<p>In reference to the above, Director/ CGHS, after reviewing the subject matter, with the approval of competent authorities, has clarified for the option of Central Government Employees to avail CGHS benefits either for their Parents or Parents-in-law.</p>



<p>It is requested that a similar option be also made available to the Railway Employees &amp; Pensioners so that their old parents/ parent-in-law can get treatment in Railway Hospitals/ Empaneled Hospitals, subject to the stipulated terms &amp; conditions on the subject matter.</p>

<p>References from Zonal Railways and NFIR have been received in Board’s office seeking clarifications regarding reckoning of 30% pay element for fixation of pay of such Running Staff who have been selected to the Stationary Post i.e non-running post upon promotion through General Selection.</p>



<ol class="wp-block-list" start="2">
<li>The matter has been examined in consultation with Establishment and Finance Directorate(s) of Railway Board. It is advised that in absence of specific orders from the Board to this effect, the benefit of reckoning of 30% pay element for the purpose of fixation of pay of running staff on their promotion/appointment to the posts filled through General Section is not admissible. Further, the General Selection is voluntary in nature and the concerned staff are aware of the mode of fixation of pay on promotion/appointment to a post under General Selection. Hence in such cases, pay fixation has to be effected without taking into account the ‘pay element’.</li>



<li>This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</li>

<h3 class="wp-block-heading"><strong>Sub: Aadhar authentication of Railway Employee regarding.</strong></h3>



<p>Attention is invited to Board’s letters, No. E(G) 2014/LE 1-27 dated 30.12.2014, No. E(G) 2017/LE 1-34 dated 03.11.2017 and No. E(G) 2020/LE 1-1 dated 04.02.2020 regarding introduction of Aadhar enabled Biometric Attendance System(AEBAS) on Indian Railways. The module for AEBAS activities for implementation; circulated under Board’s letter dated 30.12.2014 referred to above envisage inter alia possession/submission of Aadhar Card by every employee and verification of employees Aadhar ID submitted biometrically. This was required for department verification and seed the employee payroll database with the Aadhar ID.</p>



<p>2. As advised by the all zonal Railways/Units, the AEBAS has since been implemented on your railway/units after following due process and is fully functional. In continuation to the above exercise, it has been decided to further update (those still left out for some reasons) and correct the Aadhar based data, verify the Aadhar information and create Aadhar data in the HR database of Indian Railway. It will enable not only in having an update HR database of Indian Railway employees but also lead to identify impersonation of employees and weeding out duplication of employees/ ghost employees.</p>



<p>3. In view of the above, all the zonal Railways/Units are requested that the above exercise may be taken on Top Priority and a compliance report may be sent by 28.02.2023 duly indicating the additional number of railway employees added in AEBAS after due verification and the number of ghost employees, if any, weeded out during the process. It is needless to mention that UIDAI have expressed their willingness to provide necessary support in the above exercise.</p>

<h3 class="wp-block-heading">Sub: Leave applicable to Railway employees &#8211; Frequently Asked Questions (FAQ).</h3>



<p>Please refer to Board&#8217;s letter of even number dated 10.09.2015, vide which certain frequently asked questions issued by DoP&amp;T vide FAQ No. 21011/08/2013-Estt(AL) dated 25.03.2013 on leave matters were circulated for railway employees.</p>



<p>2. Now, DoP&amp;T vide FAQ dated 30.08.2022 has superseded its earlier FAQ dated 25.03.2013. Accordingly, the following FAQs will supersede the FAQs circulated vide Board’s letter dated 10.09.2015:</p>

What is the impact if&nbsp;such limit is exceeded?</td><td>No railway servant shall be granted&nbsp;leave of any kind for a continuous&nbsp;period of 5 years {Rule 910(1) of IREC&nbsp;Vol.I}. Normally, absence from duty,&nbsp;with or without leave, for a continuous&nbsp;period exceeding 5 years other than on&nbsp;foreign service, implies that such railway&nbsp;servant has deemed to have resigned&nbsp;from railway service.&nbsp; {Rule 510(2) of&nbsp;IREC VoI}.</td></tr><tr><td>2</td><td>What are the leave entitlements of Railway servants serving in Railway&nbsp;schools?</td><td>Rule No. 525 of IREC Vol.-I {Railway Services (Liberalised Leave) Rules, 1949) regulates the grant of Leave on Average Pay for persons serving in the Railway Schools. Vide Board’s letter dated 23.04.2019, which came into force w.e.f. 14.12.2018 (the date of issue of DOP&amp;T’s notification dated 11.12.2018), amendments have been made under Rule 525 &amp; 526. The said rules provide for as follows:-<br /><br />(1)(a). The leave account of every Railway servant who is serving in a Railway school such as teacher, principal, headmaster, librarian, laboratory assistant or a waterman shall be credited with Leave on Average Pay, in advance, in two instalments of five days each on the first day of January and July of every calendar year.<br />(b). In respect of any year in which a Railway servant avails a portion of the vacation, he shall be entitled to additional Leave on Average Pay in such proportion of twenty days, as the number of days of vacation not taken bears to the full vacation, provided the total Leave on Average Pay credited shall not exceed thirty days in a calendar year.<br />(c). If, in any year, the Railway  servant does not avail any vacation, Leave on Average Pay will be as per Rule 523 instead of clauses (a) and (b).For the purpose of this rule, the term “year” shall be construed not as – meaning a calendar year in which duty is performed but as meaning twelve months of actual duty in a Railway School.<br />A Railway servant entitled to vacation shall be considered to have availed himself of a vacation or a portion of a vacation unless he has been required by general or special order of a higher authority to forego such vacation or portion of a vacation. Provided that if he has been prevented by such order from enjoying more than fifteen days of the vacation, he shall be considered to have availed himself of no portion of the vacation.<br />When a Railway servant serving in a Railway school proceeds on leave before completing a full year of duty, the Leave on Average Pay admissible to him/her shall be calculated not with reference to the vacations which fall during the period of actual duty rendered before proceeding on leave but with reference to the vacation that falls during the year commencing from the date on which he completed the previous year of duty.<br />As per Rule 526 (3)(1), the account of Leave on Half Average Pay of every Railway servant (other than a Railway servant serving in a Railway School) shall be credited with Leave on Half Average Pay in advance, in two instalments of ten days each on the first day of January and July of every calendar year.</td></tr><tr><td>3</td><td>Whether railway servant can be&nbsp;permitted to leave station/ go abroad&nbsp;while on CCL?</td><td>Child Care leave is granted to a railway&nbsp;servant to take care of the needs of the&nbsp;minor children. <h3 class="wp-block-heading">Sub: Handling of Court Cases in the field offices.</h3>



<p>A number of cases on various important policy issues pertaining to pay related matters have been filed by Railway employees before various courts of law which are being contested by Zonal Railways/ PUs at different levels in consultation with Pay Commission Directorate/ Railway Board. It has been time and again re-iterated by Railway Board through periodic communications and meetings that these cases should be monitored at the level of a JAG officer or higher level to ensure that the cases are contested effectively.</p>



<p>2. However, an instance has come to the notice of this office wherein a case relating to one of the important policy decisions of Board has been dismissed/ decided ex-parte by the concerned High Court for non-prosecution as the contesting Advocate appearing on behalf of Railway administration was not present on the listed date of hearing. It is observed that the above dismissal of case is due to lack of effective monitoring at the desired level.</p>



<ul class="wp-block-list"><li>2.1 Such cases on policy/ pay related issues have huge ramifications/ financial implications and any adverse judgment if implemented would have a cascading effect on similar cases and also have far reaching consequences as it would result in similar demands from various other categories in Railways.</li></ul>



<p>3. In order to avoid such laxity in future while defending the interests of UoI before the respective court of law, it is advised that the concerned advocate appearing on behalf of UoI may be adequately briefed beforehand and instructed to ensure his presence on each hearing <strong>invariably</strong> to prevent the case being decided ex-parte.</p>



<p>4. Non-appearance by the concerned advocate before the Hon’ble Tribunal/Court on the day of hearing should be viewed seriously and appropriate action in this regard may be taken by the competent authority. Needless to say, full attention should be paid to such cases and monitored regularly by a competent JAG level officer or higher level as any laxity would result in huge ramifications on similar cases filed before various courts of law.</p>

<h4 class="wp-block-heading">Sub.: Enlarging the scope of CUG mobile scheme to cover all Railway employees</h4>



<p>Ref.: Board’s letter Nos.2010/Tele/11(2)/2Pt.II dated 18.09.2017 &amp; 21.12.2018</p>



<p>To enhance manpower productivity, Board has approved the proposal to encompass all railway personnel under the scope of CUG mobile scheme on Indian Railways by providing CUG connection to all Railway employees. Additional CUG connections are to be provided under Plan ‘C’, RCIL has been mandated to finalise the tender with revised requirements through reverse auction.</p>



<p>2. In the meantime, all departments should advise the Railway’s CUG coordinator for requirement of additional SIMs based on staff on roll. This is to be certified by the Personnel department. Railway’s CUG coordinator shall requisition the SIMs from RCIL/TSP and hand over the same to the respective department for further distribution once received from RCIL. In case of surrendering of SIM on account of attrition (retirement/ transfer), advice of the same should be sent by the concerned nodal officer of the department to the CUG coordinator. No dues certificate at the time of retirement for settlement and LPC at the time of transfer should necessarily have CUG surrender as a precondition.</p>



<p>3. It will be the responsibility of each department to maintain records for CUG SIMs provided to their users along with their Employee Numbers and provide the details in the prescribed format covering Proof of Identity and Proof of Address details as per TRAI guidelines. This information shall be shared quarterly with Railway’s CUG coordinator for onward submission to RCIL/TSP.</p>



<p>4. Prevention of any unauthorised issue of CUG connection and its use will be ensured by the concerned department. For this purpose, an authorised official must be nominated in each department.</p>

<p>The undersigned is directed to refer to this Ministry’s letter RBE No. 76/2021 dated 26.10.2021 (F.No. PC-VII/2016/1/7/2/1) on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Railway employees shall be enhanced from the existing rate of <strong>31% to 34% of the Basic Pay with effect from 1st January, 2022</strong>.</p>

<p>2. The term “Basic Pay’ in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7 CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.</p>



<p>3. The Dearness Allowance will continue to be distinct element of remuneration and will not be treated as pay within the ambit of Rule 1303 (FR 9(21)), Indian Railway Establishment Code, Volume -II (Sixth Edition &#8211; 1987) &#8211; Second Reprint 2005.</p>

<p><strong>Death of a railway employee &#8211; Payment of a family pension, death gratuity, and other dues to a Railway servant&#8217;s family when he or she dies while on duty.</strong></p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Railway servant who dies in service after having rendered not less than 7 years continuous service, <strong>enhanced family pension will be payable to the family from the date of death of the Railway Servant for a period of ten years without any upper age limit</strong>.</p></blockquote>

<p>Please refer to the Board’s letter of even number dated 04.06.2021 circulating DOP&amp;PW’s O.M. No. 1/11/2021-P&amp;PW/(E) dated 03.06.2021 vide which order was issued providing for instructions regarding payment of family pension, death gratuity and other dues to the family on death of a Railway Servant during service.</p>



<ol class="wp-block-list" start="2"><li>One of the Zonal Railways had sought clarification regarding the applicability of the Board’s instructions dated 04.06.2021 on the past cases.</li><li>The issue has been examined in consultation with Department of Pension &amp; Pensioners’ Welfare (DOP&amp;PW) and it is clarified that Board’s instructions of even number dated 04.06.2021 are also applicable in respect of employees who expired before the date of issue of the said order irrespective of deceased employee covered under Old Pension scheme or under NPS.</li></ol>



<p>This also disposes of North Eastern Railway’s letter No. पेंशन/मु./एनपीएस /समापक/2019 dated 25.02.2022.</p>

<p>The undersigned is directed to refer the issue regarding restoration of Night Duty Allowance to all categories of Railway employees. It is stated that this Ministry has already taken up this issue and forwarded matter to MoF/DoE for concurrence vide Board’s OM dated dt. 09.09.2021 and reminder dt. 23.11.2021.</p>



<p>DoE has forwarded copy of OM dt. 16.12.2021 addressed to DoPT. Also informed that a reference to DoPT on this issue has been made and reply from DoP&amp;T is awaited.</p>



<p>In light of position provided by DoE, this Ministry has requested to DoP&amp;T vide Board’s OM dt. 04.01.2022 for early resolution of the matter. However, reply From DOP&amp;T &amp; DOE is still waited.</p>

<p>(a) how many employees work with Indian Railways;<br />(b) how many of them are working on contract;<br />(c) whether Government regularise contractual workers working for the last five years;<br />(d) what are the health hazards railway employees face due to factors like diesel exhaust, noise and vibration;<br />(e) how many gangmen and repairmen have died during track repair and maintenance task in the last five years; and<br />(f) the action taken by Government for protection of life and health of its railway workers?</p>

<p><strong>STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (f) OF UNSTARRED QUESTION NO 786 BY SHRI RAKESH SINHA ANSWERED IN RAJYA SABHA ON 03.12.2021 REGARDING RAILWAY EMPLOYEES</strong></p>



<p>(a) During the year 2019-20, the total number of railway employees working on Indian Railways were 12,53,592.<br />(b) Presently, 2942 Employees are engaged on contract basis in Railways.<br />(c) No, Sir. Engagements of contractual staff on Railways are done for a fixed period of time to meet exigencies of services as a stop gap arrangement for a limited period. Engagement on contract basis does not provide for regular absorption.<br />(d) Health hazards due to Diesel exhaust, Noise and Vibrations are varied and depend upon duration of exposure. Common hazards due to above – are usually Cough, Respiratory tract irritation, lack of concentration, insomnia, blood pressure etc.<br />Due to preventive measures and medical care provided to Railway employees hazard exposure due to above factors are avoided.<br />(e) Gangmen and repairmen (Re-designated as Track Maintainer) died during track repair and maintenance task in the last 5 years is as under :-</p>

<p>(f) 1. For safety of Track Maintainer, Railway provide job specific protection gear like Luminous vests, safety helmets with detachable miner’s light, safety shoes, tricolor LED 3-cell torch, sturdy light weight backpack tool kit bag, winter jacket, raincoat with separate waterproof trouser, snow boots etc. to Track Maintainers. Further, ‘Rakshak’ type protection system on high density network of Indian Railways is also provided to alert track maintainer about approaching train.</p>



<p>2. Other measures taken by Indian Railways for safety of Trackmen include counseling by field staff, organising safety seminars, periodical medical examination of field staff, providing warning hooters etc.</p>



<p>3. Further, Railways looks after medical treatment of Railway beneficiary, Medical and Health care provided free of cost, preventive health care, Annual health check-up of all Railway employees and pre placement Medical, Periodical Medical Examination of safety category, First-aid post in all workshops, Specific prevention and safety measures are taken by the concerned departments.</p>
