<p>Subject: <strong>Drawal of next increment under Rule 10 of Central Civil Services (Revised Pay) Rules, 2016 &#8211; regarding.</strong></p>



<p>The undersigned is directed to refer to para 8(i) of the Ministry of Home Affairs U.O. No. 300/14/Pr.A.O./Admn/ MHA/23/2018-19/456 dated 29.04.2019 seeking clarifications regarding drawal of next increment, referring the instructions contained in Department of Expenditure Office Memorandum No. 4-21/2017-IC/E.IIIA dated 31.07.2018, as to whether an employee promoted or getting financial upgrdation on 01.07.2016 and granted two increments i.e. first annual increment and second promotional increment, is eligible for his next increment after completion of six months period on 01.01.2017 or after expiry of one year period on 01.07.2017.</p>

<p>2. The matter has been examined in this Department. In terms of the instructions contained in this Department’s above referred O.M. dated 31.07.2018, the employees who are getting promotion/financial upgradation on 1st July and receiving the benefit of two increments i.e. the first annual increment due on 1st July and the second notional increment on account of promotion, will accrue their subsequent increment on the following 1st January, after completion of six months period.</p>

<p>Subject:- <strong>Stepping up of pay-Consolidated guidelines-reg.</strong></p>
<p>The undersigned is directed to say that the issue of anomaly relating to senior Government employees drawing less pay than their juniors due to application of provisions of FR 22(I)(a)(1) is considered on merits for allowing stepping up pay of the seniors so as to bring it at par with that of the junior in accordance with the guidelines scattered in various OMs noted in the margin. A need has been felt to consolidate guidelines on stepping up of pay at one place keeping in view the provisions of the Central Civil Services (Revised Pay) Rules, 2016, [in short CCS(RP)Rules, 2016] as the frequent references on such issues continue to be received in this Department.</p>
<p>2. Consequent upon implementation of CCS(RP)Rules, 2016, the President is pleased to decide the following:</p>
<p>(i) In order to remove the anomaly of a Government servant promoted or appointed to a higher post on or after 1-1-2016 drawing lower pay in that post than another Government servant junior to him in the lower grade and promoted or appointed subsequently to another identical post, the pay of the senior Government servant in the higher post should be stepped up to a figure equal to the pay as fixed for the junior Government servant in that higher post. The stepping up should be done with effect from the date of promotion or appointment of the junior Government servant and will be subject to the following conditions, namely:</p>
<blockquote><p>(a) both the junior and the senior Government servants should belong to the same cadre and the posts in which they have been promoted are identical in the same cadre;</p>
<p>(b) the Level in the Pay Matrix of the lower and higher posts in which they are entitled to draw pay should be identical;</p>
<p>(c) the anomaly is directly as a result of the application of the provisions of Fundamental Rule 22(I)(a)(1) read with Rule 13 of CCS(RP)Rules, 2016. For example, if the junior officer was drawing<br />
more pay in the existing pay structure than the senior by virtue of any advance increments granted to him, the provisions of this subrule should not be invoked to step up the pay of the senior officer.</p></blockquote>
<p>(ii) The order relating to re-fixation of the pay of the senior officer in accordance with clause (i) shall be issued under Fundamental Rule 27 and the senior officer shall be entitled to the next increment on completion of his required qualifying service with effect from the date of re-fixation of pay.</p>
<p>3. The following instances/events wherein juniors draw more pay than seniors, do not constitute anomaly and, therefore, stepping up of pay will not be admissible in such events:</p>
<blockquote><p>(a) Where a senior proceeds on Extra Ordinary Leave which results in postponement of his Date of Next Increment in the lower post and consequently he starts drawing less pay than his junior in the lower grade itself. He, therefore, cannot claim pay parity on promotion even though he may be promoted earlier to the higher grade than his junior(s);</p>
<p>(b) If a senior forgoes/refuses promotion leading to his junior being promoted/appointed to the higher post earlier and the junior draws higher pay than the senior.</p>
<p>(c) If the senior is on deputation while junior avails of the ad-hoc promotion in the cadre, the increased pay drawn by the junior due to ad-hoc/officiating and/or regular promotion following such adhoc promotion in the higher posts vis-à-vis senior, is not an anomaly in strict sense of the term;</p>
<p>(d) If a senior joins the higher post later than the junior, for whatsoever reasons, whereby he starts drawing less pay than the junior. In such cases, senior cannot claim stepping up of pay at par with that<br />
of his junior.</p>
<p>(e) If a senior is appointed later than the junior in the lower post itself whereby he is in receipt of lesser pay than the junior, in such cases also the senior cannot claim pay parity in the higher post if he draws less pay than his junior though he may have been promoted earlier to the higher post.</p>
<p>(f) Where an employee is promoted from lower post to a higher post, his pay is fixed with reference to the pay drawn by him in the lower post under FR22(I)(a)(1) read with Rule 13 of CCS(RP)Rules, 2016 and due to his longer length of service in the lower grade, his pay may get fixed at a higher stage than that of a senior direct recruit appointed to the same higher grade and whose pay is fixed under different set of rules. For example a Senior Secretariat Assistant (SSA) on promotion to the post of Assistant Section Officer (ASO) gets his pay fixed under FR 22(I)(a)(1) with reference to the pay drawn in the post of SSA, whereas the pay of ASO(DR) is fixed under Rule 8 of CCS(RP)Rules, 2016 at the minimum pay or the first Cell in the Level, applicable to ASO to which he is appointed. In such a case, the senior ASO (DR) cannot claim pay parity with that of the promotee junior ASO.</p>
<p>(g) Where a senior is appointed in higher post on ad-hoc basis and is drawing less pay than his junior who is appointed in the same cadre and in same post on ad-hoc basis subsequently, the senior cannot claim pay parity with reference to the pay of that junior since the ad-hoc officiating service in higher post is reversible and also since full benefits of FR22(I)(a)(I) are not available on ad-hoc promotion but only on regular promotion following such ad-hoc promotion without break.</p>
<p>(h) Where a junior gets more pay due to additional increments earned on acquiring higher qualifications.</p></blockquote>
<p>Note: The above instances/events are only illustrative and not exhaustive.</p>
<p>4. These orders shall be in supersession of D/o Expenditure’s OM No.F.2(78)-E.III(A)63 dated 2nd February, 1966 and DOP&amp;T’s OM No.4/7/92-Estt(Pay-I) dated 4th November, 1993.</p>
<p>5. This OM is effective from 0 1.01.2016.</p>
<p>6. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders have been issued after consultation with the Comptroller and Auditor General of India.</p>

<p>Subject: <strong>Payment of overtime Allowance (OTA) in the revised pay to the employees of Defence Industrial Establishments governed by the Factories Act, 1948</strong>.</p>
<p>Consequent upon revision of pay structure as per VII CPC recommendations, the matter regarding payment of OTA, as per revised pay, to the employees of the Defence Industrial Establishments under the Factories Act, 1948 has been considered in consultation with the Ministry of Labour &amp; Employment, Ministry of Finance and Ministry of Law &amp; Justice.</p>
<p>2. It has been decided that the Overtime Allowance shall be paid to the employees of the Defence Industrial Establishment governed by the Factories Act, 1948 on the basis of revised wages with effect from the date the wages have been revised i.e. 1.1.2016. The OTA on the basis of revised wages is subject to the conditions stipulated in this Ministry&#8217;s OM No. 14(1)/97/D(Civ-11) dated 1st July 1998.</p>
<p>3. It is further added/clarified that those categories of &#8220;workers&#8221; who come within the scope of Section 64 of the Factories Act and whose basic pay exceed the wage limit, as specified in sub-section (6) of Section (1) of the Payment of Wages Act, 1936, are entitled for payment of OTA in terms of MoD OM No. 14(2)/76/D(Civ-II) dated 25.06.1983 on the basis of wage limit notionally determined. Accordingly, OTA will be paid to them on the basis of wage limit notionally determined on the basis of old pay scales until the new wage limit is defined by the Ministry of Labour &amp; Employment based on the consumer expenditure survey published by NSSO. Thereafter, the OTA will be paid to them on the basis of new wage limit notionally determined, if the basic pay exceeds the new wage limit.</p>
<p>The other conditions as laid down in this Ministry&#8217;s letter No. 14(1)/97/D(Civ-II) dated 1st July. 1998 shall remain unchanged</p>
<p>4. This issues with the concurrence of MoD(Finance/AG/PB) vide their Dy No. 1 04/AG/PB dated 15.02.2018 and after consultation with Ministry of Labour &amp; Employment vide their ID No. Z-16025/09/2017-ISH-II dated 13.11.2017</p>

<p>Sub: <b>Seventh Central pay Commission&#8217;s recommendations &#8211; revision of pay scales &#8211; amendment or Service Rules/Recruitment Rules.</b></p>
<p>The undersigned is directed to refer to this Department&#8217;s OM or even number dated 9th August. 2016 the subject mentioned above wherein it was requested that as per the CCS (Revised pay) Rules, 2016 issued by Department or Expenditure vide Notification dated 25th July, 2016, consequential amendment in the existing Service Rules.&#8217;Recruitment Rules shall be made by the Ministries/Departments by substituting the existing pay Band and Grade pay by the new pay &#8220;<strong>LEVEL in the PAY MATRIX</strong>&#8221; straightaway without making a reference 10 the Department of Personnel and Training Public Service Commission (<strong>UPSC</strong>).</p>
<p>2. Further, DoP&amp;T vide of even number dated 16.02.2017 sought information with regard to implementation of OM dated 09.08,2016. The issue is being monitored by higher authorities; however, so far this Department has not received any information from Ministries/Departments even a lapse of over a year. It has been decided to hold a meeting, under the Championship or JS (E), with all Ministries/Departments on 04.01.2018 in Room No.190, North Block, New Delhi.</p>
<p>3. All Ministries/Departments are requested to furnish a status report regarding amendment Of Recruitment Rules in pursuance of DoP&amp;T OM dated 09/08/2016 in the annexure-II enclosed herewith. The schedule or the meeting is as per Annexure-I.</p>

<p><strong>Sub :- Adoption of clarification issued by Ministry of Finance regarding modifications of Level-13 of Pay Matrix.</strong></p>
<p>Modifications to Railway Services (Revised Pay) Rules, 2016 were notified vide Gazette Notification No. G.S.R 882(E) dated 14.07.2017 thereby making changes in Level-13 of the Pay Matrix.</p>
<p>2.Now, Ministry of Finance (Department of Expenditure) vide their O.M No. 4-6/2017-IC/E-III(A) dated 28.09.2107 (copy enclosed) has issued detailed clarifications addressing the following issues arising out of the modification to Level-13 of the Pay Matrix:</p>
<p>(i) <strong>Issue No. 1</strong> &#8211; Whether pay in the Level-13 is to be fixed by multiplying by a factor of 2.57 or 2.67</p>
<p>(ii) <strong>Issue No. 2</strong> &#8211; Pay re-fixed in the modified Level-13 working out lower than the pay fixed in the earlier Level-13.</p>
<p>(iii) <strong>Issue No. 3</strong> &#8211; Re-exercise of option for coming over to the Revised pay structure in case of Level-13.</p>
<p>3. The clarifications issued by Ministry of Finance (Department of Expenditure) vide their O.M dated 28.09.2017 will be applicable mutatis mutundis in Railways with respect to RS(RP) Rules, 2016 and amendment notified on 14.07.2017. However, the period for any recovery or waving off recovery will be upto 31.07.2017 as the amendments to the RS(RP) Rules, 2016 were notified in July, 2017. Similarly, the time period for re-exercise of options, if any, as mentioned in para-15 of the enclosed O.M will count from the date of issue of this letter.</p>
<p>4.The cases of employees who retired on or after 01.01.2016 and upto 31.07.2017 and if covered under para 12 of Ministry of Finance’s OM dated 28.09.2017, shall be processed as per Rule 90 of Railway Services (Pension) Rules, 1993.</p>

Sir/Madam,</p>
<p>In continuation to KVS circular of even number dated 03.08.2017 I am directed to refer to MHRD’s letter No. F. 3-14/2017-UT.2 dated 31.10.2017 and to convey the approval of the Govt. of India for implementation of revised allowances based on the recommendations of the 7th CPC in KVS. The MHRD has agreed for additional funds to the extent of implementation of revised allowances in terms of Department of Expenditure (MoF) O.M. F. No. 1/1/2016-E.III(A) dated 26.07.2017.</p>
<p>It is further clarified that Department of Expenditure (MoF) O.M. F. No. 1/1/2016-E.III(A) dated 13.01.2017 is applicable only in case of pay scales and not in case of pension as such additional funds for the purpose of pension may not be allowed while implementing the revised pay scale and allowances in KVS.</p>

<p>Subject: <strong>Implementation of Government&#8217;s decision on the recommendation of the VIIth Pay Commission on CCS (Extraordinary Pension) Rules, 1939 &#8211; Constant Attendant Allowance &#8211; regarding.</strong></p>
<p>In continuation of this Department&#8217;s OM No.1/4/2017-P&amp;PW(F) dated 2nd August 2017, revising the Constant Attendant Allowance from the existing Rs.4500/- p.m to Rs.6750/- p.m, it has also been decided that the rate of Constance Attendant Allowance payable to the Civilian pensioners shall be increased by 25% every time the dearness allowance on the revised Pay in the Pay Matrix increases by 50%.</p>
<p>2.All other terms and conditions of this Department&#8217;s OM NO. 1/4/2017-P&amp;PW(F) dated 2nd August 2017 will remain the same.</p>
<p>3.In so far as persons belonging to Indian Audit and Accounts Department, these orders issue after consultation with the Comptroller &amp; Auditor General of India.</p>
<p>4.These orders are issued with the concurrence of the Ministry of finance (Department of Expenditure) vide, their OM No.11-1/2016-IC dated 11.07.2017 and ID NO.11-1/2016-IC/Pt dated 25.07.2017</p>

<p>Sub: <strong>Recommendations of 7th Central Pay Commission- bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016. </strong></p>
<p>Attention is hereby invited to this Office OM of even number dated 23 rd February, 2017 on the subject cited above vide which the pay details of Shri Babu Balram Jee, AAO, CPWD, lBBZ-l, Malda M/o Urban Development were made available so that benefit of bunching may be extended to eligible AAOs in adherence to the Department of Expenditure OM No. 1-6/2016-IC dated 7th September, 2016.</p>
<p>Further, Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance has issued clarifications in this regard vide OM No.1-6/2016-IC dated 3rd August, 2017 (copy enclosed).</p>
<p>All respective accounting units of Ministries/ Departments concerned are advised to review all cases wherein benefit on account of bunching has been extended in terms of this office OM dated 23rd February, 2017 and in adherence to DoE OM No. 1-6/2016-lC dated 7th September, 2016 and to re-fix the pay in terms of Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance OM No.1-6/2016-lC dated 3 rd August, 2017.</p>
<p>Accordingly, clarifications sought in this regard from various accounting units of Ministries/Departments concerned may be treated as disposed of.</p>
<p>This issues with the approval of the competent authority.</p>

<p>Sir/Madam,</p>
<p>I am directed to convey the approval of the competent authority for the adoption of the revised Pay Scales as per the 7th Central Pay Commission (CPC) to the employees of Kendriya Vidyalaya Sarigathan (both teaching and non­ teaching) as per the Pay Matrix as contained in Part-A of the schedule of Central Civil Services (Revised Pay) Rules, 2016 as well as the principle of pay fixation as contained in the said rules as notified by Ministry of Finance, Government of India vide their notification dated 25.07.2016 in respect of Central Government employees. The post wise details of the revised pay scales are given in Annexure-I.</p>
<p>&nbsp;</p>
<p>The following conditions are to be taken care of while implementing the 7th CPC in KVS :-</p>
<blockquote><p>a) The revised pay structure shall be admissible to those employees who opt for the same in accordance with the extent Rules.</p>
<p>b) Deductions on account of Provident Fund, Contributory Provident Fund or National Pension Scheme, as may be applicable, will have to be made on the basis of the revised pay w.e.f. the date an employee opts to elect the revised pay structure.</p>
<p>c) Until further orders the existing allowances in KVS shall continue to be admissible as per the existing terms and conditions irrespective of the revised pay scales adopted.</p>
<p>d) There will be no payment of arrears to the employees which will accrue to them on account of the revision of pay as the same has been put on hold by Ministry till additional budget allocation on this account is made available</p></blockquote>
<p>2. A copy of Gazette Notification No.1-2/2016-IC dated 25.07.2016 issued by Ministry of Finance Department of Expenditure as Central Civil Services (Revised Pay) Rules 2016, Memorandum No. 1-5/2016-IC dated 29.07.2016 and OM No.1- 5/2016-IC dated 01.08.2016 are forwarded for necessary information and guidance as (Annexure-II, III &amp; IV) respectively.</p>
<p>&nbsp;</p>
<p>3. Copy of Form of Option is attached as Annexure-V. The Option shall be obtained from the employees within 03 months from the date of issue of this letter, in duplicate. The statement of fixation of pay under Central Civil Services (Revised Pay) Rules, 2016 is attached as Annexure-VI. The same may be prepared with reference to the pre-revised scale and the corresponding revised Pay Matrix level as per 7thCPC, in duplicate. Each employee has to submit an undertaking. A copy of undertaking is attached as Annexure-VII.</p>
<p>&nbsp;</p>
<p>4. The option for revised pay scales may be obtained in prescribed proforma in duplicate. A copy of the same may be pasted in the service book of the employee concerned while the other copy along with a statement of fixation of pay as per Annexure-VI ibid may be sent to the Finance Officer of the Region in case of Kendriya Vidyalayas and Regional Offices for verification and approval. The Finance Officer shall retain the copy of the option exercised by the employee along with one copy of the statement of fixation of pay for record in his office, while the second copy of the statement will be returned to the Vidyalaya concerned after approval. On receipt of the statement of fixation of pay duly verified and approved from the Finance Officer, the Principal/ Deputy Commissioner will paste the same in the service book of the employee concerned.</p>
<p>&nbsp;</p>
<p>5. Options in respect of Deputy Commissioners / Assistant Commissioners and Administrative Officers of Regional Offices, whose service books are maintained in the Headquarters will be sent to Assistant Commissioner (Establishment-f) KVS Hqrs along with the statement of fixation of pay.</p>
<p>&nbsp;</p>
<p>6. The pay can be drawn as per revised scale for all the teaching&#8221; and non­ teaching staff of KVS on the basis of pay fixation statement without awaiting approval of the Finance Officer of Regional Office concerned /KVS (Hqrs) in view of specific undertaking in Annexure-VII ibid. Similar action can also be taken in case of staff of Regional Offices.</p>
<p>&nbsp;</p>
<p>7. Copy of this circular may be sent to all Kendriya Vidyalayas functioning under your administrative jurisdiction for implementation immediately under intimation to KVS (Hqrs).The nomenclature of posts mentioned at Sr. No. 19, 20, 23 &amp; 27 is that of Assistant Section Officer, Senior Secretariat Assistant and Junior Secretariat Assistant as already notified vide KVS circular dated 26.12.2016. However, while issuing orders of pay fixation, the’ nomenclatures such as Assistant, UDC, LDC only may be used as the matter of change of nomenclature of these posts is under examination.This issues with the approval of competent authority.Hindi version of this letter will follow</p>

<p>With due regards, your attention is invited to the Anomalies Committee meeting held on 26.12.2016 under the Chairmanship of AS(J) Shri J Rama Krishna Rao wherein we have reflected our concern over the delay in the revision of statutory nature allowance (Over Time Allowance under the Factories Act, 1948) in defence establishments.</p>
<p>In turn, the AS(J) pleased and instructed to resolve the matter of the payment of Over Time Allowance as per revised pay consequent to implementation of 7<sup>th</sup> CPC recommendations.</p>
<p>Therefore, you are requested to take necessary action so that the issue of the payment of overtime allowance in defence establishments on the revised pay of 07<sup>th</sup> CPC may be resolved without further delay.</p>
