<h3 class="wp-block-heading">Sub: Reimbursement of Children Education Allowance (CEA) to Railway servants having Divyang Children-reg.</h3>



<p>Attention is invited to Board’s letter of even no. dated 13.08.2018 whereby Ministry of Personnel, Public Grievances and Pensions (Department of Personnel &amp; Training) OM No. A-27012/ 02/2017 -Estt.(AL) dated 16/17.07.2018 containing consolidated instructions on the subject of CEA &amp; Hostel Subsidy to Government servants, was circulated on the Railways for information and necessary action. OM dated 16/17.07.2018 aforesaid, also contained provisions for CEA and Hostel Subsidy to Divyang Children of Government servants.</p>



<p>2. Now, Ministry of Personnel, Public Grievances and Pensions (Department of Personnel &amp; Training) vide OM NO. A-27012/ 01/2022- Estt.(AL) dated 17.02.2023 (copy enclosed) have issued further instructions on the subject expanding the scope of CEA to those Divyang Children also who are unable to attend school physically. Instructions in the enclosed OM dated 17.02.2023 shall apply mutatis-mutandis to Railway employees with effect from 17.02.2023.</p>

<h3 class="wp-block-heading">Sub.: Dispensation of condition of Production of Receipts/ Vouchers for Reimbursement of Travelling Charges for Travel within City in Pay Level 9 to 11(only) i.e. up to the rank of Major.</h3>



<p>Your kind attention is invited to Govt of India, MoD, DMA letter No. 12630/TA/DA/7th CPC/Mov C/43/ D(Mov)/21 dated 16th March 2021 had conveyed sanction of the Competent Authority with reference to Gol, Min of Finance, Deptt of Expenditure, New Delhi O M No. 19030/2/2020-E.IV dated 22nd Dec 2020 for dispensation of condition of Production of Receipts/ Vouchers for seeking Reimbursement of Travelling Charges for Travel within City. This is being reproduced below for your necessary information, kind perusal and ensuring strict compliance with effect from 16 March 2021.</p>



<h4 class="wp-block-heading">Salient Features:</h4>



<ol class="wp-block-list"><li>Condition of production of Receipts/ Vouchers by Army Officers in Pay Level 9 to 11(only) i.e. up to the rank of Major for obtaining and seeking Reimbursement of Travelling Charges for Travel within City admissible under Daily Allowance on Tour has since been dispensed off subject to furnishing of Self Certification with following details viz.;<ol><li>Period of Travel</li><li>Vehicle Number</li><li>Undertaking to the effect that-<ul><li>No Service Transport or Civil Hired Transport was provided for any part of the journey or travel performed for which the claim has been preferred.</li><li>Travel was necessitated and carried out for bonafide Military Tasks and bonafide Military Duties only.</li></ul></li></ol></li></ol>

<p>Reference is invited to this office O.M of even number dated 20.05.2011 (copy enclosed) regarding need for capacity building and to encourage officers to acquire appropriate domain specific skills with reimbursement of examination fee, for identified professional courses.</p>



<p>2. It has been decided that concurrent skill upgradation of officers of Indian Civil Accounts Organization (ICAO) on professional competencies would lead to better Public Financial Management besides balancing the pace with rapid changes occurring in Public Finances. Accordingly, the views/inputs from ICAS Officers are sought on the inclusion of new courses in the already approved list for consideration of the Competent Authority.</p>

<h3 class="wp-block-heading"><strong>AMENDMENT FOR REIMBURSEMENT OF MEDICINES : SPECIAL SANCTION IN VIEW OF COVID-19</strong></h3>



<p>1. Further to this HQ letter No B/49761/AG/ECHS dated 23 Mar 2020, even No dt 24 Apr 2020, 01 Jun 2020, 02 Jun 2020, 07 Aug 2020, 05 Oct 2020,01 Jan 2021, 16 Apr 2021 and 17 Aug 2021.</p>



<p>2. A onetime sanction for purchase of medicines and claim reimbursement was issued till 31 Oct 2021. In view of increasing cases of COVID-19 and restrictions on mov in containment zones, to promote social distancing and avoiding unnecessary exposure to ECHS beneficiaries as well as minimizing footfall at ECHS Polyclinics, the ECHS beneficiaries having life style/ chronic ailments/ diseases on long treatment may purchase medicines lasting till 30 Apr 2022 in one go or month wise based on the prescription held (prescribed by doctor of Polyclinic / Service hospital / Empanelled hospital / Sehat OPD) irrespective of NA or otherwise till 30 Apr 2022. It is also Clarified that the ECHS Polyclinics are functional and ECHS beneficiaries also have the option to collect medicines through ECHS Polyclinics as per normal practice, instead of purchasing from market.</p>



<p>3. One time sanction is hereby accorded to reimburse the above expenditure under individual reimbursement of medical claims. The reimbursement will be done as per guidelines issued by this HQ vide letter No B/49761/AG/ ECHS/Medicine Policy dt 18 May 2020 and even No dt 21 Jul 2020.</p>



<p>4. These orders shall be valid from date of issue of this letter and will be valid up to 30 Apr 2022.</p>



<p>5. The date up to 30 Apr 2022 indicates that the beneficiary may purchase medicines under this provision on any day before or on 30 Apr 2022, as per the date of his a prescription. The medicines may be purchased as per prescription for a period of 30 days if purchased in the month of Apr 2022.</p>

<p>At the outset, we, the four officers’ organisations viz. AIBOC-AIBOA-INBOC-NOBO, representing the entire fraternity of officers in the banking industry, convey our sincere gratitude to you for providing breathing time by extending time norms for various income-tax-related activities as a solace to the taxpayers against the backdrop of the <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> pandemic.</p>



<p>It is a well-known fact that bank employees and officers, being part of the country’s financial army, have been rendering uninterrupted and yeoman service from the front line and therefore have been exposed to the contagion. More than lakh bank employees and officers and their family members have been affected by Coronavirus and many have succumbed to the deadly virus.</p>



<p>Sir, we wish to point out that the banks, as a part of the industry-wide bipartite settlement, are reimbursing the hospitalisation medical expenditure of employees within certain limits for the medical treatment taken by them from various hospitals for COVID-19 treatment. This reimbursement is of two types &#8211; direct payment to the hospital and reimbursement to the employee against relevant bills.</p>



<p>Any reimbursement of medical expenditure on account of hospitalisation is being classified into taxable and non-taxable income / perquisite for the employees. This classification is based on the specific diseases provided for in Circular no. 747 dated 02.12.1996 issued by the Central Board of Direct Taxes. COVID-19 is not a part of the said list of specific diseases.</p>



<p>Consequently, the reimbursement of hospitalisation expenditure for COVID-19 being spent / reimbursed by the bank management to the employees is being classified as taxable.</p>



<p>Sir, it is a hard reality that the hospitals are charging hefty amounts for treating COVID-19 patients. It ranges from Rs.4.00 lakh to Rs.15.00 lakh depending on the severity of the disease. The employees are incurring huge amounts towards other related expenditure apart from the hospital bills. Unfortunately, after incurring such expenditure, many of our employees and their dependents did not survive.</p>



<p>Most of the senior officers / employees are in 30% tax slab and when the said reimbursement is added to their taxable income, they have to pay 30% of the said reimbursement amount as tax – ranging from Rs.1.20 lakh to Rs.5.20 lakh, even though there is no profit element or gain is there out of such payment / reimbursement of medical expenses made by the bank management.</p>



<p>The guidelines of CBDT about specific diseases are of 1996 and several new diseases have cropped up since then. Needless to emphasise, COVID-19 is one of the latest additions to critical diseases ever faced by the mankind.</p>



<p>Hence, considering the fact that the reimbursement / payment of medial expense made by the bank to its employees / officers is towards the treatment charges made by the hospitals and that there is no profit element to the employees, we urge upon your good office to revisit the list of specified diseases and notify a revised list of specific diseases including COVID-19, which will certainly be of immense help to the affected employees and / or their families.</p>

<h3 class="wp-block-heading"><strong>Reimbursement of “Transit Accommodation/ Guest Room Accommodation Charges” to Defence Service Personnel during the temporary stay in State Bhawan/ Guest Houses/ Departmental Guest Houses Run by Central Govt./ State Govt / Autonomous Orgs</strong></h3>



<ol class="wp-block-list"><li>As per Government of India, Ministry of Defence letter No.1 (1)/2019-D (Q&amp;C)/ Vol-I dated 04/05/2020 adopting the provisions of MoF, Department of Expenditures O.M. No. 2/05/2018-E.II (B) dated 01/02/2019, Army officers are entitled to <a href="https://centralgovernmentnews.com/tag/reimbursement/" target="_blank" rel="noreferrer noopener">reimbursement</a> of Transit Accommodation/ Guest Room Accommodation Charges as per the ibid order.</li><li>In this regard, Army Officers are requested to refer to ADGPS letter No. B/25451/Doc Pro Offrs/AG/PS- 3(D)/07/2020 dated 24th Dec 2020 regarding the procedure for claiming the reimbursement and guidance.</li></ol>

<p>The Supreme Court of India has delivered a verdict that would spell relief for central government employees.</p>

<h2 class="wp-block-heading"><em>Reimbursement cannot be denied to a central government employee either during service or after retirement if he/she does not seek treatment from a hospital that is not on the list of CGHS empanelled hospitals, the SC said.</em></h2>



<p>In its judgement, a two-judge bench of the apex court clearly says that an employee of the central government cannot be denied reimbursement of medical bills on the grounds that the employee opted for treatment from a private hospital during an emergency.</p>



<p>Reimbursement cannot be denied either during service or after retirement if the employee does not seek treatment from a hospital that is not in the government panel or in the list of the Central Government Health Scheme (<strong><a href="https://centralgovernmentnews.com/category/cghs/" target="_blank" rel="noreferrer noopener">CGHS</a></strong>) empanelled hospitals, the SC said.</p>



<p>“The right to medical claim cannot be denied merely because the name of the hospital is not included in the government order,” the bench of Justice RK Agrawal and Justice Ashok Bhushan said.</p>



<p>Speaking for the bench, Justice RK Agrawal stated, “Can it be said that taking treatment in speciality hospital by itself would deprive a person to claim reimbursement solely on the ground that the said hospital is not included in the Government Order?”</p>



<p>“The real test must be the factum of treatment. Before any medical claim is honoured, the authorities are bound to ensure as to whether the claimant had actually taken treatment and the factum of treatment is supported by records duly certified by Doctors/Hospitals concerned.”</p>



<p>“Once, it is established, the claim cannot be denied on technical grounds,” the Supreme Court said.</p>



<p>‘No fetters can be placed on rights of Central govt employee’</p>



<p>The apex court went on to add that it is a settled legal position that the employee during his lifetime in service or after his retirement is “entitled to get the benefit of the medical facilities and no fetters can be placed on his rights”.</p>



<p>It further said that speciality hospitals are established for treatment of specified ailments and services of doctors specialized in a discipline are availed by patients only to ensure proper, required and safe treatment.</p>



<p>The court also took note of “slow and tardy pace of disposal of MRC by the CGHS in case of pensioner beneficiaries and the unnecessary harassment meted out to pensioners who are senior citizens, affecting them mentally, physically and financially…”</p>



<h3 class="wp-block-heading">SC orders formation of high powered committee</h3>



<p>Directing that all such claims “shall be attended by a Secretary-level High Powered Committee in the concerned Ministry which shall meet every month for quick disposal of such cases”, the court said: “We are of the opinion that after submitting the relevant papers for claim by a pensioner, the same shall be reimbursed within a period of one month.”</p>



<p>It also directed the setting up of “Committee for grievance redressal of the retired pensioners consisting of Special Directorate General, Directorate General, 2 (two) Additional Directors and a specialist in the field which shall ensure timely and hassle-free disposal of the claims within a period of seven days.”</p>

<p>“We further direct the concerned Ministry to take steps to form the Committee as expeditiously as possible,” the court said.</p>



<h3 class="wp-block-heading">CGHS approach ‘very inhuman’</h3>



<p>The court order was issued on a petition by a retired central government official who had sought treatment from two private hospitals and demanded the reimbursement of medical bills. The government had initially refused to reimburse the bill saying that implant of CRT-D device was not required.</p>



<p>The court said: “It is acceptable to common sense, that ultimate decision as to how a patient should be treated vests only with the doctor, who is well versed and expert both on academic qualification and experience gained. Very little scope is left to the patient or his relative to decide as to the manner in which the ailment should be treated.”</p>



<p>Holding that the CGHS approach in the instant case was “very inhuman”, the court said: “This is hardly a satisfactory state of affairs. The relevant authorities are required to be more responsive and cannot in a mechanical manner deprive an employee of his legitimate reimbursement.”</p>



<p>The Central Government Health Scheme (CGHS), the court said was propounded with the purpose of providing a health facility scheme to the central government employees so that they are not left without medical care after retirement.</p>

<p>Subject:- <strong>Reimbursement of cancellation/ reschedule charges for air/ train tickets booked for the purpose of LTC and relaxation of LTC advance due to <a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> pandemic &#8211; clarification reg.</strong></p>



<p>The undersigned is directed to refer to para 3(i1) of DoPT’s O.M. of even no. dated 7 January 2021 on the subject noted above vide which it was communicated that:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><em>In cases where the airlines have kept the refund amount in ‘Credit Shell’, Ministries / Departments may extend the period of repayment of LTC advance taken by the Government servant for LTC journey scheduled during the lockdown period (March-May,2020), till 28.02.2021 or till such time the amount in ‘Credit Shell’ is utilized by the Government servant to perform LTC journey, whichever is earlier.</em></p></blockquote>



<p>2. In this regard, it is clarified that the employees who were eligible to perform LTC journey in 2020 as per LTC Rules, but could not perform the LTC journey during the lockdown period (March-May, 2020) and whose refund amount has been kept in ‘Credit Shell’ by the airlines, are allowed to perform their LTC journey till 28.02.2021, and such LTC shall be counted against the block year applied for. This shall also apply in cases of fresh recruits who are entitled to LTC every year for the initial block of eight years.</p>

<h3 class="wp-block-heading"><strong>Subject:- Reimbursement of cancellation/ reschedule charges for air/ train tickets booked for the purpose of LTC and relaxation of LTC advance due to COVID-19 pandemic &#8211; relaxation regarding.</strong></h3>



<p>During the months of March &#8211; May, 2020, a Nation-wide Lockdown was implemented across the country in view of the prevailing <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> epidemic. During this period, all domestic flights within India were cancelled but certain airlines have charged the cancellation charges against the pre-booked air tickets. In such a situation, many Government employees who had booked LTC tickets in advance for that period are facing financial difficulties in view of the high cancellation amount charged by the airlines. In this regard, requests are being received in this Department for grant of one-time relaxation for reimbursement of the cancellation charges.</p>



<p>2. It has also been observed that many airlines have not refunded the ticket amount for the air tickets booked in advance for the LTC journey scheduled during the Iockdown period. These airlines have kept the booking amount with them in the form of ‘credit shell’ and have given the option to the passengers to travel within a year. This is causing undue hardships to the Government employees as the <strong><a href="https://centralgovernmentnews.com/category/ltc/" target="_blank" rel="noreferrer noopener">LTC</a></strong> advance along with penal interest, is required to be returned if the journey is not undertaken. Requests have been received in this regard for extension of time-limit for settlement of LTC advance and exemption of penal interest till such date the journey is performed by them.</p>



<p><strong><a href="https://centralgovernmentnews.com/faq-on-ltc-cash-voucher-scheme-ltc-fare-for-central-government-employees-during-the-block-2018-21/" target="_blank" rel="noreferrer noopener">FAQ on LTC Cash Voucher Scheme – LTC Fare for Central Government Employees during the Block 2018-21</a></strong></p>



<p>3. The matter has been considered in this Department, in consultation with Department of Expenditure, and the following decisions are conveyed :-</p>



<ul class="wp-block-list"><li>Ministries/ Departments are delegated the power to reimburse the cancellation/ reschedule charges of air/train tickets, as a one-time relaxation, to such Government servants who had booked advance air/train tickets for the purpose of LTC journey during the Lockdown period from 24th March, 2020 to 31st May, 2020 but were not able to perform the journey due to cancellation/ rescheduling of flights / trains during that period. Such government servants seeking reimbursement of cancellation/ reschedule charges shall be required to produce the receipt of cancellation/ re-schedule charges incurred by them.</li><li>In cases where the airlines have kept the refund amount in ‘Credit Shell’, Ministries / Departments may extend the period of repayment of LTC advance taken by the Government servant for LTC journey scheduled during the lockdown period(March-May, 2020), till 28.02.2021 or till such time the amount in ‘Credit Shell’ is utilised by the Government servant to perform LTC journey, whichever is earlier. Also, penal interest may not be charged on LTC advance amount taken by the Government servant on LTC journey scheduled during the lockdown period.</li><li>In cases where the Government servants have drawn LTC advance as well as leave encashment so as to perform the LTC journey, but could not perform journey during the lockdown period and now intend to opt for Special Cash Package Scheme in lieu of LTC in accordance with Department of Expenditure’s OM No. 12(2) / 2020-E.II(A) dated 12.10.2020, they are also allowed to avail the facility of the Scheme. The LTC advance and leave encashment which have remained unsettled due to non-performance of the journey, may be adjusted as per the provisions of the Special Cash Package Scheme.</li></ul>

<p><strong>Subject: Revision of rate &amp; guidelines for reimbursement of expenses on purchase of Hearing Aids under CS(MA) Rules, 1944 and CGHS.</strong></p>



<p>The undersigned is directed to refer to the Office Memorandum No. S.14025/10/2002/MS dated 26th May, 2015 on the above mentioned subject and to state that on the basis of recommendations of an Expert committee, it has been decided to revise the rates and guidelines for hearing aids reimbursement under CS(MA) Rules, 1944 and CGHS.</p>



<p>2. The revised ceiling rates fixed for various types of hearing aids (for one ear) are as under:-</p>



<p><strong>Digital. BTE Rs.8,000/- [Eight thousand only]</strong><br /><strong>Digital ITC/CIC Rs.9,000/- [Nine thousand only]</strong></p>



<p>The above revised cost of hearing aids shall include all taxes, including GST and shall carry three years’ warranty. The cost of BTE type hearing aids shall also include the cost of hearing mould. The cost of ITC/CIC type hearing aids shall also include the cost of customized shell.</p>



<p>Body worn/pocket type category and Analogue BTE category with ceiling&nbsp;<strong>rates Rs.3000/- per ear and Rs.7000/-</strong>&nbsp;per ear have been excluded, since they have become obsolete.</p>



<h5 class="wp-block-heading">3. Beneficiaries covered under CS(MA) Rules/CGHS shall be eligible to obtain hearing aids as per the following guidelines:</h5>



<p>i. Patients/beneficiaries should be properly referred to ENT Specialist of CGHS/Government Hospital/CGHS empanelled Hospital by Medical Officer of CGHS from CGHS wellness centre/AMA in case of CS(MA) beneficiary.</p>



<p>ii. It would be mandatory to carry CGHS beneficiary’s identity Card (in original) whenever the CGHS beneficiaries visit the CGHS/Government ENT Specialist/Specialist of CGHS /CS(MA) empanelled Hospital for consultation and Audiometric test.</p>



<p>iii. The ENT specialist of CGHS/Government hospital/CGHS/CS(MA) empanelled hospital shall then recommend a hearing aids on basis of Audiometric and Audio-logical assessment, specifying the type of hearing aids most suited for the beneficiary. The ‘Audiogram. Report’ shall be authenticated by the ENT specialist. The recommendation shall be as per the categories approved under CGHS and not as per any Brand name.</p>



<p>iv. The permission to procure hearing aids shall be granted by the Additional Director(Zonal) of CGHS-Zonal Office in case of CGHS pensioners beneficiaries, and by the Head of Department/Office in case of serving employees and CGHS beneficiaries of Autonomous bodies on the basis of recommendation of a CGHS/Government ENT specialist/ ENT Specialist of CGHS /CS(MA) empanelled hospital, and an ‘undertaking’ that the beneficiary has not been reimbursed the cost of hearing aids in the preceding five years.</p>



<p>4. Reimbursement claim shall be submitted to CGHS Zonal Office through the CMO, In-charge of the Concerned dispensary by CGHS pensioner beneficiaries and to concerned Ministry/Department/Office in case of serving employees and to concerned Autonomous Body(AB) in case of beneficiaries of ABs in the prescribed medical reimbursement claim form along with the following documents</p>



<h5 class="wp-block-heading">a. Permission Letter for purchase of Hearing aids in original.</h5>



<h5 class="wp-block-heading">b. Copy of CGHS Card.</h5>



<h5 class="wp-block-heading">c. Bill / Receipt (in original) carrying details of the hearing aids seller.</h5>



<h5 class="wp-block-heading">d. Empty Box/boxes or the carton (s) with label showing details of the hearing aids supplied.</h5>



<h5 class="wp-block-heading">e. Reimbursement shall be limited to the ceiling rate or actual cost of the hearing aids, whichever is less.</h5>



<p>5. Records of permission granted for procurement of hearing aids shall be maintained by CGHS in respect of pensioner CGHS beneficiaries and by the concerned Ministry / Department / Office in respect of other beneficiaries.</p>



<p>6. Replacement of hearing aids may be permitted after five years. Henceforth, there will be no requirement of submission of condemnation certificate by the beneficiary at the time of requesting the replacement of a hearing aid that has completed its five years mandated life.</p>



<p>7. Maintenance and repair and cost of batteries will be the responsibility of the beneficiary.</p>



<p>8. The revised rates and guidelines shall come into force from the date of issue of this O.M. and shall be valid till further revision and shall supersede all the earlier orders issued on the subject.</p>



<p>9. This issues with the approval of Integrated Finance Division (CD No.1486 dated: 29/09/2020) of Ministry of Health &amp; Family Welfare.</p>
