Sub:- Comprehensive Transfer Policy guidelines for tenure posting in Railway Board, RDSO, etc. – simplification req.

Transfer/posting of Railway officers is presently governed by the Comprehensive Transfer Policy for Railway Officers, issued vide Board’s letters No. E(O)III/2014/PL/05 dated 31.08.2015 and 12.12.2018 r/w letters of even number dated 25.10.2018, 30.11.2018 & 17.12.2018.

2. After considering the issue to start the online Portal for inviting the applications for posting in Railway Board, RDSO and CTIs on tenure basis, it has been decided with the approval of the Competent Authority, to adopt the following procedure henceforth in this regard:-

• Applications for postings in Railway Board, RDSO and CTIs, will be submitted on HRMS portal through the link, named “Willingness for Posting (Railway Board, RDSO, CTIs)”.
• Willing officers will need to apply through his/her individual HRMS account.
• As per the data available in HRMS regarding service/department and present grade of the officer, he/she will be considered for posts, he/she is eligible for.
• The officer can apply at any time during the year and these applications will be valid for one year.
• For filling up a post in Railway Board, RDSO and CTls, the process of selection will be initiated from amongst the list of willing officers available on HRMS, who have applied for transfer/posting through HRMS Portal. Further selection procedure will remain the same as existing on date.
• Facility to withdraw applications is also available

3. All other instructions, as contained in Board’s aforesaid letters dated 31.08.2015, 12.12.2018, 25.10.2018, 30.11.2018 and 17.12.2018, will remain unaltered.

4. These instructions will be applicable with immediate effect. All proposals for transfer/ posting, for which vacancy notices are yet to be issued, may be processed as per the revised procedure as mentioned above.

5. All Zonal Railways/ PUs are advised to circulate above instructions to all officers posted under their administrative control for information.

Sub: Revision of rates of Tenure Allowance to officers of Organized Group ‘A’ Railway Services posted as Deputy Directors, Joint Directors and Directors posted in Railway Board and RDSO and Group ‘B’ officers when posted against senior scale post in RDSO.

Vide Railway Board’s Letters bearing RBE 181/2017 and RBE 182/2017 orders regarding grant of tenure Allowance to Officers of Organized Group ‘A’ Railway Services posted as Deputy Directors, Joint Directors and Directors posted in Railway Board and RDSO were issued. Now, in continuation of the said orders, it has been decided that Officers of Organized Group ‘A’ Railway Services posted as Deputy Directors, Joint Directors and Directors posted in Railway Board and RDSO and Group ‘B’ officers when posted against senior scale post in RDSO will be entitled to get their pay fixed in the applicable revised Pay Level attached to the post or to draw their basic pay plus Tenure Allowance on the following terms and conditions:

1. ‘Basic Pay’ in the revised pay structure (the pay based on 7th Central Pay Commission recommendations) means the pay drawn by the deputation, from time to time, in the prescribed Level, in Pay Matrix, of the post held substantively in the parent cadre, but does not include any other type of pay like personal pay, etc.
2. In case where the basic pay in parent cadre has been upgraded during continuance of deputation on account of Proforma Promotion, Non-Functional Upgradation (NFU) or any other upgradation, such upgraded basic pay under such upgradation shall not be taken into account for the purpose of Tenure Allowance.
3. If during the continuance of deputation an officer gets an upgradation in his parent cadre by way of Proforma Promotion, Non-Functional Upgradation (NFU) or any other upgradation to Level 14 of the Pay Matrix, he shall be given the option to draw the personal pay in accordance with Rule 12 of RS(RP) Rules, 2016 as amended vide RBE No. 70/2017 dated 14.07.2017 without Tenure Allowance or the pay which he was drawing before such upgradation with Tenure Allowance, whichever is more beneficial.

2. All other provisions contained in RBE 181/2017 and RBE 182/2017 shall continue to be applicable.

3. These orders shall take effect from 1st July, 2017

4. This issues with the concurrence of Finance Directorate of Ministry of Railways.

Sub: Implementation of the recommendations of Seventh Central Pay Commission – Revision of the rates of Tenure Allowance to officers of Organized Group ‘A’ Railway Services posted as Deputy Directors, Joint Directors, Directors and Group ‘B’ officers when posted against senior scale post in RDSO.

Kindly refer to Board’s letter No. PC-VI/2008/1/7/5/3 dated 27.03.2009 (S.No. PC-VI/94, RBE No. 58/2009) on the above mentioned subject.

2. Consequent upon the decision taken by the Government on the recommendations of 7th Central Pay Commission, it is decided that on their posting as Deputy Directors, Joint Directors, and Directors in the office of RDSO, the officers of the Organized Group ‘A’ Railway Services wi11 be entitled to draw their basic pay plus Tenure Allowance on the terms and conditions as stipulated below subject to review/modifications, if any, based on DoPT’s guidelines on Deputation (Duty) Allowances.

(i) The Officers of Organized Group ‘A’ Railway Service posted in the RDSO as Deputy Directors, Joint Directors and Directors will be subjected to a prescribed tenure, on the expiry of which they will be reverted to field posts in Zonal Railways / Production Units and Construction Organizations.

(ii) Officers belonging to Organized Group ‘A’ Railway Services posted in RDSO as Deputy Directors/Joint Directors/Directors will be paid Tenure Allowance at the rate of 10% of their basic pay subject to a ceiling of Rs. 9000/-p.m.

(iii) The allowance will not be paid beyond the normal tenure of three years for Deputy Directors, four years for Joint Directors and five years of Directors.

(iv) No Tenure Allowance will be admissible to the officers of the Services posted as Executive Directors and above in RDSO.

(v) This allowance shall not be admissible to those Deputy Directors/Joint Directors/Directors who are given extension or re-employment after superannuation.

(vi) In cases where the tenure posting is a post with a lower Level of pay, the pay of the Officer going to such a post will be filled in the tenure post as per extant rules.

‘Basic Pay‘ in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix but does not include any other type of pay like Special Pay, etc.

3.The existing conditions contained in pa 4 of Board’s letter No. PC-V/98/I/7/3 dated 12.02.2004 would continue to be operative. TADK will not be admissible.

4.These orders shall take effect from 1st July, 2017.

5.This issues with the concurrence of Finance Directorate of Ministry of Railways.

Sub: Restructuring of IT Cadre on Zonal Railways/PUs/RDSO etc.

A Committee comprising of Executive Directors of Railway Board was constituted to review the existing Cadre restructuring of EDP Centres on Zonal Railways, Production Units & RDSO etc. and suggest changes in the light of the increasing computerization and growing emphasis on Centralized Enterprise wide applications across all departments and suggest whether a separate cadre is required for managing EDP Centres and suggest reviewed structure long with job requirements and essential qualifications and also suggest whether any special training field should be made mandatory for them in order to contribute more effectively in their assigned task.

The Executive Directors Committee have examined all the issues in consultation with both the Federations (AIRF/NFIR ) . The Ministry of Railways have considered the Report of the Committee. As a result of the review undertaken on the basis of functional, operational and administrative requirements , it has been decided with the approval of railways that Group ‘C’ categories of Senior Engineer (IT) and Junior Engineer (IT) of IT Cadre be restructured in the percentage of 67:33 respectively in accordance with the percentage of restructuring implemented for other technical categories of all Engineering Departments including Workshops Technical categories vide Board’s letter No.PC-III/2013/CRC/4 dated 08.10.2013 (RBE No 102/2013). However, while implementing re ucturing , the following instructions should be carefully and strictly adhered to:

Date of effect The restructuring of post of Senior Engineer(Information Technology) and Junior Engineer (Information Technology) will be with reference to the cadre strength in operation as on 01.04.2017. The staff who will be placed in Higher Grade pay as a result of implementation of these orders will draw pay in Higher grades w.e.f. 01.04.2017. The benefit of restructuring will be restricted to the persons who are working in a particular cadre on the cut-off-date i.e 04.2017. therefore, posts not in operation would be treated as deemed to have been surrendered, and the resultant saving equivalent to the surrendered posts will be credited to the vacancy bank.2.

Applicability

• These orders will be applicable to the permanent regular cadre operated as Revenue posts.
• These orders will not be applicable to ex-cadre & work-charged posts which will continue to be based on worth of charge.

3.Pay Fixation

The pay of staff promoted against the additional higher grade posts as a result of restructuring (including chain/resultant vacancies) will be fixed as per Rule 13 of RS(RP) Rules,2016 with the benefit of one increment @ 3% of basic pay, with the usual option of pay fixation as per extant rules.

4.The existing classification and filling up of the vacancies

(i) The existing classification of the posts as ‘selection’ and/or ‘non-selection’ , as the case may be remains unchanged . However, for the purpose of implementation of these orders if any individual Railway servant becomes due for promotion to a post classified as a ‘selection post’ the existing selection procedure will stand modified in such a case to the extent that the selection will be based only on scrutiny of service records and confidential reports without holding any written and/or viva-voce test. This modified selection procedure has been decided upon by the Ministry of Railways as a onetime exception by special dispensation, in view of the number involved with the objective of expediting the implementation of these orders. Similarly, for posts classified as ‘non-selection’ at the time of this restructuring, the promotion will be based only on scrutiny of service records and confidential reports.

(ii) Normal vacancies existing on 01.04.2017 (except, direct recruitment quota) and those arising on that date from this cadre restructuring including/chain/resultant vacancies should be filled in the following sequence:

• From panels approved on or before 01-04-2017And current on that date;
• and the balance in the manner indicat ra 4 (i) above.

(iii)Such selections which have riot tien finalized by 01.04.2017 should becancelled/abandoned.

(iv) Employees who retire/resign or expire in between the period from the date of effect of these orders to the date of of these orders, will be eligible for the fixation benefits and arreatx under these orders w.e.f. 01.04.2017, if they are otherwise eligible for the said benefit.

(v) Extant instructions for D&A/Vigilance clearance will be applicable for effecting benefit of restructuring these orders with reference to date of effect of these orders.

5.Minimum years of service in each grade

While implementing the restructuring orders, instructions regarding minimum period of service required for promotion issued from time to time should be followed.

6.Basic functions, duties and responsibilities

Since IT Cadre is being restructured on functional,operational and administrative considerations , the posts being placed in higher scales of pay as a result of restructuring should include the duties and responsibilities of greater importance.

7.Provision of reservation

The extant provisions in this regard should be followed.

8. Refusal of promotion

Such of the staff as had refused promotion before issuance of these orders and stood debarred for promotion may hence be considered for promotion , in relaxation of the extant provisions as a onetime exception, if they indicate in writing that they are willing to be considered for such promotion against the vacancies existing on 01.04.2017 and arising due to restructuring on the date. The relaxation will not be applicable to vacancies arising after the date of effect i.e 01.04.2017.: 3 :

9. Matching Savings

• Entire scheme of restructuring is to be a self-financing and expenditure neutral proposition. Financial implications should be worked out taking into account mid-value of pay structure (level) as per pay matrix notified vide Part ‘A’ of Ministry of Railways Gazette Notification dated 28.07.2016 (RBE No. 90/2016).
• Since the benefit of restructuring will be restricted to the persons who are working in IT cadre on the cut-off date i.e. 01-04-2017, the posts not in operation would be treated as deemed to have been surrendered and the resultant saving equivalent to the surrendered posts will be credited to vacancy bank and thus the cadre restructuring would be expenditure neutral proposition. Where the money value due to such surrender proves inadequate for financing the restructuring,„exercise, the required matching surrender may be arranged at the Divisional/Zonal ‘level. There would be no cadre restructuring without matching savings by surrender of post
• The percentage distribution of posts as per these orders is to be based upon the operational cadre strength as on 01.04.2017.

10. Annual Review

Annual review of Group ‘C’ staff of IT cadre will be undertaken w.e.f. 01.04.2018, taking into account the cadre strength as on 01.04.2018.

This issues in consultation with the Establishment and Pay Commission Directorate and with concurrence of the associate Finance Directorate of this Ministry.
