Non-grant of revised pension 7th CPC to pre-2016 retirees – reg.
Ref: NFIR’s letter No. II/35/20l8 dated 08/09/2018

In view of difficulties faced for revision of pension (w.e.f. 01/01/2016 -7th CPC) of retired Running Staff consequent upon non-reckoning of 55% add on pay element to retired Running Staff, 30% add on pay element for retired Loco inspectors (pre-2016) and non-reckoning of ‘Charge Allowance‘ granted to JA Grade Officers (worked on adhoc basis and retired) which is counted as pay for all purposes as per extant instructions, NFIR vide its letter dated 08/09/2018 requested the Railway Board to make adequate provisions in the ARPAN software to enable the zonal Railways tb redress the grievances of retired staff.

Along with its communication dated 08/09/2018, Federation also enclosed copies of Western Railway and Sourh Central Railway’s letters dated 06/07/2018 & 10/08/2018 wherein specific difficulties/problems faced by the zonal Railways were highlighted’ Federation feels disappointed that though a period of more than two months passed, neither.rectification in the software ARPAN has bleen don. no, Federation apprised of steps taken to mitigate problem.

While enclosing copy of Federation’s letter dated 08/0912018 (together with enclosures), NFIR once again requested Railway Board to kindly intervene to see that rectification in the software is ensured soon. Federation may please be apprised of the action taken in the matter.

References have been received from pensioners and pensioner’s association that the revised pension and arrear of revised pension as per 7th CPC has not been credited into the account of the pensioners/family pensioners.

All the CPPCs of the Banks are, therefore, requested to credit the revised pension and arrears of revised pension immediately in the account of pensioners/family pensioners for which Special Seal Authorities (SSAs) have been issued to the banks and in any case not later than 30 days of receipt of the Special Seal Authority (SSA) from this office so that the grievances of and hardships faced by the pensioners/family pensioners could be minimised.

This issues with the approval of Chief Controller (Pension).

Kindly refer to RBA No.170/2017 dated 30.11.2017 on the above subject. requesting Railways to verify the scrolls received from various Pension Paying Banks to establish that payment of revised pension has commenced in favour of all pensioners for whom revised PPOs have been issued. It is understood that despite lapse of nearly 6 months, revised pension is not being received by many pensioners and the issue is being raised in various Pensioners’ Forums including SCOVA.

Follow up on payment of revised pension by the banks is necessary to take the benefits to the pensioners in a timely manner. Therefore, a special drive may be launched in the EDP centres to reconcile the debit scrolls with the revised PPOs to ascertain the number of cases where payment of revised pension has not yet been initiated by the banks despite issue of revised PPOs. The matter may be taken up with defaulting Banks and a report sent at jda@rb.railent.gov.in in the following format by 30th June,2018 for Board’s information:

iii) DOP&PW O.M. F.No. 38/37/08-P&PW (A) dated 30-7-2015

Dear Sir,
We seek your benign intervention in the following matter of serious injustice with a section of Pre-2006 Central Government Pensioners:

1. Sixth Pay Commission had Merged and upgraded some posts keeping in view their duties & responsibilities. The recommendations of the Sixth CPC were accepted by the Government vide Resolution of the Government Notified on 29-8-2008 and orders were issued thereon vide DOPT & DOPPW vide OMs dated 1-9-2008.

2. DOP&PW subsequently modified these orders vide O.M. File No. 38/37/08-P&PW (A) dated 11-2-2009 and ordered that the benefit of upgrading of posts by Sixth Pay Commission shall not be given for the fixation of Revised Pension of Pre-2006 Pensioners.

3. Above cited orders of DOP&PW (dated 11-2-2009) had been quashed by the various Courts including the Apex Court, which inter-alia directed that “The fixation (of Pension) … will be subject to the provision that the revised pension, in no case, shall be lower than 50% of the sum of the minimum of the pay in the pay band and the grade pay thereon corresponding to the pre-revised pay scale from which the pensioner had retired.” DOP&PW issued the orders thereon vide OM dated 1-9-2008.

4. DOP&PW vide OM No.38/37/08-P&PW(A) Dated 30th July, 2015, in compliance with the judicial pronouncements, had decided that the pension/family pension of all pre-2006 pensioners/family pensioners may be revised in accordance with this Department’s OM No.38/37/08-P&PW(A) dated 28.1.2013 with effect from 1.1.2006.

5. Para 5 of DOPPW OM dated 11-2-2009 had specifically been quashed by various Courts – including the High Court of New Delhi in WP(C) 3035/2016 dated 3-8-2016 in Ram Phal-vs-Union of India & Ors and CAT Bangalore in CP 237/2015 in OA 231/2013 (Parthasarthy-Vs-Union of India).

6. High Court of Kerala at Ernakulam had held as under in OP (CAT).No. 169 of 2015 (Z) in its judgment dated 18th January, 2016 UNION OF INDIA vs N.R.PURUSHOTHAMAN PILLAI:
“The resultant position that emerges from the pronouncement of the Central Administrative Tribunal as well as the different High Courts and the Apex Court is that, computation of pension in the matter of implementation of the 6th Pay Commission Report has to be at 50% of the pay scale with respect to the scale of pay applicable to the post in question and not to the corresponding scale of pay to the one at which the incumbent has retired.”

7. Regrettably the benefit of upgrading of posts was still not given to the Pre-2006 Pensioners in spite of the above cited judgments of various Courts. The benefit of the Court judgments on this had been restricted only to the Petitioners and not to other similarly placed Pre-2006 Pensioners.

8. This is totally discriminatory and violates Article 14 of the Constitution as well as under the settled law that the decisions taken in one specific case either by the Judiciary or the Govt. should be applied to all other similar cases without forcing the other employees or pensioners to approach the court of law for an identical remedy or relief.

9. Delhi High Court in W.P.(C) 8012/2013 had held that “policy decision of the Government in the OM dated September 01, 2008 to fix pension for all categories of pensioners did not classify post of pre January 01, 2006 retirees and all were entitled to pension as per a common formula”

10. It is, therefore, requested that Pre-2006 Pensioners be given the benefit of upgraded Pay Band and Grade Pay of the post from which they retired so that minimum pension be not lower than 50% of the pay in the revised pay band plus the grade pay corresponding to the post from which the pensioner retired – as per DOPPW OM dated 30-7-2015.

With reference to the subject mentioned above and in continuation of the CSIR letters of even number dated 11.05.2017 and 02.06.2017, the undersigned is directed to state that the matter has been considered by the Secretary, DSIR & Director General, CSIR in consultation with JS & FA,DSIR / CSIR and following has been decided:

a) Pension / Family pension for all pensioners (pre-2016 & post 2016) may be revised notionally in terms of CSIR circular letter No.5-1(428) / 2017 – PD dated 11.05.2017. For this notional revision of pension DoP&PW OM dated 04.08.2016, 12.05.2017, 06.07.2017, 18.07.2017 and Ministry of Finance, Department of Expenditure OM 23.05.2017 may be used.

b) Payment of revised pension / family pension (i.e monthly pension) to all the pensioners (both pre-2016 and post 2016) as per 7th CPC, from the month of September, 2017 onwards may be made.

c) Those retiring from the month of September, 2017 will be paid the eligible gratuity as per revised / enhanced ceiling and commutation of pension as per the 7th CPC pension amount.

d) Those who retired between 01-01-2016 and 31-08-2017 will be paid the difference in gratuity between the eligible amount as per revised ceiling and what they were paid at the time of retirement.

e) For the payment of arrears on account of revision of other pensionary benefits for the period 01.01.2016 to 31.08.2017 (viz., arrears of pension and the difference between original and revised commutation amount), separate instructions will follow. Therefore, these amounts of arrears will NOT be paid until further orders.

Attention is invited to previously issued OMs to Ministries/Departments/ AGs/UTs by CPAO on the subject mentioned obove. It is observed thot progress in disposal of such coses hos declined in spite of repeated requests for early settlement of pending coses and out of 89,481 cases,25,692 cases are still pending for revision. To avoid delay in payment of revised pension and arrear to the pensioners, special drive is required to clear these cases

It is requested to clear all the pending revision cases by 31st December, 2016.PAOs may be instructed to revise the remaining pending cases and send the revision authorities to CPAO for further authorization. It is also requested that in case some pending revisions are not covered under this OM, a certificate may be sent to CPAO in this regard so that these cases may be removed from the pendency list.

Subject: Revision of pension of Pre-2006 pensioners (JCOs/ ORs and Commissioned Officers) – delinking of qualifying service of 33 years for revised pension.

Reference: This office Circular Nos. 547 dated 11.09.2015, 548 dated 11.09.2015, 549 dated 30.09.2015, 551 dated 28.12.2015, 554 dated 14.01.2016, 562 dated 13.06.2016 and , 567 dated 16.09.2016.

A copy of GOI, MOD letter No.1(2)/2016-D(Pen/Pol) dated 30th September 2016 on the above subject is forwarded herewith for information and necessary action which is self explanatory.

2. Prior to issue of the above letter dated 30th September, 2016, the minimum guaranteed pension was revised w.e.f. 01.01.2006 as per GOI, MOD letter No.17(4)/2008(1)/D(Pen/ Policy) dated 11.11.2008 circulated vide this office Circular No. 397 dated 18.11.2008. Further, it was revised vide this office Circular Nos. 547 dated 11.09.2015 and 548 dated 11.09.2015. Similarly, the minimum guaranteed pension of Ordinary Family Pension was revised vide this office circular Nos. 397 dated 18.11.2008, 494 dated19.03.2013 and 567 dated 16.09.2016. Now, consequent upon the issue of the above Govt. letter dated 30th September 2016 , the consolidated revised pension ordinary family pension of all Pre-2006 Armed Forces pensioners/ Family pensioners w.e.f.1.1.2006 shall not be less than 50% and 30% respectively of the minimum of the pay in the Pay band plus Grade Pay corresponding to the pre-revised scale from which the pensioner had retired/ discharged/ invalided out/ died including Military Service Pay and ‘X’ group pay, if any, without pro-rata reduction of pension even if they had rendered qualifying service of less than 33 years at the time of retirement.

3. The revised consolidated enhanced rate of Ordinary Family Pension w.e.f. 01.01.2006 (consolidated as per Para-4 of GOI, MOD letter No.17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008) in respect of Pre-2006 Armed Forces Family Pensioners shall not be less than 50% of the minimum of the fitment tables for the rank in the revised pay band.

4. Revised tables indicating minimum guaranteed retiring/ service pension and ordinary family pension have been annexed to this letter as follows:-

Annexure- A for Commissioned officers (Army, Navy, Air Force)
Annexure- B for JCOs/ ORs Pensioners (Army)
Annexure- C for JCOs/ ORs Pensioners (Air Force)
Annexure- D for JCOs/ORs Pensioners (Navy)

5. Pension Disbursing Agencies (PDAs) are hereby authorized to step up the pension/ family pension of the affected pre-2006 pensioners where the existing pension being paid to the pensioners, is less than the rate of pension indicated in above said annexure.

6. The provisions of above Govt. letter shall take effect form 01.01.2006 and arrears, if any, shall be payable from 01.01.2006. Further, the Pension/ Family pension of the Armed Force Personnel has been revised a number of times in past vide various letters issued by Ministry of Defence, therefore, if pension already revised w.e.f. 01.01.2006, 01.07.2009, 24.09.2012 & 01.07.2014 (OROP) under respective Govt. orders happens to be more than this amount, then Retiring/ Service and Family Pension as per above orders will continue to be paid as basic pension during that period.

7. Prior to issue of above Govt. letter dated 30th September, 2016, this office has issued corrigendum PPOs on the basis of annexures mentioned in previous circulars for revision of minimum guaranteed pension for less than 15 years and 20 years of qualification service for JCOs/ ORs and Officers respectively. Now, consequent upon issue of the above Govt. letter dated 30th September, 2016, the revision of service element for less than 15 years and 20 years of qualification service for PBORs and Officers respectively will also be revised as per this circular only. Therefore, the Annexure for revision of service element as required by previous circulars is not necessary.

8. It is also mentioned that all cases of service element/ service pension in respect of War Injury Pensioners will be revised by the Pension Disbursing Agencies (PDAs). Therefore, the revision claims in respect of War Injury pensioners called for vide this office Circular No. 562 dated 13.06.2016 has been dispensed with henceforth.

9. Further, no table for Hony. Naik, Hony. Havildar and Havildar granted Hony. rank of Nb Subedar has been indicated. It is hereby clarified that since Hony. Rank of Naik, Havildar and Havildar holding Hony rank of Nb Sub are drawing pay in the pay scale of Sepoy, Naik and Havildar respectively, therefore, they are entitled for modified parity with reference to substantive rank held at the time of retirement/ discharge/ invalidment except Naik (TS) who draws the pay of Naik. Naik (TS) should be entitled for modified parity with respect to Naik rank.

10. Provisions of this circular will also be applicable to pensioners of TA and DSC (irrespective of single or dual pension).

11. LTA and Additional Pension will be regulated as per extant orders.

12. All other terms and conditions shall remain unchanged.

The Ministry of Personnel, Public Grievances and Pensions has released the office memorandum F.No.38/37/2016-P&PW(A)(ii) dated 4th August 2016 of the 7th pay panel’s recommendations for the pensioners. As per the 7th Pay Commission Pension Order, the retired central government employees will now get a minimum pension of Rs 9,000, from the current Rs 3,500.

As per Office Memorandum, para 4.4

“4.4. The minimum pension with effect from 01.01.2016 will be Rs. 9000/- per month (excluding the element of additional pension to old pensioners). The upper ceiling on pension/family pension will be 50% and 30% respectively of the highest pay in the Government (The highest pay in the Government is Rs. 2,50,000 with effect from 01.01.2016).”

Also refer para 5 in the above said OM

“5. Where the revised pension /family pension in terms of paragraph 4.1 above works out to an amount less than Rs. 9000/-, the same shall be stepped up to Rs. 9000/-. This will be regarded as pension/family pension with effect from 1.1.2016.”

So, the Minimum pension will be Rs. 9000/- and maximum pension will be 2,50,000 with effect from 01.01.2016.

Multiplication Factor:

Basic pension shall be multiplied by 2.57 As per para 4.1 in the above said order,
“4.1 For existing pensioners, who have retired before 01.01.2016, the revised pension/family pension with effect from 01.01.2016 shall be determined by multiplying the pension/family pension, as had been fixed at the time of implementation of 6th Central Pay Commission (CPC) recommendations, by 2.57. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.”

Pension payments to Central / State Government pensioners by Agency banks – Compensation for delay
Please refer to our circular DGBA.GAD.No.H-6212 / 45.01.011 / 2010-11 dated March 11, 2011, on the captioned subject, wherein we had advised the agency banks that all the pensioners, including non-State resident pensioners, would be compensated for delay in credit of pension / revised pension / arrears, for the delayed period beyond the due date at the “Bank Rate plus two per cent” penal interest.
2. Recently. the Bank Rate, which was kept unchanged at 6 per cent since April 2003, has been aligned with Marginal Standing Facility (MSF) rate and currently stands at 9.5 %. Henceforth, whenever there is an adjustment to the MSF rate, the Reserve Bank will consider and align the Bank Rate with the revised MSF rate.

3. It has now been decided todelink the penal interest levied for delayed credit of pension / revised pension / arrears, from the Bank Rate plus two per cent, and charge a fixed interest rate of 8 per cent on such delays. This rate will be subject to review by RBI as considered appropriate.

4. You may please issue suitable instructions to your concerned Regional Offices / branches authorized to disburse pension, accordingly.

5. Please acknowledge receipt.
