<h3 class="wp-block-heading">Sub:- Comprehensive Transfer Policy guidelines for tenure posting in Railway Board, RDSO, etc. &#8211; simplification req.</h3>



<p>Transfer/posting of Railway officers is presently governed by the Comprehensive Transfer Policy for Railway Officers, issued vide Board’s letters No. E(O)III/2014/PL/05 dated 31.08.2015 and 12.12.2018 r/w letters of even number dated 25.10.2018, 30.11.2018 &amp; 17.12.2018.</p>



<p>2. After considering the issue to start the online Portal for inviting the applications for posting in Railway Board, RDSO and CTIs on tenure basis, it has been decided with the approval of the Competent Authority, to adopt the following procedure henceforth in this regard:-</p>



<ul class="wp-block-list">
<li>Applications for postings in Railway Board, RDSO and CTIs, will be submitted on HRMS portal through the link, named&nbsp;<strong>“</strong><em><strong>Willingness for Posting (Railway Board, RDSO, CTIs)”</strong></em>.</li>



<li>Willing officers will need to apply through his/her individual HRMS account.</li>



<li>As per the data available in HRMS regarding service/department and present grade of the officer, he/she will be considered for posts, he/she is eligible for.</li>



<li>The officer can apply at any time during the year and these applications will be valid for one year.</li>



<li>For filling up a post in Railway Board, RDSO and CTls, the process of selection will be initiated from amongst the list of willing officers available on HRMS, who have applied for transfer/posting through HRMS Portal. Further selection procedure will remain the same as existing on date.</li>



<li>Facility to withdraw applications is also available</li>
</ul>



<p>3. All other instructions, as contained in Board’s aforesaid letters dated 31.08.2015, 12.12.2018, 25.10.2018, 30.11.2018 and 17.12.2018, will remain unaltered.</p>



<p>4. These instructions will be applicable with immediate effect. All proposals for transfer/ posting, for which vacancy notices are yet to be issued, may be processed as per the revised procedure as mentioned above.</p>



<p>5. All Zonal Railways/ PUs are advised to circulate above instructions to all officers posted under their administrative control for information.</p>

<h3 class="wp-block-heading">Sub: Transfer Policy- Eligibility service condition for Non-Gazetted Employees on Inter Railway Request Transfer (IRRT).</h3>



<p>Ref: Rly Bd’s Lr. No-E(NG)I-2017/TR/24 dated 10.03.2022 (RBE No-28/2022 &amp; 34/22)</p>



<p>Attention is invited to RBE No-28/2022 and RBE No-34/2022 wherein Railway Board has directed to Zonal railway that in the case of Non-Gazetted Railway employees the minimum service period should be enhanced for IRRT from 05 years to 10 years. However, the categories of staff for which such enhancement would be applicable may be decided by the General Manager of the concerned Zone keeping in view the need of manning important posts for smooth train Operations.</p>



<p>The matter has accordingly been considered by the competent authority i.e. GiM/LECoR and it has now been decided that the minimum service period of 5 years to 10 years Is here by enhanced for the following categories of staff</p>

<p>In all other categories, the service condition of 05 years will be as per instructions issued by Railway Board vide letter No-E(O)III/2014/ PL/05 dated 31.08.2015</p>

<p>As the Railway administrations are aware, instructions already exist which provide that in cases of request transfer, the requests should be dealt with in an organized and  expeditious manner so that there is no occasion for any grievance in the mind of the staff in regard to the handling of their request.</p>



<p>It has been observed that despite the existence of such instruction, due to administrative exigencies,it sometimes becomes difficult to relieve the transferred employee a within a reasonable time, which results in loss of seniority to the employee in his new place of posting. The loss is even greater when he goes to  posts one grade below, and new recruits from subsequent batches join before him.</p>

<p>The loss in seniority in such cases resulting from delayed relieving of the emproyee often leads to litigation, and structures passed by Hon&#8217;able Courts.</p>



<p>In one such case recently, the Hon&#8217;ble CAT/Chennai in OAs, No.751/2019 and other similar OAs, vide their common order dated 05.07.2019, inter-alia observed as under:</p>



<p>Since it is submitted by the applicants that IREC is silent on the above issue and accordingly there is a void in this regard in the policy, we deem it appropriate to direct the first respondent to consider the concerned raised in the OAs as a policy issue and take an appropriate decision on whether and if so, how the interests of such transferred employees  should be protected in regard to their seniority at-least from the date from which they where approved for IRT, if they could not be relieved soon thereafter in public interest. Such policy decision may be taken and orders issued within a period of six month from the date of receipt of a copy of this order.&#8221;</p>



<p>The matter has accordingly been considered in the Board. while it may not be desirable / feasible to assign seniority to transferred employee of approval of in the new unit from the date of approval of the transfer, when the employees is still actually working in the parent unit, every effort should be made to relieve her/him at an early date. Where delay in relieving of the employees after orders are issued exceeds is likely to exceed 3 months, the case should be put up by Sr.DPO/ WPO to DRM/ CWM as the case may be giving specific reasons for the delay and  likely date of relief.</p>
