<p>Ref: chairman/Railway Board&#8217;s letter No. E(MPP)/ 2016/3/20 dated 28.11.2018 and Board&#8217;s letter dated 06.12.2018</p>



<p>Vide Board (CRB) letter No. E(MPP)/ 2016/3/20 dated 28.11.2,018, DG/NAIR had been authorized as the Head of the Academic Council of all CTIs to develop Training Modules of all categories of Non-Gazetted staff. Accordingly, training module of Medical Department was finalized and sent to this office.</p>



<p>2. Ministry of <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener" aria-label="Railways (opens in a new tab)">Railways</a> (Railway Board) has reviewed the above Training Modules proposed and submitted by DG/NAIR. Board (DG/Health &amp; MS) has approved the revised training module.</p>



<p>3. The revised module prepared have been scanned and uploaded under <strong>E(MPP) Training Circulars</strong> and can be viewed or downloaded from <strong>railnet</strong>.</p>



<p>4. General Manager / PHOD shall identify and decide the locations for conducting training of staff on the above revised module in their respective Zones.</p>

<p>Subject: <strong>Adoption of instructions issued by DoP&amp;T regarding restrictions of officiating pay under FR-35 (Rule 1329 IREC Vol. II) in the context of RS(RP) Rules, 2016 in lieu of Charge Allowance.</strong></p>



<p>Consequent upon the decision taken by Government of India vide MoF’s Resolution No. 1-2/2016-IC dated 25.07.2016, recommendations of 7 Central Pay Commission regarding all the Allowances (except Dearness Allowance) were referred to a Committee of Secretaries headed by the Finance Secretary. The Committee’s recommendations were implemented w.e.f. 01.07.2017 vide MoF’s Resolution No. 11-1/2016-IC dated 06.07.2017.</p>



<p>In terms of Para 8.2.5 of 7th CPC’s Report, all the allowances not mentioned in the 7th CPC’s Report ceased to exist w.e.f 01.07.2017.</p>



<p>It is observed that Charge Allowance, which is granted in Indian Railways to Officers officiating on a higher post in administrative exigencies, was also not included in the report of the 7th CPC and hence stands abolished w.e.f. 01.07.2017.</p>



<p>It has now been decided by the Railway Board that DoPT’s Office Memorandum No. 1/4/2017-Estt.(Pay-I) dated 28.02.2019 (Annexure-I) regarding Restriction of pay under FR-35 (Rule 1329 IREC Vol. ID) in the context of CCS(RP) Rules, 2016 may be adopted in mutatis mutandis manner in Indian Railways in context of RS(RP) Rules, 2016 in place of Charge Allowance w.e.f. 01.07.2017.</p>

<p>Subject : <strong>Compensation for non-deposit or delayed deposit of contribution under National Pension System during 2004-12</strong></p>



<p>The undersigned is directed to invite attention to the guidelines issued by Controller General of Accounts, Ministry of Finance, Department of Expenditure, vide OM No.1(7)/2003/TA/Part file/279, dated 02.09.2008 for streamlining of procedure for remittances of contributions under the National Pension System (NPS) by PA0s/CDDOs and NCDDOs which provides, inter-alia, the detailed procedure for the purpose of crediting of the NP5 contribution to the NPS Trustee Banks so as to ensure that the contribution is credited to the NPS regulatory system as per the timelines prescribed therein without delay .</p>



<p>2. Based on the recommendations of the 7th Central Pay Commission and the recommendations of a Committee of Secretaries, as set up in pursuance of the decision of the Government contained in para 15 of the Resolution of this Department bearing No. 1-2/2016-IC dt. 25.7.2016 to suggest measures for streamlining the implementation of the NPS, the Department of Financial Services, Ministry of Finance, has issued a Notification F. No. 1/3/2016-PR dt. 31.1.2019, clause 1(2)(x), 1(2)(xi) and 1(2)(xii) thereof provides as under:</p>



<p><strong>Compensation for non-deposit or delayed deposit of contribution under National Pension System during 2004-12</strong></p>



<ul class="wp-block-list"><li>In all cases, where the <a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS  (opens in a new tab)">NPS </a>contributions were deducted from the salary of the Government employee but the amount was not remitted to CRA system or was remitted late, the amount may be credited to the NPS account of the employee along with interest for the period from the date on which the deductions the amount may be credited to the NPS account of the employee along with interest for the period from the date on which the deductions were made till the date the amount was credited to the NPS account of the employee, as per the rates applicable to GPF from time to time, compounded annually.<br /></li><li>in all cases where the NPS contributions were not deducted from the salary of the Government employee for any period during 2004-2012, the employee may be given an option to deposit the amount of employee contribution now. In case he opts to deposit the contributions now, the amount may be deposited in one lump sum or in monthly installments. The amount of installment may be deducted from the salary of the Government employee and deposited in his NPS account. The same may qualify for tax concessions under the Income Tax Act as applicable to the mandatory contributions of the employee.<br /></li><li>In all cases where the Government contributions were not remitted to CRA system or were remitted late (irrespective whether the employee contributions were deducted or not), the amount of Government contributions may be credited to the NPS account of the employee along with interest for the period from the date on which the Government contributions were due till the date the amount is actually credited to the NPS account of the employee, as per the rates applicable to GPF from time to time. Instructions to this effect may be issued by the Department of Expenditure/Controller General of Accounts. All such cases of delay may be resolved within a period three months.</li></ul>



<p>3. In pursuance of the aforesaid provisions of the said Notification dt. 31.1.2019, all the Ministries/Departments are required to ensure that the decisions, as contained therein insofar as these relate to the issue of delayed credit of NPS contribution to CRA system, are carried out in respect of Central Government employees under their administrative purview in consultation with the concerned Financial Advisors and the respective pension accounting organizations, i.e., Controller General of Accounts in respect of Central Civil Ministries/Departments, Railway Accounts in respect of Ministry of Railways, P&amp;T Accounts in respect of employees of Department of Posts and Department of Telecommunication and the Controller General of Defence Accounts in respect of Defence Civilians.</p>



<p>4. While carrying out the above decision contained in the afore said notification dt. 31.1.2019, it has to be ensured that the modalities for implementing the same are uniform across the pension account mg organizations and, therefore, for this purpose, the office of Controller General of Accounts of this Department shall be the nodal organization for laying down the modalities. Accordingly, the office of Controller General of Accounts shall issue guidelines for the purpose. The concerned Financial Advisor shall be the central point for the purpose in the respective Ministries/ Departments.</p>



<p>5. It is likely that the concerned Ministries/ Departments need data and information from the Central Record keeping Agency, namely, NSDL, to carry out the above decision in respect of employees under their administrative domain. In order, therefore, to facilitate such action by the Ministries/Departments, the CRA shall look into its record and in all cases which are covered under the decision contained in the aforesaid Notification dt. 31.1.2019, it shall pass on such employee-wise details, on its own, to the concerned Head of the Office and DDO/ PAO, where the employee is currently posted within 15 days of the date of issue of these orders so that the desired and timely action gets initiated by the Ministries/ Departments.</p>



<p>6. In their application to the employees working in the Indian Audit &amp; Accounts department, these orders issue in consultation with the Office of Comptroller &amp; Auditor General of India.</p>

<p>Sub.:<strong> Revision of flat rate of licence fee (Standard Rent) for residential accommodation all Indian Railways w.e.f. 01.07.2010, 01.07.2013 and 01.07.2016 – reg.</strong></p>



<p>The flat rates of licence fee (Standard Rent) for residential accommodation over the Indian Railways were revised w.e.f. 01.07.2010, 01.07.2013, and 01.07.2016 and notified vide Board’s letter number of even number dated 26.12.2018 retrospectively.</p>



<p>In light of various representations received, Full Board have, inter alia, considered the issue of non-recovery of the arrears on quarter rent from 01.07.2010 to 30.06.2016 and decided the followings :-</p>



<ul class="wp-block-list"><li>Actual recoveries of revised flat rates of licence fee (Standard Rent) be effected only from 01.07.2016 and it has also been brought out that in effect this implies write-off of a significant amount between 01.07.2010 to 01.07.2016.</li><li>A general norm of 10% increase in licence fee effective from 1st July every year (first such increase is due w.e.f. 01.07.2017 and thereafter as on 01.07.2018 retrospectively and so on over the existing licence fee as on 30th June of the each year) be effected to ensure earlier recoveries of enhanced licence fee till further revision.</li></ul>



<p>All other terms and conditions mentioned, in Board’s letter of even no dated 26.12.2018 will continue.</p>



<p>Immediate action may please be taken to give effect to these orders and compliance may be reported.</p>

<p>Please refer to Rule 5 &amp; 6 af RS(RP) Rules,2016 regarding exercise of option to come over to revised pay structure effective from 01.01.2016 as notified by the RS(RP) Rules,2016. The said option was to be exercised within 3 months of the date of notification i.e. 28.07.2016 of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final.</p>
<p>2. In this context, it is stated that Ministry of Finance, Department of Expenditure vide their permitted opportunity to Government Servants to revise their initial option in terms of Rule 5 &amp; 6 of CCS(RP) Rules,2016. These orders issued by Ministry of Finance, Department of Expenditure shall be applicable <strong>mutatis mutandis</strong> in Railways with respect to RS(RP) Rules, 2016.</p>
<p>3. The &#8216;three months&#8217; period mentioned in para 3 of aforesaid OM of Ministry of Finance, Department of Expenditure dated 12.12.2018 shall be three months from the date of issue of these instructions.</p>
<p>4. The matter has also been raised by both recognised Staff Federations AIRF and NFIR.</p>

<p>Instructions were issued vide Board&#8217;s letter of even number dated 31.05.2017 (RBE No. 53/2017) to permit Railway officers/staff in occupation of Railway accommodation in areas other than Delhi/NCR on their deputation to Railway PSUs to retain their railway accommodation at the place of previous posting for a period up to 30.06.2019.</p>
<p>2. Now, in exercise of the powers vested with the Board to make reasonable relaxations in public interest for a class/group of employees in all or any of the existing provisions regarding house allotment/retention, it has been decided to permit Railway officers/staff in occupation of Railway accommodation in Delhi/NCR area on their deputation to Dedicated Freight Corridor Corporation of India Ltd. (DFCCIL) to retain their railway accommodation at the place of previous posting for a period up to 30.06.2019.</p>
<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Please refer to this Ministry’s letter of even number dated 05.12.2017 on the above cited subject,vide which, the revised rules relating to the grant of House Building Advance (HBA) as issued by Ministry of Housing &amp; Urban Affairs (Housing-III Section) vide their OM No.I.17011/11(4)/ 2016-H-III dated 09.11.2017 pursuant to acceptance of 7th CPC recommendations, were mutatis-mutandis made applicable to Railway employees.</p>
<p>2. Further clarifications were issued vide this Ministry’s letter of even number dated 28.03.2018 and 27.04.2018.</p>
<p>3. Ministry of Housing &amp; Urban Affairs vide their OM dated 29.06.2018 have now issued instructions regarding applicability of rules contained in their OM dated 09.11.2017 with effect from 01.01.2016 and enhancement of House Building Advance (HBA) in those cases which were sanctioned on or after 01.01.2016 but before 09.11.2017 and these are subject to conditions mentioned in their letter of 29.06.2018. A copy of the same is sent herewith, which shall be applicable mutatis-mutandis on the Railways.</p>

<p>Reference has been received from one of the zonal railways, seeking clarification, whether Board&#8217;s instructions contained in the letter of even number dated 21.02.2018 (RBE No.25/2018), regarding relaxation of upper age limit are applicable in the case of engagement of substitutes or otherwise.</p>
<p>The matter has been looked into and it is clarified that relaxation in upper age limit provided vide RBE No.25/2018 are also applicable in the case of engagement of substitutes.</p>
<p>(This disposes of South Central Railway&#8217;s letter No.P(R)/563/XII dated 06.03.2018)</p>
