<p>Sub: <strong>Clarification on restriction of Officiating Pay under FR-35 (Rule 1329 IREC Vol. II) in the context of RS(RP) Rules, 2016.</strong></p>



<p>Subsequent to adoption of Department of Personnel &amp; Training’s (DoP&amp;T) OM No. 11412017-Estt.(Pay-I) dated 28.02.2019 regarding restrict ion of Officiating Pay under FR-35 (Rule 1329!REC Vol. II) in the context of RS(RP) Rules, 2016 in lieu of Charge Allowance vide Board’s letter RBE No. 127/2019 dated 08.08.2019, clarification has been sought by many Railways on issues related to FR-35.</p>



<ol class="wp-block-list" start="2"><li>The crux of the issues raised by all the Railways is broadly as under:-</li></ol>



<p>(i) Pay fixation methodology on regular promotion to JAG following officiating appointment after 01 .07.2017.</p>



<p>(ii) Pay fixation as per Para-4 (illustration-3) of DoP&amp;T’s OM dated 28.02.2019.</p>



<p>(iii) Pay fixation after adoption of instant instructions in respect of Railway servants who have otherwise been officiating in higher grade prior to 0l .07.2017.</p>



<ol class="wp-block-list" start="3"><li>The other issues raised by the Railways relate to (i) quantum of increment which in certain cases turns out to be less than 3%, (ii) date of adoption of DoP&amp;T’ s OM on FR-35 , (iii) drawal of higher pay by a junior officer in case his officiating appointment was made earlier to a senior officer etc.</li><li>In order to address the various issues raised by Zonal Railways, a detailed FAQ alongiwth suitable illustrations to be followed in different circumstances are enclosed as Annexure-1.</li><li>This issues are with the concurrence of Finance Directorate and Competent Authority.</li></ol>

<p>Sub: <b>Clarification about educational qualification of Ex-servicemen candidates</b> – reg.</p>
<p>References have been received from various Railway establishments seeking clarification regarding acceptance or otherwise of certificates pertaining to qualification submitted by Ex-servicemen for post of Senior Section Engineer which contained following endorsement:-</p>
<p>“Diploma in Engineering in appropriate discipline plus total 10 years of technical experience in the appropriate field is recognized as equivalent to Degree in Engineering. It is considered valid for the purpose of selection to Gazetted posts and services under the Central or State Government.”</p>
<p>2. This endorsement in Diploma certificates of Ex-servicemen candidates have been made on the basis of certain notification of Ministry of Education and Social Welfare (Department of Education Technical) contained in letter No. F-18-19/75/T-2 dated 26/5/1977.</p>
<p>3. The matter has been examined in consultation with Air Headquarter/New Delhi, Ministry of Defence and Ministry of Human Resource Development. It has now been informed by M/o HRD that notification dated 26/5/1977 has been declared fictitious by Hon’ble Central Administrative Tribunal, Chandigarh in OA No. 343/PB/2013 in their order dated 15/12/2015 in the matter of Shri Om Prakash Kangotra and others Vs Union of India &amp; others.</p>
<p>4. In above light, it has been decided that aforesaid certificates need not be accepted, wherein, Degree in Engineering has been notified as prescribed qualification for recruitment on the Railways.</p>

<p>The decision of competent authority in the Ministry of Railways to extend the facility of joining RELHS-97 to those Railway employees who retired at the normal age of ‘superannuation irrespective of number of years of their service before superannuation, was conveyed to the Zonal Railways Vide Board’s letter cited under reference. However, one of the Zonal Railways has raised the issue of cut-off date of implementation of the order. The issue has been examined in consultation with Finance Directorate in the Board’s office.</p>
<p>In this context it is clarified that the instruction issued vide Board’s letter cited under reference is applicable to all Railway employees who have retired or retiring from-Railway service on attaining age of superannuation without any Cut-Off date.</p>
<p>This issues with the concurrence of Finance Directorate in the Board’s office.</p>

<p>Sub : <strong>Selection procedure for promotion to Selection Posts &#8211; Formation of panel in the order of seniority amongst those securing qualifying marks.</strong></p>
<p>Ref: PNM/NFIR item No.2/2012.</p>
<p>Railway Board, vide letter of even‘number dated 06.02.2014, have issued certain clarification with respect to selection procedure for promotion to Selection Posts. Some of the Zonal Railways have raised some doubts in conducting selection from erstwhile Group ’D’ to Group ’C’ posts.</p>
<p>2. The matter has been re-examined in consultation with both the Federation, viz., AIRF and NFIR and as a sequel to Railway Board’s letter of even number dated 06.02.2014 on the above subject, it is clarified that while conducting selection against 33 1/3% promotion quota from erstwhile Group ’D’ (G.P. Rs.1800) to Group &#8216;C’ (G.P.1900/2000) posts, panel is required to be drawn in the order of their seniority amongst the qualified staff as per the provisions of para 189 of IREM, Vol-l and ACS No.154 &amp; 155.</p>
