<h3 class="wp-block-heading">Subject:- Pay Rules/ Regulations, 2017 for Army/ Navy/ Air Force officers, MNS, JCOS/OR &amp; equivalent- Opportunity for revision of Option to come over to revised Pay Structure.</h3>



<p>Sir,<br />I am directed to refer to Rules 5 &amp; 6 of Pay Rules/ Regulations 2017 for Defence Personnel regarding exercise of option to come over to the revised pay Structure effective from 01.01.2016 as notified by the Pay Rules/Regulations for Defence personnel and to state that the said option was to be exercised within one hundred and eighty days from the date of the notification i.e. 03.05.2017, 30.06.2017 (for NCs(E)) and 14.07.2017 (for MNS), of the said Rules. In this regard vide MoD letter No. 1(29)/2017/D (Pay /Services) dated 06 Aug 2019 an Opportunity to revise the option to come over to revised pay structure was provided. The following Pay Rules/ Regulations, 2017 have been issued for Defence Personnel:-</p>



<p>(a) Army Officers Pay Rules, 2017.<br />(b) Navy Officers Pay Regulations, 2017.<br />(c) Air Force Officers Pay Rules, 2017.<br />(d) Military Nursing Service Pay Rules, 2017.<br />(e) Army Pay Rules, 2017.<br />(f) Navy Pay Regulations, 2017.<br />(g) Air Force Pay Rules, 2017.<br />(h) NCs (E) of Air Force Rules- 2017.</p>



<h3 class="wp-block-heading">7th Pay Commission &#8211; Opportunity for revision of Option for Defence Personnel</h3>



<p>2. Personnel of Army/ Navy/ Air Force/ MNS/ NCs(E) who were promoted/ financially upgraded between 01.01.2016 and the date of Notification of Pay Rules by this Ministry i.e. 03.05.2017 and who have been requesting for re-exercising of option to switch over to the 7th CPC structure&nbsp;<strong>shall be permitted to re-exercise their option in terms of Rules 5 &amp; 6 thereof</strong>. The revised option shall be exercised within a period of&nbsp;<strong>one hundred and eighty days</strong>&nbsp;from the date of issue of this letter. The option exercised in terms of these orders shall be final and shall not be liable to any further change under any circumstances. All other terms and conditions laid down in the Said Rules 5 &amp; 6 of Pay Rules/Regulations 2017 shall continue to be applicable.</p>



<p>3. The personnel covered under this letter May also be given Opportunity<strong>&nbsp;to revise option for fixation of Pay as per provision of FR22 (i)(a)(1).</strong></p>



<p>4. The other conditions contained in MoF(DoE) OM No. dated 31.07.2018 and 28.11.2019 as adopted by this Ministry, may be duly followed.</p>



<p>5. This issues with the approval of Ministry of Finance vide their ID No. 03-04 /2022- E.IIIA dated 09.05.2023 and concurrence of Defence( Finance) vide their ID Note No. 1(8)2017-AG/PA/ 85-PA/Part-I dated 15.05.2023.</p>

<p>Kindly refer your office letter AC II/ Pen/VJA/ Corr/Vol.11/2018 dated 04.05.2020 seeking clarifications on Department of Expenditure OM 4-13/17-IC/E-II A dated 12.12.2018, providing an opportunity to government servants for revision of option to come over to the revised pay structure as notified in CCS (RP) rules 2016.</p>



<p>2. DoE OM dated 04.05.2020, permitted another opportunity to Central Government employees who have already exercised their option to come over to the revised pay structure as notified by <a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" rel="noreferrer noopener">CCS</a> (RP) 2016 to revise their initial option in terms of Rule 5 &amp; 6 thereof. The provisos of Rule 5 of RP rules 2016 are self-explanatory: Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure and for those Government Servants who has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation as the case may be, with explanation 1 under Rule 5 as the option to retain the existing pay structure under the provisos to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.</p>

On the foregoing facts it is hereby clarified that DoE OM 12.12.2018 permits employees who have already exercised option to come over to the revised pay structure or to retain the old pay structure from 01.01.2016 till the date of issue of OM, to revise their initial option in terms of Rule 5 &amp; 6 thereof.</p>



<p>4. Hence it is requested to settle the grievances of officials/ officers on the subject matter at your end on the basis of above clarification.</p>

<p>I am directed to forward herewith letter No. 7-11/7th CPC pay fixation dated 16-12-2019 from General Secretary, National Association of <a href="https://centralgovernmentnews.com/category/postal-department/" target="_blank" rel="noreferrer noopener" aria-label="postal Employees (opens in a new tab)">postal Employees</a> Group C, addressed to secretary (Post), regarding the wrong practice of DAP, Hyderabad, issuing clarification dated 22.05.2019 [ Read ] on DoE OM 4- 13/17-IC/E-III A dated 12-12-2018.at their level.</p>



<p>The matter has been examined at this end and the competent Authority has directed to withdraw the impugned order dated 22-05-2019 issued by PAO, AP circle Hyderabad. The matter may be referred to this office for seeking clarification on the OM of DoE dated 12.12.2018, mentioning specific cases of officers/ officials with service particulars.</p>

<p>The Clarification dated 22.5.2019 issued by by PAO, AP circle Hyderabad in respect of Opportunity to revision of option to come over to CCS (RP) Rules 2016</p>



<p><strong>Point of doubt:-</strong> In view of M.F. O.M. No.4-13/17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial up-gradation in Feb/ March/ August/ September, 2017 and December 2018 are eligible to exercise revised option to come over to revised pay structure on the date of their financial up-gradation under MACPS.</p>

<p><strong>Clarification:</strong> The Central Govt. employees have been permitted another opportunity to revise their initial option to come into revised pay structure in terms of Rules 5 &amp; 6 thereof of CCS (RP) Rules, 2016 vide M.F. OM No. 4-13/17-IC/E-IIIA dated 12-12-2018. Wherein, it has been also repeated to make the meaning clear that all other terms and conditions as laid down in the said Rules 5 &amp; 6 shall continue to be applicable for the revised options. As per the second provision of the Rule 5, in cases where a Government servant has been placed in a higher grade pay or scale between 1st January 2016 and the date of notification of these rules on account of promotion or up-gradation, the Government servant may switch over to the revised pay structure from the date of such promotion or up-gradation, as the case may be. Hence it is clarified that the officials who are awarded promotion /financial up-gradation after the date of notification of the CCS (RP) Rules, 2016 (i.e. 25.07.2016 are not entitled to exercise option/revised option-to come over to the revised pay structure on the date of their promotion /financial up-gradation.</p>



<p><strong>Point of doubt:</strong> In view of M.F., O.M. No.4-13/17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial up-gradation in Feb/March, 2017 under MACPS are eligible to exercise revised option to come over to revised pay structure on the date of their subsequent increment in pre revised pay structure (i.e. on 01.07.2017).</p>



<p><strong>Clarification:</strong> As furnished in the clarification on point of doubt – 1 above, all other terms and conditions as laid down in the Rules 5 &amp; 6 thereof shall continue to be applicable for exercising revised option. As per the first provision of the Rule 5, a Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases ‘to draw pay in the existing pay structure. As per explanation-1 under the Rule 5, the option to retain the existing pay structure under the provisions to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or Scale.</p>



<p>Further, switching over to the revised pay structure either on 01-01-2016 or from a later date than 01-01-2016 i.e. on the date of promotion /up-gradation or the date next /any subsequent increment, are applicable under Rule 5 in case of post /Pay Band or Grade Pay held on 01-01-2016. Thus, if the date of next or any subsequent increment (i.e. on 01-07-2016 or any subsequent date of increment) for a post /Pay Band or Grade Pay held on 01-01-2016 falls after the date of promotion, then the date of next/any subsequent increment for the post /Pay Band or Grade Pay held on 01-01-2016 has no relevance for option, as this post /Pay Band or Grade Pay on 01.01.2016 is no longer held on the date of next /any subsequent date of increment.</p>



<p>Hence, it is clarified that the officials who are awarded promotion /financial up gradation under MACPS prior to the next or any subsequent date of increment in the pre revised pay structure are_not entitled to exercise option/revised option to come over to revised pay structure on the date of next or any subsequent date of increment i.e. 01.07.2017 ete., (With regards to the said clarification this office Lr. No. No.669/PM-II /IFA/Genl./7thCPC Pay fixation dated 23.07.2018 addressed to the AO(IFA), O/o the Postmaster General, Visakhapatnam by endorsing copies to all the Regional Offices and the Divisional Heads may also be referred to.)</p>



<p><strong>Point of doubt on Method of fixation of pay</strong>: As per the representations, the officials are seem to be on the opinion that fixation of their pay on promotion/up-gradation on or after 01-01-2016 will be done first in pre-revised pay structure (6th CPC) and then (after placement to the promotional grade in pre revised pay structure), the revision of pay in the revised pay structure will be done as per Rule 7 of CCS (RP) Rules, 2016.</p>



<p><strong>Clarification</strong>: In case of an admissible option is exercised to come over to revised pay structure on the date of promotion/up-gradation or on the date of next/any subsequent increment in pre revised pay structure; revision of pay will be made first as prescribed in clause A of sub rule 1 under Rule 7 of the CCS (RP) Rules, 2016 w.r.t. the existing basic pay in pre revised pay structure i.e. in the prescribed existing Pay Band and Grade Pay, and after switching over to the revised pay structure, the fixation of pay on promotion (after 01.01.2016) shall be made as prescribed in rule 13 of the CCS(RP) Rules, 2016.</p>

<p><strong>Finance Ministry order for opportunity to revise option to come over to 7th CPC Pay Scale.</strong></p>



<p>Department of Expenditure, Ministry of Finance issued OM 4- 13/17-IC/E-III A dated 12-12-2018. in the matter of giving one more opportunity to revise option to come over to <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener" aria-label="7th CPC (opens in a new tab)">7th CPC</a> Pay Scale.</p>



<p>This OM issued to invite attention to Rules 5 &amp; 6 of the CCS (RP) Rules, 2016 regarding exercise of option to come over to the revised pay structure effective from 1.1.2016 as notified by the CCS(RP) Rules, 2016 and to say that the said option was to be exercised within 3 months of the date of notification, i.e., 25.7.2016, of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final,</p>



<p>The Staff Side of the National Council (JCM) has requested that employees may be given another opportunity to re-exercise their option in view of certain hardships caused to certain employees. A number of references have also been received in this Ministry, proposing that the affected employees may be given an opportunity to re-exercise their option.</p>



<p>The matter has been considered and the President is pleased to decide that in relaxation of the stipulation contained in Rule 6(4) of CCS(RP) Rules, 2016, the Central Government employees, who have already exercised their option to come over to the revised pay structure as notified by the CCS(RP) Rules, 2016, shall be permitted another opportunity to revise their initial option in terms of Rules 5 &amp; 6 thereof. The revised option shall be exercised within a period of 3 months from the date of issue of these orders. The option once exercised in terms of these orders shall be final and shall not be liable to any further change under any circumstances. All other terms and conditions as laid down in the said Rules 5 and 6 shall continue to be applicable.</p>



<p>It is obvious that in respect of those employees who have already exercised option to come over to the revised pay structure from 01.01.2016 itself or in whose case the revised pay structure took effect from 01.01.2016 and who re-exercise their option under these orders to come over to the revised pay structure from a date subsequent to 01.01.2016 as per Rule 5 of CCS (RP) Rules, 2016, the arrears on account of revised pay already drawn by them from 01.01.2016 up to the date from which they now opt to come over to the revised pay structure shall be recovered.</p>

<p>Vide Board&#8217;s letter dated 10.04.2018 (RBE No.56/2018) higher grade pay of Rs. 2000/- was made applicable to all the Drivers Gr. III (Constable) of RPF/RPSF only who are similarly placed as compared to the petitioners in W.P. No. 15763/2013.</p>

<p>In this connection, a reference was received seeking clarification as to whether direct recruited Driver Gr.III of RPF/RPSF {who were enlisted in service as Driver Gr. III on 15.07.2010 in the pay scale of Rs. 5200-20200 + GP Rs. 1900/-) are to be treated at par with the petitioners of Writ Petition No. 15763/2013 (Shri Valibhai Y Darvodiya &amp; 17 Ors Vs CSC/ RPF,  CCG/ Mumbai and DC /RPF) for the purpose of granting {higher grade pay of Rs. 2000/-.</p>



<p>The matter has been examined in depth and it is accordingly clarified that all the Drivers Gr.III of RPF/ RPSF are to be considered similarly situated as the petitioners in W.P.No. 15763/2013 for grant of higher grade pay of Rs. 200/-.</p>



<p>4. Further, the recruitment at the revised upgraded pay in future will be made after duly incorporating the revised pay in the relevant Recruitment Rules.</p>



<p>This issues with the concurrence of Finance Directorate of this Ministry.</p>

<p>Following the O.M.No.4-13/17/IC/E-IIA  dated 12th December, 2018 issued by the Department of Expenditure, Ministry of Anance on the opportunity for revision of option to come over to reyised pay structure, this office has received references seeking clarification on the eligibility of the officials for exercising revised option from some of the units namely; O/o CPMG &#8211; Vijayawada, HRO &#8211; &#8216;V&#8217; Division and Waltair RS HO in Visakhapatnam Division in A.P. Circle. The matter has been perused with reference to the OM dated 12.12.2018 and the CCS (RP) Rules, 2016 and the point of doubts are clarified as under:-</p>



<p>1. <strong>Point of doubt</strong> : In view of M.F., O.M. No.4-13/17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March/ August/ September, 2017 and December 2018 are eligible to exercise revised option to come over to revised pay structure on the date of their financial up-gradation under <strong>MACPS</strong>.</p>



<p><strong>Clarification</strong>:- The Central Govt. employees have been permitted another opportunity to revise their Initial option to come into revised pay structure in <strong>terms of Rules 5 &amp; 6 thereof of CCS (RP) Rules, 2016</strong> vide M.F., OM No.<br /> 4-13/ 17-IC/E-IIIA dated 12-12-2018. Wherein, it has been also repeated to make the meaning dear that <strong>all other terms and conditions as laid down in the said Rules 5 &amp; 6 shall continue to be applicable for the revised options. </strong>As per the second provision of the Rule 5, in cases where a Government servant has been placed in a higher grade pay or scale between 1st January 2016 and the date of notification of these rules on account of promotion or up-gradation, the Government servant may switch over to the revised pay structure from the date of such promotion or up-gradation, as the case may be. <strong>Hence it is clarified that the officials who ace awarded promotion/ financial upgradation after the date of notification of the CCS (RP) Rules, 2016 (j,e. 25.07.2016) are not entitled to exercise option/revised option -to come over to the revised pay structure on the date of their promotion/ financial upgradation.</strong></p>



<p>2. <strong>Point of doubt</strong>:  In view of M.F., O.M. No.4-13/ 17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March, 2017 under MACPS are eligible to exercise revised option to come over to revised pay structure on the date of their subsequent increment in pre revised pay structure (i.e. on 01.07.2017).</p>



<p><strong>Clarification</strong>:- As furnished In the clarification on point of doubt &#8211; 1 above, <span style="text-decoration: underline;">all other terms and conditions as laid down In the Rules 5 &amp;. 6 thereof shall continue to be applicable</span> for exercising revised option. As per the first provision of the Rule 5, a Government servant may elect to Continue to draw  pay in the existing pay structure until the date on which he earns his next or any subsequent increment In the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure. As per explanation-1 under the Rule 5, <span style="text-decoration: underline;"><strong>the option to retain the existing pay structure under the provisions to this rule shall be admissible only in respect of one existing pay Band and Grade pay or Scale.</strong></span></p>



<p>Further, switching over to the revised pay structure either on 01-01-2016 or<br />
from a later date than 01-01-2016 i.e. on the date of promotion/ upgradation<br />
or the date next/ any subsequent increment, are applicable under Rule 5 in case of post/ Pay Band or Grade Pay held on 01-01-2016. Thus, if the date of next or any subsequent increment (i.e. on 01-07-2016 or any subsequent date of increment) for a post/Pay Band or Grade Pay held on 01-01-2016 falls after the date of promotion, then the date of next/ any  subsequent increment for the post/ Pay Band or Grade Pay held on 01-01-2016 has no relevance for option, as this post/ Pay Band or Grade Pay on 01.01.2016 is no longer held on the date of next/ any subsequent date of Increment.</p>



<p><strong>Hence. it is clarified that the officials who are awarded promotion/ financial up gradation under MACPS prior to the next or any subsequent date of increment in the pre revised Day structure are not entitled to exercise option/revised option to come over to revised Day structure on the date of next or any subsequent date of increment i e 01.07.2016 or 01.07.2017 etc. (With regards to the said clarifications this officer. No. 69/ PM-II/IFA/ Genl./ 7thCPC Pay fixation Visakhapanam  by endorsing copies to all the Regional Offices and the Divisional Heads may also be referred to.)</strong></p>

The said option was to be exercised within 3 months of the date of notification i.e. 28.07.2016 of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final.</p>
<p>2. In this context, it is stated that Ministry of Finance, Department of Expenditure vide their permitted opportunity to Government Servants to revise their initial option in terms of Rule 5 &amp; 6 of CCS(RP) Rules,2016. These orders issued by Ministry of Finance, Department of Expenditure shall be applicable <strong>mutatis mutandis</strong> in Railways with respect to RS(RP) Rules, 2016.</p>
<p>3. The &#8216;three months&#8217; period mentioned in para 3 of aforesaid OM of Ministry of Finance, Department of Expenditure dated 12.12.2018 shall be three months from the date of issue of these instructions.</p>
<p>4. The matter has also been raised by both recognised Staff Federations AIRF and NFIR.</p>

<p>Subject: <strong>Central Civil Services (Revised Pay) Rules, 2016 &#8211; opportunity for revision of option to come over to revised pay structure</strong></p>
<p>The undersigned is directed to invite attention to Rules 5 &amp; 6 of the CCS (RP) Rules, 2016 regarding exercise of option to come over to the revised pay structure effective from 1.1.2016 as notified by the CCS(RP) Rules, 2016 and to say that the said option was to be exercised within 3 months of the date of notification, i.e. 25.7.2016 of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final.</p>
<p>2. The Staff Side of the National Council (JCM) has requested that employees may be given another opportunity to re-exercise their option in view of certain hardships caused to certain employees. A number of references have also been received in this Ministry, proposing that the affected employees may be given an opportunity to re-exercise their option.</p>
<p>3. The matter has been considered and the President is pleased to decide that in relaxation of the stipulation contained in Rule 6(4) of CCS(RP) Rules, 2016, the Central Government employees, who have already exercised their option to come over to the revised pay structure as notified by the CCS(RP) Rules, 2016, shall be permitted another opportunity to revise their initial option in terms of Rules 5 &amp; 6 thereof. The revised Option shall be exercised within a period of 3 months from the  date of issue of these orders. The option once exercised in terms of these orders shall be final and shall not be liable to any further change under any circumstances. All other terms and conditions as laid down in the said Rules 5 and 6 shall continue to be applicable.</p>
<p>4. It is obvious that in respect of those employees who have already exercised option to come over to the revised pay structure from 01.01.2016 itself or in whose case the revised pay structure took effect from 01.01.2016 and who ire-exercise their option under these orders to come over to the revised pay structure from a date subsequent to 01.01.2016 as per Rule 5 of 008 (RP) Rules, 2016, the arrears on account of revised pay already drawn by them from 01.01.2016 up to the date from which they now Opt to come over to the revised pay structure shall be recovered.</p>
<p>5. In their application to the employees serving in IA&amp;AD, these orders were issued after consultation with the Comptroller and Auditor General of India.</p>

<p>The Board of Governors, KVS in its 96th meeting held on 28.01.2014, while considering the agenda on adoption of Revised Model Recruitment Rules / Pay Scales for various official language (OL) cadre posts in KVS according to DOPT, Govt. of India OM No. AB-14017/46/2011-Estt(RR) dated 19.09.2013 had, inter-alia, decided as under:-</p>
<p>“The Board approved the Model Recruitment Rules and the pay scales ordered in the OM No AB 14017/46/2011-Estt.(RR) dated 19.09.2013 of GOI, Ministry of Personnel, PG&amp;Pensions, DOPT with the direction that the revised pay scales would be given prospectively only to those OL cadre posts incumbents of KVS who fulfill the eligibility conditions of Model RRs. It was also decided to obtain the approval of MRHD in this matter”.</p>
<p>2.Thereafter a detailed proposal seeking approval of the Ministry of HRD was submitted by KVS letter of even number dated 24.02.2014.</p>
<p>3.After detailed examination of the proposal of KVS, the Ministry of HRD vide their letter No. F. 3-5/2014-UT.2 dated 04.01.2018 has conveyed the approval of the competent authority for adoption of Model Recruitment Rules for the various Official Language cadre posts in KVS w.e.f. 28.01.2014 with the condition that officials presently working in Kendriya Vidyalaya Sangathan would not become automatically eligible for modified scales but only after adoption of RRs and applicability in respect of existing officials would happen, if they are eligible as per the conditions of eligibility of Model Recruitment Rules.</p>
<p>4.Pursuant to the above approval of the Ministry of HRD, the Commissioner, Kendriya Vidyalaya Sangathan vide KVS office order dated 22.01.2018 constituted a committee under the Chairpersonship of Joint Commissioner (Administration), KVS to verify the eligibility of each incumbent to various Official Language cadre posts in KVS.</p>
<p>5.The committee examined the documents of all the employees from their service records and, in its meeting held on 08.02.2018, found all the existing employees of KVS eligible as per the Model Recruitment Rules. The committee submitted its recommendations on 09.02.2018.</p>
<p>6.Accordingly, approval of the Ministry of HRD is hereby conveyed for the adoption of the revised Model Recruitment Rules and revised pay structure for various Official Language cadre posts in Kendriya Vidyalaya Sangathan as under:-</p>

<p>Subject: <b>Recommendations of the Central Pay Commission (CPC) &#8211; bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016.</b></p>
<p>With reference to the subject mentioned above and in continuation of this Department&#8217;s OM of even number dated 07.09.2016 and 13.06.2017, detailed instructions are hereby being issued on the application of the benefit on account of bunching of stages while fixing the pay in the revised pay structure as a response to a large number of references received from Ministries/Departments.</p>
<p>2. The provisions giving effect to the recommendations of the 7th CPC on extending the benefit on account of bunching were notified vide DoE O.M. dated 07.09.2016. Benefits on account of bunching have been extended during the initial fixation of pay in the revised pay structure while implementing the recommendations of earlier CPCs also. Bunching occurs in the fixation of pay when the pay at two or more consecutive stages in a Pay Scale/ Grade Pay in the pre revised scale get fixed at the same stage in the corresponding Pay Scale/ Level in the revised pay structure.</p>
<p>3. The modalities of determining the extent of bunching and the nature of benefits to be extended on account thereof, based on the recommendations of the CPCs, have differed across different Pay Commission periods. While the 5th CPC recommended that benefits be extended when more than four stages get bunched, the 6th CPC recommended that benefits be extended when two or more stages get bunched. The fitment tables drawn by the 6th CPC and notified by the Government subsequently provided for the benefit of bunching only when more than two stages were bunched. As regards the benefits to be extended on account of bunching, the 5th CPC recommended benefit of one increment for every four consecutive stages bunched. the 6th CPC recommended benefit of one increment for every two consecutive pay stages bunched. For HAG scales, however, benefit of one increment was given at each of the pay stages in the 6th CPC pay structure.</p>
<p>4. In terms of the DoE O.M. dated 07.09.2016 based on the 7th CPC recommendations, bunching occurs when two or more stages get bunched and benefit of one increment is to be given for every two stages bunched. These provisions are to be applied while revising the pay from the 6th CPC regime to the 7th CPC regime. In the 6th CPC pay structure, about 35 pay scales existing in the 5th CPC pay structure were replaced by a system of running pay bands recommended by the 6th CPC. The 6th CPC pay structure consisted of 19 grades spread across four distinct pay bands and 4 distinct scales including two fixed scales. The 6th pay structure being replaced by the 7th CPC recommended Pay Matrix, thus. consists of 4 Pay Bands with 15 levels of Grade Pay, along with 4 standalone scales, viz., HAG scale, HAG+ scale, Apex scale (fixed) and the scale of Cabinet Secretary (fixed).</p>
<p>5. While in the 5th CPC structure, the stages in every pay scale were well defined, the stages were not well defined in the 6th CPC structure. The pay was to be fixed in the running Pay Band by rounding off to the next higher multiple of 10. Every multiple of 10 was a pay stage in the 6th CPC regime. However, all consecutive 10 rupee stages for any Grade Pay cannot be taken as consecutive stages for the purpose of bunching in reference to the 7th CPC recommendations as is also clear from the illustration contained in para 5.1.37 of the 7th CPC Report. Based on the illustration contained in para 5.1.37 of the 7th CPC Report, Department of Expenditure’s O.M. dated 07.09.2016 provided that a difference of at least 3%, the rate of annual increment, in the 6th CPC pay structure was essential for counting of two stages. The 6th CPC had replaced the system of equidistant pay stages in a pay scale based on equal annual increments in the 5th CPC regime by a system of annual increment of 3% on the sum of pay in the running pay band and the Grade Pay which was to be added to the running pay as increment. Therefore, the pay stages in any given Grade Pay were specific to an employee and depended upon the initial fixation of pay in that Grade Pay. As a result, the amount of increment earned in the same Grade Pay would differ in the same Pay Scale/ Grade Pay not only between different employees but also across years for the same employee. To illustrate, an employee whose pay was fixed at Rs 46,100 in GP of 8700 in PB-4 would have the first annual increment of Rs 1390 which would be added to his running pay in the Pay Band. another employee whose pay initially was fixed at Rs 46,400 in the same Grade Pay would have the first annual increment of Rs 1400. In such a scenario where the pay stages are specific to the employee, it is not possible to arrive at universal pay stages for the purpose of determining the extent of bunching. Therefore, for the purpose of determining the extent of bunching in a system of running pay bands, the consecutive pay stages that need to be considered are the pay stages which are specific to the employee</p>
<p>6. In the 5th CPC structure, the maximum and the minimum of every pay scale were well defined. In the 6th CPC structure, Entry Pay was separately notified for most Grade Pay levels to govern the entry pay of direct recruits in that level. The pay of those moving from a lower grade to a higher one on promotion was regulated in terms of provisions contained in Rule 13 of CCS (RP) Rules, 2008. As such, the Entry Pay notified for a given Pay Scale/ Grade Pay is the effective minimum of that Grade Pay for direct recruits. For an employee getting promoted, the sum of the minimum of the relevant Pay Band and the Grade Pay is the effective minimum pay. The 7th CPC, in its Report, has commented that this led to many situations where direct recruits drew higher pay as compared to personnel who reached that stage through promotion. Demands were received by the 7th CPC from many staff associations and employees for removal of this disparity which the 7th CPC refers to as differential entry pay.</p>
<p>7. In the revised dispensation for pay fixation in the New Pay Structure as recommended by the 7th CPC, direct recruits shall start at the minimum pay corresponding to the level to which recruitment is made, which will be the first cell of each level. For those promoted from the previous level, the fixation of pay in the new level will depend on the pay they were already drawing in the previous level. The pay, however, cannot be less than the first stage of the relevant level. While enumerating the benefits of migrating to the new system at para 5.1.47 of the 7th CPC Report, it has been stated that ‘the issue of differential entry pay has been resolved‘. At para 5.1.36 of the 7th CPC Report it has also been mentioned that rationalization has been done with utmost care to ensure minimum bunching at most levels. Rationalization has been done by the 7th CPC through the Index of Rationalisation (IoR) which has been multiplied with the Entry Pay in the 6th CPC regime to arrive at the first cell of each level. With the Entry Pay along with IOR being used as the determiner of the first cell, pay stages below the Entry Pay have been consciously brought up to the level of Entry Pay and its corresponding pay stage in the revised pay structure. As a result, all pay stages below the Entry Pay in any Level will, on re-fixation, converge to the first pay stage in that level. As this convergence takes place on account of a conscious decision of the 7th CPC intrinsic to the architecture of the Pay Matrix by indicating the Entry Pay as the starting point of each Level, benefit on account of bunching cannot be extended with reference to pay stages lower than the Entry Pay indicated by the 7th CPC for that level in the Pay Matrix. Extending the benefit of bunching with reference to pay stages below the entry pay will perpetuate the difference in pay on account of differential Entry Pay which was addressed by the 7th CPC.</p>
<p>8. Based on the above. it is clarified that the following shall be kept in view while determining the extent of bunching as also the benefits to be extended on account of bunching at the time of initial fixation of pay in the 7th CPC pay structure:</p>

<blockquote><p>(i) Benefit on account of bunching is to be extended when two or more stages get bunched.</p></blockquote>

<p>(ii) Benefit of one increment is to be extended on account of bunching of every two consecutive stages.</p>

<p>(iii) As stipulated in MoF OM dated 07.09.2016, a difference of 3% to be reckoned for determination of consecutive pay stages, specific to each employee.</p>

<blockquote><p>(iv) All pay stages lower than the Entry Pay in the 6th CPC pay structure as indicated in the Pay Matrix contained in the 7th CPC Report are not to be taken into account for determining the extent of bunching.</p></blockquote>

<p>9. All Ministries/ Departments are advised to review all cases wherein benefit on account of bunching has been extended in terms of this Department’s OM dated 07.09.2016 and to re-fix the pay in terms of the instructions contained herein.</p>

<p>Sub: <strong>Recommendations of 7th Central Pay Commission- bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016. </strong></p>
<p>Attention is hereby invited to this Office OM of even number dated 23 rd February, 2017 on the subject cited above vide which the pay details of Shri Babu Balram Jee, AAO, CPWD, lBBZ-l, Malda M/o Urban Development were made available so that benefit of bunching may be extended to eligible AAOs in adherence to the Department of Expenditure OM No. 1-6/2016-IC dated 7th September, 2016.</p>
<p>Further, Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance has issued clarifications in this regard vide OM No.1-6/2016-IC dated 3rd August, 2017 (copy enclosed).</p>
<p>All respective accounting units of Ministries/ Departments concerned are advised to review all cases wherein benefit on account of bunching has been extended in terms of this office OM dated 23rd February, 2017 and in adherence to DoE OM No. 1-6/2016-lC dated 7th September, 2016 and to re-fix the pay in terms of Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance OM No.1-6/2016-lC dated 3 rd August, 2017.</p>
<p>Accordingly, clarifications sought in this regard from various accounting units of Ministries/Departments concerned may be treated as disposed of.</p>
<p>This issues with the approval of the competent authority.</p>
