										<content:encoded><![CDATA[<p><strong>Can the 7th Pay Commission recommend the lowering of retirement age for Central Government employees?</strong></p>
<p>“The unconfirmed information says that the 7th Pay Commission is planning to bring about a dramatic change in the retirement age of Central Government employees”.</p>
<p>Yet another news story about the retirement age of Central Government employees surfaced yesterday. The reputed English news website of India Today featured a special article yesterday about the 7th Central Pay Commission. In the article, the 7th Pay Commission is likely to reduce the retirement age to 55 or on the completion of 33 years, whichever comes first.</p>
<p>This has raised the question in the minds of many if the Pay Commission has the authority to recommend the reducing of retirement age.</p>
<p>The Pay Commission has all the authority to present its explanations and recommendations about changes in the retirement age of Central Government employees. But, the Centre has the discretionary powers to either accept or reject the recommendations.</p>
<p>The fifth Pay Commission recommended that the retirement age be increased. Based on the recommendation, the government increased the retirement age from 58 to 60, in May 1998(Click to view the Dopt Order). The Third Pay Commission also recommended the date of retirement of Central Government employees. The commission recommended that the retirement effect from the afternoon of the last day of the month in which the employee concerned attains the age of superannuation instead of the afternoon of the actual date of his superannuation(Click to view the Dopt Order). But, for now, there’s no confirmed news about the recommendation of reduction in retirement age.</p>
<p>Earlier this year rumors were in circulation that 60 years of age or 33 years of service, then it changed as 58 or 33 years service and now it becomes as 55/33 years. Though many are ready to even accept the changes in retirement age, what is unpalatable for them is the idea of linking the years of service with their age. If a talented employee joins the Central Government services at a very young age, then he is likely to lose up to seven years of service tenure.</p>
<p>All the government employees, especially those above the age of 40, are vehemently opposing the idea. The questions they are putting forth are –</p>
<p><strong>Who are all willing to reduce the retirement age from 60 and why?</strong></p>
<p>Youngsters who are looking for government jobs support the idea of reducing the retirement age. But, the question remains if they will continue to support it once they get the job.</p>
<p>Will the unemployment crisis in the country end if the retirement age is reduced by two years?</p>
<p>Is there any age limit for ministers who handle important responsibilities?</p>
<p>Do politicians have a retirement age from politics?</p>
<p>And so may questions raises in the side of existing workforce.</p>
<p>There is no end to this debate…it continues forever…!<br />

<p><em>“All Government servants are to retire on the last day of the month in which they attain the age of 60 years, subject to the exceptions mentioned therein”.</em></p>
<p>The DoPT Minister informed in the Parliament as a written reply to a question to the subject above mentioned as follows…</p>
<p>As per Rule 56 of Fundamental Rules all Government servants are to retire on the last day of the month in which they attain the age of 60 years, subject to the exceptions mentioned therein. A copy of the relevant rule is annexed. Different age of retirement for certain categories has been fixed on functional requirements.</p>
<p>Employees of the Supreme Court retire on attaining the age of 60 years. The employees of Central Universities are not Central Government employees. However, the retirement age of the employees are as under:-</p>
<p><strong><em>(i) Vice Chancellor – 70 years</em></strong></p>
<p><strong><em>(ii) Teachers – 65 years</em></strong></p>
<p><strong><em>(iii) Registrar – 62 years</em></strong></p>
<p><strong><em>(iv) Finance Officer – 62 years</em></strong></p>
<p><strong><em>(v) Controller of Examination – 62 years Different age of retirement is prescribed on functional requirements.</em></strong></p>
<p><strong>Extracts of Provisions in FR 56</strong></p>
<p>F.R. 56(a) Except as otherwise provided in this rule, every Government servant shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.</p>
<p>Provided that a Government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years. Provided further that a Government servant who has attained the age of fifty-eight years on or before the first day of May, 1998 and is on extension in service, shall retire from the service on expiry of his extended period of service. Or on the expiry of any further extension in service granted by the Central Government in public interest, provided that no such extension in service shall be granted beyond the age of 60 years.</p>
<p>(b) A workman who is governed by these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.</p>
<p>(bb) The age of superannuation in respect of specialists included in the Teaching, Non-Teaching and Public Health Sub-cadres of Central Health Service shall be 62 years. “Provided that for the specialist included in the Teaching sub-cadres of the Central Health Service who are engaged only in teaching activities and not occupying administrative positions, the age of superannuation shall be sixty-five years: provided further that such specialist of the Teaching Sub-cadres of Central Health Service who are occupying administrative positions shall have the option of seeking appointment to the teaching positions in case they wish to continue in service up to sixty-five years.”</p>
<p>(bbb) The age of superannuation in respect of nursing teaching faculty with M.Sc in Nursing in the Central Government Nursing Institutions shall be 65 years subject to the condition that they continue to function as faculty members after the age of 60 years.</p>

<p>NEW DELHI: The Government on Thursday was left in a tizzy over what its officials described as a &#8220;deliberate mischief&#8221; in form of a widely circulated message on Whatsapp that the Union Government had decided to reduce the retirement age of central government employees from 60 to 58 years.</p>
<p>The message also cited a purported answer given by the Ministry of Personnel in Parliament on December 11 to say that the government will bring a bill in Parliament in February-March 2015 to reduce the retirement age to 58. The government has now begun an inquiry to trace the person who circulated this wrong message as it caused considerable confusion among the bureaucracy and the political class as the purported move to reduce the retirement age was reported by some television channels as well as posted widely on social networking websites. Urban Development Minister Venkaiah Naidu had to get up in Parliament on Thursday afternoon to deny any such move to reduce the retirement age and posted the same on his Twitter account. Minister of State for Personnel, Jitendra Singh, who had answered a question in Parliament on Thursday saying there was no move to reduce the retirement age, had to make a statement to Doordarshan and ANI in the evening to set the record straight. The Press Information Bureau (PIB) sent out multiple messages and also issued an official statement in the night saying there was no such proposal.<br />
A senior government official said a probe has been necessitated to trace out the offender as a parliament reply given earlier by the Ministry of Personnel on December 11 had been twisted and a wrong picture painted of the contents of the said reply in the widely circulated WhatsApp message. On December 11, the Ministry of Personnel was in fact asked if there was a move to increase the retirement age from 60 to 62. The Ministry replied that there was no such move. But the said Whatsapp message said the Ministry was asked on December 11 was whether the retirement age would be reduced from 60 to 58 and claimed the government had answered in the affirmative and also said a bill will be brought to Parliament in February-March 2015 for the same. &#8220;This is a completely wrong message and a deliberate mischief by someone,&#8221; a senior government official said, adding that an inquiry has been started to trace out the said person.</p>
