<p>I am directed to forward herewith a copy of Office Memorandum No.142/80/2015-A.V.D.  dated 15th September, 2017 on the subject cited above wherein the DOP&amp;T has circulated instruction on utilizing the services of retired Officers for conducting departmental inquiries (copy enclosed).</p>



<p>2. It is stated that panels of retired officers (not below the rank of Deputy Secretary) from the Ministries/ Department under Government of India and PSUs is to be created and maintained for conducting Departmental Inquiries against the delinquent officers.</p>



<p>3 It is therefore requested that names of retired officers (not below the rank of Deputy Secretary) willing to act as Inquiry Officers for conducting Departmental Inquiries may be forwarded to the following address Shri Nahar Singh Meena, Section Officer, Room 108 D, Vigilance Section, Department of Pests, Dak Bhawan, Sansad Marg. <p>Subject: <strong>Procedure for empanelment of retired officers as the Inquiry Officers for conducting Departmental Inquiries- reg.</strong></p>
<p>The undersigned is directed to state that the issue of utilizing the services of retired officers for conducting departmental inquiries had been under consideration of the Department. It has now been decided that panels of retired officers from the Ministries/Departments under Government of India and PSUs would be created and maintained by the respective Cadre Controlling Authorities for conducting Departmental Inquiries against the delinquent officials.</p>
<p>2. <strong>Procedure for empanelment of retired officers as the Inquiry Officers</strong> &#8211; Panels of retired officers not below the rank of Deputy Secretary in Central Government and equivalent officer in the State Governments/PSUs to be appointed as the Inquiry Officer for the purpose of conducting departmental inquiries would be maintained level/rank wise and place-specific by each cadre controlling authority where its offices are located.</p>
<p>3. <strong>Validity of the panel</strong> &#8211; The panel of the retired officers created for the purpose of appointing Inquiry Officers for conducting departmental inquiry will be valid for a period of three years. The respective Cadre Controlling Authority will ensure that a panel of retired Inquiry Officers is available with them.</p>
<p>4. Following are the eligibility conditions for appointment of willing retired officers as the Inquiry Officers to conduct departmental inquiries:-</p>
<blockquote><p>(i) Retired officers who are willing to serve as Inquiry Officer.<br />
(ii) He/she should not have been penalized in a Disciplinary Proceeding case (no penalty in DP or prosecution in criminal case)</p></blockquote>
<p>5. The respective Cadre Controlling Authority will immediately take necessary action for inviting applications from willing and eligible retired officers to serve as the Inquiry Officer for conducting departmental inquiry. In this regard, a format for inviting applications is annexed.</p>
<p>6. A three-member committee consisting of Joint Secretary level officers including CVO of the concerned Ministry/Departments/PSUs would be constituted by the respective cadre controlling authority. The other two members can be from the same Ministry/Department or from the attached or subordinate office. After receipt of willingness of the retired officers, names of the officers will be screened by the committee so constituted. The formation of panel will be a continuous and ongoing process. The DA will decide on the appointment of the JO based on willingness for a case, experience in the sector and status of residence. Committee constituted for making panels of retired officers as the Inquiry Officer has to keep in mind that applications of retired officers willing to serve as an Inquiry Officer should be scrutinized carefully to ensure that the applicant meets the eligibility criteria.</p>
<p>7. The number of disciplinary cases assigned to an Inquiry Officer may be restricted to 8 cases in a year, with not more than 4 cases at a time.</p>
<p><strong>8. Terms and conditions for appointment of retired officers as the Inquiry Officer.</strong></p>
<p>The designated Inquiry Officer shall require to give an undertaking as follows:-</p>
<blockquote><p>(i) that he/she is not a witness or a complainant in the matter to be inquired into or a close relative or a known friend of the delinquent Government officer. A certificate to this effect will be obtained from the Inquiry Officer with respect to every inquiry and placed on record</p>
<p>(ii) shall maintain strict secrecy in relation to the documents he/she receives or information/data collected by him/her in connection with the inquiry and utilize the same only for the purpose of inquiry in the case entrusted to him/her.</p></blockquote>
<p>9. No such documents/information or data shall be divulged to anyone during<br />
the Inquiry or after presentation of the Inquiry Report. All the records, reports etc. available with the Inquiry Officer shall be duly returned to the authority which appointed him/her as such, at the time of presentation of the Inquiry Report.</p>
<p>10. The Inquiry Officer shall conduct the inquiry proceedings at a location taking into account the availability of records, station/place where the misconduct occurred as well as the convenience of the witnesses/ PO etc. Video Conferencing should be utilized to the maximum extent possible to minimize travel undertaken by the IO/PO/CO. The cadre controlling authorities will facilitate necessary arrangements for the Video Conferencing.</p>
<p>11.The Inquiry Officer shall undertake travel for conducting inquiry (in unavoidable circumstances) with the approval of an authority as may be nominated by the concerned Ministry/Department.</p>
<p>12.The Inquiry Officer shall submit the inquiry report after completing the inquiry within 180 days from the date of his/her appointment as the Inquiry</p>
<p>Officer. Extension of time beyond 180 days can be granted only by the Authority as may be prescribed.</p>
<p>13. The rates of honorarium and other allowances payable to the Inquiry Officer will be as under:-</p>

<p>50% will be paid on submission of the Inquiry Report. Remaining amount will be paid within 45 days. In case it is not possible to proceed with the matter due to stay by courts etc., the Inquiry Officer may be discharged from his/her duties and payment of honorarium and other allowances will be made on pro rata basis.</p>
<p>14. Before the payment is received by the Inquiry Officer, it will be his/her responsibility to ensure that:-</p>
<blockquote><p>(a)All case records and inquiry report (two ink signed copies) properly documented and arranged is handed over to the office of Disciplinary Authority.</p>
<p>(b)The report returns findings on each of the Articles of Charge which has been enquired into should specifically deal and address each of the procedural objections, if any, raised by the charged officers as per the extant rules and instructions.</p>
<p>(c)There should not be any ambiguity in the inquiry report and therefore every care should be taken to ensure that all procedures for conducting departmental inquiries have been followed in accordance with the relevant rules/instructions of disciplinary and appeal Rules to which the delinquent Government officials are governed.</p></blockquote>
<p>15. Letter regarding engaging a retired officer as the Inquiry Officer will only be issued with the approval of the Disciplinary Authority of the Ministry/Department/ Office concerned.</p>
<p>16. A review of every empanelled Inquiry Officer will be done after receipt of 2 inquiry reports where adherence to time lines and the procedure and quality of work will be assessed by the concerned Ministry. Subsequent allocation of work may be done only after such evaluation. The services of Inquiry Officers whose performance is not upto the mark will be terminated with the approval of appointing authority.</p>
<p>17.Any issue arising out of this O.M. between the Inquiring Officer and the Disciplinary Authority will be decided by the Secretary , DoPT whose decision shall be final and binding on both parties.</p>
<p>18.These guidelines are issued for internal use of DoPT and other Cadre controlling authorities may adopt the same with suitable amendments.</p>

<p>5. Adoption of mutually agreed transfer policy for AAOs and implementation of the policy transparently and filling up of vacant posts by providing promotions to Civil Accounts Employees.</p>

<p>7.  Imparting training and grant of incentive for implementation of e-payment system.</p>
<p>8. Removal of discrimination in the date of effect of Promotion and grant of date of effect of promotion from 1st January of the year to all cadres.</p>
<p>9. Allotment of one seat in the National Council,(JCM) and 2nd seat in Departmental Council(JCM) to All India Civil Accounts Employees Association.</p>
<p>10. Counting of service for Grant of benefit of II ACP to Sr. Accountant appointed as Accountant-</p>
<p>(a)  from the date passing departmental competitive examination conducted by SSC.<br />
(b) from  the 1st July of the next year of passing open examination conducted by SSC as per orders of DOPT and MHA</p>
<p>11. Grant Pay Scale of Rs. 1350-2200 from 01.01.86 to DEOs as has been granted by the Defence Accounts Department as well as in terms of the CAT judgments.</p>
<p>12. Removal of injustice to newly recruited Accountant in the matter of granting 1st increment through rectification of the procedure of Departmental Confirmatory test and also imparting training to the candidates.</p>
<p>13. Grant of two financial up gradation to MTS under ACP scheme who had completed 24 years of service before implementation of MACP Scheme as has done by the O/o the Pr. of Audit and Director, Economic service Ministries, Delhi vide order No:- AMG.I/Admn-1/32 dated 24.06.2014 .</p>
<p>14. Grant of Headquarter allowance to Sr.PS/PS/Stenos posted in office of CGA.</p>
<p>15. Removal of anomaly in grade pay arisen in PAO, CRPF after amalgamation of the office in Civil Accounts Organization.</p>
<p>16. As per decision of Supreme Court, payment of arrears in cash from 01.01.1996 to 18-02-2003 to Sr. Accountants due to upgradation of pay scale from 1-1-1996 .</p>
<p>17. Decentralization of CPAO and formation of regional offices to make the very purpose of operation of Pension Accounting Offices effective and conveniently accessible to old aged Pensioners.</p>
<p>18. Relaxation for revision of option for fixation of pay in the revised pay structure for persons promoted to the grade of Asstt. Accounts Officer (AAO) after 01.01.2006.</p>
<p>19. As has been done in earlier occasions and granted by Defence Accounts Department, Grant of honorarium for checking of pay fixation cases and pension cases after implementation of 6th CPC recommendations.</p>
<p>20.  No redeployment of retired officers and employees in the Civil Accounts Organization.</p>

<p style="text-align: left;">Subject : <strong>Empanelment of public spirited senior level retired Civil / Defence Service Officers as National Level Monitors(NLMs) for monitoring implementation of rural development programmes.</strong></p>
<p>The undersigned is directed to refer to Ministry of Personnel, Public Grievances &amp; Pensions, Department of Pension &amp; Pensioners’ Welfare D.O. letter No.4/36/2013-P&amp;PW(D) dated the 23rd December, 2013 and to say that the Ministry of Rural Development has evolved a comprehensive system of independent third party monitoring of implementation of its rural development programmes across the country by deputing Individual and Institutional National Level Monitors(NLMs) who are public spirited senior level retired Civil/Defence Service Officers and Academia, for ensuring accountability and transparency in the execution of various programmes of this Ministry. The experience/exposure to rural development and rural development related programmes is required for empanelment as Individual NLM. The empanelment of NLMs are done against open advertisement issued in the leading Newspapers and on the website of the Ministry inviting applications from eligible and willing Individuals and Institutions for empanelment as NLMs. As per the scheme, following categories/level of retired officers having working knowledge on computer use, upto the age of 65 years as on specified date of publication of advertisement, are eligible for empanelment as Individual NLM:</p>
<blockquote><p>a) ex-service officer from the Armed Forces of the rank of Lt. Colonel and above,<br />
b) retired officers of Para Military Forces having equivalent rank to Lt. Colonel or above in the Armed Forces,<br />
C) retired Central/State Government Officers including IT professionals and Management Experts of the level of Deputy Secretary and above to the GOl,<br />
d) retired Engineers of the rank of Superintendent Engineer and above in Central/State Government,<br />
e) retired officers of the rank of Deputy Secretary in the offices of AGs and the Comptroller and Auditor General of India.<br />
f) retired police officers of the rank of Superintendent of Police and above.<br />
g) retired professors of any recognized University/Research Institutionsl Scientific organization, and<br />
h) retired PSU/PSB officers of the rank of Deputy General Manager and above</p></blockquote>
<p>2. This Ministry pays TA/DA and other monitoring charges to the NLMs as per terms and conditions of their services, The reports submitted by the NLMs are sent to the Programme Divisions of this Ministry for taking follow-up action on all the NLM reports. The reports of NLMs are also shared with the District Collector and the Chairman of the Vigilance and Monitoring Committee of the district for corrective measures.</p>

Subject: Engagement of Retired Central Government Officers as Consultants in the Department of Heavy Industry, Ministry of Heavy Industries &amp; Public Enterprises.</p>
<p>The Department of Heavy Industry proposes to prepare a panel of officers of Central Government, who have retired from the Service or will be retiring in the next 3 months at Section Officers’ level in the Grade Pay of Rs. 4800/- &amp; above, for engagement as Consultants against the vacancies at Section Officers’ level. They should have experience of minimum 10 years in Administration / Record Management / Finance / Procurement / Parliament matters / Legal matters and also have working knowledge of Computer. The initial engagement will be for a period of one year and may continue further subject to their performance &amp; availability of vacancies. The maximum age limit for engagement as Consultant is 65 years.</p>
<p>2. Such persons would get monthly remuneration equivalent to their Last Pay Drawn (Band Pay + Grade Pay + <a href="http://centralgovernmentnews.com/category/dearness-allowance/">Dearness Allowance</a>) minus Basic <a href="http://centralgovernmentnews.com/category/pension/">Pension</a> &amp; Dearness Pension.</p>
<p>3. The willing &amp; eligible retired/retiring officers of Central Government are requested to send their Bio-Data and contact details, specially mentioning the details of their Experience/Grade Pay drawn etc. to the undersigned positively by 31st July 2013.</p>

<p>The undersigned is directed to forward herewith a copy of a circular No. A- 32013/06/2011-Ad.l dated 31st/4th June, 2012 of Ministry of Home Affairs inviting panel of retired Section Officers/Officers who were holding analogous posts in purely Government organisations for engagement as Consultants in various Divisions of the Ministry of Home Affairs for information and necessary action.</p>
