<p>Subject: <strong>Amendment in Article 51 Of Education Code for Kendriya Vidyalayas &#8211; reg.</strong></p>



<p>The Board of Governors of KVS in its meeting held on has approved discontinuation of 2 yeas extension in service being provided to National Awardee Teachers after attaining the age of Superannuation. This was decided by the MHRD &amp; conveyed vide its letter No.F.3-26/201B-UT-2 dated 07.12.2018. However, services of these teachers Will be utilized by the KVS on contractual basis against clear vacancy. No proposal should be forwarded to KVS (HQ) in this regard henceforth.</p>



<p>In compliance with the decisior of BOG, KVS the existing and amended provision of Article 51 of Education Code be read as under:-</p>



<h2 class="wp-block-heading" style="text-align:center">Existing Article 51 &#8211; Age of Retirement</h2>



<p>Every employee of the Sangathan shall retire in the afternoon of the last day of the month in which he attains the age of sixty (60) years, except those Who are born on the last day of the month who shall retire on the day of the previous month. Two years extension in service shall be granted to National Awardee teachers on year to year basis subject to physical fitness end mental alertness.</p>



<h2 class="wp-block-heading" style="text-align:center">Amended Article 51 &#8211; Age of Retirement</h2>



<p>Every employee of the Sangathan shall retire in the afternoon of the last day of the month in which he attains the age of sixty (60) years, except those who are born on the 1st day of the month Who shall retire on the last day of the previous month.</p>



<p>The above amendment shall Come into force with immediate effect.</p>

</strong></p>
<p>The CEO&amp;MD and DMD of Industrial Finance Corporation of India Ltd. (IFCI Ltd.) were appointed with effect from 12.12.2013 for a period of three years. IFCI became a Government Company with effect from 07.04.2015. The Appointments Committee of Cabinet has approved the continuation of CEO&amp;MD and DMD of IFCI Ltd. beyond their age of superannuation till the completion of their contract period i.e. upto 11.12.2016.</p>

<p>According to recent reports published in the ‘Manoramaonline’, the 10th Kerala Pay Revision Commission expected to recommend to hike in retirement age for Kerala State Govt employees by two years from 56 to 58.</p>

<p><strong>Kerala may raise retirement age to 58</strong></p>
<p><strong> </strong></p>
<p>“Thiruvananthapuram: Increasing the retirement age for Kerala government employees by two years to 58 may be one of the recommendations of the 10th Kerala Pay Revision Commission. The commission, led by Justice C.N. Ramachandran Nair, will submit its report on July 10.</p>
<p>&nbsp;</p>
<p>The commission is expected to recommend the increase of retirement age to balance the extra burden on the treasury due to a pay rise across the board. The report recommends a minimum salary of Rs 16,000 and a maximum salary of Rs 1 lakh for employees.</p>
<p>&nbsp;</p>
<p>The youth wings of all political parties are against increasing the retirement age in the government service. Even the United Democratic Front government’s policies do not favour later retirement. The retirement age was raised to 56 from 55 during the previous Left Democratic Front rule.</p>
<p>&nbsp;</p>
<p>Other recommendations include lowering the minimum eligibility for full pension to 25 years in service from the present 30. Full pension is equivalent to half of the basic pay. The report would also have recommendations intended to raise the efficiency of the employees along with their pay scale.”</p>

<p>Recently rumour mill went overdrive in social media with the following news that</p>
<blockquote><p><em><strong>1.central government decided to Merge 50% DA with basic pay with effect from 1.1.2015 and order will be issued within 15 days</strong></em></p>
<p><em><strong>2. Encashment of Earned Leave to be curtailed to 180days instead of existing 300 days.</strong></em></p>
<p><em><strong>3.It went on to say that age of Retirement will be on completion of 33 Years of service or at the age of 58 Years whichever is earlier</strong></em></p></blockquote>
<p>According to the Social Media , the above strong decisions were taken in last three meeting of cabinet committee to recommend 7th pay commission. Further the post published in social media warned the central government employees that if above decisions are implemented; they should not expect more from 7th Pay Commission. Since it is considered to be the indication of what the think tank of central government will do for its employees.</p>
<p>We enquired about this rumour with one of the Member to the National council JCM, who recently met the 7th Pay Commission. According to him, the central government has firm on its decision not to accept the Merger of DA with Pay, since the due date of the 7th Pay Commission to submit its recommendation is nearing and the central government in many occasions cleared that the recommendation of 7th pay commission will be implemented from 1.1.2016. So there is no question of issuing order for merger of 50% DA with effect from 1.1.2015.</p>
<p>Further he clarified that the present government wanted to use the man-hours of central government employees productively by introducing new systems like bio metric attendance etc. Hence curtailing EL Encashment will lead the central government employees to take more leave if it is not allowed for encashment. So there is no need to implement such proposal as government point of view is against taking leave by Govt officials.</p>
<p>There is mixed response from the sources whether the retirement age of central government employees will be revised or not. It is believed that the present government is in favour of reducing retirement age to 58. But at the same time government doesn’t want loose resources of knowledge gained through experience by reducing retirement age of Government employees. Since the work culture of government service is deteriorating day by day due to various factors , govt would like to retain the experience of the senior Government officials . Anubhav is the one of the initiative introduced by the central government to improve the work culture of youngsters in government service. So there will not be any change in retirement age of central government employees at present.</p>

<p><em>“All Government servants are to retire on the last day of the month in which they attain the age of 60 years, subject to the exceptions mentioned therein”.</em></p>
<p>The DoPT Minister informed in the Parliament as a written reply to a question to the subject above mentioned as follows…</p>
<p>As per Rule 56 of Fundamental Rules all Government servants are to retire on the last day of the month in which they attain the age of 60 years, subject to the exceptions mentioned therein. A copy of the relevant rule is annexed. Different age of retirement for certain categories has been fixed on functional requirements.</p>
<p>Employees of the Supreme Court retire on attaining the age of 60 years. The employees of Central Universities are not Central Government employees. However, the retirement age of the employees are as under:-</p>
<p><strong><em>(i) Vice Chancellor – 70 years</em></strong></p>
<p><strong><em>(ii) Teachers – 65 years</em></strong></p>
<p><strong><em>(iii) Registrar – 62 years</em></strong></p>
<p><strong><em>(iv) Finance Officer – 62 years</em></strong></p>
<p><strong><em>(v) Controller of Examination – 62 years Different age of retirement is prescribed on functional requirements.</em></strong></p>
<p><strong>Extracts of Provisions in FR 56</strong></p>
<p>F.R. 56(a) Except as otherwise provided in this rule, every Government servant shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.</p>
<p>Provided that a Government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years. Provided further that a Government servant who has attained the age of fifty-eight years on or before the first day of May, 1998 and is on extension in service, shall retire from the service on expiry of his extended period of service. Or on the expiry of any further extension in service granted by the Central Government in public interest, provided that no such extension in service shall be granted beyond the age of 60 years.</p>
<p>(b) A workman who is governed by these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.</p>
<p>(bb) The age of superannuation in respect of specialists included in the Teaching, Non-Teaching and Public Health Sub-cadres of Central Health Service shall be 62 years. “Provided that for the specialist included in the Teaching sub-cadres of the Central Health Service who are engaged only in teaching activities and not occupying administrative positions, the age of superannuation shall be sixty-five years: provided further that such specialist of the Teaching Sub-cadres of Central Health Service who are occupying administrative positions shall have the option of seeking appointment to the teaching positions in case they wish to continue in service up to sixty-five years.”</p>
<p>(bbb) The age of superannuation in respect of nursing teaching faculty with M.Sc in Nursing in the Central Government Nursing Institutions shall be 65 years subject to the condition that they continue to function as faculty members after the age of 60 years.</p>

<p>Will the retirement age of Central Government employees be extended by another two years, from 60 to 62? This is one of the hottest topics of discussion among Central Government employees these days.</p>

<p>The reason for this excitement is the reply given by the Minister concerned to the question raised by Raja Mohan Reddy in the Parliament. With the change of government, the question was asked in order to find out the state of mind of the new Government.</p>

<p><strong><span style="color: #ff0000;">No, there is no proposal to increase the age of retirement of central government employees from existing 60 to 62 years</span></strong>, Jitendra Singh, Minister of State for Personnel, Public Grievances and Pensions, and in Prime Minister’s Office, said in a written reply to the Lok Sabha on 16.7.2014.</p>

<p>Central Government had raised the retirement age of its employees to 60 from 58 years in 1998.</p>

<p>“Attention of the Government has been drawn to reports appearing in some sections of the media regarding raising the retirement age of Central Government employees <strong>from 60 to 62 years</strong>.<br />

<p>Cabinet enhances retirement age of teaching faculties to 62 <em>&#8211; Excelsior Correspondent</em><br />
SRINAGAR, June 19: In yet another major decision ahead of the Assembly elections, State Cabinet, which met under the chairmanship of Chief Minister Omar Abdullah, here this afternoon, enhanced the retirement age of teaching faculties of the Universities of Kashmir/ Jammu, SKUAST, Kashmir/ Jammu and Government Medical Colleges, Srinagar/ Jammu from 60 years to 62 years.</p>
<p>The announcement in this regard was made by the Chief Minister during the Rehbar-e-Taleem teachers conference at Jammu few days back and the same received the Cabinet’s approval today.</p>
<p>The Cabinet also approved the reckoning of the five years of service rendered by Rehbar-e-Taleem teachers before regularization, for the purpose of fixing their seniority and counting such service, notionally, for pension and other retirement benefits, wherever applicable.</p>
<p>It was also decided that after regularization the services of Rehbar-e-Taleem teachers will be transferable within the district to which they belong.</p>
<p>The Cabinet also approved the setting up of a one-man commission headed by Justice (Rtd) M L Koul to enquire into the circumstances, leading to deaths by firing, or otherwise, in law and order situations in different districts of Kashmir valley, during 2010.</p>
<p>The Commission of enquiry will also enquire into the adequacy, or otherwise, of the force used, fix responsibility, wherever excessive force has been used, resulting in fatalities, and where due care has not been taken to avoid such fatalities, suggest measures to avoid the recurrence of such incidents in future and recommend the action to be taken against those found responsible in any such incidents.</p>
<p>The Commission will submit its report to the Government within a period of three months from the date of issuance of the notification in this regard.</p>
<p>The Cabinet also approved the recommendations of J&amp;K State Commission of Backward Classes for inclusion of 38 villages in the list of Backward Areas.</p>
<p>The villages include Balsaroo, Godhan, Kadyal, Lathari, Mawa, Brahmina, Majoor, Sandal and Sumah of tehsil Akhnoor and district Jammu, Dragu, Tehsil Bhaderwah district Doda, Rajool, Kummi, Partyal, Padal, Deon, Mohargarh, Talhar, Kathar-Brahmana and Dhergarh of tehsil and district Samba, Pamrote and Fazalabad of tehsil Surankote and Gursai of tehsil Mendher district Poonch, Lower Bhatian of tehsil Thannamandi, Dehri Ralyote of tehsil Rajouri, hamlet Charung of village Hasplote, Hasyote, Rajdhani, Saim Sammat, Dodason Payeen, hamlet Ghaikhakha of village Dodasan and hamlet Remote of village Dodasan Balla of tehsil Thannamandi district Rajouri, Audsoo, Ganoora and Lalan of tehsil Anantnag, Odina of tehsil Sonawari district Bandipora, Sehpora tehsil Anantnag, Watalbagh tehsil Ganderbal, Khanpoora and Sheikhzoo of tehsil Lar district Ganderbal.</p>
<p>In another important decision, the Cabinet approved formation of Special Purpose Vehicle (SPV) for development of the Coal Block at KudnaliLaburi, (Talcher) in Odisha allocated jointly to JKSPD &amp; NTPC by the Union Ministry of Coal.</p>
<p>The SPV Board of Directors will be comprised of five Directors including Administrative Secretary PDD J&amp;K, who will be the Chairperson of the Board of Directors. The approval also includes signing of Joint Venture Agreement by the J&amp;K SPDC &amp; NTPC besides setting up of End Use Power Plant in Odisha with NTPC.</p>
<p>The allocation of the Coal Block is a major achievement for Jammu and Kashmir, which suffers from energy deficit especially during winter season when the generation of power through various HEPs decreases significantly owing to low discharge in the rivers.</p>
<p>The State Government with this major initiative will be able to establish a dedicated base load Thermal Power Station which would effectively wipe out the current energy deficit of nearly 28 per cent and improve the reliability of power supply round the year.</p>
<p>The decision is in line with the broader policy of the State Government under the leadership of Chief Minister Omar Abdullah to make the State energy sufficient by harnessing huge hydro potential available to the State along with the Solar and Thermal Power.</p>
<p>Within next five years, the State Government expects that these efforts will prove to be fruitful for the people and will give major boost to the economy of the State.</p>
<p>The creation of Local Area Development Fund (LADF) for all Hydro-Electric Projects commissioned during and after 2008 with contribution of 1 % free power generated by the project allocated to State for the purpose by all hydro-electric projects also received the nod of Cabinet.</p>
<p>The State Government will also facilitate 1 % by way of Development Grants. A special provision for creation of LADF has been made under the State Hydro Power Policy to carry out Local Development Activities to ensure visible additional benefit to local communities in the project area as part of the cost of the project.</p>
<p>It also approved recasting of Section 185-A(2) of the J&amp;K Water Resources (Regulation &amp; Management) Act, 2010 so that the fund, so created, will be operated upon by the Administrative Secretary, Finance Department, for the purpose of being utilized for the establishment of hydel projects, hydro-electric projects, multi purpose hydro-electric projects, buying back hydro-electric power projects, already established in the State, capital investment in the electric transmission and distribution network within the territory of the State, and the purchase of power by the State Government or its entities, with the prior approval of the Government.</p>

<div>During the cabinet meeting of June 3 that was presided over by J&amp;K Chief Minister, Omar Abdullah, it was decided to increase the retirement age of state employees from 58 to 60, on par with the Central Government employees.</div>

<div>It is worth mentioning here that the resolution marks the successful culmination of more than 6 years of protests and demands made by various employees unions across the state. There are also talks that the decision was made with the Lok Sabha elections in mind, which are due at the end of this year.</div>

<div>The minimum age limit to qualify for state government employment has also been increased by three years to 40.</div>

<p>Once again, raising the retirement age has started making headlines. But this time, they are not rumours or false stories. There is some truth in it. A recognized political party has promised to increase the retirement age of state government employees from 60 to 65.</p>
<p><strong>&#8216;Samajwadi Party&#8217;</strong><br />
In the election manifesto released yesterday, the party has promised to raise the retirement age of the state employees to 65.</p>
<p><strong>Not 62, but 65..!</strong></p>
<p>Retirement age for state government employees differ from state to state. Since the state governments do not follow the Central Government’s retirement age at 60, the demand has now started to show up in election manifestos of different states.</p>
<p>State governments have the power to decide the retirement ages of its employees. The recent Budget happenings of the Kerala State Government in this issue are well known.</p>
<p>Last year, there were a number of developments in this issue for the employees of Uttar Pradesh State Government. Since employees getting job at the age of 40 and retiring at 60 will not be able to complete qualifying service hence, will be devoid of benefits such as gratuity. Therefore, a demand was put forth to increase the retirement age..!</p>
<p>While replying to this question, Minister Mohd Azam Khan said that the State Government had no plans to raise the retirement age. He also accepted that the maximum age for recruitment for State Government employment has been changed to 40. He said that there were currently no plans of increasing retirement age because it would adversely affect the employment opportunities of others.</p>
<p><strong>Amidst these situation, it is worth noting that the Samajwadi party, in its election manifesto, has announced that it would increase the retirement age to 65.</strong></p>
