse/brother/sister as stated in Para 3(i) above.</p></blockquote>
<p>4. All the Ministries/Departments are requested to bring these instructions to the notice of all concerned under their control.</p>

<p>The undersigned is directed to refer to this Department&#8217;s Order of even number dated 09.09.2016 on the subject mentioned above, wherein the concerned Ministries/Departments were requested to relieve the officer(s) concerned immediately so that the officers could join the allocated Ministry/ Department. However, it has been observed that not all the officers have been relieved so far.</p>
<p>2. The concerned cadre units as well as the officers concerned are, therefore, once again requested to comply with the above referred order. If the Ministry/ Department concerned fail to issue relieving orders, the concerned officer(s) shall be deemed to have been relieved w.e.f. 30.09.2016(A/N). The onus to join the allocated Ministry/Department on the basis of the above order dated 09.09.2016 issued by this Department will be on the officer concerned and failure to do so may attract punitive action.</p>

<p>Subject: <strong>Rotational transfer of CSS officers of DS Grade and above. &#8211; Furnishing of personal information thereof.</strong></p>
<p>The undersigned is directed to say that this Department has proposed a revised rotational transfer policy in respect of CSS Officers. It has been decided to carry out rotational transfers of CSS officers of the DS Grade and above on the basis of a proposed revised rotational transfer policy, on the following parameters:</p>
<blockquote><p>(i) Ministries/Departments are categorized into Group A and Group 8 for posting/transfer;</p>
<p>(ii) The proposed RTP provides a tenure of five years for DS/Director in a Ministry/Department, including continuous tenure rendered in any other designation in the same Ministry/ Department;</p>
<p>(iii) In Group A, certain Ministries qualify for a reduced tenure by one year;</p>
<p>(iv) An officer on transfer shall ordinarily be posted from Group A-&gt; Group B and Group B-&gt; Group A, if they have completed the prescribed tenure. However, the officers presently posted in Group &#8216;A&#8217; Ministries/Departments may opt for posting in the same Group. In that case on posting to a Ministry/Department in Group &#8216;A&#8217; the tenure will be counted afresh. However, this option will not be available to officers currently posted in Group &#8216;B&#8217; to remain in Group &#8216;B&#8217;.</p>
<p>(v) An officer who is to be transferred out from the current Ministry/Department on completion of prescribed tenure may also be allowed option for posting in a Ministry Department where he earlier served subject to the condition that there is a gap of period which is equal to tenure prescribed for the post.</p>
<p>(vi) Officers who are within two years of superannuation will be exempted from rotationaI transfers.</p>
<p>(vii) For calculation of residency in a Ministryl Department, the cutoff date has been taken as 31.03.2015.</p>
<p>(viii) The Placement Committee will decide posting of officers on the basis of preference, past postings etc.</p></blockquote>
<p>3. Groupwise distribution of Ministries/Departments is at Annex.I.The list of brief details of officers who are likely to be considered for rotational transfer is at Annexure-II. Information relating to slots is at Annexure-III.</p>
<p>4. All the Ministries/Departments are requested to verify the list of officers (Annex.II) and any addition or deletion if required, may kindly be brought to the notice of this Department with out any delay.</p>
<p>5. The officers listed at Annex. II are requested to exercise their options for posting in the Ministries/ Departments in the other Group or as the case may be as per proposed revised RTP latest by 1.04.2015 in the format at Annexure-IV to Under Secretary, CS-I (D), Department of Personnel and Training through e-mail (uscsoned@gmail.com) or through fax number given below. Hard copies of the same may also be furnished immediately. Maximum three choices wit in the available slots may be exercised. If option is not received by 01.04.2015, it will be presumed that the officer has no specific choice and posting will be decided by the Placement Committee accordingly.</p>

<div>There has been demand that a Government employee who is a care giver of the disabled child may not have to suffer due to displacement by means of routine transfer/rotational transfers. This demand has been made on the ground that a Government employee raises a kind of support system for his/her disabled child over a period of time in the locality where he/she resides which helps them in the rehabilitation.</div>
<div></div>
<div>2. The matter has been examined. Rehabilitation is a process aimed at enabling persons with disabilities to reach and maintain their optimal physical, sensory, intellectual, and psychiatric or a social functional level. The support system comprises of preferred linguistic zone, school/academic level, administration, neighbours, tutors/special educators, friends, medical care including hospitals, therapists and doctors, etc. Thus, rehabilitation is a continuous process and creation of such support system takes years together.</div>
<div></div>
<div>3. Considering that the Government employee.who has disabled child serve as the main care giver of such child, any displacement of such Government employee will have a bearing on the systemic rehabilitation of the disabled child since the new environment/set up could prove to be a hindrance for the rehabilitation process of the child. Therefore, a Government servant who is also a care giver of disabled child may be exempted from the routine exercise of transfer/rotational transfer subject to the administrative constraints.<br />
The word &#8216;disabled&#8217; includes</div>
<blockquote>
<div>(i) blindness or low vision</div>
<div>(ii) hearing impairment</div>
<div>(iii) locomotor disability or Cerebral Palsy</div>
<div>(iv) leprosy cured</div>
<div>(v) mental retardation</div>
<div>(vi) mental illness and<br />
(vii) multiple disabilities.</div>

<div>4. Upbringing and rehabilitation of disabled child requires financial support. Making the Government employee to choose voluntary retirement on the pretext of routine transfer/rotation transfer would have adverse impact on the rehabilitation process of the disabled child.</div>

<div>5. This issues with the approval of MoS(PP).</div>
<div></div>
<div>6. All the Ministries/Departments, etc. are requested to bring these instructions to the notice of all concerned under their control.</div>

<div>There has been demand that a Government employee who is a care giver of the disabled child may not have to suffer due to displacement by means of routine transfer/rotational transfers. This demand has been made on the ground that a Government employee raises a kind of support system for his/her disabled child over a period of time in the locality where he/she resides which helps them in the rehabilitation.</div>

<div>2. The matter has been examined. Rehabilitation is a process aimed at enabling persons with disabilities to reach and maintain their optimal physical, sensory, intellectual, and psychiatric or a social functional level. The support system comprises of preferred linguistic zone, school/academic level, administration, neighbours, tutors/special educators, friends, medical care including hospitals, therapists and doctors, etc. Thus, rehabilitation is a continuous process and creation of such support system takes years together.</div>

<div>3. Considering that the Government employee.who has disabled child serve as the main care giver of such child, any displacement of such Government employee will have a bearing on the systemic rehabilitation of the disabled child since the new environment/set up could prove to be a hindrance for the rehabilitation process of the child. <strong>Therefore, a Government servant who is also a care giver of disabled child may be exempted from the routine exercise of transfer/rotational transfer <span style="text-decoration: underline;">subject to the administrative constraints</span></strong>. The word &#8216;disabled&#8217; includes (i) blindness or low vision (ii) hearing impairment (iii) locomotor disability or Cerebral Palsy (iv) leprosy cured (v) mental retardation (vi) mental illness and (vii) multiple disabilities.</div>

<div>4. Upbringing and rehabilitation of disabled child requires financial support. Making the Government employee to choose voluntary retirement on the pretext of routine transfer/rotation transfer would have adverse impact on the rehabilitation process of the disabled child.</div>

<div>5. This issues with the approval of MoS(PP).</div>

<div>6.  All the Ministries/Departments, etc. are requested to bring these instructions to the notice of all concerned under their control.</div>

<p>Subject:- <strong>Rotational Transfer Policy (RTP) applicable to Central Secretariat Stenographers&#8217; Service personnel &#8211; Constitution of Committee therefor &#8211; reg.</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 13/1/2009-CS.1I dated 15.07.2011 on the subject mentioned above vide which transfer policy (Rotational Transfer Policy) in respect of officials<br />
belonging to Central Secretariat Stenographers&#8217; Service has been laid down.</p>
<p>2. As per the RTP, tenure of a CSSS official in a particular cadre unit/Ministry/ Department shall be 10 years. An officer is normally posted outside the cadre unit/Ministry/Department only upon promotion. In pursuance of this policy, a committee consisting of three adequately senior officers is constituted at the time of promotion/consideration of transfer of CSSS officials. Based on the recommendations of the said committee, requisite order for promotion/transfer of CSSS officials is issued with the approval of the competent authority.</p>
<p>3. In compliance of Supreme Court&#8217;s order dated 31.10.2013 in WP (Civil) No. 82/2011, it has been decided to constitute a committee for recommending the transfer of CSSS personnel in each grade and further to specify the authority competent to take a decision in this regard. The constitution of the grade-wise Committees in this regard will be as mentioned below. Nomination of the members in the committees, wherever required, will be made by the authority competent to approve the transfers in the respective grades. The committees will make recommendations and final decision will be taken by the authority mentioned under each of the Committee :-</p>
<p>i. <strong>Stenographer Grade &#8216;D&#8217;</strong>, PB-I, Rs.5200-20200/- + Rs.2400/- G.P, entry by Direct Recruitment<br />
a) US(CSSS),<br />
b) Another US,<br />
c) SO(CS-II.C,Dealing with the subject)</p>
<p>Authority competent to approve the recommendations of the Committee:-</p>
<p>Deputy Secretary/Director CS-II</p>

<p>3. While making recommendations for posting /transfer in the grades of PAs upto PSO,due consideration would be given to the three options given by the official, as provided under OM No. 13/1/2009-CS II dated<br />
15.07.2011, and subject to seniority and availability of vacancies, effort would be made to accommodate their options to the extent possible. This criteria may not, however, be applicable in case of Stenographers Grade&#8217; D&#8217; who are recruited through direct recruitment.</p>
<p>4. Other terms and conditions of the a.M. No. 13/1/2009-CS.1I dated 15.07.2011 will remain unchanged.</p>
