<h3 class="wp-block-heading">Sub: Reservation in upgradation of pay structure of certain cadres &#8211; clarification</h3>



<p>Ref: PCVII/ 2019/ RSRP/3 dated 17.11.2022 &amp; 01.12.2022</p>



<p>References are being received from Zonal Railways seeking clarifications on letters referred above, whether Reservation is applicable in case of upgradation and cadre restructuring. The matter has been thoroughly examined in view of the judgment of Hon’ble Supreme Court in CA No.6934-6946 of 2005 in Union of India vs. Pushparani &amp; others on 29.07.2008 in similar matters and clarified as under:</p>



<p><strong>Upgradation of posts (functional or otherwise) due to stagnation resulting in&nbsp;</strong><strong>cadre review:</strong></p>



<ol class="wp-block-list">
<li>In case of Mass Upgradation, where a grade of whole cadre is upgraded from existing grade to higher grade and where all the incumbents are placed in higher grade, without creation of new posts,&nbsp;<strong>reservation shall not be applicable</strong>.</li>



<li>However, in cases, where a portion of the sanctioned cadre strength is upgraded to an existing higher grade in that category or a new higher grade, resulting in increase in number of posts,&nbsp;<strong>then the reservation is to be applied to parted strength in lower grade as well as upgraded strength</strong>.</li>



<li>Accordingly instructions issued regarding application of reservation as per extant rules vide reference cited would hold good.</li>
</ol>



<p>This disposes off references received from RCF/Kapurthala, South Western Railway and Eastern Railway vide letter nos. 2022-E /RCF/ SCT &amp; OBC/ RES/ RB dt. 18.04.2023, SWR/ P.135/1/ Upgradation/ Ch.S&amp;WI dt. 13.04.2023 &amp; E.839/ Upgradation/ Ch.S&amp;WI/ HQ dt.17.04.2023 respectively.</p>

<div>Subject: <strong>Revision of format for OBC Caste Certificate</strong></div>

<div>Madam/Sir,</div>
<div>The Government of India had issued instructions on 8th September, 1993 vide DoPT OM. No. 36012/22/93-Estt.(SCT) providing for reservation to Other Backward Classes in the services and posts under the Government of India. The format of the Caste Certificate was prescribed vide Annexure A of the O.M. No. 36012/22/93-Estt.(SCT) dated 15th November 1993. In the said format, the then Ministry of Welfare’s Resolution No. 12011/68/93-BCC(C) dated 10th September 1993 was mentioned, which contained the list of castes and communities treated as OBC’s till that time. Since then, a large number of castes and communities have been added to the Central List of OBCs through various resolutions of the Ministry of Social Jusiice and Empowerment. The details of the resolutions subsequent to the Resolution dated 10th September 1993 do not find mention in the existing format. The said format also prescribes that the certificate issuing authority should certify that the candidate does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to the aforesaid OM. dated 8.9.1993.</div>

<div>2. Representations have been received in this Department wherein candidates belonging to OBC Communities have reportedly faced difficulty in getting the benefits of reservation. This is because of the fact that in the caste certificate issued by the concerned district authorities, although the name of the caste/community is mentioned in the certificate, the specific resolution by which the said caste/community has been included in the Central List of  OBCs is not indicated.</div>

<div>3. Keeping in view such problems faced by the candidates, this issue was examined in consultation with the National Commission for Backward Classes and it has been decided to revise the existing format of OBC Caste Certificate. A copy of the revised format is enclosed(Anuexure). All the certificate issuing authorities are requested to invariably mention the details of the Resolution (Number and Date) by which the castec/community of the candidate has been included in the Central List of OBCs and also to ensure that he/she does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to the aforesaid O.M. dated 8.9.1993 as amended from time to time.</div>

<div>4. I am to request that the revised format of the Certificate may please be brought to the notice of authorities under the State Governments/Union Territories who are empowered to issue the Caste Certificate.</div>

<p>The undersigned is directed to refer to this Department’s OM. of even no. dated 20.03.2014 regarding judgment of the Hon’ble Supreme Court pronounced on 08.10.2013 in the matter of Civil Appeal No.9096 of 2013 (arising out of SLP(civil) No.7541 of 2009 titled Union of India &amp; Anr. Vs. National Federation of Blind &amp; Ors. and this Department’s O.M. of even no. dated 03.12.2013.</p>
<p>2. The Ministries/Departments/Organisations of the Government of India were requested to furnish data on vacancies available and posts identified for persons with disabilities in all the cadres under their control, including attached offices, subordinate offices, public sector undertakings/Government companies, cantonment board and the services under their administrative control so that consolidated Status Report could be filed before the Hon’ble High Court of Delhi before the next date of hearing on 28.04.2014.</p>
<p>3. The Ministries/Departments who have already furnished requisite information may furnish data in regard to the Services, if any, which are being administered by them.</p>

<p><span style="color: #ff0000;"><strong>Filling up backlog vacancies :</strong></span> Achievement of the Drive as reported by various Ministries / Departments on its conclusion revealed that out of total 75,522 identified backlog vacancies , there were 64,175 backlog vacancies which could be filled up and of these, 48,035 vacancies were filled up. Overall success rate of the Drive was 74.85%.</p>

<p>Subject: <strong>Filling up <a href="http://centralgovernmentnews.com/?s=Backlog+Vacancies" target="_blank">backlog vacancies</a> reserved for Scheduled Castes (SCs)/Scheduled Tribes (STs)/Other Backward Classes (OBCs).</strong></p>
<p>A Special Recruitment Drive for filling up of the backlog vacancies reserved for SCs/STs/OBCs had been launched in November, 2008 and was concluded on 31st March, 2012.</p>
<p>2. Achievement of the Drive as reported by various Ministries / Departments on its conclusion revealed that out of total 75,522 identified backlog vacancies , there were 64,175 backlog vacancies which could be filled up and of these, 48,035 vacancies were filled up. Overall success rate of the Drive was 74.85%. Reasons for non-filling up of reserved vacancies may be attributed to the lack of finishing skills like English fluency or interview skills, non availability of qualified reserved category candidates for posts requiring professional qualification especially in ST category, scarcity of qualified reserved category persons results in job switch over or not joining after selection as they get better jobs and in some cases selection is done on all India basis whereas allocation is made zone/State wise.</p>
<p>3. The Government considered the status of filling up of backlog vacancies reserved for SCs/STs/OBCs and desired that concerted efforts be made to fill up the backlog vacancies at the earliest and the status of action taken in this regard be monitored at the highest level. Besides, actions on the following measures are to be taken at the earliest to enhance the employability of reserved category candidates:</p>
<blockquote><p>(i) In order to fill up the vacancies in the posts requiring professional qualifications, the concerned Ministries/Departments may take a decision within a period of six months on launching of a Special Recruitment Drive providing certain relaxations so that the vacancies may be filled up;</p>
<p>(ii) Finishing training should be imparted to the reserved category candidates once they complete technical/professional qualifications. Ministry of Social Justice and Empowerment and Ministry of Tribal Affairs would devise such programmes. Such programmes should be implemented with involvement of State and State Administrative Training Institutes.</p>
<p>(iii) Training programmes for interview skills and English proficiency may also be devised for reserved category persons for posts requiring non-professional qualifications;</p>
<p>(iv) The issue of providing reserve list/wail list of successful reserved category candidates would be taken up with the Recruitment Agencies so that in a situation when reserved category candidates with higher merit do no join the post, the post may be filled up from the candidates available in the reserved list;</p>
<p>(v) The issue of less employability of SCs/STs/OBCs and Persons with Disabilities for Government sector may require in-depth analysis of the causes and to suggest remedial measures. It would be appropriate to constitute a Committee with representations from Ministry of Social Justice and Empowerment, Ministry of Tribal Affairs, Department of Personnel and Training, major Ministries /Departments like Ministry of Home Affairs, Ministry of Railways and government recruitment agencies.</p>
<p>The committee should find out specific reasons for backlog in filling up of vacancies and suggest measures to enhance the employability of reserved category candidates. (vi) More and more posts may be identified for the persons with disabilities. Micro specifications may be made liberal by providing reasonable accommodation/technological help.</p>
<p>(vii) Schemes may be launched for establishment of inclusive schools/colleges where even persons with disabilities may be able to get education so that the dearth of qualified persons especially in Hearing Impaired category may be taken care of.</p>
<p>(viii) As regards awareness of opportunity for the Persons with Disabilities, the Non- Government Organisations (NGOs) working in the concerned area may be roped in by the Department of Disability Affairs for dissemination of information about schemes/programmes/job opportunities.</p></blockquote>
<p style="text-align: left;">
<p>4. All the Ministries /Departments are requested to take follow up action on the decision taken by the Government. Quarterly reports be sent to this Department for monitoring the progress of implementation of these directions.</p>

<div>Subject:-<strong>Nomination of Liaison Officer and Setting up of Cell in each Ministry / Department for enforcement of orders of reservations in posts and services of the Central Government.</strong></div>

<div>The undersigned is directed to say that the instructions have been issued by the Department of Personnel and Training from time to time for nomination of Liaison Officers, their roles, duties &amp; responsibilities and setting up of a Special Reservation Cell in each Ministry / Department under the direct control of the Liaison Officer for enforcement of orders of reservation in posts and services of the Central Government.</div>
<div></div>
<div>2. It is reiterated that in each Ministry/Department/Attached and Subordinate Office, the Deputy Secretary in charge of administration (or any other officer at least of the rank of Deputy Secretary) should be designated as a Liaison Officer in respect of matters relating to the representation of the Scheduled Castes, Scheduled Tribes and Persons with Disabilities. Similarly, instructions provide for nomination of separate Liaison Officer in Ministries/ Departments in respect of matters relating to the representation of the Other Backward Classes.</div>

<div>3. The provisions about Liaison Officer, his role, responsibilities, control etc. and setting up of reservation cell is contained in Annexure.</div>
<div></div>
<div>4. All Ministries / Departments are requested to bring the contents of this O.M. to the notice of all the attached and subordinate offices under their control and also ensure that the cells are set up expeditiously in the Ministry / Department and in Attached / Subordinate offices under administrative control of Heads of Department.</div>

<div></div>
<div><strong>RESPONSIBILITIES OF THE LIAISON OFFICER:</strong></div>
<div>The Liaison Officer is especially responsible for:</div>
<div>(i) Ensuring due compliance by the subordinate appointing authorities with the orders and instructions pertaining to the reservation of vacancies in favour of the Scheduled Castes, the Scheduled Tribes and the Persons with Disabilities / the Other Backward Classes and other benefits admissible to them.</div>
<div></div>
<div>(ii) Ensuring timely submission of SC/ST/OBC and PwD Reports / and II by each appointment authority in the Ministry / Department concerned and ensuring scrutiny and consolidation of the above reports in respect of all establishments and services in and under the control of the Ministry/Department and sending the consolidated reports in the prescribed proforma to the Department of Personnel &amp; Training.</div>

<div>(iii) The Liaison officers have to endorse the non-availability of an SC/ST/OBC Officer for being associated in the DPC before actually convening the DPC. Therefore, it will be one of the duties of the Liaison Officers to acquaint themselves well in time about the dates of various DPCs which will be held in future. He should have with him a ready list of officers of various levels belonging to SC/ST of a few sister Departments / Ministries so that whenever requirement arises, an SC/ST officer of appropriate level consistent with the level of the other members of the DPC and the level of appointment for which a DPC is proposed to be convened, can always be associated as a member. Such a list may be prepared by the Liaison Officers by informally consulting the administrative wing of other Ministries/Departments.</div>

<div>(iv) Ensuring that while making a reference to the Department of Personnel and Training and to the National Commission for Scheduled Castes/the National Commission for Scheduled Tribes for de-reservation of reserved vacancies, full details in support of the proposal for de reservation are given.</div>
<div></div>
<div>(v) Ensuring the extension of necessary assistance to the National Commission for Scheduled Castes and the</div>
<div>National Commission for Scheduled Tribes in the investigation of complaints received by the Commission, in regard to service matters and in the collection of information for their annual reports.</div>
<div></div>
<div>(vi) Conducting annual inspection of the reservation registers/rosters maintained in the Ministry/Department/Offices under the control of the Ministry/Department with a view to ensuring proper implementation of the reservation orders.</div>
<div></div>
<div>(vii) Acting as Liaison Officer between the Ministry/Department and the Department of Personnel &amp; Training for supply of other information, answering questions and queries and clearing doubts in regard to matters covered by the reservation orders.</div>
<div></div>
<div><strong>RESERVATION CELL:</strong></div>
<div>2. Each Ministry/Department is required to set up a Special Reservation Cell within the Ministry/Department under the direct control of the Liaison Officer to assist the Liaison Officer in discharging of his duties effectively.</div>
<div></div>
<div><strong>PRIVILE. GES OF THE LIAISON OFFICER:</strong></div>
<div>3. Cases of negligence or lapse in the matter of following the reservation and other orders relating to the Scheduled Castes, the Scheduled Tribes, the Persons with Disabilities and the Other Backward Classes coming to the light through the inspections carried out by the Liaison Officer or otherwise, should be reported / submitted by him to the Secretary/Additional Secretary to the Government of India in the respective Ministry / Department or to the Head of the Department in respect of offices under the Heads of Department, as the case may be. The concerned Secretary/Additional Secretary/Head of the Department shall pass necessary orders on such reports to ensure strict compliance of the reservation orders by the appointing authority concerned.</div>
<div></div>
<div><strong>LIAISON OFFICERS IN PSUs etc.</strong></div>
<div>4. Each Public Sector Undertaking, Statutory and Semi Government Body, Autonomous Body / Institution including Municipal Corporations, Co-operative Institutions, Universities, Voluntary Agencies receiving grants in aid from the Government connected with appointment and promotion of the SC/ST candidates should appoint Liaison Officer in the same manner as is existing in the Ministries/Departments.</div>
<div></div>
<div><strong>SPAN OF CONTROL OF LIAISON OFFICER OF MINISTRIES / DEPARTMENTS:</strong></div>
<div>5. The Liaison Officer of a Ministry/Department has to act as Liaison Officer in respéct of the matters relating to the representation of Scheduled Castes/Schedule Tribes/PWDs and OBCs in all establishments and services under the administrative control of the Ministry /Department. The instructions issued by the Department of Public Enterprises provide that each undertaking shall have Liaison Officer with functions similar to that of the Liaison Officer in Ministry/Department. The appointment of Liaison Officer in the undertaking does not, however, dilute or alter or curtail the responsibilities of the Liaison Officer of the administrative Ministry / Department in regard to implementation of reservation policy in the Undertaking. Liaison Officers of the Ministries!/Departments have special responsibility to monitor implementation of reservation in their attached &amp; subordinate offices, Autonomous Bodies, PSUs under the administrative control of the concerned Ministry/Department and Voluntary Agencies which are getting substantial grant-in-aid from the Government of India. In order to ensure due compliance of the reservation orders of the Government, the Liaison Officers may periodically visit inspect the offices/organizations under them. They should ensure that reservation roster for SCs/STs/OBCs/PHs have been maintained properly and there is no gap in the entries made in the rosters, Liaison Officers should carry out their duties in relation to reservation by calling for the records from them and by convening the meetings of the officer of such organizations who are responsible for ensuring reservation in organizations under their control. If Liaison Officers of Ministries/Departments notice that there is flouting of reservation instructions by any officers or complaint against any officer of harassment or deliberate manipulating things to damage the interests of the weaker sections they should feel free to report such lapses to the Secretary / Additional Secretary of the Ministry/Department concerned without fear &amp; hesitation of hierarchical disobedience.</div>

<div>This Department had been collecting annual data about representation of SCs, STs, OBCs and Persons with Disabilities in Central Government Services as on 1st  January of each year. Vide Office Memoranda of even number dated 15th  October, 2012 and 5th  November, 2012 all the Ministries/Departments were apprised that the government has decided to collect the aforesaid data &#8216;on line&#8217;. For the purpose, URL www.rrcps.nic.in  was created and every Ministry/Department was given a user name and the login password to the URL and it was requested that the data of representation of SCs, STs and OBCs and Persons with Disabilities as on 1st  January, 2012 may be filled up &#8216;on line&#8217; on trial basis.</div>

<p>2. It has been found that most of the Ministries/Departments have not even created their profile. Some Ministries/Departments have initiated the data entry but the data has not been successfully sent it to this Department.</p>
<div></div>
<div>3. The data of annual representation of SCs, STs, OBCs, and Persons with Disabilities as on 1.1.2013 is also due and is required to be submitted by Ministries/Departments on-line only.</div>
<div></div>
<div>To facilitate and to smoothen the process of on-line submission of data on-line, this Department is organizing workshops on the following dates, to help the Ministries/Departments in filling up the data:-</div>
<div>(i) 22nd January, 2013 (for Ministries/Departments at Annexure A)</div>

										<content:encoded><![CDATA[<p><strong>Reservation in Promotion for SCs and STs in Government Jobs &#8211; Rajya Sabha Passes the Amendment Bill</strong></p>
<p>Rajya Sabha Passes Constitutional Amendment Bill</p>
<p>The Government of India has always been concerned about the welfare of downtrodden especially Scheduled Castes and Scheduled Tribes. As a part of the affirmative action, reservation in promotion had been available to the SCs and STs since 1955. However, some decisions of the Supreme Court like in Indra Sawhney, Veer Pal Singh Chauhan and S. Vinod Kumar cases had caused certain effects on the scheme of reservation in promotion for SCs and STs. To overcome these effects, the Government had brought four Constitutional amendments, namely, 77th, 81st , 82nd and 85th amendments.</p>
<p>The latest of such judgments was in M. Nagaraj case in which the Supreme Court has laid down some pre-requisite conditions for providing reservation in promotion. These conditions are, namely, assessing the quantum of representation of SCs, STs, there backwardness and effect on efficiency.</p>
<p>In wake of the effects of the judgment of Supreme Court the Government had introduced a Constitutional Amendment Bill in Rajya Sabha during the last session so that the Scheduled Caste and Scheduled Tribes may continue to get reservation in promotion as existing. There had been demand to retain Article 335. Accordingly, the Bill was amended to delete the words “ or in Article 335”, so that the condition of the efficiency as mentioned in the Article 335 should continue to be a part of the Constitution and should not be obliterated. Moreover, it ensures that the effects of proviso to article 335 are retained which permits relaxed standards for candidates belonging to the scheduled castes and the scheduled tribes in case of promotion against reserved vacancies. The amended Bill has now been passed by the Rajya Sabha.</p>
<p>The Government is making efforts to get the Bill passed by the Lok Sabha also in this session itself.</p>

<p>It is clarified that there is no concept of grace marks in betterment attempt and grace marks awarded to any Betterment candidate in 2010 and 2011 DE are being withdrawn.</p>

<p>CLARIFICATION</p>
<p>References have been received from various charges with regard to the award of grace marks to those candidates belonging to SC/ST category who have already qualified in the past with the relaxed standards so as to enable them to attain the ‘Own Merit Status’ by appearing in a betterment attempt or otherwise.</p>
<p>The matter has been examined. The grace marks policy was introduced with the purpose of enabling marginally failing candidates to pass the examination. Enabling reserved category candidates to pass the examination in general category by the grace marks policy was not the espoused philosophy behind the policy. Therefore, the grace marks were not allowed in such cases till the introduction of the betterment scheme. Till 2010, grace marks were given only to pass the examination, but not to obtain “Own Merit Status’ by candidates of the Reserved Category. However, grace marks were allowed to a few candidates appearing in betterment attempts in the Departmental Examinations 2010 and 2011 are being withdrawan. It is accordingly clarified that there is no concept of grace marks in the betterment attempt and any such grace marks awarded to any candidate in Departmental Examinations 2010 and 2011 are being withdrawn.</p>

<div align="justify"></div>
<div align="justify">5.1  In case of cadres having more than 13 posts, all appointing authorities should maintain reservation registers in the format given in  <strong>Annexure-I</strong>.</div>
<div align="justify"></div>
<div align="justify">5.2  Reservation roster registers will be maintained in format given in the <strong>Annexure-II</strong> for cadres having less than 14 posts.</div>
<div align="justify"></div>
<div align="justify">5.3  Following principles shall be followed for preparation and maintenance of reservation registers and reservation roster registers:</div>
<blockquote><p>(a) Separate registers/ roster registers shall be maintained for appointments made by direct recruitment and promotion. In case of promotion, separate registers / roster registers shall be maintained for each mode of promotion viz. limited competitive examination, selection, non-selection, etc.</p></blockquote>
<blockquote><p>(b) A common register / roster register shall be maintained for permanent appointments and temporary appointments likely to become permanent or to continue indefinitely.</p>
<p>(c) A separate register / roster register shall be maintained for purely temporary appointments of 45 days or more but which have no chance whatever of becoming permanent or continuing indefinitely.</p>
<p>(d) Immediately after an appointment is made, the particulars of the person appointed shall be entered in the register / roster register in the appropriate columns and the entry signed by the appointing authority or by an officer authorized to do so.</p>
<p>(e) No gap shall be left in completing the register / roster register.</p>
<p>(f) The register / roster register shall be maintained in the form of a running account year after year. For example if recruitment in a year stops at point 6, recruitment in the following year shall begin from point 7.</p>
<p>(g) If reservation register becomes unwieldy or difficult to manage, a fresh register may be started by applying the method of initial preparation of registers.</p>
<p>(h) In case of cadres where reservation is given by rotation, fresh cycle of roster shall be started after completion of all the points in the roster.</p>
<p>(i)  Since reservation does not apply to deputation/absorption, where the recruitment rules prescribe a percentage of posts to be filled by these methods, such posts shall be excluded for determining reservations.</p>
<p>(j)  After every recruitment year, an account shall be noted in the reservation register indicating representation of Scheduled Castes/Scheduled Tribes/Other Backward Classes and details of backlog reserved vacancies etc.</p></blockquote>
<div align="justify">Note : Reservation registers / roster registers are only an aid to ensure that Scheduled Castes, Scheduled Tribes and Other Backward Classes get quota reserved for them. These registers/roster registers do not determine seniority.</div>
<div align="justify"></div>
<div align="justify"><strong>Grouping of Posts </strong><br />
5.4  In the case of posts filled by direct recruitment, small cadres may be grouped with posts in the same group for the purpose of reservation orders taking into account the status, salary and qualifications prescribed for the posts in question.</div>
<div align="justify"></div>
<div align="justify">5.5  The posts of Sweepers should not be grouped for the purpose of reservation, with other categories of Group D posts, even though the number of posts of Sweepers may not be large in an office /establishment.</div>
<div align="justify"></div>
<div align="justify">5.6  Proposals for grouping of posts should be referred to the Department of Personnel &amp; Training for prior approval together with full particulars of the posts proposed to be grouped together in the following respect:</div>
<blockquote><p>(i) Designation and number of each post.<br />
(ii) Group to which the posts belong i.e. Group A, Group B, Group C or Group D.<br />
(iii) Scale of pay of each post.<br />
(iii)  Method of recruitment for each post as provided in the recruitment rules.<br />
(iv) Minimum qualifications prescribed for direct recruitment to each post.</p></blockquote>
<p>&nbsp;</p>
<div align="justify">5.7  While reservations would be made according to the groups as provided above, the total reservation in any of the posts/services so grouped should not exceed 50 per cent of the vacancies to be filled in it i.e. in the particular post/service, in a recruitment year. The total reservation for SCs, STs and OBCs in any post or service should also not exceed 50 percent of the total number of posts in the particular post/service.</div>
<div align="justify">
<strong>Initial Preparation of Reservation Register / Roster</strong></div>
<div align="justify">5.8  In order to prepare the reservation register initially, names of all the candidates holding the post as on the date of starting the reservation register may be entered in the register starting with the earliest appointee who was in the cadre as on the date of start of register. If an appointee in the cadre is a Scheduled Caste candidate, SC may be entered in column 4 of the register against his name. If that candidate was appointed by reservation, SC may be written in column 5 also but if he was appointed on his own merit, UR will be written in column 5. If the next appointee is a general category candidate, general shall be written in column 4 against his name and UR in column 5, and so on till all the appointments are adjusted. After making entries as indicated above, details about the number of SC, ST and OBC candidates appointed by reservation, backlog reserved vacancies, if any, may be indicated in &#8216;Remarks&#8217; column.</div>
<div align="justify"></div>
<div align="justify">5.9  After initial preparation of the register, the names of persons appointed thereafter may be added by filling up the columns as stated above.</div>
<div align="justify"></div>
<div align="justify">5.10 Roster registers shall be maintained for cadres with 2 to 13 posts. For preparing roster, names of all the incumbents in the cadre as on 2.7.1997 may be entered in the register starting from the earliest appointee. If an appointee in the cadre is a Scheduled Caste candidate, SC may be entered in column 5 of the register against his name. If that candidate was appointed by reservation, SC may be written in column 6 also but if he was appointed on his own merit, UR will be written in column 6. If the next appointee is a general category candidate, general shall be written in column 5 against his name and UR in column 6, and so on till all appointments are adjusted. In doing so, a general category candidate may appear on a reserved point and an SC/ST/OBC candidate may appear against an unreserved point. If name of an SC/ST/OBC candidate appointed by reservation is entered against a general point, entries may be made in remarks column against that point and also against nearest point reserved for SCs/STs/OBCs, as the case may be, to the effect that such a candidate is to be treated to have been adjusted against the relevant reserved point. Likewise, entries will be made in remarks column for candidates who are appointed as general category candidates but whose names appear against reserved points. Similar adjustments will be made in respect of SC candidates appearing against a point reserved for STs or OBCs and so on. After all the 14 points are consumed, fresh cycle of the roster may be started. As many roster points may be treated to have been consumed on the date of start of the roster register as many employees occupy the roster points as on the date of start of the register. From that point onward, vacancies may be filled as per roster points subject to adjustment of reserved category candidates appointed by reservation and general category candidates as explained above.</div>
<div align="justify">
<strong>SC/ST/OBC Candidates Appointed on Merit</strong></div>
<div align="justify">5.11 SC, ST and OBC candidates in case of direct recruitment and SC and ST candidates in case of promotion, appointed on their own merit and not owing to reservation should not be shown against reserved quota. They will be adjusted against unreserved quota.</div>
<div align="justify"></div>
<div align="justify">5.12 If an unreserved vacancy arises in a cadre and there is any SC/ST candidate within the normal zone of consideration in the feeder grade, such SC/ST candidate cannot be denied promotion on the plea that the post is not reserved. Such a candidate will be considered for promotion alongwith other candidates treating him as if he belongs to general category. In case he is selected, he will be appointed to the post and will be adjusted against the unreserved point.</div>
<div align="justify"></div>
<div align="justify">5.13 Only such SC/ST/OBC candidates who are selected on the same standard as applied to general candidates shall be treated as own merit candidates. If any SC/ST/OBC candidate is selected by getting any relaxation in experience qualification, number of permitted chances in written examination, zone of consideration etc., he/she shall be counted against reserved vacancies. Such a candidate cannot be considered for appointment against an unreserved vacancy.</div>
<div align="justify"></div>
<div align="justify">5.14 SC/ST candidates appointed on their own merit (by direct recruitment or promotion) and adjusted against unreserved points will retain their status of SC/ST and will be eligible to get benefit of reservation in future/further promotions, if any.</div>
<div align="justify"></div>
<div align="justify">5.15 50% limit on reservation will be computed by excluding such reserved category candidates who are appointed/ promoted on their own merit.</p>
<p><strong>Adjustment of Compassionate Appointees</strong></div>
<div align="justify">5.16 A person selected for appointment on compassionate grounds should be adjusted in the reservation register/ reservation roster register against the appropriate category viz. SC/ST/OBC/UR category depending upon the category to which he belongs. For example, if he belongs to SC, he shall be adjusted against a vacancy reserved for SCs. Similarly if he is an ST or OBC candidate, he shall be adjusted against vacancy reserved for STs or OBCs, as the case may be. An unreserved category candidate shall be adjusted against an unreserved vacancy.</div>

<p style="text-align: center;"><strong>RESERVATION IN PROMOTION</strong></p>
<p>Minister of Personnel, Public Grievances &amp; Pensions Shri.V.Narayanasamy replied to a question in Lok Sabha on 12th December 2012 regarding the subject of reservation in promotion.</p>
<p>In his written reply, reservation is available to Scheduled Castes and Scheduled Tribes at the rate of 15% and 7.5%, respectively, in all Groups viz. A, B, C (including erstwhile Group D posts) in case of promotion by non-selection method. In case of promotion by selection method, reservation is available in Group B, C and upto the lowest rung of Group A at the same rates.</p>
<p>As regards senior posts of Secretary, Additional Secretary and Joint Secretary in the Central Ministries/ Departments, these posts are filled on deputation basis under the Central Staffing Scheme except the posts in the Ministry of External Affairs. Reservation does not apply to posts filled on deputation. The officers borrowed from various cadres including the State Cadres, who are empanelled to hold such posts and who give their option for deputation are appointed under the Central Staffing Scheme. Likewise, the posts of Director (not including the posts in Central Secretariat Service) are also filled under the Central Staffing Scheme.</p>
<p>In case the empanelment does not lead to adequate representation to categories like SC/ST, women, particular State Cadres, North East, etc., the criteria for empanelment would be suitably relaxed to give due representations. For this purpose, adequacy of representation would mean the cumulative representation in four batches, i.e. current batch and immediately preceding 3 batches being less than 2/3rd of all India percentage of empanelment. The number of officers to be selected on this basis shall not exceed about 15% of the number included in the recommended list and these selections would follow the required process albeit with suitably relaxed norms. The relaxation is given in terms of Average Weighted Score obtained by an SC/ST officer in comparison to General Category Officers, if he/she is clear from vigilance angle.</p>
<p>Instructions exist that in promotions by selection within Group A (Class I) carrying an ultimate salary of Rs.18, 300/- (pre-revised) per month or less, the Scheduled Caste/Scheduled Tribe officers, who are senior enough in the zone of consideration for promotion so as to be within the number of vacancies for which the select list has to be drawn, would be included in the list provided they are not considered unfit for promotion.</p>
