<h3 class="wp-block-heading">Sub:- Provision of OPD consultation &amp; related investigation for RELHS beneficiaries aged 75 years &amp; above from specialists of Private Hospitals empanelled by Railway &#8211; As a PILOT PROJECT FOR ONE YEAR FROM 01.11.2023 TO 31.10.2024.</h3>



<p>The matter of provison of direct Outpatient Department (OPD) consultation and related investigation from specialists of private hospitals empanelled by Railway for RELHS beneficiaries aged 75 years and above has been drawing attention of Ministry of Railway for some time. After consideration of the issue, Railway Board has decided as under:-</p>



<p>(i) RELHS beneficiaries aged 75 years and above may be permitted to seek direct OPD consultation from specialists of.Private Hospitals empanelled by Railway, without referral from Railway Hospital/ Health Unit under which beneficiary 1s registered.</p>



<p>(ii) If any CGHS listed investigation/ procedures is advised and is required to be undertaken <strong><em>In emergency,</em></strong> no other authorization will be required, and the same may be undertaken from empanelled hospital at CGHS rates for that city/or as per MoU with Railways in cashless procedure. Bills along with copy of UMID card, copy of prescription/ Reports and declaration form (copy enclosed) signed by the beneficiary and duly endorsed by the competent authority of the empanelled hospital will be sent to Railway under which the hospital 1s empanelled for payment.</p>



<p>(iii) In non-emergency cases, approval of competent authority from Railways will be required for undertaking&nbsp;<strong>(a)</strong>&nbsp;CGHS non-listed investigations/ planned procedures; and (b) those CGHS listed investigations, which cost above Rs. 10000/-, whenever advised by specialist of empanelled hospitals.</p>



<p>(iv) Medicines prescribed by a specialist doctor of private railway empanelled hospitals will be issued by concerned Railway hospitals/Health Units on authorization of available railway doctor.</p>



<p>(v) Private Hospitals empanelled under Railways shall provide above facilities on cashless basis at CGHS rates to Railway beneficiaries aged more than 75 years. The hospitals shall submit the bills along with valid UMID card and declaration form signed by the beneficiary who has availed the facilities, duly endorsed by the competent authority of the empanelled hospital.</p>



<p>(vi) This facility will be available for only those aged 75 years &amp; above RELHS beneficiaries who are eligible for OPD consultation at Railway Hospitals/ Health Units. This facility is not available to beneficiaries having UMID card with FMA.</p>



<p>(vii) These guidelines will not supercede the instruction issued vide Board’s letter No. 2018/ TransCell/ Health/ CGHS (eOffice No.327783) dated 16.06.2021 which will remain inforce for emergency cases/IPD cases as specified therein.</p>



<p>(viii) This is a Pilot Project only for one year i.e. 01.11.2023 to 31.10.2024.&nbsp;<strong>Railways will ensure the period of Pilot Project without fail.</strong></p>



<p>(ix) To ensure that UMID cards are not misused, proper accountal of expenditure incurred on the present scheme may be maintained by Railway/ PU.</p>



<p>(x) Empanelled hospitals need to be provided access to HMIS portal so that data-is captured efficiently and can be retrieved whenever required.</p>

<h3 class="wp-block-heading">Subject: Grant of Ex-Gratia Payment to CPF Retirees who retired after 31-12-1985 &#8211; Appeal for removal of discrimination between CPF Retirees who retired upto 31-12-1985 &amp; after 31-12-1985</h3>



<p>Reference: DOP&amp;PW OM No. 45/52/97-P&amp;PW Dated: 16-12-1997.</p>



<p>1. We invite your kind attention and seek early justice for the CPF (Contributory Provident Fund) Retirees who retired after 31-12-1985 and are suffering great hardship due to non- receipt of the Ex-gratia Payment as paid to those CPF Retirees who retired upto 31-12- 1985.</p>



<p>2. Ex-Gratia Payment of Rs.600/- PM plus DR was granted, to CPF Optees who retired between 1-4-1957 to 31-12-1985 vide DOP&amp;PW orders cited above. The amount of Ex- gratia Payment and DR thereon were revised from time to time. But no Ex-Gratia Payment has been granted to the CPF Optees who retired after 31-12-1985. This is unjust, discriminatory and causing continuous hardship to the post 31-12-1985 CPF Retirees.</p>



<p>3. All CPF Retirees were recruited before 1-4-1957 and as such formed one class of employees. Any distinction between them on the basis of date of Retirement is discriminatory and violative of Articles 14, 16 and 39 of the Constitution of India as well as according to the Law of Justice settled in DS Nakra’s case and General Bains’ Case decided by the Apex Court of India.</p>



<p>4. The number of surviving CPF Optees, who retired after 31-12-1985, is very small as all the CPF Optees joined service before 1-4-1957 and the last ones of such optees would have retired by 1997 or before that. As such, the financial implication of granting them Ex- Gratia payment would also be small but would do the much delayed justice to them and provide them the much needed relief .</p>



<p>5. It is, therefore, requested that the CPF Optees who retired after 31-12-1985 and their Families be granted Ex-Gratia Payment &amp; DR at par with the CPF Optees who retired upto 31-12-1985 and unjust discrimination and hardship may please be removed.</p>

<h3 class="wp-block-heading">Sub: Grant of Dearness Allowance to Railway employees &#8211; Revised Rates effective from 01.07.2022.</h3>



<p>The undersigned is directed to refer to this Ministry’s letter <a href="https://centralgovernmentnews.com/dr-to-railway-pensioners-family-pensioners-dearness-relief-effective-from-1st-jan-2022/">RBE No. 40/2022 dated 05.04.2022 (F.No. PC-VII/2016/I/7/2/1)</a> on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Railway employees shall be enhanced from the existing rate of <strong>34% to 38% of the Basic Pay with effect from 1st July, 2022.</strong></p>



<p>2. The term &#8216;Basic Pay&#8217; in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.</p>



<p>3, The Dearness Allowance will continue to be distinct element of remuneration and will not be treated as pay within the ambit of Rule 1303 (FR 9(21)), Indian Railway Establishment Code, Volume -II (Sixth Edition &#8211; 1987) &#8211; Second Reprint 2005.</p>



<p>4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>



<p>5. This issues with the concurrence of Finance Directorate of Ministry of Railways.</p>

<p>Please connect Board’s letter of even no. dated 24.8.2020 wherein a suggestive list of discrepancies was provided with a request to carryout intensive checks of <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" rel="noreferrer noopener">pension </a>payments. Now, one of the Zonal <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a> has brought out some more discrepancies noticed by them during the spot checks. Accordingly, a revised suggestive list duly incorporating these discrepancies is attached for ready reference.</p>



<p>Kindly arrange to notify the staff deputed for the purpose to verify the pension payments accordingly.</p>

<p>1. Payment of revised pension as per <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong>.<br />2. Admissibility of DR to the pensioners who are permanently absorbed in PSUs.<br />3. Age related additional quantum of pension w.r.t date of birth of the pensioner / family pensioner and with reference to the prescribed percentage of increase.<br />4. Ascertaining missing age profile of the pensioner/ family pensioner.<br />5. Restoration of commuted pension.<br />6. Payment of enhanced family pension at the extant rates and the period.<br />7. Wrong fixation of Basic pension to ex-gratia pensioners.<br />8. Discrepancies in payment of Fixed Medical Allowance to the Pensioners,<br />9. Continuation of pension payment to deceased pensioners’ account<br />10. Amount lying unconnected in inoperative Bank Account of the pensioners.<br />11. Any other item which PFA/ CPO may consider fit.</p>

<ul class="wp-block-list"><li>The allowances to all the staff was paid from 1st of July 2016 but the KMA and other related allowances to running staff have not been decided. Such delay is a cause  of Railwaymen blaming the Federation and gives room for staff agitations. This type of situation cannot do well to the institution. The Railway Board should seriously think and resolve the issues quickly.</li><li>Railway Board constituted a Task Force Safety Committee consisting of five very senior officers (General Managers), the Committee gave recommendations on 10th January 2017 wherein it has been mentioned that the running staff who join duty after leave at 0:00 hours and worked train immediately after resumption, commit accidents. Therefore, the Committee recommended that the running staff should not be booked to work train before 8 ‘o’ clock in the morning when they resume duty after availing leave.<br />Unfortunately recommendations of the Committee are not being followed and the running staffs are booked invariably to work first train after 0:00 hours on resumption from leave. He urged the Member Staff to see that suitable instructions are issued to the Zonal Railways to follow the recommendations of the Committee to avoid situations which may cause accidents.</li><li>The Railway Board issued orders in the year 2004, as a result of decision arrived at, in the DC/JCM meeting, but unfortunately this decision has been changed unilaterally in the year 2007 by the Board. This change has created adverse situation like denial in granting appointment on compassionate grounds. He urged the MS that the order of 2004 be restored without delay.</li><li>Time and again the Railway Board had issued detailed guidelines, not to retain money from settlement dues of railway employees on superannuation, but unfortunately these orders are being violated by withholding heavy amounts from settlement despite the fact that employees are not in occupation of Railway quarter and equally no disciplinary action pending against them.</li><li>Retired Railway employees have been re-engaged against vacancies, but they are not paid Night Duty Allowance though they perform night duty. OT Allowance is also not paid to these re-engaged staff when they work over hours of duty at out stations. He empathetically stated that injustice is being caused to the retired Railway employees who are re-engaged as all such rules are equally applicable to them when they have been re-engaged to Railway service.</li><li>The PPOs of running staff are not being revised because concordance tables have not been provided although orders have been issued to revise their pension pay orders by sighting illustrations, but it is not working as the staff have developed habit of working with the assistance of concordance table, as such concordance tables be<br /> prepared and issued.</li><li>Regarding filling up of vacancies, he expressed satisfaction on the information given by Member Staff that by the end of May 2019, a panel of 62,960 selected candidates of Pay Matrix Level-I and similarly panels of ALPs and SMs will also be made available. He stated that occurrence of 3% vacancies of total cadre is through natural attrition, therefore the sequence of formation of panels should be planned and followed in a methodical manner as a regular course.</li><li>Case of payment of honorarium to cashiers and other accounts staff of NWR for the year 2008, 2009 and 2010, is pending in the Railway Board for sanction. The inordinate delay in payment is a matter of concern for everyone. Our position becomes very embarrassing when staff complain about differential treatment as there is zero maintenance of staff quarters while on the other hand the quarters of officers are well maintained. He requested that immediate action be taken in the matter to mitigate the staff complaints.</li></ul>

<p>&nbsp;&nbsp;&nbsp; Sub :- Inordinate delay in finalization of pension related grievances of Railway Pensioners.</p>



<p>Ref:- Board’s letter No. 2018 /AC-I1/21 11/Pn rep to MoS (G) dated 28.09.2018.</p>



<p>&nbsp;Hon&#8217;ble
 MoSR(G) has expressed deep dissatisfaction at the inordinate delay, on 
one Zonal Railway, in inclusion of the name of unmarried disabled 
daughter in PPO. He has directed that efforts should be made to dispose 
off such grievances within a month’s time.</p>



<p>Attention is
 also drawn to Board’s letter under reference, wherein a detailed Action
 ‘Taken Report (ATR) was required to be submitted to Board’s office by 
8.10.2018 by all Railways on status of disposal of pension related 
grievances. Many Zonal Railways took a prolonged period to report their 
respective status. This resulted in delay in submission of the ATR to 
MoSR/G. While reviewing the ATR, MoSR/G has expressed his displeasure 
and has directed that responsibility may be fixed for the delay in 
submission of the ATR, in the subject case. Further, MoSR/G has directed
 all the Zonal Railways and Production units to urgently initiate the 
following course of action:-</p>



<p>a) GMs, PCPOs and PE As 
needs to put a system in place for adapting a coherent approach in 
resolving the pension related grievances immediately;</p>



<p>b) Immediate action must be taken to digitize the records so that Railways move away from paper documentation;</p>



<p>c)
 Electronic communication means should be adopted, including periodic 
reporting, rules/records updation, seeking documents and disseminating 
information, to ensure regulatory disclosure; .</p>



<p>d) Updatation of pension related records and validation of revision by various stakeholders should be close to real time.</p>



<p>e)
 System improvement and technological upgradation should be adopted in 
strict time lines so that the system may come into force from 1st April,
 2019.</p>



<p>&nbsp;Action taken in this regard may kindly be reported to Board’s Office urgently latest by 25th March, 2019 .</p>

<p>Sub: <strong>Admissibility of Dearness Relief to pensioners on absorption in PSUs/ employed family pensioners.</strong></p>
<p>Kindly, refer to Board&#8217;s letter no. 2012/AC-II/21/Misc Matters dated 11.04.2016 followed by reminder dated 07.11.2016 reiterating instructions issued vide Board’s letter No. F(E)III/99/PN1/21 dated 05.08.1999 and letter no. F(E)III/2005/PN1/2. dated 29.09.2009 on the above subject. It was stated that instances have been brought to notice of Vigilance Directorate by one of the PSU wherein Dearness Relief on pension is being paid to certain re- employed pensioner not eligible to the draw the same as no endorsement towards non- admissibility of DR was made on their PPOs. Accordingly, it was requested to conduct a thorough check to detect such cases where DR relief on re-employment in Railway PSU sand other orgaliization has been paid/ drawn in violation of the laid down guidelines an send the compliance report to Board&#8217;s office. However, reply in this regard is not forthcoming from any of the Railways .</p>
<p>It is once again requested to conduct a thorough check to detect such cases followed by necessary recovery from the defaulting retired Railway Pensioner, besides taking further necessary action as per rules.</p>
