<p>In supersession of this Ministry’s letter no V-11013/07/2018 -BAE dated 18.08.2021, approval of the Competent Authority is hereby conveyed for implementation of Hon’ble CAT PB order dated 05.07.2022 in OA No 100/2691/2021 filed by Shri Bhanwar Lal Rawal &amp; Ors. regarding <strong>grant of final pension with all pensionary benefits to the retiring/ retired government servants</strong>.</p>



<p>2. However, before releasing the final pension and all pensionary benefits to the retiring/retired government servants, an undertaking may be taken from them that <em><strong>if any excess payment is made to an individual, then the same shall be recovered from him or her after the disposal of the WP No 9890/2019 pending before the Hon&#8217;ble High Court or any other similar litigation.</strong></em></p>



<p>3. In view of the above, CCA, MIB may issue necessary instructions to all PAOs for release of final pension and all pensionary benefits to retiring/retired government employees of AIR/DDn immediately.</p>



<p>4. This matter may be accorded “Top Priority”.</p>

<p>Sub :- <strong>Waiver of recovery of wrongful/ excess payments made to retired Government servants &#8211; regarding</strong></p>



<p>The undersigned is directed to say that Hon’ble Supreme Court in the case of State of Punjab and Others Vs. Rafiq Masih (White Washer), etc. in C.A. No. 11527 of 2014 summarised a few situations wherein recoveries by the employers would be impermissible in law. One of these situations relates to recovery from retired employees or employees who are due to retire within one year of the order of recovery.</p>

<ol class="wp-block-list" start="2"><li>Based on the above judgment, Department of Personnel &amp; Training has issued instructions vide their OM No. 18/03/2015-Esst. (Pay-l) dated 02.03.2016 that the issue of wrongful/excess payment made to Government servants may be dealt with in accordance with the decision of the Hon’ble Supreme Court in the above mentioned case. The instructions further provide that wherever the waiver of recovery in the situations mentioned in that OM is considered, the same may be allowed with the express approval of Department of Expenditure in terms of DoPT’s OM No. 18/26/2014-Estt (Pay-l) dated 06.02.2014.</li><li>In order to examine the matter in its entirety, all Ministries/Departments and Pension Disbursing Banks are requested to provide the following information regarding excess payment of pension and other retirement benefits to the retired Government employees:</li></ol>



<ul class="wp-block-list" id="block-219a09f3-cb3f-4f80-bcdd-d4957160a65b"><li>No. of retired employees from whom recovery of excess payment of pension and other retirement benefits has been made or is sought to be made by the Ministry/ Department as well as its attached offices and subordinate offices.</li><li>No. of pensioners from whom recovery of excess payment of pension and other retirement benefits has been made or is sought to be made by the Pension Disbursing Bank.</li><li>Period of excess payment in each case and the date on which excess payment was noticed.</li><li>Amount of excess payment in each case.</li><li>Whether any court/ CAT order has been received for waiver of recovery of excess payment in the light of the judgement of Hon’ble Supreme Court in Rafiq Masih’s case. If so, the details of such cases received in last three years (year-wise) and action taken on the order of court/ CAT may be indicated</li><li>Whether any representation has been received for waiver of excess payment. If so the details of such representations received in last three years (year-wise) and action taken on the representations may be indicated.</li></ul>



<p>4. All the Ministries/Departments are, therefore, requested to furnish the information sought in para 3 above to this Department by 15.09.2020 positively.</p>

<ol class="wp-block-list"><li>Pension/ Earnings of Senior Citizens may be exempted from Income Tax upto Rupees 15 lakhs per annum.</li><li>Additional quantum of pension may be allowed to the pensioners on attainment of 70 years age instead of 80 years as at present with further increase to those who attain 80 and 85 years age.</li><li>Restoration of commuted value of pension be done on completion of 10 years instead of 15 years.</li><li>The <a rel="noreferrer noopener" aria-label="Single Female Government Employees (opens in a new tab)" href="https://centralgovernmentnews.com/provision-for-granting-special-casual-leave-for-the-woman-employees-working-in-the-central-government-organizations/" target="_blank">Single Female Government Employees</a> be granted &#8220;Old Age Parent Care Leave&#8221; on the pattern of &#8220;Child Care Leave&#8221;.</li><li>Female Government Employees be allowed 05 days extra Casual Leave to facilitate maintaining their health (specially those females of age 50 years and above), keeping in view the peculiar menopause stage leading to hormonal changes as has been granted to &#8220;Physically Challenged Employees&#8221;.</li><li><a rel="noreferrer noopener" aria-label="Child Care Leave (opens in a new tab)" href="https://centralgovernmentnews.com/child-care-leave-dopt-and-finmin-orders/" target="_blank">Child Care Leave</a> for women employees be granted with full salary in the 2nd year as against 80% of salary at present.</li><li><a rel="noreferrer noopener" aria-label="Accumulation of Earned Leave  (opens in a new tab)" href="https://centralgovernmentnews.com/lap-accumulation-of-earned-leave-leave-on-average-pay-beyond-the-ceiling-of-300-days/" target="_blank">Accumulation of Earned Leave </a>(EL / LAP) by Government employees in excess of 300 days be allowed without restriction in the light of judgement delivered by the Punjab &amp; Haryana High Court.</li><li>Family Planning Allowance, discontinued with effect from July I, 2017 should be restored and continued wherever already granted in terms of provisions made by the Government of India.</li><li>Pay re-fixation be granted to the retired Defence Forces Personnel re-employed in the Central Government Department / Organizations on the basis of last pay drawn by them at the time of retirement from Armed Forces.</li><li><a rel="noreferrer noopener" aria-label="Fixed Medical Allowance (opens in a new tab)" href="https://centralgovernmentnews.com/pensioners-eligible-for-fixed-medical-allowance-from-the-date-of-application-for-fma/" target="_blank">Fixed Medical Allowance</a> for retired Government employees be enhanced to not less than Rs. 3000 per month as against Rs. 1000 p.m. at present in view of high cost of medicines and medical treatment.</li><li>Provision be made for construction of Shelter Homes for Pensioners at various locations in the country.</li><li>Reimbursement of Tuition fee and Hostel subsidy be allowed upto Post Graduation level in the case of wards of Central Government employees.</li><li>Reimbursement of College/ Hostel fee may also be permitted in the case of wards of retired Government employees (pensioners).</li><li>Provision of accommodation for Office /recreation purposes be made to various Pensioners&#8217; Orgarizations in the country.</li></ol>

<p>Selfies can&#8217;t be used as photographs in pension forms, the personnel ministry has told central government employees readying for retirement.</p>

<p>Issuing a fresh set of dos and don&#8217;ts for civil pensioners, the Ministry of Personnel, Public Grievances and Pensions has also ruled out photographs with coloured and dark glasses and long hair covering the eyes.</p>
<p>Do not paste/upload black and white photographs. Dimensions of photographs and signature should not be smaller that the box provided in the application form. Photograph should not be in the form of selfie, it said in its recent directive.</p>
<p>Central government civil pensioners are required to submit three copies of a joint photograph (or separate photographs) with their wives or husbands (duly attested by head of office) along with form 5 of the <strong>Central Civil Service Pension Rules 1972</strong> for affixing on a payment pension order.</p>
<p>A government servant must get the form, which has fields to fill in personal details, from the head of office eight months before the date of his or her retirement.</p>
<p>According to the ministry, a photograph with a dark background or in uniform, or with eyes hidden under coloured or dark glasses will not be accepted. Photograph in computer print will not be accepted, it said.</p>
<p>The photograph is not to be signed and the eyes must not be covered by hair, the ministry said.</p>
<p>Glares on eyeglasses should be avoided with a slight upward or downward tilt of the head, it said.</p>
<p>The ministry has issued the fresh set of guidelines to all central government departments.</p>
<p>The purpose behind issuing these guidelines is to ensure prompt disposal of pension cases so that retired government employees do not have to wait for long to get their pension, a senior ministry official said.</p>
<p>There are about 48.41 lakh central government employees and 61.17 lakh pensioners.</p>

<p><strong>Interactive Awareness Workshop Under Pensioners’ Portal</strong></p>
<p>The Department of Pension and Pensioners Welfare, Ministry of Personnel, Public Grievances and Pensions is implementing a web based mission mode project on pensions namely Pensioner’s Portal under the National e-Governance Plan. The Department has also started initiative called SANKALP for channelizing the experience and skill of Pensioners towards meaningful social activities.</p>
<p>The Department is proposing to conduct the next such Awareness Programme for Pensioners at Assam Rifles Garrison, Near D.C. Office, Kohima (Nagaland) on 25.03.2015. The meeting will be chaired by Secretary (P,AR&amp;PG).</p>
<p>The basic objective of the project is to facilitate redressal of Pensioners’ Grievances as also to provide information and guidance to pensioners on various pension and retirement related matters. User Ministries/Departments, Pensioners, Banks, Controller General of Accounts (CGA), Central Pension Accounting Office (CPAO), Post Offices etc. are the stakeholders in this venture aimed at welfare of the Pensioners.</p>
<p>With a view to providing know how about the operational aspects of this Portal and the Grievances Redressal Mechanism in particular, the Department of Pensions is conducting Awareness Programmes at different locations in the country.</p>
