<h3 class="wp-block-heading">Sub: Permission to retain Railway accommodation at the place of previous posting by Railway officers/staff going on deputation to Rail Energy Management Company Ltd.(REMC Ltd.)</h3>



<p>Attention is invited to Board’s letter of even number dated 31.12.2020 conveying the decision of the full Board that REMCL may retain one Railway quarter in Delhi for use of Railway officers on deputation to their organization for a period of two years on payment by the REMCL to the Railways an amount equivalent to the house rent allowance admissible to the officer plus the flat rate of license fee prescribed by the Railways from time to time in respect of the said Railway accommodation.</p>



<p>2. On consideration of a request received from REMCL and in exercise of powers vested in it to make reasonable relaxations in public interest for a class/group of employees, in all or any of the existing provisions regarding house allotment/retention, full Board have decided that REMCL may retain one Railway quarter in Delhi for use of Railway officers on deputation to their organization for a further period of one year i.e. upto 31.12.2023 subject to the condition that in place of payment of amount equivalent to house rent allowance and license fee to the concerned Railway, they would now provide lease accommodation to the officer of the concerned Railway, in lieu of the Railway quarter retained, as per the officer’s choice according to Railway priority list, at the rate of lease entitlement of corresponding grade of officer of their organization.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<h3 class="wp-block-heading">Sub: Retention of railway accommodation at previous place of posting by Railway officers &#8211; Relaxations and conditions governing retention &#8211; reg.</h3>



<p>Keeping in view the requests/demands (fresh cases as well as continuation) received from various Zonal Railways/ Production Units/PSUs/State JVs/RLDA etc. for permitting the retention of railway accommodation to Railway officers at their previous place of posting, the Full Board in exercise of powers vested in it to make reasonable relaxations in public interest for a class/group of employees in all or any of the provisions regarding house allotment /retention, have decided as follows:-</p>



<h2 class="has-text-align-center wp-block-heading"><a href="https://centralgovernmentnews.com/indian-railway-holiday-list-2023-pdf/" target="_blank" rel="noreferrer noopener">Indian Railway Holiday List 2023 PDF</a></h2>



<ul class="wp-block-list"><li><strong>i). MCF/Raebareli</strong>: The facility of retention of railway accommodation at their previous place of posting granted to Railway officers/staff on posting at Modern Coach Factory(MCF), Raebareli which was earlier permitted upto 31.12.2020 vide letter No.E(G)2014 QR 1-3 dated 31.07.2020(RBE No.59/2020) is extended for a further period upto 31.03.2023, on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation at MCF.</li><li><strong>ii). RCF/Kapurthala:</strong>&nbsp;The Railway officers/staff at Rail Coach Factory(RCF), Kapurthala are permitted to retain railway accommodation at their previous place of posting upto 31.03.2023 on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation at RCF.</li><li><strong>iii). East Central Railway</strong>: The facility of retention of railway accommodation at their previous place of posting granted to Railway officers/staff on posting at East Central Railway which was. earlier permitted upto December, 2022 vide letter No.E(G)2009 QR 1-2 dated 23.04.2021(RBE No.32/2021), is extended for a further period upto March, 2023 on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation at East Central Railway.</li><li><strong>iv). South East Central Railway</strong>: The facility of retention of railway accommodation at their previous place of posting granted to Railway officers(SAG &amp; above) on posting at South East Central Railway headquarter&nbsp;which was earlier permitted upto 31.12.2022 vide letter No.E(G)2019 RN 2-2 dated 31.12.2019(RBE No.219/2019), is extended for a further period upto March, 2023 on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation at South East Central Railway.</li><li><strong>v). NER, ECoR, SWR_&amp; WCR</strong>: The facility of retention of railway accommodation at their previous place of posting granted to Railway officers(SAG &amp; above) on posting at NIER, ECoR, SWR &amp; WCR which was earlier permitted upto 13.2.2023 vide letter No.E(G)2009 QR 1-2 Pt. dated 05.01.2022, is extended for a further period upto March, 2023 on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation in above said Zones.</li><li><strong>vi) Chairman/RRB, Directors/Faculty Members of CTIs, GMs &amp; DRMs.</strong>:&nbsp; These Railway officers have been permitted to retain Railway accommodation at their previous place of posting for full tenure on payment of special licence fee for the retained house, as mentioned in para 3, w.e.f. 01.07.2022, irrespective of whether or not they have been allotted accommodation at present place of posting.</li><li><strong>vii). Railway PSUs(Other than DFCCIL &amp; NHSRCL):</strong>&nbsp;The facility of retention of railway accommodation at their previous place of posting granted to Railway officers/Staff on deputation to Railway PSUs (other than DFCCIL &amp; NHSRCL) and in occupation of railway accommodation in = areas other than Delhi/NCR which was earlier permitted upto 30.06.2022 vide letter No. E(G)2008 OR 1-15(PSUs) dated 15.07.2021, is extended for a further period upto 31.03.2023 on the same terms &amp; conditions as contained in ibid letter dated 15.07.2021.</li><li><strong>viii). RLDA</strong>: a) The Railway officers on deputation to RLDA will be allowed to retain existing house for full term of deputation and will also be entitled for fresh allotment from Railway Board Pool.</li><li>b) The absorbed Vice-Chairman &amp; Members of RLDA are permitted to retain Railway accommodation till full tenure, if such houses are located in NCR area.</li><li><strong>ix). DFCCIL:</strong>&nbsp;Railway officials on deputation to DFCCIL have been permitted to retain Railway accommodation at previous place of posting till 30.06.2023 vide Board’s letter dated 09.05.2022. The Railway officers who have joined DFCCIL as Director on absorption basis after 01.04.2020 are permitted to retain railway accommodation at their previous place of posting for 03 years from the date of absorption in DFCCIL.</li></ul>



<p>2. The organizations covered in item No.(vii) to (ix) of para-1, would provide leased accommodation (in place of depositing the lease amount with Railway) to the officers from concerned Railways, for all houses retained by them as per the officer’s choice “according to Railway priority list, at the rate of lease entitlement for corresponding grade of officers of these organizations.</p>



<p>3. Full Board have also decided that except for Railway officials posted in Railway PSUs/RLDA/Joint Ventures, NFR and USBRL -J&amp;K Project, in all other cases including those covered in item (i) to (vi) of para-1 &amp; other such cases, where Railway officials have been allowed to retain Railway accommodation at their previous place of posting, special licence fee as mentioned in table below, shall be applicable after 02 months of permitted retention period on transfer on normal licence fee (as per instructions contained in Board’s letter No. E(G)2000 QR 1-23 dated 24.11.2020), w.e.f. 01.07.2022 onwards, irrespective of whether or not the Railway official has been allotted accommodation at his/her new place of posting (instead of normal licence fee that was applicable earlier):-</p>

<p>Instructions were issued under Board’s letters No. E(G) 2008 QR 1-15 PSUs) dated 12.11.2020 and 15.7.2021 conveying the decision of Full Board that Railway Officers/staff on deputation to DFCCIL and occupying Railway accommodation may retain railway accommodation for a period upto 31st March, 2022 for Delhi/ NCR area and upto 30th June, 2022 in respect of other than Delhi/NCR area.</p>

<p>2. Now, on consideration of a request received from DFCCIL for extension of the period for retention of Railway accommodation by officers/staff on deputation to DFCCIL and in exercise of the powers vested with the full Board to make reasonable relaxations in public interest for a class/group of employees in all or any of the provisions regarding house allotment/retention, the Full Board have decided that Railway officers/staff on deputation to DFCCIL and occupying Railway accommodation may retain railway accommodation for a further period upto 30.06.2023 subject to the condition that DFCCIL would provide leased accommodation (in place of depositing the lease amount with Railway) to the officers from concerned Railways, for all houses retained by DFCCIL as per the officer’s choice according to Railway priority list, at the rate of lease entitlement for corresponding grade of officers of DFCCIL.</p>

<p><strong>Sub: Retention of Railway accommodation at the previous place of posting in case of General Manager of Zonal Railways and Production Units.</strong></p>



<p>In exercise of the powers vested with the full Board to make reasonable relaxation in public interest for a class/group of employees in all or any of the provisions regarding house allotment/retention, the full Board have now decided that General Managers of Zonal Railways/Production Units may retain accommodation at the place of previous posting for the entire tenure of their current posting, plus another two months thereafter on payment of normal rent.</p>



<p>2. On completion of tenure simultaneously with the retirement, the retention will be permitted for maximum 08 months as per existing provisions of para-5 of Board’s letter No. E(G) 2000 QR 1-23 dated 24.11.2020 (RBE No.99/2020) i.e normal rent for first four months and double the normal rent for remaining four months.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<h3 class="wp-block-heading">Sub : Revision of flat rate of licence fee (Standard Rent) for residential accommodation all Indian Railways w.e.f. 01.07.2020 &#8211; reg.</h3>



<p>The flat rates of licence fee (Standard Rent) for residential accommodation all over Indian <strong><a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a></strong> were last revised w.e.f. 01.07.2016 vide Board’s letter of even number dated 26.12.2017. Ministry of Railways has now decided to revise the licence fee (Standard Rent) for residential accommodation all over the Indian Railways w.e.f. 01.07.2020, as shown in the Annexure-A.</p>



<p>2. The revised rates will be effective from 01.07.2020. Further, revised rate as on 01.07.2020 will now be the fresh base for 10% increase per year for subsequent years, in terms of Board ‘s letter of even nu m ber dated 08.08.2019.</p>



<p>3. The revision shall be valid for residential accommodations all over the Indian Railways. However, it does not apply to sub-standard accommodation.</p>

<p>Board have, in supersession of above orders, now decided that retention of <strong><a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a></strong> accommodation shall be allowed for the period from 17.03.2020 to 30.11.2020 by the officers/staff who were/are due to vacate their flats/ houses during the above period. No damage rent will be charged for this period. These relaxations will be given to such allottees also who have become unauthorized occupants of Railway accommodation before 17.03.2020. However, in such cases, excluding the retention period from 17.03.2020 to 30.11.2020, the damage charges at telescopic rates, as was continuing prior to this period will apply.</p>

<p>Ministry of Housing and Urban Affairs, vide their OM No.12035/2/2020-Pol-II dated 31.05.2020 has allowed suo-motu retention for the period from 17.03.2020 to for the allottees under the Central Government General Pool Residential Accommodation (<strong>CGGPRA</strong>) Rules 2017. This suo-moto retention has been further extended up to 30.06.2020 by the Ministry of Housing and Urban Affairs vide their OM dated 05.05 2020</p>

<p>2. Keeping in view the above, <strong>Board have decided to allow suo-motu retention of railway accommodation by officers/staff for the period from 17.03.2020 to 30.06.2020</strong>. The suo-motu retention period will be on payment of licence fees as applicable to the allottees under these rules. No damage rent will be charged for this period. These relaxations will be given to such allottees also where she/he has become unauthorized occupant of government accommodation before 17.03.2020. However, in such cases, after the retention period up to 30.06.2020, the damage charges at telescopic rates, as was continuing prior to this period, will be resumed.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Instructions were issued vide Board&#8217;s letter of even number dated 31.05.2017 (RBE No. 53/2017) to permit Railway officers/staff in occupation of Railway accommodation in areas other than Delhi/NCR on their deputation to Railway PSUs to retain their railway accommodation at the place of previous posting for a period up to 30.06.2019.</p>
<p>2. Now, in exercise of the powers vested with the Board to make reasonable relaxations in public interest for a class/group of employees in all or any of the existing provisions regarding house allotment/retention, it has been decided to permit Railway officers/staff in occupation of Railway accommodation in Delhi/NCR area on their deputation to Dedicated Freight Corridor Corporation of India Ltd. (DFCCIL) to retain their railway accommodation at the place of previous posting for a period up to 30.06.2019.</p>

<p>Sub: <strong>Revision of flat rate of license fee (Standard Rent) for residential accommodation in Railways w.e.f. 01/07/2010, 01/07/2013, and 01/07/2016-reg.</strong></p>
<p>Ref: (i) Railway Board&#8217;s letter No. F(X)I-2002/11/2 dated 26/2/2017.<br />
(ii) NFIR&#8217;s letter No. II/23/Part III dated 12/03/2018.<br />
(iii) Railway Board&#8217;s reply vide No. F(X)I-2002/11/2 dated 09/05/2018 addressed to GS/NFIR.<br />
(iv) NFIR&#8217;s PNM Agenda Item No.18 sent to Railway Board on 26/06/2018.</p>
<p>Federation desires to invite kind attention of Railway Board to the letter dated 26/12/2017 wherein instructions have been issued for revision of flat rate of license fee (Standard Rent) for residential accommodation in Railways with retrospective effect i.e. 01/07/2010, 01/07/2013, and 01/07/2016. Federation expresses its anguish over non-appreciation of ground reality highlighted by the Federation vide its letter dated 12/03/2018 for taking remedial action and instead, sent reply vide letter dated 09/05/2018 that the revision in the flat rate of license fee is based on the pattern of Ministry of Housing and Urban Affairs. Due to this negative approach, the Federation was compelled to raise the issue vide PNM Agenda Item No. 18 (sent to Railway Board on 26/06/2018), but unfortunately, instructions have not been modified yet.</p>
<p>Besides above, the Federation desires to convey to the Railway Board that the reports are received from the NFIR affiliated Unions that though outstanding dues towards office rent, electricity, telephone and water charges have already been cleared by the affiliates, the Divisional Administrations have raised bills for payment arrears towards rentals of office accommodation from 01/07/2010 to 30/06/2013, 01/07/2013 to 30/06/2016 and 01/07/2016 to 31/03/2018. While the Board&#8217;s instructions dated 26/12/2017 are unjustified, the action of Railway Administration, demanding payment of arrears on account of Office rent of the accommodations in possession of the affiliated Unions is totally wrong.</p>
<p>As the subject has already been taken up by the Federation in the PNM fora at Board&#8217;s level, it is urged that the instructions dated26/12/2017 be kept in abeyance or withdrawn.</p>

<p>Ref: SER&#8217;s letter No. L/Housing Policy/Improvement/225 dated 16.05.2018</p>
<p>This is in reference to SER&#8217;s letter quoted above.</p>
<p>It is advised that the level of pay scale recommended by the 7th CPC are corresponding to grade pay, as such the instruction issued vide Board&#8217;s letter under reference still holds good. It is further advised that there has been no change in the entitlement of the railway employees for Railway accommodation. Eligibility of entitlement and eligibility to register for the waiting list of a particular type of quarter are two different issues, should be dealt with separately.</p>
