Sub: <strong>Grievances of the Central Government Employees</strong></p>
<p>Owing to serious discontentment on various retrograde recommendations of the VII CPC, there had been countrywide resentment among the Central Government Employees, and the Staff Side(JCM), under the aegis of the NJCA, had decided for an &#8220;Indefinite Countrywide Strike&#8221;, commencing from 6th July, 2016, which was deferred after negotiations with the GoMs, comprising of Hon&#8217;ble Minister for Home Affairs, Finance Minister, Railway Minister and State Minister for Railways, held on 30.06.2016, wherein it was assured that, demands of the Central Government Employees, viz. improvement in Minimum Wage and Fitment Formula, Rates of Allowances, Guaranteed Pension/Family Pension in lieu of NPS etc. would be resolved within a fixed time frame of four months, for which committees were constituted by the Government of India.</p>
<p>While substantial delay took place in setting-up of various committees itself, however, it is a matter of deep concern that, the committees have not yet finalized their reports despite lapse of more than eight months time.</p>
<p>The Staff Side had, at the very outset, opposed setting-up of Committee on Allowances, demanding upward revision and restoration of certain allowances which were recommended to be abolished by the 7th CPC, nevertheless, the government on the contrary constituted the said committee.</p>
<p>It may be recalled that, it has been an established convention in the past also that, payment of the revised rates of the allowances is done w.e.f. the date of implementation of the report of the Central Pay Commission, but this time, unlike previous occasion, the Central Government Employees are still being paid House Rent Allowance, Transport Allowance etc. on the pre-revised rates.</p>
<p>It was being expected that, Committee on Allowances would complete its proceedings within the fixed timeframe and the CGEs would be paid allowances on the revised rates w.e.f. the date of implementation of the 7th CPC report, but unfortunately, it is being delayed inordinately, owing to which there is serious resentment brewing among the CGEs.</p>
<p>While Committee on Allowances also met on the previous day, i.e. 28.03.2017, and we were expected that it would finalize its recommendations in the said meeting, but on enquiring we have been made to understand that, the issue of revision of rates of HRA was even not discussed in the said meeting.</p>
<p>We, therefore, take this opportunity to apprise you that, unjustified and inordinate delay in finalizing the reports of the committees is not only breach of the assurance given to the Staff Side by the GoMs, but also creating an uncongenial atmosphere among the CGEs.</p>
<p>It would, therefore, be quite appropriate that, the issue may be considered with all seriousness as per assurance given to the Staff Side, and revision of the rates of the allowances, NPS, Minimum Wage and Fitment Formula and Pension/Family Pension, along with restoration of certain allowances abolished by the 7th CPC, be finalized without further loss of time in the larger interest of industrial harmony in the country.</p>

<p>All Central Government employees are eagerly waiting for the report of Allowance Committee, which is going to be submit today to the Government.</p>
<p>Reports suggests that the Allowance Committee may submit its report on 20th February 2017 and it will be notified with effect from 1st April 2017. Federation sources told that It is unacceptable and we will fight it out until the revised allowances implemented with effect from 1.1.2016.</p>

<p>Attention is invited to the instructions contained in Board’s letters of even number dated 9.3.2004, 9.8.2005, 9.8.2006, 12.12.2007, 24.10.2008, 10.12.2009 , 01.07.2013 and 24.07.2014 on the above subject.</p>
<p>2. The matter has been considered by the Board subsequent to issue of letter No. E(G)2009 QR 1-2 dated 20.10.2014 and it has been decided that railway employees posted to ECR and NWR may be allowed house rent allowance upto 31.12.2015 on the same terms and conditions laid down in the letter of even number dated 09.03.2004 ibid and as amended/clarified from time to time.</p>
<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>The 7th Central Pay Commission has been recommended to reduce the percentage of House Rent Allowance for all categories of Central Government employees rationalized to 24 percent, 16 percent and 8 percent of the Basic Pay for Class X, Y and Z cities respectively.</p>
<p>&nbsp;</p>
<p>The Commission also recommends that the rate of HRA will be revised to 27 percent, 18 percent and 9 percent when DA crosses 50 percent, and further revised to 30 percent, 20 percent and 10 percent when DA crosses 100 percent.</p>

<p>&nbsp;</p>
<p><b>7th CPC HRA:</b> HRA is the most important factor of allowance issuing to existing Central Government employees, it is given for compensate to live in rented house. The HRA rules are allowed for getting allowance even if he/she living in own house.</p>
<p>&nbsp;</p>
<p>A major changes had been made in 6th CPC on HRA rules. The percentages were prescribed on basic pay according to the cities in India. The cities are classified as X, Y and Z and the rates of percentage respect of the cities are 30%, 20% and 10% on basic pay (Grade pay including).</p>
<p>&nbsp;</p>
<p>Central Government employees are expecting changes in the rate of percentage according to cities.</p>
<p>&nbsp;</p>

The present scheme of HRA is based on the recommendation of the 6th CPC, which is as follows:</p>

<p>We reproduce hereunder the recommendation made by the third Central Pay Commission in the matter of grant of house rent allowance. (Para 29 Part I. Vol. IV.Chapter 56), which would be the best if implemented even today. While we find it difficult to accept the kind of parity suggested above, we are aware of the acute problem caused by the lack of adequate government housing and by the inadequate government housing and by the inadequacy of the existing rates of house rent allowance and recommend as follows:-</p>
<p>&nbsp;</p>
<p>Government should take houses on long lease and make residential accommodation available to its employees on payment of 10% of their pay.</p>
<p>&nbsp;</p>
<p>(ii) Government should lay down appropriate house rent allowance rates in different cities and towns based not on population criteria, but on an actual assessment of the prevailing levels of rent in different cities and towns. Alternatively, certain notional rents for different types of accommodation meant for officers and personnel of specified pay groups should be laid down for particular cities after studying the actual conditions in that city. The difference between the actual rent paid and 10% of pay should be reimbursed subject to a maximum of the difference between the notional rent and 10% of the pay. The existing norms in regard to entitlement of accommodation, size of rooms etc. could, if necessary, be reduced depending on the housing situation and the norms usually adopted by different income groups in renting accommodation in the various cities. Such notional rents should, to start with, be applied to all stations falling under the description of classified cities for purposes of House Rent Allowance, Additions could also be made to the list later on by including other cities deserving similar treatment.</p>

<div> (iii) Till the Government is able to make arrangements recommended in the preceding sub-paragraphs, the rates of HRA should be as follows:-</div>

<div>The above said recommendations is still to be acted upon by the Government and the transitory provisions suggested by them i.e. payment of allowances at a pre-determined rate on the basis of classification made of the cities depending upon the population continue to be employed. The non-implementation of the above recommendation of the third CPC , has without exception, gone to depress the wage of all sections of Central Government employees as they are perforce to spend more than what they receive as HRA for obtaining and retaining the accommodation.</div>

<p>The rates prescribed by the 6th CPC, though an improvement over its predecessor Commission, it has not improved the situation. The real estate value throughout the country has skyrocketed and owning an accommodation within the city/Municipal limit has become impossible for Government employees. There is not a single town/village where the real estate boom has remained unaffected. The phenomenal increase in the value of land has naturally impacted the rent, one is to pay on leasing house/flat. The house rent allowance does not bear even a small percentage of the rent. The 7th CPC may recommend to the Government to act upon the suggestion made by the 3rd CPC without any further delay. Pending action on the part of the Government, the Commission may suggest the following rates of House Rent allowance;</p>

<p>Subject : <strong>Re-classification/Upgradation of Cities/Towns on the basis of Census – 2011 for the purpose of grant of House Rent Allowance (HRA) for CPSE employees</strong></p>
<p>The undersigned is directed to refer to para ‘7’ of DPE OM dated 26.11.2008, para ‘2’(iii) of OM dated 02.04.2009 and DPE OM dated 07/01/2013 on the subject cited above.</p>
<p>2. Department of Expenditure, vide OM No. 2/5/2014-E.II(B) dated 21/07/2015, has re- classified the cities/towns on the basis of Census-2011 as “X”, “Y” and “Z” for the purpose of HRA as enumerated in the Annexure to this OM.</p>
<p>3. It has been decided that the re-classification of cities/towns on the basis of census 2011 for the purpose of grant of HRA as contained in the Department of Expenditure OM dated 21/07/2015 would also be implemented in the Central Public Sector Enterprises with effect from 1st April 2015.</p>
<p>4. These guidelines would be applicable to the employees of CPSEs who are on 2007 IDA pay scale and also to the employees on 6th CPC recommendation based CDA pay scales.</p>
<p>5. All the administrative Ministries/Departments of the Government of India are requested to bring the foregoing to the notice of the public sector enterprises under their administrative control for their information and necessary action.</p>
<p>6. This issues with the approval of Minister (HI &amp; PE).</p>

										<content:encoded><![CDATA[<p>Finance Ministry issued orders on upgradation of cities / towns on the basis of Census 2011 for the purpose of House Rent Allowance</p>
<blockquote><p><span style="color: #800000;"><em>The new and revised list of cities &amp; towns has been declared by the Finance Ministry today for the purpose of House Rent Allowance on the basis of Census 2011.</em></span></p></blockquote>
<p>House Rent Allowance to Central Government employees is now calculated on the basis of the population census of 2001. The cities and towns are classified as X, Y, and Z, based on their population. Employees in these towns are eligible for 30%, 20% and 10% House Rent Allowances respectively.</p>
<p>Population census is conducted once every ten years. The most recent census was held in 2011. Official information and findings of the Census was sent by the registrar General &amp; Census Commissioner to the Finance Ministry a long time ago.</p>
<p>There is no denial in the fact that the Confederation of Central Government Employees has been constantly demanding this upgrading. The Confederation had, on 28.04.2014, sent a letter to the Finance Ministry. The letter said that even though the 2011 Census Report CD was received, there is no official announcement from the Government in this regard. The letter also demanded that a revised HRA and TA be implemented immediately in the reclassification of cities and towns on the basis of 2011 Census. On 30.07.2014, the Finance Ministry had, in reply to the mail, said that steps are being taken to implement the revised HRA and TA rates to the Central Government employees of these cities and towns.</p>
<p>Now, Finance Ministry issued orders on re-classification / upgradation of cities / towns on the basis of Census 2011 for the purpose of House Rent Allowance to Central Govt employees with effect from 1.4.2015.</p>

<p>Subject : <strong>Re-Classification / Upgradation of Cities / Towns on the basis of Census-2011 for the purpose of grant of House Rent Allowance (HRA) to Central Government employees.</strong></p>
<p>Reference is invited to this Department’s O.M. No.2(13)/2008-E.II(B) dated 29.08.2008 relating to grant of House Rent Allowance (HRA) to Central Government employees on the recommendations of the 6th Central Pay Commission (CPC) whereby a list of cities / towns classified as “X”, “Y” and “Z” for the purpose of grant of HRA was enclosed as Annexure. The matter relating to re-classification of cities / towns on the basis of Census-2011 for the purpose of grant of HRA to Central Government employees has been considered by the Government.</p>
<p>2. The President is pleased to decide that in supersession of all the existing orders relating to classification of cities/towns for the purpose of grant of HRA to Central Government employees, cities/towns shall now be re-classified as “X”, “Y” and “Z” for the purpose of HRA as enumerated in the Annexure to these orders.</p>
<p>3. Consequent upon implementation of the recommendations of the 5th Central Pay Commission, certain cities / towns were placed in a lower classification as compared to their existing classification for HRA purpose, vide this Department’s O.M. No.2(30)/97-E.II(B) dated 03.10.97. However, these cities/towns were allowed to retain their existing higher classification, vide Para 3 thereof; and further extended vide O.M. No.2(21)/E.II(B)/2004 dated 16.03.2005 &amp; O.M. No.2(13)/2008-E.II(B) dated 07.01.2009. As other cities / towns to which protection of retaining earlier higher classification was allowed, got upgraded during the intervening period and as on date only two cities i.e. Ajmer in Rajasthan and Durgapur in West Bengal were retaining such protection. Consequent upon upgradation of these two cities also on the basis of their population as per Census-2011, provisions contained in Para 3 of this Department’s O.M. No. 2(30)/97-E.II(B) dated 03.10.97 which Were allowed to further continue vide O.M. dated 16.03.2005 &amp; 07.01.2009, stand withdrawn/discontinued.</p>
<p>4. Special orders allowing continuance of HRA at Delhi (‘X” class city) rates to Central Government employees posted at Faridabad, Ghaziabad, NOIDA and Gurgaon, at Jalandhar (“Y” class city) rates to Jalandhar Cantt., at “Y” class city rates to Shillong, Goa &amp; Port Blair vide this Department’s O.M. No.2(13)/2008-E.II(B) dated 29.08.2008, and continuance of HRA at par with Chandigarh (“Y” class city) to Panchkula vide this Department’s O.M. No.2(13)/2008-E.II(B) dated 04.03.2011, shall continue to be applicable till the recommendations of 7th CPC are considered by the Government.</p>
<p>5. These orders shall take effect from 1st April, 2015.</p>
<p>6. The Orders will apply to all civilian employees of the Central Government. The orders will also be applicable to the civilian employees paid from the Defence services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and the Ministry of Railways, respectively.</p>
<p>7. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the comptroller &amp; Auditor General of India.</p>

<div>House Rent Allowance to Central Government employees is now calculated on the basis of the population census of 2001. The cities and towns are classified as X, Y, and Z, based on their population. Employees in these towns are eligible for 30%, 20% and 10% House Rent Allowances respectively.</div>

<div>It is well known that the Confederation Secretary General had recently sent a letter to the Finance Ministry reiterating that the House rent Allowance must be recalculated on the basis of the new Census-2011 report.</div>
<p>&nbsp;</p>
<p>Based on the 2001 Census, Central Government employees residing in towns with population of more than 50 lakhs are given a House Rent Allowance of 30% of their basic pay. Employees living in towns with population of more than 5 lakhs are given House Rent Allowance of 20%. Those living in all the other towns are given a HRA of 10%.</p>

<div>Similarly, Transportation Allowance too is given in two categories A-1, A, and Other places. 13 towns are currently classified as A-1 and A categories.</div>

<div>The general feeling is that the demand for the revision of HRA based on the Population Census 2011 should come from all sides.</div>
<div></div>
<div>Take the cities of Ahmadabad and Pune, for example. Populations in these towns have crossed the 50 lakh mark (Ahmadabad’s population is 63,52,254; and Pune’s population is 50,49,968). Similarly, according to Census 2011, the population of many smaller towns have crossed the 5 lakh mark. There is no doubt that a revision of House Rent Allowance based on the 2011 Population Census will benefit hundreds of thousands of employees.</div>

<p>PREAMBLE:-</p>
<p>The Hon’ble Chief Minister in the Budget Speech 2013-14 has announced the Government’s decision to enhance the House Rent Allowance of State Government employees working in Bangalore city to 30% of their basic pay. Accordingly the following orders are issued.</p>
<p style="text-align: center;">
<strong>GOVERNMENT ORDER NO. FD 05 SRP 2013</strong><br />
<strong>BANGALORE, DATED: 10th MAY 2013</strong></p>
<p style="text-align: left;">
Government are pleased to order that the rate of House Rent <a href="http://centralgovernmentnews.com/category/allowance/">Allowance </a>in respect of State Government employees posted to any place within the limits of BBMP shall be revised from the existing<strong> 25% of basic pay to 30% of basic pay with effect from 01st April 2013.</strong></p>
<p style="text-align: left;">
2. These orders shall be applicable to all full time Government employees who are governed by the provisions of the Karnataka Civil Services Rules and who are on time scales of pay.</p>
<p style="text-align: left;">
3. These orders are extended to (i) full-time employees borne on work-charged establishments of Government on time scale of pay (ii) full-time employees of the Aided educational institutions and non-teaching staff of the Universities who are on time-scale of pay and (iii) teaching staff of the Universities / Colleges who are drawing pay in the UGC/ICAR/AICTE scales of pay.</p>

4. The payment on account of <a href="http://centralgovernmentnews.com/category/hra/">House Rent Allowance</a> involving fractions of 50 paise and above shall be rounded off to the next rupee and fractions of less than 50 paise shall be ignore</p>
