<h3 class="wp-block-heading"><strong>Subject: Implementation of Govt. decision on 7th CPC recommendations on Risk Allowance to Central Govt. employees-regarding</strong></h3>



<p>Consequent upon the decision taken by the Government on the recommendations made by the <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th Central Pay Commission</a></strong> on the subject of Risk Allowance and with the approval of D/o Expenditure, it has been decided to revise the rates of Risk Allowance paid to the Central Govt. employees. The revised rates of Risk Allowance are as follows:</p>

<p>3. <a href="https://centralgovernmentnews.com/tag/7th-cpc-risk-and-hardship-allowance/" target="_blank" rel="noreferrer noopener">Risk Allowance</a> with revised rates shall be payable from the date of issue of this OM. Further, all other terms and conditions envisaged in the O.M. No.21012/4/88-Allowances dated 22.08.1988 shall continue to apply.</p>

<p>The undersigned is directed to refer to this Deptt&#8217;s O.M. of even no. dt. 07.03.2018 and reminders dt. 17.04.2018, 29.102018 and 16.112018 (Copies enclosed) vide which Ministries/Departments were requested to provide the details regarding number of employees eligible for Risk Allowance, estimated existing annual expenditure as per the existing rates and estimated annual expenditure if the existing rates are multiplied by the 2.25 factor as decided by the Government. </p>



<p>2.Despite reminders, this Department has received comments only from 26 Ministries/Departments which are &#8211; M/o Panchayati Raj, D/o Public Enterprises, Cabinet Secretariat, D/o Atomic Energy, D/o Agriculture and Cooperation, Inter-State Council Secretariat &#8211; MHA, D/o Justice, DARPG, D/o Chemicals &amp; Petrochemicals, D/o Food &amp; Public Administration, M/o Petroleum &amp; Natural Gas, M/o External Affairs, D/o Rural Development, M/o Housing Urban Affairs, Secretariat of Vice- President, D/o Biotechnology, PMO, M/o Tribal Affairs, D/o Fertilizers, M/o Culture, M/o MSME, D/o Expenditure, M/o Earth Sciences, D/o Defence, D/o Space and Railway Board. </p>

<p>Ministry of Railways (Railway Board) have decided to constitute a Committee for inclusion of fresh categories within the ambit of Risk &amp; Hardship Allowance. The Committee will consist of the following:-</p>



<p>(i) EDPC-II, Railway Board                                              … Convener<br />
(ii) EDF(E), Railway Board                                              … Member<br />
(iii) EDCE(G), Railway Board                                          … Member<br />
(iv) Sh. Shiv Gopal Mishra, General Secretary/AIRF … Member<br />
(v) Shri Guman Singh, President/NFIR                         … Member</p>



<p>The Terms of Reference of the Committee will be as under:-</p>



<p>“To holistically examine the inclusion of fresh categories within the ambit of Risk and Hardship Allowance introduced by 7th CPC.”</p>



<ol class="wp-block-list"><li>The tenure of the Committee will be Six months from the date of its constitution.</li><li>The Headquarters of the Committee will be at New Delhi.</li><li>PC-VII branch, Railway Board will be the Nodal branch for functioning of the Committee. Therefore, submission of report of the Committee for consideration of Railway Board, implementation of its recommendations and all related issues including Parl, Questions, RTI cases and other formalities with regard to the Committee, shall be dealt with by PC-VII branch, Railway Board.</li><li>The Convener and Members of the Committee will draw TA/DA as per extant rules.</li></ol>

<p>Sub: <strong>Recommendations of 7th CPC &#8211; Payment of Risk &amp; Hardship Allowance for Track Maintainers working in construction s organization &#8211; Reg.</strong></p>
<p>Ref: (i) Railway Board&#8217;s letter No.87/2017) No. PC-VIII/ 2017/I7/5/4 dated 1/08/2017 (RBE (P), E.C. Railway vide letter</p>
<p>(ii) Railway Board&#8217;s clarification issued to GM No. PC-VII/ 2017/I7/5/4 dated 25/10/2018.</p>
<p>Federation desires to bring to the kind notice of Railway Board that consequent to the acceptance of recommendations of 7th CPC relating to grant of Risk &amp; Hardship Allowance to Track Maintainers, the Railway Board vide letter dated 10/0812017 (RBE No. 87/2017) issued instructions to the GMs of Zonal Railways to grant Risk &amp; Hardship Allowance to the Track Maintainers of Indian Railways as per Cell R3 H2 of Risk and Hardship Matrix @ Rs 2700/- p.m. per person. The 7th CPC in its ;eport mentioned that the &#8220;Track Maintainers-I, II, III and IV of lndian Railways should be granted Risk &amp; Hardship Allowance in view of hardship faced by these categories of employees&#8221;.</p>
<p>It has however been brought to the notice ofthe Federation that on a reference received from GM (p), E.C. Railway, thelailway Board vide letter dated25ll0l2018 addressed to GM (p), E.C. Railway, has clarified that the Track Maintainers working in Construction Oiganizations are not eligible for grant of Risk and Hardship Allowance. Federation does not agiee with the unjustifieJ view taken by the Railway Board and the same is unacceptable to NFIR due to the following reasons:-</p>
<ul>
<li>Track Maintainer is essentially required to work on Rail tracks, whether under Open line or in the Constructions Organizations.</li>
<li>In the Construction Organization, the Track Maintainers are required to perform duties of laying of rails, sleeper, points, and crossing in a programmed way and for completing work within targeted periods. Hardship and Risk is involved in their duties.</li>
<li>It needs to be appreciated that the Track Maintainer by designation, has been granted Risk and Hardship Allowance, therefore denying Risk and Hardship Allowance to the desisnated Track Maintainers working in Construction Organizations is improper.</li>
</ul>
<p>The duties performed by the Track Maintainers working in Construction organization as mentioned above justify payment of Risk and Hardship Allowance in accordance with Board&#8217;s instructions dated 10/0812017 (RBE No. 87/2017). The erroneous clarification of the Railway Board vide letter dated 25/10/2018 therefore needs to be withdrawn immediately.</p>
<p>NFIR, therefore, requests the Railway Board to review the case and withdraw Board&#8217;s letter dated 25110/2018. Action taken in the matter may be apprised to the Federation.</p>

<p>The undersigned is directed to refer to this Deptt&#8217;s O.M. of even no. dt. 07.03.2018 requesting the Ministries/Departments to provide the details  regarding number of employees eligible for Risk Allowance and estimated annual expenditure in the prescribed performa thereon.</p>
<p>2. Despite reminders dt. 17.04.2018 and 29.10.2018, till date only 15 Ministries/Departments have responded. All Ministries/Departments who have still not furnished the information are requested to furnish the same in the attached proforma latest by 30.11.2018 failing which it will be presumed that the remaining Ministries/Departments have no information to furnish and that they have no employees in receipt of Risk Allowance. <p>The undersigned is directed to refer to this Deptt&#8217;s O.M. of even no. dt. 07.03.2018 (Copy enclosed) vide which Ministries/Departments were requested to provide the details regarding number of employees eligible for Risk Allowance, estimated existing annual expenditure as per the existing rates and estimated annual expenditure if the existing rates are multiplied by the 2.25 factor as decided by the Government.</p>
<p>&nbsp;</p>
<p>2. Despite remainders, this Department has received comments only from 12 Ministries/Departments which are &#8211; M/o Panchayati Raj, D/o Public Enterprises, Cabinet Secretariat, D/o Atomic Energy, D/o Agriculture and Cooperation, Inter-State Council Secretariat, MHA, D/o Justice, D/o Food and Public Administration, M/o External Affairs, M/o Earth Science, D/o Defence, D/o Defence Production.</p>
<p>&nbsp;</p>
<p>3. It is requested that the aforesaid data may be furnished to this Department in the format prescribed in O.M. dt. 07.03.2018(copy enclosed) at the earliest.</p>

<p>Kind attention of Railway Board is invited to Federation’s letter dated 29/08/2017 wherein it was requested to take action for covering the remaining categories of P. Way staff such as Black Smiths, Welders etc., for payment of Risk &amp; Hardship Allowance as their duties/responsibilities are also risky and hardships prone due to the fact that they are required to work physically on the P. Way tracks and that the 7th CPC has unfortunately failed to consider the role of these staff in laying/maintenance of Railway tracks. However, decision for payment of Risk &amp; Hardship Allowance in favour of these P. Way staff working (Black Smith, Welders etc.,) is yet to be taken by Board. A copy of Federation’s letter dated 29/08/2017 on the subject is enclosed for ready reference.</p>

<p>Further to above, Federation finds that the jobs performed by Pointsmen, Traffic Gate Keepers, Traffic Assistants (Operating Department &#8211; working in Yards, stations etc.,), Staff of TRD/OHE, AC Coaches, EMU Car Sheds, Electrical Workshops, General Services and S&amp;T Staff are also risky consequently they are prone to accidents and health hazards. These categories have not been covered for Risk &amp; Hardship Allowance under the Risk &amp; Hardship Matrix (Cell R3H2) due to the reason that the 7th CPC had failed to give weightage to the nature of duties and responsibilities being performed by these staff. The Railway Board also has not taken initiative to highlight the Risk and Hardship conditions before the Committee on Allowances headed by the Finance Secretary, Government of India.</p>

<p>NFIR, therefore, requests the Railway Board to kindly arrange to initiate action for covering P. Way Staff such as Black Smiths, Welders, Helpers, Pointsmen, Traffic. Gate Keepers, Traffic Assistants (Operating Department), Electrical Staff working in TRD/OHE, AC Coaches, EMU Car Sheds, Electrical Workshops, General Services and S&amp;T Staff under Risk and Hardship Matrix (Cell R3H2) for payment of Risk &amp; Hardship Allowance @ Rs. 2700/- p.m. Action taken in the matter may kindly be apprised to the Federation soon.</p>

<p>Consequent upon the acceptance of recommendation of 7th Central Pay Commission on Allowances, the President is pleased to decide grant of Risk and Hardship Allowance to Track Maintainers &#8211; I, II, III &amp; IV of Indian Railways as per cell R3H2 (Rs. 2700 for Level 8 and below and Rs. 3400 for Level 9 and above) of Risk and Hardship Matrix.</p>

<p>The rate of ex-gratia lump sum compensation for 100 percent disability to CAPFs &amp; Assam Rifles personnel, who are disabled in the performance of their bonafide official duty under various circumstances and are boarded out from service on account of disability attributable to aggravated in service, has been revised vide this Ministry OM No.27011/64/2010-R&amp;W (Part) dated 07/06/2017 from Rs. 09 lakhs to Rs. 20 lakhs w.e.f 01/01/2016.</p>
<p>The 7th CPC has recommended a common regime of Risk and Hardship Allowance for Army and CAPFs which has been accepted by the Government.</p>
<p>This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to question by Shri Bahadur Singh Koli in the Lok Sabha today.</p>

										<content:encoded><![CDATA[<p><strong>7th CPC: AIIMS nurses to go on mass casual leave tomorrow</strong></p>
<p>Services at AIIMS are likely to be hit tomorrow as around 5,000 nurses of the premier hospital plan to go on mass casual leave to protest against the &#8220;discrimination&#8221; by the Seventh Central Pay Commission.</p>
<p>The AIIMS Nurses Union has also threatened to go on an indefinite strike from March 27 if their demands for revision of their pay scales and a hike in allowances are not met.</p>
<p>We are protesting against the retrograde recommendations of the Seventh Pay Commission. Our demand is that the entry pay grade for staff nurses should be enhanced to Rs 5,400 from the existing Rs 4,600 and the nursing allowance should be enhanced by Rs 7,800.</p>
<p>Besides, risk allowance and night duty allowances should be given to all nurses as it is given to all other government employees, said Harish Kumar Kajla, President of AIIMS Nurses Union.</p>
<p>We deal with the deadly infections daily but we are not provided enough risk allowance. If the demands are not met, we will go on an indefinite strike from March 27, Kajla added.<br />
The association further claimed that the AIIMS management despite giving assurances has not addressed their issues for over a year.</p>
<p>On the assurance give by the management in a meeting regarding recommendation of enhanced pay scale, the Nurses Union had withdrawn the agitation called upon by the All India Nurses Union and subsequently withdrawn the mass casual leave called on February 26, 2016.</p>
<p>The AIIMS Nurses Union was patiently waiting for the last one year for the fulfilment of the promises made by the administration but our demands went into deaf ears. Despite repeated representations, the administration has shown no mood to address the issue raised by the Union, Kajla claimed.</p>
<p>According to faculty members, the move will badly hit the emergency services and the functioning of the operation theatres of the institute apart from other patient services.</p>
<p>The pay scales proposal has been sent to the Ministry of Health for consideration while the report of government on the allowances has not yet been finalised, a senior AIIMS official said.</p>
