<p>As per extant instructions, reservation is provided to Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs) at the rate of 15%, 7.5% and 27% respectively in case of direct recruitment on all India basis by open competition. In case of direct recruitment on all India basis otherwise than by open competition, the percentage fixed is 16.66% for SCs, 7.5% for STs and 25.84% for OBCs.</p>



<p>In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation for SC / ST / OBC is generally fixed on the basis of proportion of their population in the respective States / Union Territories.</p>



<p>With the enactment of &#8216;The Rights of Persons with Disabilities Act, 2016&#8217;, reservation is also provided to Persons with Benchmark Disabilities against the posts and services of the Central Government at 4% of the total number of vacancies to be filled up by direct recruitment in the cadre strength in each group of posts i.e. Group A, B and C.</p>



<p>As per Ex-servicemen (Re-employment in Central Services and Posts) Rules, 1979, as amended from time to time, 10% of the vacancies in the posts upto of the level of the Assistant Commandant in all para-military forces; (ii) 10% of the vacancies in Group C posts; and (iii) 20% of the vacancies in Group D posts, to be filled by direct recruitment shall be reserved for ex-servicemen.</p>



<p>The persons belonging to Economically Weaker Sections (EWSs) who are not covered under the scheme of reservation for SCs, STs and OBCs shall get 10% reservation in direct recruitment in civil posts and services in the Government of India.</p>

<strong>Insurance of Rail Passengers</strong></p>
<p style="text-align: right;">01 AUG 2018</p>
<p style="text-align: left;">An Optional Travel Insurance Scheme was launched w.e.f 01.09.2016 for the Confirmed/RAC Railway passengers who book e-ticket through official website of Indian Railway Catering &amp; Tourism Corporation (IRCTC) portal at the premium of Rs. 0.92 per passenger. Under the scheme, sum assured is paid to the victim/family or legal heir of the victim as the case may be in case of death/injury of reserved passengers due to train accident/untoward incidents as defined under section 123 read with Sections 124 and 124A of the Railways Act, 1989, subject to the qualification that the coverage will be valid from the actual departure of train from the originating station to actual arrival of train at the destination station including &#8216;process of entraining&#8217; and &#8216;process of detraining&#8217; the train.</p>
<p>Subsequently, to promote digital/cashless transaction, insurance is being provided free of cost from 10.12.2016 to all the Confirmed/RAC Railway passengers buying online ticket from IRCTC and no premium is being charged from the passengers.</p>
<p>The sum assured to be given to victim/family or legal heir of the victim are as follows:-</p>
<p><strong>(i) In case of Death- Rs. 10 lakh,</strong></p>
<p><strong>(ii) Permanent Total Disability &#8211; Rs.  10 Lakh,</strong></p>
<p><strong>(iii) Permanent Partial Disability upto &#8211;  Rs.  7.5 Lakh,</strong></p>
<p><strong>(iv) Hospitalization Expenses for Injury &#8211; Rs.  2 Lakh,</strong></p>
<p><strong>(v) Transportation of mortal remains &#8211; Rs.  10 Thousand.</strong></p>
<p>IRCTC which is a wholly owned undertaking of Ministry of Railways has entered into an agreement with three Insurance Companies through Limited Tender, namely (i) Shriram General Insurance Company Ltd., (ii) ICICI Lombard General Insurance Company Ltd., &amp; (iii) Royal Sundaram General Insurance Co. Ltd..</p>
<p>Compensation liability of Railway for death or injury of Railway passengers in train accidents and untoward incidents is laid down in Section 124 and 124A read with Section 123 of Railways Act, 1989. The amount of compensation is Rs. 8 Lakh in case of death and Rs. 64000 to Rs. 8 Lakh in the case of injury, depending upon the gravity of injury.</p>
<p>The insurance scheme is available to passengers of all reserved classes (SL, 1AC, 2AC, 3AC) of all trains (except passenger trains &amp; sub-urban trains) for only tickets booked online on the IRCTC websites. Passengers booking reserved tickets through the manually operated Railway reservation counters and those travelling on unreserved tickets are not entitled to avail of this insurance scheme.</p>

<p>Subject: <strong>Implementation of Resenation Policy of the Government of India &#8211; Reg.</strong></p>
<p>Sir/Madam,</p>
<p>With reference to the above subject, I am to inform that for implementation of reservation policy of the Central Government. MHRD vide order No.6-30/2005-U5 dated 6th December, 2005 directed the UGC to ensure effective implementation of the reservation policy in the Central Universities and those of Institutions Deemed 10 Universities receiving aid from the public funds except in minority institutions under Article of the Constitution. Accordingly, UGC, vide letter No.1-5/2006(SCT) dated 25-08-2006, circulated new Guidelines for strict implementation of Reservation Policy of the Government. This has been further reiterated by MHRD O.M.No.12-60/2013-UI dated 25-6-2013.</p>
<p>The Ministry of Human Resource Development vide its letter No. 1-7/2017-CU.V dated 06-09-2017 has directed the UGC to examine the issues mentioned in judgments (10 in number) quoted by the Hon&#8217;ble High Court Of Allahabad, in its order dated 07-04-2017 and submit its recommendations to MHRD for their consideration and appropriate decision.</p>
<p>Accordingly, UGC had constituted a Committee and submitted its recommendations to Ministry of Human Resource Development on 07-11-2017. Thereafter, in compliance of the judgement Of the Allahahad High Court upheld by the Hon&#8217;ble Supreme Court Of India and in view of tendered by the DOPT and recommendations Of the UGC, MHRD vide its O.M.No.1-7/2017-CU.V dated 22.2.2018; has intimated that the department&#8217;s O.M. No.12-60/2-13-UI dated 25-06-2013 stands amended to the extent mentioned below in the UGC guidelines 2006, in accordance with the recommendations of the UGC, which are as under:</p>
<p><strong>&#8220;(i) Clause 6(c);</strong><br />
In case of reservation SC/ST, all the Universities, Deemed to be Universities, Colleges and other Grant-in-Aid institutions and Centres shall prepare the roster system keeping the Department Subject as a unit for an levels of teachers as applicable.</p>
<p><strong>(ii) Clause 8(a)(v):</strong><br />
The roster, department-wise, shall be applied to the total number of posts in each of the categories [(e.g.) Professor, Associate Professor, Assistant Professor] within the Department/Subject&#8221;.</p>
<p>The above decision may also be circulated to its constituent and affiliated colleges for immediate follow up action.</p>
<p>You requested to prepare fresh within month of receipt of this letter under intimation to UGC.</p>
<p>This isues with the approval of the Competent Authority.</p>

<p>The Ministry of Women and Child Development is considering taking up a proposal for age relaxation for widows for employment in Government and Central PSUs. The Ministry is also considering moving a proposal for tax rebates for single women who are having children. These are at a preliminary stage and formal proposals have not yet been prepared.</p>
<p>This information was given by the Minister of Women and Child Development, Smt Maneka Sanjay Gandhi in reply to a question in the Rajya Sabha today.</p>

										<content:encoded><![CDATA[<p><strong>Changes in Reservation Policy</strong></p>
<p>The policy of reservation to Scheduled Castes and Scheduled Tribes in services under the Government of India is administered through various executive instructions issued from time to time, copies of which are available on DoPT’s website.</p>
<p>While upholding the validity of Constitution amendment to provide reservation in promotion in favour of Scheduled Castes and Scheduled Tribes, the Hon’ble Supreme Court in the M.Nagaraj case prescribed certain conditions. The Hon’ble Rajasthan High Court also quashed the notifications providing for consequential seniority and promotion to the members of the Scheduled Castes and Scheduled Tribes. This judgment was upheld by the Apex Court in its judgment dated 7.12.2010.</p>
<p>In order to provide impediment free reservation to Scheduled Castes and Scheduled Tribes in promotion, a Constitution (117th Amendment) Bill was introduced in the Rajya Sabha and was passed on 17.12.2012. The Bill, however, could not be considered in the 15th Lok Sabha and lapsed on its dissolution. The matter is under examination.</p>
<p>This was stated by the Minister of State for Personnel, Public Grievances and Pensions Dr. Jitendra Singh in a written reply to Shri Harish Meena in the Lok Sabha today.</p>

<p>While answering to a question in Lok Sabha on 9th July 2014, Minister of DoPT Shri DR.Jitendra Singh said in a written form as follows…</p>
<p>Department of Personnel and Training is the nodal department for formulating policies, inter-alia, on reservation in services for Scheduled Castes, Scheduled Tribes and Other Backward Classes. It is for each Ministry/Department to implement the orders of reservation policy scrupulously. Complaints from individuals regarding non-implementation of reservation policy are forwarded to the concerned Ministries/Departments for appropriate action.</p>
<p>Moreover, Liaison Officers have been appointed in all the Ministries/Departments and offices under the control of Heads of Departments to ensure due compliance of reservation policy. Instructions also exist that Scheduled castes/ Scheduled Tribes employees can directly submit their complaints to National Commission for Scheduled Castes and National Commission for Scheduled Tribes, as the case may be.</p>
<p>As per decision of the Supreme Court, total reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes cannot exceed the limit of 50%.</p>

Will the Minister of PERSONNEL,PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-</p>
<p>(a) whether the Ministries and Undertakings are not complying properly with the reservation policy in appointment;<br />
(b) if so, the action taken by the Government in view of the recommendations of the National Commission for Scheduled Castes and Scheduled Tribes with regard to filling up of the reserved vacancies;<br />
(c) whether the Government proposes to introduce any bill in this regard;<br />
(d) if so, the details thereof;<br />
(e) the details of requests received from various social organizations/peoples` representatives in this regard till date; and<br />
(f) the action taken/being taken by the Government in this regard?</p>

<p>(a) &amp; (b): Policy of reservation in appointments under the Government of India is complied with by the Central Government Departments/Ministries as per the instructions issued from time to time by the Department of Personnel and Training. The Central Government has also been launching ‘Special Recruitment Drives’ from time to time to fill up the backlog reserved vacancies. The Central Public Sector Undertakings also follow these instructions mutatis mutandis.</p>
<p>Necessary consultation is made with the National Commission for Scheduled Castes and National Commission for Scheduled Tribes in policy matters affecting the interests of the Scheduled Castes and Scheduled Tribes as per the provisions of Article 338 and 338A of the Constitution.</p>
<p>(c): The Government has not taken any decision in the matter.</p>
<p>(d): Does not arise, in view of reply given to part (c) of the Question.</p>
<p>(e) &amp; (f): Various representations are received from Associations, Hon’ble Members of Parliament etc. from time to time and their suggestions/recommendations are kept in view by the Government at the time of taking any decision in the matter of reservation policy.</p>

<p><strong>Welfare Measures for Persons with Disabilities</strong></p>
<p>Section 2 of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) (PwD) Act, 1995 defines &#8220;Disability&#8221; as:-</p>
<p>(i) Blindness;</p>
<p>(ii) Low vision;</p>
<p>(iii) Leprosy-cured;</p>
<p>(iv) Hearing impairment;</p>
<p>(v) Loco motor disability;</p>
<p>(vi) Mental retardation;</p>
<p>(vii) Mental illness;</p>
<p>As per Section 2 (t) of the PwD Act, person with disability means a person suffering from not less than forty percent (40 percent) of any disability as certified by a medical authority.</p>
<p>As per Section 33 of the PwD Act, 1995, every appropriate Government shall appoint in every establishment such percentage of vacancies not less than three percent for persons or class of persons with disability of which one per cent each shall be reserved for persons suffering from-</p>
<p>(i) Blindness or low vision;</p>
<p>(ii) Hearing impairment;</p>
<p>(iii) Loco motor disability or cerebral palsy, in the posts identified for each disability:</p>
<p>Provided that the appropriate Government may, having regard to the type of work carried on in any department or establishment, by notification subject to such conditions, if any, as may be specified in such notification, exempt any establishment from the provisions of this section.</p>
<p>As per Section 39 of the PwD Act, 1995, all Government educational institutions and other educational institutions receiving aid from the Government, shall reserve not less than three per cent seats for persons with disabilities.</p>
<p>Government has issued instructions that PwDs should be provided reservation in all Groups of identified posts, in the matter of direct recruitment and in Group ‘C’ and ‘D’ posts identified, in the matter of promotion. Vide O.M. dated 26th December, 2012, Government has issued instructions to ensure that Persons with Disabilities (PwDs) get a equal opportunity in consideration for appointment to an identified post.</p>
<p>The Government has finalized a Draft Rights of Persons with Disabilities Bill proposing reservation of not less than 5% of the posts for the persons with disabilities.</p>

<p><strong>Revision of Income Criterion for Obcs</strong></p>
<p>The Government has increased the income criterion for the persons to avail reservation benefits for Other Backward Classes from Rs. 4.5 lakh to Rs. 6 lakh per annum with effect from 16.05.2013.</p>
<p>The increase in the income limit to exclude Creamy Layer is in keeping with the increase in the Consumer Price Index.</p>
<p>The increase in income limit of Creamy Layer would enable more people of Other Backward Classes to take advantage of reservation in Government Services and admission in Central Educational Institutions, thereby bringing about equity and greater inclusiveness in society.</p>

<p>Subject: <strong>Filling up <a href="http://centralgovernmentnews.com/?s=Backlog+Vacancies" target="_blank">backlog vacancies</a> reserved for Scheduled Castes (SCs)/Scheduled Tribes (STs)/Other Backward Classes (OBCs).</strong></p>
<p>A Special Recruitment Drive for filling up of the backlog vacancies reserved for SCs/STs/OBCs had been launched in November, 2008 and was concluded on 31st March, 2012.</p>
<p>2. Achievement of the Drive as reported by various Ministries / Departments on its conclusion revealed that out of total 75,522 identified backlog vacancies , there were 64,175 backlog vacancies which could be filled up and of these, 48,035 vacancies were filled up. Overall success rate of the Drive was 74.85%. Reasons for non-filling up of reserved vacancies may be attributed to the lack of finishing skills like English fluency or interview skills, non availability of qualified reserved category candidates for posts requiring professional qualification especially in ST category, scarcity of qualified reserved category persons results in job switch over or not joining after selection as they get better jobs and in some cases selection is done on all India basis whereas allocation is made zone/State wise.</p>
<p>3. The Government considered the status of filling up of backlog vacancies reserved for SCs/STs/OBCs and desired that concerted efforts be made to fill up the backlog vacancies at the earliest and the status of action taken in this regard be monitored at the highest level. Besides, actions on the following measures are to be taken at the earliest to enhance the employability of reserved category candidates:</p>
<blockquote><p>(i) In order to fill up the vacancies in the posts requiring professional qualifications, the concerned Ministries/Departments may take a decision within a period of six months on launching of a Special Recruitment Drive providing certain relaxations so that the vacancies may be filled up;</p>
<p>(ii) Finishing training should be imparted to the reserved category candidates once they complete technical/professional qualifications. Ministry of Social Justice and Empowerment and Ministry of Tribal Affairs would devise such programmes. Such programmes should be implemented with involvement of State and State Administrative Training Institutes.</p>
<p>(iii) Training programmes for interview skills and English proficiency may also be devised for reserved category persons for posts requiring non-professional qualifications;</p>
<p>(iv) The issue of providing reserve list/wail list of successful reserved category candidates would be taken up with the Recruitment Agencies so that in a situation when reserved category candidates with higher merit do no join the post, the post may be filled up from the candidates available in the reserved list;</p>
<p>(v) The issue of less employability of SCs/STs/OBCs and Persons with Disabilities for Government sector may require in-depth analysis of the causes and to suggest remedial measures. It would be appropriate to constitute a Committee with representations from Ministry of Social Justice and Empowerment, Ministry of Tribal Affairs, Department of Personnel and Training, major Ministries /Departments like Ministry of Home Affairs, Ministry of Railways and government recruitment agencies.</p>
<p>The committee should find out specific reasons for backlog in filling up of vacancies and suggest measures to enhance the employability of reserved category candidates. (vi) More and more posts may be identified for the persons with disabilities. Micro specifications may be made liberal by providing reasonable accommodation/technological help.</p>
<p>(vii) Schemes may be launched for establishment of inclusive schools/colleges where even persons with disabilities may be able to get education so that the dearth of qualified persons especially in Hearing Impaired category may be taken care of.</p>
<p>(viii) As regards awareness of opportunity for the Persons with Disabilities, the Non- Government Organisations (NGOs) working in the concerned area may be roped in by the Department of Disability Affairs for dissemination of information about schemes/programmes/job opportunities.</p></blockquote>
<p style="text-align: left;">
<p>4. All the Ministries /Departments are requested to take follow up action on the decision taken by the Government. Quarterly reports be sent to this Department for monitoring the progress of implementation of these directions.</p>
