<p>Sub: <strong>Appointment on Compassionate Ground</strong></p>
<p>The issue Of considering appointment on compassionate grounds(CG) to sons/daughters, born through Other than first legally married wife has been engaging the attention of this Ministry for quite some time, in the backdrop Of partial quashing of CG related instructions contained in this Ministry&#8217;s letter dated 02.01.1992 regarding such appointments, by the Hon’ble High Court/Calcutta in the case(WPCT 20 of 2009) Namita Goldar &amp; Ors. Vs 1301 &amp; Others.</p>
<p>2. In this regard, Railway Board has taken into account following observations of the Hon’ble Supreme Court, on the subject of CG appointment, in the case of State Bank of India &amp; another Vs Rajkumar, (Civil appeal No. 1641 of 2010):</p>
<blockquote><p>&#8220;it is now well settled that appointment on compassionate grounds is not a source of recruitment. On the other hand it is an exception to the general rule that recruitment to public services should be on the basis of merit, by an open invitation providing equal opportunity to al/ eligible persons to participate in the selection process. The dependants of employees, who die in harness, do not have any special claim or right to employment, except by way of the concession that may be extended by the employer under the Rules Or by a separate scheme, to enable the family of the deceased to get over the sudden financial crisis. The claim for compassionate appointment is, therefore, traceable only to the scheme framed by the employer for such employment and there is no right whatsoever Out side such scheme….&#8221;.</p></blockquote>
<p>3. Railway Board has also taken into account following observation of Hon&#8217;ble High Court of Jharkhand (Ranchi) in writ petition No. WP(S) 16 of 2014 (pronounced on 24.07.2014) “&#8221;Compassionate appointment is a matter of policy of the employer and the employer cannot be compelled to provide compassionate appointment contrary to its policy/scheme. When there is specific circular which clearly provides that the children of second marriage of the employee shall not be eligible for compassionate appointment, no direction can be issued to the respondents to consider the case of the petitioner.&#8221;</p>
<p>4. The matter has been examined and in Supersession Of this Ministry&#8217;s letter dated 02.01.1992 issued under RBE No. 01/1992 and No. dated 03.04.2013, it has been decided that the first right of being considered for compassionate grounds appointment is vested, in cases Of death Of Railway servants while in service, with the legally wedded surviving widow provided she has not remarried at the time of making request for appointments on compassionate grounds. It is clarified that in cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955, there can only be one legally wedded wife/widow, as second marriage, while spouse is living, is void/voidable in view of the Section 5(1) read with Section 11 of the Act. In this respect, Railway Board’s letter NO. GS 1-1 dated 10.04.1992 connects.</p>
<p>5. If aforementioned legally wedded surviving widow does not want herself to be considered for compassionate grounds appointment, she can nominate, for CG appointment, a &#8220;bread winner&#8221; for the family from amongst the following:</p>
<blockquote><p>(a) In cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955. Son(including adopted son); or daughter(including widowed/ adopted/ married/divorced daughter). However, if such Railway Servant has left sons/daughters, who have been treated as legitimate Or deemed to be legitimate, under Section 16 of Hindu Marriage Act, 1955, neither widow can nominate them as bread winner for CG appointment nor such sons/daughters can claim CG appointment.</p>
<p>(b) In cases Of those Railway Servants who are governed by their respective Personal Laws: Son(including adopted son); Or daughter(including widowed/ adopted/ married/divorced daughter).</p></blockquote>
<p>However, if such Railway Servant has left sons/daughters through second/subsequent legally valid marriages, i.e. other than through first wife and deceased Railway Servant have failed to Obtain requisite permission for such second/subsequent marriage as required under section 21 (relating to restrictions regarding marriage) Of the Railway Services (Conduct) Rules, 1966, neither first widow/second/subsequent widow can nominate such sons/daughters as bread winner for CG appointment nor such sons/daughters can claim CG appointment. Moreover, such Second/subsequent widow also would not have any right to seek compassionate grounds appointment.</p>
<p>6. All Zonal Railway/PUs/Units are directed to decide cases accordingly.</p>

<p>Sub: <strong>Mandatory Yoga Training for all officers/Staff of Indian Railways including RPF personnel</strong></p>
<p>Zonal Railways may kindly refer to Board’s letter No.E(MPP)/2000/19/1/Meditation dated 23.11.2001 (RBE No.231/2001), vide which Yogo training was introduced for trainees in the Railway Training Centres’. These instructions were reiterated and were made permanent vide Board’s letter No.E(MPP)2009/19/1/pt.(Meditation) dated 13.11.2003 (RBE No.194/2003).</p>
<p>It has been established that Yoga/Meditation courses help in improving levels of concentration, alertness and reduction in stress and hence with a view to provide greater thrust, it has been decided to cover all officers and staff including RPF personnel in the progromme, for general well being of employees. Further, in Budget 2015-16, it was emphasized that training in Yoga will be imported to the staff especially from RPF.</p>
<p>In the light of foregoing, Board has decided to include mandatory Yoga Training progrommes in all the Centralized Training Institutes and Non-Gazetted Training Centres including RPF Training Centres. Accordingly, all the training progrommes whether Initial, Refresher, Promotionol or structured training progrommes would provide for slots for Yoga Training as per details specified below:</p>
<p><img decoding="async" src="http://7thpaycommissionnews.in/wp-content/uploads/2015/06/Yoga-Training-for-CG-Employees.png" alt="Yoga Training for CG Employees" width="100%" /></p>
<p>Accordingly, all Training Centers are advised to arrange these training progrommes. In case necessary, tie up may be mode with certified/Professional Yoga Centres/Trainers on payment basis as may be decided by the concerned General Managers of Zonal Railwoys, PUs and Heads of CTIs etc., in consultation with their Associate Finance under the Zonal Railways/CTIs budgetary powers. Necessary tie up as mentioned above may be finalized within 2 months and training on Yoga in terms of the aforesaid directions may be started immediately thereafter. There would be no exemption from attendance in this progromme unless there are adequate reasons to be accepted by Head of Training Institution personally.</p>
<p>As regards the batch size, the minimum batch size should be 20, however, where more numbers are proposed to be covered in a batch, the some should be decided in consultation with the trainer. In so for as RPF personnel are concerned, RPF Directorate hove already issued instructions vide their letter No.2013/Sec(E)/TRG(POL)-1/1 dated 19.3.2015. These instructions are subsumed and would form part of the aforesoid instructions for RPF personnel.</p>
<p>These instructions supersede all previous instructions on the subject of Yoga Training including the ceiling limit fixed for payment of remuneration to Yoga Instructors/Trainers, hired for the purpose.</p>
<p>As regards the number of officers/staff who are being imported Yoga Training, monthly statement showing total number of officers/staff and RPF personnel trained per month will have to be sent to the Board on a continuing basis on the training progrommes begin.</p>
<p>This issues with the concurrence of the Finance Directorate of Ministry of Railways.</p>

<p>In context of E.C.Railway’s letter under reference, it is stated that the matter has been examined and it is clarified that:-</p>
<blockquote class="tr_bq"><p>(a) The employees joining a post in <strong>Grade Pay of Rs.4600</strong>, on direct recruitment basis may be considered for grant of financial upgradation in Grade Pay of <strong>Rs.4800, Rs.5400 of PB-2 and Rs.5400 of PB-3</strong>, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.</p>
<p>&nbsp;</p>
<p>(b) Similarly, the employees joining a post in <strong>Grade Pay of Rs.4200</strong>, on direct recruitment basis may be considered for grant of financial upgradation in <strong>Grade Pay of Rs.4600, Rs.4800 and Rs.5400 of PB-2</strong>, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.</p>
<p>&nbsp;</p>
<p>(c) Accordingly, the employees joining a post in <strong>Grade Pay of Rs.2800</strong>, on direct recruitment basis may be considered for grant of financial upgradation in <strong>Grade Pay of Rs.4200, Rs.4600 and Rs.4800 of PB-2</strong>, provided that no two successive grades i.e., feeder and promotional are in the same Grade Pay.</p></blockquote>

<p>2. Further, the grant of financial upgradation under MACP Scheme is subject to fulfilment of terms and conditions contained in Board’s letter dt. 10.06.2009 (RBE No.101/2009) and clarifications issued in context thereof and the same may please be ensured while considering cases for financial upgradation under MACP Scheme.</p>

<p><em>G.I., Min. of Railways, Railway Board’s Letter N0.2013/TG-1/20/P/PRS Ticket, dated 9.3.2015</em></p>
<p>Subject: Printing of All India Helpline Number 138 and Security Helpline No.182 on the ticket.</p>
<p>Vide Board’s letter No. 2015/TG-II/02/HeIpline dated 23.2.2015, it has been decided to provide the All India Helpline Number 138 for passengers, as interface for queries/complaints related to Medical emergency, Cleanliness, Food &amp; Catering, Coach Maintenance, Linen etc.</p>
<p>2. In order to publicise the above mentioned number, Board desires that the text “All India Passenger Helpline No.138” may be got printed at the front of the PRS as well as UTS tickets.</p>
<p>3. The text “PNR and train arrival/departure enquiry No.139” may also be printed on the front of the ticket.</p>
<p>4. Further, with reference to the revised general instructions enclosed with Comml Circular No.7 of 2015, Board desires that the text “to report unsavoury situation during journey please dial railway security helpline No.182” may also be got printed at the back of the PRS as well as UTS tickets.</p>
<p>5. It is also desired that the text please carry valid Identity proof’ as appearing at the back of PRS ticket may be moditied as “please carry original identity proof’.</p>
<p>6. IRCTC may also make necessary arrangements to ensure printing of the above mentioned text on the hard copies as well as SMS of e-tickets.</p>
<p>7. The above instructions may be implemented w.e.f 1.3.2015.</p>
<p>8. Necessary instructions in this regard may be issued to all concerned.</p>

<p>Pressure mounted from railway employees of different zones that the PL Bonus should be announced and paid in cash to enable them to make purchases for celebrating Dussehra. It is needless to mention that Puja days (Navratra) will commence from 25th Sept 2014 onwards hence there is need to arrange payment in cash.</p>
<p>NFIR, therefore, requests to kindly arrange to issue suitable instructions for payment of P.L. Bonus in cash as a special case.</p>

<div>NFIR vide its letter dated 30/01/2013 had invited attention of the Railway Board (MS) to clarification issued by the Railway Board vide letter dated 13/12/2012 and illogically upheld further vide letter dated 05/03/2013. In its letter dated 30/01/2013, while explaining rule position in detail, Federation had demanded meeting at the level of Railway Board (MS) considering its wider implications and the inappropriate stand taken by the Railway Board, besides keeping in abeyance the implementation of instructions dated 13/12/2012.</div>
<div></div>
<div>Unfortunately, Railway Board did not take any action despite Railway Board (MS) verbal assurance. The wrong stand taken by the Railway Board on the issue has resulted into affecting undue recoveries from the salaries of staff on some Zonal Railways creating deep sense of resentment among them who are now feeling aggrieved and agitated.</div>
<div></div>
<div>2. In this connection, NFIR wishes to invite once again the kind attention of the Railway Board (MS) that the clarification dated 13/12/2012 allows financial upgradation under MACPS under promotional /cadre hierarchy whereas the MACP Scheme permits granting financial upgradation in Grade Pay hierarchy and is admissible upto GP Rs. 12000/- in PB-4.</div>
<div></div>
<div>This proves the contention of the Federation that the said clarification is grossly erroneous as the same is against the policy guidelines on MACPS and may not withstand judicial scrutiny.</div>
<div></div>
<div>3. Apart from above. NFIR wishes to bring to the notice of Railway Board (MS) following additional facts for kind information and necessary action:-</div>
<div></div>
<div>That the Ministry of Health &amp; Family Welfare, Nirman Bhawan, New Delhi vide O.M. No.Z2901171/2012-N dated 11th April 2013, which is the nodal ministry in sofar as para-medical stall are concerned has permifted financial upgradation in PB-3 with GP Rs.6600/- to the nursing staff pursuant to the judicial scrutiny of the issue at the level of Supreme Court.</div>
<div></div>
<div>That the Federation is shocked to know from many Zonal Railways that based on Railway Board’s clarification issued on 13/12/2012 recoveries from all similarly placed stall, including para-medical stall has since begun and the staff are being put to totally disadvantageous position.</div>
<div></div>
<div>4. Federation further wishes to clarify that the O.M. dated 11th April 2013, should be implemented mutatis-mutandis in favour of railway employees who are similarly situated as any action contrary to the said O.M. will be contempt the orders of Apex Court.</div>
<div></div>
<div>NFIR. therefore, requests the Railway Board (MS) to immediately withdraw the clarification issued under letter dated 13/12/2012, as requested earlier and issue suitable instructions to all General Managers etc.. not to affect recoveries. Federation is, however, ready to discuss the issue at the level of Railway Board (MS). Federation may be kept advised of the action taken.</div>

<p>Sub: <strong>Amendments in the norms of minimum qualifications for recruitment / promotion of teachers for classes I to VIII in Railway Schools (Primary and Trained Graduate Teachers).</strong></p>
<p>Ref: Para No.178 of IREM, Vol-l (Revised Edition 1989)</p>
<p>The minimum qualifications for recruitment / promotion of Primary School Teachers,Trained Graduate Teachers and Post Graduate Teachers working in Railway Schools have been laid down in Boards letter No. E(P&amp;A)I-87/PS-5/PE-9 dated 04.10.1989, which are in line with those laid down by Kendriya Vidyalaya Sangathan and Delhi Administration for these categories of teachers.</p>
<p>2. National Teachers Education Council (NTEC) vide the Gazette Notification dated 23.08.2010, which was further amended vide its Gazette Notification dated 29.07.2011 has laid down the minimum qualifications for recruitment/promotion of teachers for classes I to VIII under the Right of Children to free and Compulsory Education (RTE) Act, 2009.</p>
<p>3. The issue of updating the existing qualifications at par with those laid down by NCTE for recruitment/promotion of teachers for classes I to Viii has been examined by Ministry of Railways. It has been decided that the qualifications as indicated in the Annexure to this letter will be applicable for recruitment / promotion of Primary School Teachers and Trained Graduate Teachers working in railway schools including Oak Grove School, Jharipani. These revised norms of minimum qualifications will be applicable for future promotion / recruitment of Railways Primary School Teachers and Trained Graduate Teachers only. The qualifications prescribed are the same for both direct recruitment as well as promotion. As per the existing instructions, preference may be given, in case of direct recruitment to candidates possessing qualifications higher than those prescribed for the post.</p>
<p>4. There is no change in the existing minimum qualification for PGT as laid down in Board’s letter No. E(P&amp;A)I-87/PS-5/PE-9 dated 04.10.1989.</p>
<p>5. The above orders will take effect from the date of issue of this letter. Any selections already initiated would be conducted and finalized based on the notifications already issued.</p>

<p>The issue of laying down uniform guidelines for issuance of notification for open market recruitment for the vacancies accruing during the period 01/1/2014 to 31/12/2014 has been under consideration of this Ministry. The matter has been examined and the decisions arrived at by the Board are apprised for compliance:- .</p>
<blockquote><p>(a) The current procedure of selection from open market in vogue shall be adhered to and notification adhering to the same may be issued;</p>
<p>(b) While the other <a href="http://centralgovernmentnews.com/category/railways/" target="_blank">Railway</a> Recruitment Cells will restrict themselves to the procedure of calling applications physically, RRC/Southern Railway only, as a pilot project, will give the option to the candidate to apply physically and online;</p>
<p>(c) Instruction contained in Board’s letter No. 2011-E(SCT)1/104/1 dated 25/9/20 12 (copy enclosed) be adhered to while issuing aforesaid notification; and</p>
<p>(d) Vacancies against Ex-servicemen quota will be filled up along with the general recruitment.</p></blockquote>

<p>Sub: <strong>Clarification regarding qualification prescribed for direct recruitment to the post of Lab. Supdt., Gr.III in Pay Band of Rs.9300-34800 (Grade Pay: Rs.4200).</strong></p>
<p>Attention is invited to Board’s letter of even number dated 12.11.2001 (RBE No.225/2001) wherein qualification for direct recruitment to post of Lab. Supdt., Gr.III in Pay Band of Rs.9300-34800 (Grade Pay: Rs.4200) has been prescribed as under.</p>
<p>“B.Sc. with Bio-chemistry/Micro-Biology/Life Science or equivalent plus Diploma in Technology (DMLT) or equivalent OR B.Sc. in Medical Technology (Laboratory) from institutions.”</p>
<p>2. A question has arisen whether a candidate with qualification of B.Sc. (Chemistry) Honors with Botany &amp; Zoology as subsidiary subject can be considered for the post of Lab. Supdt., Gr.III in Pay Band of Rs.9300-34800 (Grade Pay: Rs.4200) where qualification was notified as stated in para 1 above.</p>
<p>3. The matter has been examined in consultation with Health Directorate of this Ministry and it is clarified that if the candidate has studied during his Graduation both Chemistry and Biology whether as main or as optional/subsidiary subject and is in possession of DMLT or equivalent will be treated as eligible for consideration for employment to the posts cited in the captioned subject.</p>

<p>Attention is invited to Board’s letter of even number dated 15.6.2010 (RBE No.88/2010) on the above subject, where in instructions had been issued for extending the currency of instructions contained in RBE No.210/1991 pertaining to freezing of 25% of the vacancies falling within the direct recruitment quota in the category of Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.1900) and in Senior Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.2800) and 20% in the category of Junior Accounts Assistant in Pay Rand-I of Rs.5200-20200 (Grade pay: Rs.2800) and Accounts Clerk in Pay Band-I of Rs.5200-20200 (Grade Pay : Rs.1900). The question of continuance of the above freeze orders has been considered by the Board and it has been decided to extend the currency of the instructions mentioned for a further period up to 31.12.2013. Rest of the vacancies may be filled up after reviewing the requirement of clerical staff.</p>
<p>2. In this regard, Board also desire that the <a href="http://centralgovernmentnews.com/category/railways/" target="_blank">Railways</a> and Production Units should furnish information regarding the sanctioned strength of Junior Clerk, Senior Clerk, Junior Accounts Assistant and Accounts Clerk as on 1.4.92 and as on 1.1.2013 as well as their views with respect to continuance or otherwise of such a freeze order for future in the said categories of staff.</p>
<p>3. The instructions will be effective from the date of expiry of earlier freeze order i.e.01.01.2013.</p>
<p>4. It has also come to the notice of this Ministry that the instructions on this freeze order is being interpreted by certain railway establishments in the manner as if there is total ban to till up the posts in question. It is clarified that these instructions only limit percentage of recruitment and should not be construed as complete ban. Remaining posts may, therefore, be filled up by the Railways in terms of instructions on the subject.</p>
