<p>No separate posts of Asstt. Headmasters/Asst Head-mistresses/Vice Principals should be created. Where considered necessary, the senior-most post-graduate teacher in scale Rs.6500 -10500 (RSRP) selection grade working in a Higher Secondary School/senior-most graduate teacher in scale Rs.5500 &#8211; 9000 (RSRP) working in a High School, should be put to work as Asstt. Headmaster/Asstt. Headmistress/ Vice-Principal by reducing his/her teaching load. (Railway Board’s letter No. E(W)62/SC-2/44 dt. 4.5.63 and, PC-V98/Ill 1/26 dt. 23.10.1988</p>



<p>However, in Higher Secondary Schools/Inter Colleges, with an enrolment of 1000 or more students, the senior-most Post Graduate Teachers in scales of Rs.7500-12000 (RSRP)/Rs.8000-13500 (RSRP), as the case may be designated and utilised as Vice­ Principals by reducing their teaching workload. If necessary, selected suitable Post Graduate Teachers may be shifted to locations where needed, if they are not readily available there. </p>

<p>As regards 6th CPC Schedules regarding the pay scale of teaching staff have been circulated by Board’s letter No. PC VI/2008/If RSRP/1 dated 22.09.2008 &amp; 17.07.2009. The scales allotted to the teaching staff are as under:</p>

<p>i) These categories will retain their existing classification as group C<br />ii) Residency period will remain unchanged.<br /># modified vide letter dated 17.07.2009 (RBE No. 131/09)</p>



<p>No specific recommendations have been made by the 7th CPC in respect of Pay Scales of Teaching Staff of Railway schools, therefore, only replacement Pay Level in the Pay Matrix is applicable to Teaching Staff.</p>



<p>Each case of transfer of a Railway School to the State Government should be examined on merits. Where this can be done, the Railway Administrations may agree to license the school buildings on nominal license fee and give the furniture free of cost so as to make it attractive for the State Govt. to take over the school. In any case, approval of the Railway Board may be obtained before any Railway School is handed over to the State Government.</p>

<p>The main objective of conducting inspections in Railway Schools is to streamline their day-to-day administration and effect necessary, improvements in educational standards. Vigorous follow-up action should be taken on Inspection Reports submitted by Inspecting Officers and whenever deficiencies have been pointed out these should be speedily rectified.</p>



<p>The Chief Personnel Officers should take a personal interest and ensure that necessary improvements, were called for, are affected with a view to improving the standard of Railway Schools. It should also be ensured that Railway Schools are regularly inspected by the State Govt. Inspectors and their recommendations implemented to the extent possible. In this connection, attention is also invited to the recommendations of Educational Advisers which were sent along with Board’s letter No. E(W)58/ED1/9 dated 21.9.1959.</p>

<p>Any changes in the pattern of classes in Railway Schools such as addition or abolition of classes, upgradation or down gradation of schools etc. should be reported to Board for information together with the reasons necessitating such changes.</p>

<p><strong>Concessions to the Scheduled Caste and Scheduled Tribe Communities in the matter of admission to the Railway Schools including Oak Grove School at Jharipani:</strong></p>



<p>(1) It has been decided by the Railway Board that the following concessions should be allowed to the students belonging to the Scheduled Caste and Scheduled Tribe communities in the admission to the Railway schools:</p>



<ul class="wp-block-list"><li>(a) A distinct reservation of 15% for SC and 7.5% for ST candidates;</li><li>(b) Where admissions are made with reference to percentage of marks obtained, 1 % reduction in marks may be allowed in the case of SC and ST candidates provided the lower percentage does not fall below the minimum marks required to pass the qualifying examination;</li><li>(c) The upper age limit for SCs/STs may be raised by three years;</li><li>(d) No child/ward of a member of staff belonging to SC/ST community should be refused admission in Primary classes; .<br />(e) In other classes, admission should not normally be refused up to the extent of the<br />quota exclusive of any who secures admission on merits.</li></ul>



<p>(2) To ensure that the concessions in the matter of admission as referred to above are actually available to the SC and ST communities, the Railway administration should maintain the following data:</p>



<ul class="wp-block-list"><li>(i) No. of candidates seeking admission each year;</li><li>(a) No. out of these are children and wards of Railway servants separately for SC, ST and other communities;</li><li>(b) Outsiders, separately for SC, ST and other communities :</li><li>(ii) Number refused admission in the same details as in (i) above;</li><li>(iii) Reasons for refusal of admission in the case of SC and ST candidates;</li><li>(a) Where they are children and wards;</li><li>(b) Where they are outsiders.</li></ul>



<p>(3) Reservation for physically handicapped candidates &#8211; 3% of seats are reserved for Physically Handicapped children.</p>

<p>S.R.O. 08(E).- In exercise of the powers conferred by the proviso to Article 309, and Clause (5) of Article 148 of the Constitution, the President hereby makes the following rules to amend the Civilians in Defence Services (Revised Pay) Rules, 2016, namely :-</p>



<p>(1) These rules may be called the Civilians in Defence Services (Revised Pay) (Amendment) Rules, 2019.</p>



<p>(2) They shall be deemed to have come into force on the 1st day of January, 2016.</p>



<p>In the Civilians in Defence Services (Revised Pay) Rules, 2016,-</p>



<p>(a) in Rule 5, the following amendment be made;</p>



<p><strong>For</strong>:<br /> “Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w I&#8221; day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”</p>



<p><strong>Read as</strong>:<br /> “Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w 1&#8243; day of January, 2016 and the 25&#8243; day of July, 2016 on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”</p>

<p><em><strong>Subject:- Fixation of pay in respect of employees appointed on or after 01.01.2006 in the Grade of 4280 (PR).</strong></em></p>
<p>Doubts have been expressed by various quarters regarding fixation of pay of an employee appointed to the post carrying Grade Pay of 4210,4220,4240,4260 and 4280 in PB-3- 9300-34800 (PR)<strong>, </strong>on or after 01.01.2006 in terms of SRO 266 of 2009 dated 31.08.2009 read with SRO 42 of 2011.</p>
<p>The issue has been examined in the Finance Department and it has been observed that consequent to notification of Jammu &amp; Kashmir Civil Services (Revised) Pay Rules, 2009 vide SRO 93 of 2009 dated 15.04.2009, the pre-revised pay scales of 5000-8000, 5150-8300, 5500­9000,5600-9100, 5700-10100 and 6500-10500 were clubbed into single PB-2 &#8211; 9300-34800 (PR) with common Grade Pay of 4200. This created practical impediments in making appointments to various posts under these pre-revised pay scales/ Grade Pays, particularly in making promotions both functional or in-situ from one Grade Pay to another within the scales so clubbed. The promotion within these scales would mean nothing except change of designation.</p>
<p>In order to overcome the bottlenecks coming in the way of making appointments or promotions in these pre-revised scales, Grade Pays of 4210,4220,4240,4260 and 4280 were introduced to pave way for promotion from one post to another scale.</p>
<p>Accordingly, it is clarified that the newly incorporated Grade Pays viz 4210,4220,4240,4260 and 4280 under SRO 42 of 2011 are applicable to all employees in the revised pay structure, but as far as the applicability of ready reckoner attached to said SRO is concerned, same is relevant for pay revision of employees who have been appointed before 01.01.2006, and were holding these posts on 01.01.2006 to arrive at their revised pay on 01.01.2006 in the revised pay structure in accordance with Rule 7 of J&amp;K Civil Services (Revised) Pay Rules, 2009.</p>
<p>It is also clarified that SRO 42 of 2011 is not an amendment to Rule (8) of Jammu &amp; Kashmir Civil Services (Revised) Pay Rules, 2009, prescribing fixation of pay of direct entrants to Government service on or after 01.01.2006, but is an insertion/ substitution of new Grade Pays in Section-I of first schedule attached to Jammu &amp; Kashmir Civil Services (Revised) Pay Rules, 2009 against S.Nos 11 to 16 of Pay Band-2.</p>

<p>Sub: <strong>Recommendations of 7th Central Pay Commission- bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016. </strong></p>
<p>Attention is hereby invited to this Office OM of even number dated 23 rd February, 2017 on the subject cited above vide which the pay details of Shri Babu Balram Jee, AAO, CPWD, lBBZ-l, Malda M/o Urban Development were made available so that benefit of bunching may be extended to eligible AAOs in adherence to the Department of Expenditure OM No. 1-6/2016-IC dated 7th September, 2016.</p>
<p>Further, Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance has issued clarifications in this regard vide OM No.1-6/2016-IC dated 3rd August, 2017 (copy enclosed).</p>
<p>All respective accounting units of Ministries/ Departments concerned are advised to review all cases wherein benefit on account of bunching has been extended in terms of this office OM dated 23rd February, 2017 and in adherence to DoE OM No. 1-6/2016-lC dated 7th September, 2016 and to re-fix the pay in terms of Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance OM No.1-6/2016-lC dated 3 rd August, 2017.</p>
<p>Accordingly, clarifications sought in this regard from various accounting units of Ministries/Departments concerned may be treated as disposed of.</p>
<p>This issues with the approval of the competent authority.</p>

<p>G.S.R.882(E). In exercise of powers conferred by the proviso of Article 309 of the Constitution, the President hereby makes the following rules in amendment to the Railway Services (Revised Pay) Rules, 2016 namely :</p>
<p>1. (1) These rules may be called Railway Services (Revised Pay) Amendment Rules, 2017.</p>
<p>(2) They shall be deemed to have come into force on the 1st day of January, 2016.</p>
<p>2. In the Railway Services (Revised Pay) Rules, 2016,</p>
<p>(a) In rule 12, for the words &#8220;the date of notification of these rules&#8221;, the following shall be substituted, namely:</p>
<p>&#8220;1st January, 2016 and the same shall apply to the pay of officers coming on deputation to posts in the Central Government which are not covered under the Central Staffing Scheme.&#8221;;</p>
<p>(b) In the Schedule, &#8211;</p>
<p>(i) for PART A, the following PART shall be substituted, namely;-</p>

<p><i>AVOID INORDINATE DELAY IN EXTENDING THE BENEFITS OF CCS (REVISED PAY) RULES 2016 TO THE EMPLOYEES OF CENTRAL GOVERNMENT AUTONOMOUS BODIES AND BOARDS CONSTITUTED STATUTORILY</i></p>
<p>The benefits of the 7th CPC has not yet been extended to the personnel working under : autonomous bodies and Boards, though it was constituted statutorily. During the previous wage revisions, they have been allowed to enjoy the benefits within one month of release of the Government Notification on Revised Pay Rules. Employees and Pensioners of more than 600 Autonomous bodies and Boards etc. are eagerly waiting for the last more than two months, for revised pay structure implementation in their respective institutions.</p>
<p>Like most of the Central Government departments, since most of the autonomous bodies and Boards did not have much fund to spare for payment of revision of pay hike, they have to depend upon their Ministries concerned. In the case of Ministries also, the budget allotment is not sufficient to meet its own needs satisfactorily and are starving. It is in this background the Finance Ministry&#8217;s stand becomes crucial. During 6th CPC, the Finance Ministry has given clearance without much delay. The present delay has become a cause of concern for the employees and pensioners.</p>
<p>Confederation of Central Government Employees and workers has already taken up their case with the Government, but till this date the Finance Ministry has not issued orders extending the 7th CPC benefit to employees of Autonomous bodies and Board. The Confederation urges upon the Central Government to expedite action in this regard and to end the uncertainty and anxiety among a large section of employees and pensioners.</p>

<p>Subject: <strong>Fixation of Pay of senior PAs in the pre-revised scale of Rs.7450-11500 with the PAs of CSSS promoted between 1.1.2006 to 31.8.2008 —clarification regarding allowing arrears — regarding.</strong></p>
<p>The undersigned is directed to say that references are still being received from Ministries/Departments regarding fixation of pay of senior PAs of CSSS and payment of arrears in the revised pay structure with the PAs of CSSS who were promoted between 1.1.2006 to 31.8.2008. PAs of CSSS promoted between 1.1.2006 to 31.8.2008 were allowed arrears from the date of their promotion as they had come over to the revised pay on the date of their promotion. Seniors to such promotee PAs of CSSS, however, were subsequently allowed stepping up of their pay with reference to these officials and they were not allowed arrears on the ground that the officials with reference to whom they got their pay stepped up were also not entitled to this.</p>
<p>2. The issue of fixation of pay with reference to the pre-revised pay scale of Rs. 7450-11500 and payment of arrears was taken up by Establishment Division of this Department with Department of Expenditure as this amounts to compelling the senior official, who was already serving as PA prior to 1.1,2006 and opted for fixation of his pay under revised pay rules from 1.1.2006 to opt for revised pay structure from the date of stepping up with the junior.</p>
<p>3. It is, therefore, clarified that the senior is entitled to arrears of pay from the date he opted to come over to the Revised Pay Scales tilt the date of stepping up of pay. These will be paid on the basis of pay actually fixed as on 1.1.2006.</p>

HYDERABAD: Sixteen months after it was pulled up for sanctioning projects without the approval of the government, the Hyderabad-based Defence Research and Development Organisation (DRDO) has done it again. This time, the premier defence research establishment has amended the pay scales of its employees on its own in violation of the rules and without the approval of the Union finance ministry.</p>
<p>Documents in possession of TOI show that DRDO amended or upgraded the Grade Pay of Technical Officer &#8216;A&#8217; from Rs 4,600 to Rs 4,800. The defence organization effected the hike in 2009 with retrospective effect from 2006 and it came to the knowledge of the Union finance ministry in April 2012 through a query raised under the Right To Information (RTI) Act. The defence organization was also directed to withdraw the higher pay scale already granted to its Technical Officers.</p>
<p>But what followed was hilarious! In response to the reprimand from the Centre, DRDO reportedly sought retrospective permission for amending the Grade Pay scales. At this, an even furious finance ministry turned down the request in a strongly worded letter saying that the &#8220;arrangement was irregular, contrary to the accepted recommendations of the 6th Central Pay Commission (CPC) and in violation of allocation and transaction of business rules since it had been undertaken suo motu without reference, much less concurrence.&#8221;</p>
<p>The finance ministry also rubbished the claims of DRDO that this was done to maintain &#8216;relative hierarchy of Senior Technical Assistants (STA &#8216;C&#8217;) vis-a-vis Technical Officers &#8216;A&#8217;. DRDO was reminded that 6th CPC&#8217;s recommendations were aimed at de-layering the government and that ensuring the same &#8216;relative hierarchies&#8217; as existed before the CPC awards defied the very purpose of rationalisation/standardization of pay scales attempted by successive Pay Commissions. At the end, DRDO was once again asked to withdraw the orders.</p>
<p>And now, DRDO in an attempt to cover up its administrative blunder, has distressed its more than 1,100 such technical officers across its 52 laboratories of which almost 124 promotees have already retired. In December 2013, DRDO not only downgraded these officers of DRDO Research and Technical Cadre, but also asked these officials to appear for special review and assessment and interview schedule in addition to the recovery of money so paid to them.</p>
<p>Meanwhile, the aggrieved officials maintain that it took them five years residential period and rigorous assessment tests to earn technical officers promotions from Rs 4,600 to Rs 4,800 grade. The DRTC Officers Association has reportedly urged defence minister A K Antony to bring the erring officers to book. These officials have been asked to return money to the tune of Rs 1,000 to Rs 5,000 earned monthly all these years as a result of this increased grade pay.</p>
<p>This was the second instance that DRDO has been found indulging in arbitrary functioning. About 16 months ago, a clandestine audit conducted by the Comptroller General of Defence Audit (CGDA) on the instructions of defence minister Antony, found major anomalies in DRDO&#8217;s arbitrary functioning. The defence organization was found guilty of sanctioning projects without government approval etc.</p>
<p>When asked about the developments, DRDO director general Avinash Chander said &#8220;while following the orders, the defence organization is trying to find a solution to the problem and issues raised by the technical officers issue.&#8221; Dr G Malakondaiah, chief controller, R&amp;D (HR) at DRDO, while refusing to comment upon the orders in the past, said attempts are on to find a way out of the situation stemming out of the technical officers&#8217; pay scale issue.</p>
<p><span style="text-decoration: underline;"><strong>Curious case of pay hikes</strong></span></p>
<p>In violation of rules and without the approval of the Union finance ministry, DRDO has amended the pay scales of its employees in 2009</p>
<p>The premier defence research establishment upgraded the Grade Pay of Technical Officer &#8216;A&#8217; from Rs 4,600 to Rs 4,800 with a retrospective effect from 2006</p>
<p>After coming to know about it in April 2012, the Union finance ministry reprimanded the DRDO and directed it to withdraw the &#8216;hikes.&#8217; In response, DRDO sought a retrospective permission from the finance ministry instead</p>

<div>Subject: <strong>Central Civil Services (Revised Pay) Rules, 2008 &#8211; the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.</strong></div>

<div>The undersigned is directed to invite a reference to Rules 5 &amp; 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.</div>

<div>2. This Ministry issued instructions vide this Departments OM No.10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a one time measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.</div>

<div>3. In view of the benefit extended to Central Government employees as per the aforesaid OM dated 19.3.2012, the issue relating to according of a fresh opportunity to Central Government employees to re-exercise their option to come over to the revised pay scale as per CCS(RP) Rules, 2008 was raised by the Staff side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.</div>

<div>4 The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid OM dated 19.3.2012 bring about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the CCS(RP) Rules, 2008 in respect of employees who are covered under the said OM dated 19.3.2012, the President is pleased to decide that all those employees who are covered under the provisions of the aforesaid OM dated 19.3.2012 may once again be permitted to re-exercise their option to come over to the Revised pay structure.</div>

<div>5. The benefit under these orders for re-exercise of option shall be available for a period up to 31.3.2013. The revised option shall be intimated to the head of the office by the concerned Government employees in accordance with the provision of Rule 6 (2) of the CCS (RP) rules, 2008.</div>

<div>6. All the Ministries and Departments are requested to bring the content of this OM to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.</div>
<div></div>
<div>7. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.</div>
