<p>Sub: <strong>Revision of pay structure of Gr. ‘B’ Gazetted posts of Official Language Department of Zonal Railways / PUs at par with the CSOLS cadre.</strong></p>



<p>The issue regarding revised pay structure of gazetted posts of Official Language (OL) Cadre on Zonal Railway at par with those existing in Central Secretariat Official Language Service (<strong>CSOLS</strong>) has been under examination in consultation with Ministry of Finance (Department of Expenditure). The President Is now pleased to decide that pay structure of Group ‘B’ Gazetted posts of Official Language cadre of Zonal Railways may be upgraded subject to the following conditions:-</p>



<ol class="wp-block-list"><li>The pay structure of Group &#8216;B&#8217; Gazetted posts of Official Language Department of Zonal Railways / PUs will be upgraded from existing PB-2 GP Rs. 4800/- (Level 8) to PB-3+ GP 5400/- (Level -10 ) Group “A” with designation &#8220;Rajbhasha Adhikari&#8221;. from the date of issue of this order.</li><li>The Recruitment Rules of the above posts in the Zonal <a rel="noreferrer noopener" href="https://centralgovernmentnews.com/category/railways/" target="_blank">Railways</a> would be brought at par with that of Assistant Director(OL,) in CSOLS.</li><li>The functions of these posts is exactly similar to Assistant Director (OL) of CSOLS.</li><li>Once the upgradation of posts from PB-2 GP Rs. 4800/- L-8 to PB-3 GP Rs. 5400/L-10 is effective. further instructions regarding procedure for placement of existing incumbents in lower grade to higher / upgraded post and change of RRs will be issued separately. by Management Service Directorate.</li></ol>



<p>This issues in consultation with the Official Language directorate and with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Ref:- Board’s letter No. PC-VII/2018/RSRP/1 dated 17.12.2018 (RBE No. 197/2018)</p>



<p>Please
 refer to Board ‘s letter mentioned above inter-alia circulating 
Ministry of Finance’s (MoF) OM No.4-13/17-IC/E-IIIA dated 12.12.2018 
regarding opportunity for revision of option to come over to revised pay
 structure under CCS(RP) Rules, 2016 for adoption of the same in 
Railways with respect to RS(RP) Rules, 2016.</p>



<p>Consequent to issue of the same, certain Railways has sought clarification whether option to switch over to <strong>7th CPC pay structure can be exercised in a prospective manner covering promotions </strong>materialized after notification of RS(RP) Rules, 2016.</p>



<p>2.
 With respect to above, it is stated that earlier, the issue has been 
examined in Board’s Office and a reference has already been made to MoF 
seeking clarification on the issue. <strong>Response from MoF is awaited.</strong></p>



<p>Till
 such time clarifications are received from MoF, it is advised that 
while allowing options, conditions as stipulated in Rules 5 &amp; 6 of 
RS(RP) Rules, 2016 may strictly be followed as Ministry of Finance while
 liberalizing conditions under Rule 6(4) of CCS(RP) Rules, 2016 which 
provides that the option once exercised shall be final and permitting 
another opportunity to employees to revise their initial option in terms
 of Rule 5 &amp; 6 within a period of 3 months, made no changes in the 
other conditions laid down in Rules 5 &amp; 6 of CCS(RP) Rules, 2016 
governing exercise of option.</p>



<p>3. Hence, it is clarified
 that option for switching over to 7th CPC with respect to promotions up
 to 28 .07.2016 (date of notification of RS(RP) Rules, 2016) valid only 
and option for switching over to 7th CPC cannot be exercised with 
respect to promotions materialized after the said date.</p>



<p>Further, <strong>Illustrations on pay fixation methodology in cases</strong></p>



<p>(a)
 where a Railway Servant has been placed in a higher grade pay or scale 
between 1st day of January, 2016 and the date of notification of RS(RP) 
Rules, 2016 on account of promotion or upgradation and elect to switch 
over to revised pay structure from the date of such 
promotion/upgradation and</p>



<p>(b) fixation of pay in case 
an employee elect to continue to draw pay in existing pay structure 
until he vacates his post or ceases to draw pay in the existing pay 
structure with respect to promotion upgradation materialized after the 
date of notification of RS(RP) Rules, 2016 in terms of relevant 
provisions of RS(RP) Rules, 2016 is enclosed as Annexure-I.</p>

<p>Attention is invited to instructions under reference prescribing, inter-alia, minimum educational qualification for open market recruitment to the post of Pharmacist, Grade-III in Level-5 (Pay Band -1 of Rs.5200-20200 having Grade Pay of Rs.2800) as under:-</p>
<p>“10+2 in Science or its equivalent with 02 (two) years Diploma in Pharmacy and registration with Pharmacy Council of India or registration with State Pharmacy Council”.</p>
<p>2. The review of qualification for the above post has been under consideration of this Ministry, pursuant to the issue raised by both the recognized Federations. Accordingly, it has been examined in consultation with Health and Pay Commission Directorate of this Ministry and it has been decided by the Board that the qualification for the post of Pharmacist, Grade III in Level-5 will be as under:-</p>
<p><b>“10+2 in Science or its equivalent with Diploma in Pharmacy from recognized institution and registered as Pharmacist under the Pharmacy Act, 1948</b></p>

<b>Bachelor degree in Pharmacy (B. Pharma) from a recognized University or equivalent and Registered as a Pharmacist under the Pharmacy Act, 1948″</b></p>
<p>3. These instructions will be applicable from the date of issue of this letter. Cases already under process will continue to be dealt in terms of earlier instructions.</p>

Sub: <strong>Non-payment of Over Time Allowance to the staffworking on Track Machines on South East Central Railway-reg.</strong><br />
Ref: (i) CPO, SEC Rly&#8217;s letter No. P-HQ/RUL/118/2/6234 dated 24/25-02-2015 &amp; P-HQ/RUL/118/2/767 dated 15/05/2015.</p>
<p>(ii) Railway Board&#8217;s letter No. E(LL)/98/HER/9 dated 09/04/2015.<br />
(iii) NFIR&#8217;s letter No. i/8 Part I dated 06/06/2016.<br />
(iv) Railway Board&#8217;s letter No. 98/E(LL)HER/9 dated 24/03/2017.<br />
Federation is disappointed to note the contents of Railway Board&#8217;s letter dated 24/03/2017 wherein Board has clarified to the GM (PyS.E.C. Railway that the principle of averaging for payment of OT Allowance to the Track Machine Staff to be given effect from 1010712013, the date of issuance of Board&#8217;s letter. Federation is constrained to state that the Board has completely ignored the rule position contained in letter dated 06/07/2000,10/07/2013 &amp; 16/06/2016 and issued wrong clarification. Federation also feels sad to convey that mere copy has been endorsed to NFIR, without mentioning NFIR&#8217;s reference to Railway Board.</p>
<p>So far as clarification issued by Board is concerned, the Federation does not agree with the same in the light of the following facts/merits.</p>
<blockquote><p>i) The Railway Board vide letter No. E(LL)98-HER/9 dated 0610712000 had introduced duty roster in respect of Staff working on Track Machines and laid down rostered hours of work for three weeks at a stretch followed by rest for a continuous period of one week at the Headquarters in consultation with the Ministry of labour. These instructions further stipulated that the individuals shall not be employed for more than 12 hours on any day and in respect of Overtime payment, the staff will be governed by the extant instructions under HOER i.e. principle of averaging.</p>
<p>ii) Subsequently Railway Board vide letters dated 09/09/2009 &amp; 30/10/2012 had conveyed continuance of three weeks&#8217; roster at a stretch followed by continuous rest of one week at the Headquarters (valid upto September, 2015).</p>
<p>iii) On raising the issue relating to non-payment of Overtime to the Track Machine staff working on Zones by the NFIR at Board&#8217;s level, Railway Board vide letter dated 10/07/2013 had again issued instructions that the Track Machine Staff when deployed for 3 weeks continuously followed by one week rest, the payment of overtime be regulated by the principle of averaging on four weekly basis whenever working hours exceed 192 hours and keeping in view the provisions of Board&#8217;s letter dated 11/06/1974.</p>
<p>iv) Railway Board vide letter dated 1610612016 has again reiterated for  implementation of instructions envisaged in Board&#8217;s letter dated 6/7/2000.</p>
<p>v) It needs to be appreciated that Board&#8217;s instructions dated 06/07/2000 have neither been modified nor superseded. Therefore, payment of Overtime to the staff working on Track Machines is required to be regulated in terms of Board&#8217;s instructions dated 06/07/2000 from that date and not from the date of issue of Board&#8217;s letter dated 10/07/2013.</p></blockquote>
<p>The facts mentioned above clearly establish the entitlement of overtime payment with effect from 06/07/2000 and not prospectively. Accordingly, the Track Machine Staff of South East Central Railway who have been denied Overtime payment from August 2010 by the Zonal Railway due to mis- interpretation of Rules are rightly entitled from August,2010.</p>
<p>NFIR therefore, requests the Railway Board to review its clarification dated 24/03/2017 and, issue fresh clarification to the Zonal Railways in general and South East Central Railway in particular for implementing instructions dated 06/07/2000 and allowing overtime payment retrospectively. A copy of the instructions issued may be endorsed to the Federation.<br />

<p><strong>Sub: Procrastination of staff issues &#8211; non-fulfillment of commitments by the Railway Board &#8211; serious unrest prevailing among railway employees-intervention requested.</strong></p>
<p>Federation is constrained to bring to your kind notice that the staff in almost all categories are the dissatisfied lot due to non-redressal of their genuine grievances at Railway Board&#8217;s level as also non-fulfillment of commitments made in the formal meetings held with the Railway Board. The staff issues dealt in the fora of PNM, DC/JCM as well in separate meetings are continued in a stalemate position for years together without finality.</p>
<p>In the above context, NFIR places below the real position to impress upon the CRB that the Railway Board&#8217;s failures have been causing dissatisfaction and agony among employees in general and those in safety categories in particular:</p>
<p>&nbsp;</p>
<p><strong>(a) Non-fulfillment of assurances/commitments:-</strong></p>
<ul>
<li>Replacement of 6th CPC GP Rs. 4600 (PB-2) with GP 4800 (PB-2) for Sr. Section Engineers and other Inspectorial/Supervisory Officials in the Railways.</li>
<li>Replacement of 6th CPC GP 4200/- PB-2 with GP 4600/- PB-2 for Loco Pilots (Mail/Exp).</li>
<li>Stepping up of pay of Loco Inspectors inducted prior 01/01/2006 on remaining 6 1/2 Zones in Indian Railways. (Although SLPs have been dismissed by Apex Court, the Railway Board have twisted the matter and allowed stepping up of pay to the petitioners before Court, stating that the benefit allowed as&#8221; personam&#8221;. (This is a clear case of blatant violation of agreement reached with Federations). NFIR’s letter No. 11/95/Pt. X dated 24/01/2017 to CRB and letter dated 06/02/2017 may kindly be perused. GS/NFIR met Hon’ble MR and apprised the facts. The Hon’ble MR agreed that agreement should be honoured when Member Staff was present during discussion. The Railway Board&#8217;s negative attitude has been contributing unrest among Loco Running Staff.</li>
<li>Upgradation of Apex Group &#8216;C&#8217; posts to Group &#8216;B&#8217; (Gaz) &#8211; 3335 posts.</li>
<li>Implementation of 10: 20: 20: 50 ratio for Track Maintainers in VI CPC GP 2800, 2400, 1900 and 1800 respectively (7th CPC Pay Matrix levels 5, 4, 2 &amp; 1).</li>
</ul>
<p><strong>(b) Agreed decisions not implemented:</strong></p>
<ul>
<li>Manning of coaches by Ticket Checking Staff &#8211; Restoration of Board’s orders of 2000.</li>
<li>Cadre restructuring of IT cadre staff.</li>
<li>Implementation of norms for creation of posts of SSE (Signal) JE (Signal), Maintainer (Signal) etc.,</li>
<li>Merger of Senior Technicians (Signal) with JE (Signal) &#8211; NFIR PNM Item No. 14/2010.</li>
<li>Induction of Course Completed Act Apprentices in Safety category vacancies in GP 1800/Pay Matrix Level I</li>
<li>Absorption of staff of Quasi Administrative units in Railways &#8211; Restoration of policy decision of 1973 &amp; 1977 which was arbitrarily cancelled in the year 1997 without prior consultations with the Federations. It needs to be appreciated that quasi staff are not outsiders and IREM provisions confirm Federation&#8217;s contention.</li>
</ul>
<p><strong>(c) NFIR&#8217;s pending PNM Items:</strong></p>
<ul>
<li>Items pending since over five years = 22</li>
<li>Items pending since over three years = 27</li>
<li>Items pending sine over two years = 12<br />
<strong>Total = 61</strong></li>
</ul>
<p><strong>(d) DC/JCM &#8211; pending items:</strong></p>
<ul>
<li>Items pending since over five years = 45</li>
<li>Items pending since over six years = 09</li>
<li>Items pending since over seven years = 31<br />
<strong>Total = 85</strong></li>
</ul>
<p>(e) Issues deliberated in the meetings of Fast Track Committee and Joint Committee (on Running Staff kilometrage rates etc.,) are continued to remain unresolved.</p>
<p>(f) MACPS issues numbering over 30 are pending with Railway Board since more than 3 years.</p>
<p>(g) Non-filling of vacancies (safety and other than safety categories) is causing deterioration of efficiency levels and health of existing staff who are heavily over burdened with work pressure.</p>
<p>NFIR therefore requests the CRB to kindly intervene for rectifying the matters to restore confidence among staff who are extremely unhappy on non-redressal of grievances and non-implementation of agreements.<br />
Federation also conveys that further delay in sorting out the issues and implementing agreements may lead to wide spread agitation in Railways.</p>

<p><strong>Ref:</strong> Board&#8217;s letters of even no dated 03.09.2009, 07.06.2010, 21.11.2011, 23.05.2012, 15.1.2013, 24.05.2013, 03.01.2014, 16.06.2014, 31.12.2014 &amp; 09.02.2016 on the above subject.</p>
<p>Attention is drawn to Board&#8217;s order issued on 03.09.2009, consequent upon implementation of 6th CPC recommendations, regarding mode of filling up of Non-gazetted posts consequent upon merger of grades. The above scheme of such mode of filling up of non-gazetted posts has since been extended from time to time, last validity being till 31.12.2016.</p>
<p>2. 7th CPC, in its report in para 5.1.45 has recommended that benchmark for performance appraisal for MACP as well as for regular promotion be enchanced from <em><strong>Good</strong></em> to <em><strong>Very Good</strong></em>. While recommendation for MACP has been accepted by Government and instructions in this regard have been issued vide Board&#8217;s letter No.PC-V/2016/MACPS/1 dated 19.12.2016 (RBE No.155/2016), the issue regarding benchmark for regular promotion is still examination in consultation with DoP&amp;T.</p>
<p>3. Accordingly, it has been decided by the Board that till such time instructions for benchmark for regular promotion are issued, the existing methodology and benchmarks for Promotion, as enumerated in the Board’s letters referred to above, may continue till further orders.</p>

<p>Sub: <strong>Revision in the rate of Ration Money Allowance in respect of Non-gazetted RPF/RPSF personnel.</strong></p>
<p>In terms of Board&#8217;s letter of even number dated 19.06.2015, non-gazetted RPF/RPSF personnel were entitled for Ration Money Allowance at par with Central Para Military Force (CPMF)/Central Armed Police Force (CAPF) Personnel i.e. @ Rs.95.52/- per day/per head w.e.f. 01.04.2014.</p>
<p>2. It has now been decided to revise the rate of Ration Money Allowance from existing rate of Rs.95.52 per head per day to Rs.97.85 per head per day from 01.04.2015 to 31.12.2015.</p>
<p>3. Accordingly, sanction of the Ministry of Railways is hereby accorded post-facto to revise the rate of Ration Money Allowance from Rs.95.52 per head per day to Rs.97.85 per head per day from 01.04.2015 to 31.12.2015.</p>
<p>4. The other terms and conditions as stipulated in para 4 of Board&#8217;s letter of even number dated 10.06.2009 remain unchanged.</p>
<p>5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Sub: <b>Clarification about educational qualification of Ex-servicemen candidates</b> – reg.</p>
<p>References have been received from various Railway establishments seeking clarification regarding acceptance or otherwise of certificates pertaining to qualification submitted by Ex-servicemen for post of Senior Section Engineer which contained following endorsement:-</p>
<p>“Diploma in Engineering in appropriate discipline plus total 10 years of technical experience in the appropriate field is recognized as equivalent to Degree in Engineering. It is considered valid for the purpose of selection to Gazetted posts and services under the Central or State Government.”</p>
<p>2. This endorsement in Diploma certificates of Ex-servicemen candidates have been made on the basis of certain notification of Ministry of Education and Social Welfare (Department of Education Technical) contained in letter No. F-18-19/75/T-2 dated 26/5/1977.</p>
<p>3. The matter has been examined in consultation with Air Headquarter/New Delhi, Ministry of Defence and Ministry of Human Resource Development. It has now been informed by M/o HRD that notification dated 26/5/1977 has been declared fictitious by Hon’ble Central Administrative Tribunal, Chandigarh in OA No. 343/PB/2013 in their order dated 15/12/2015 in the matter of Shri Om Prakash Kangotra and others Vs Union of India &amp; others.</p>
<p>4. In above light, it has been decided that aforesaid certificates need not be accepted, wherein, Degree in Engineering has been notified as prescribed qualification for recruitment on the Railways.</p>

										<content:encoded><![CDATA[<p><strong>DMRC Staff say their demand for Salary Restructuring not yet been met</strong></p>
<p>New Delhi: The Delhi Metro Rail Corporation has hit rough waters with its employees resorting to protests once again. The protesting non-executive employees of the corporation have now begun a hunger strike as they claim their demands for salary restructuring are going unheard by the administration.</p>
<p>As many as 3,600 employees, mainly technicians, are taking turns to protest at Jantar Mantar and at the seven metro depots. They are not ruling out train services being affected as 32 of those on hunger strike have already been hospitalized. Members of the staff council are likely to meet the administration on Monday to reach a common consensus.</p>
<p>They demand that the salaries of technicians be revised from Rs 8,000 – 14,140 to Rs 10,170 – 18,500. For senior technicians, they have demanded a hike in pay-scale from Rs 10,170 – 18,500 to Rs 14,000 – 26,950 and for head technicians from Rs 14,000 – 26,950 to Rs 16,000 – 30,770.</p>
<p>According to General Secretary, DMRC Employees Union, Kuldeep Maan, the employees fear that once the Seventh Pay Commission is implemented, their problems with the corporation would be quashed. “We have been victims of DMRC’s exploitation since 2007. Our protest has been on for long now but nothing has happened. On November 3, we decided to extend the protest to Jantar Mantar and November 5 onwards employees began their hunger strike,” he said.</p>
<p>To register his protest for the cause Kishan went a step ahead and resigned from his membership of the employees’ council. “So far, 32 of the many employees on hunger strike have been hospitalised. If the administration does now blink an eye many more will be taken ill and then we won’t be responsible if metro operations are hit,” said another protesting member. The administration had called for a meeting once, but it bore no fruitful conclusions, he added.</p>
<p>Responding to the report, the DMRC said, “It is an internal matter of the organization and the Human Resource department has taken up the issues of these employees.”</p>
