<p>Reference is invited to Department of Pensions &amp; Pension Welfare’s OM NO I/11/2021-P&amp;PWE dated 03.06.2021 (copy enclosed) regarding the subject above.</p>



<p>2. All the Pr. CCAs/CCAs/CAs (ICs) of the respective Ministries/Departments are requested to ensure strict compliance of the said OM. It 1s also incumbent on all concerned to ensure that the family pension and other dues in respect of the deceased employees in such cases are released to their families on priority basis, without looking at the maximum time limit prescribed in the CCS (Pension) Rules and CGAs OM issued dated 19th Feb 2021 in this regard for processing such cases.</p>



<p>3. It is also to be ensured that the provisional family pension may continue to be paid for the month in which claim is received by PAO from Head of Office and till the period PPO is prepared and dispatched to CPAO in such a manner that disbursement of family pension to the family pensioner for the succeeding month is commenced by the bank without any disruption in continuous receipt of family pension at any point of time. Therefore, PAO shall indicate the date from which the family pension Is authorized in the PPO to be paid by the Bank.</p>

<h3 class="wp-block-heading">Sub: Grant of provisional benefits on death/disability of Railway servants covered under National Pension System (NPS) &#8211; reg.</h3>



<p>Attention is invited to Board’s letter of even number dated 20.01.2020 vide which clarification was issued providing that Railway servant/ family member in the case of death of Railway servant or his discharge from service on account of invalidation/disability is entitled to pension/ family under old pension scheme under <a href="https://centralgovernmentnews.com/indian-railways-latest-news-today/" target="_blank" rel="noreferrer noopener">Railway</a> Services (Pension)/ Rules 1993 if the Railway servant/ family wants to. Also, the entire accumulated pension funds under NPS may be recovered from him/family with interest for the period from the date of receipt of entire accumulated pension wealth to a subscriber under NPS to the date of refund to the Government at the rate and manner applicable to GPF deposits from time to time.</p>



<p>2. Now, references have been received in this office stating that some of the department family members of the deceased employees under NPS are not in a position to surrender the entire accumulated NPS corpus in one go. it has been requested that the dependent family members of the deceased Railway employees may be given option to return the accumulated NPS corpus of the employee in installments and from the arrears of the family pension instead of depositing the entire accumulated NPS corpus with interest.</p>



<p>3. The above issue have been examined in consultation with Department of pension &amp; Pensioners’ Welfare (DOP&amp;PW) the nodal Department of the Government in pensionary matters. It is clarified that in case, the Railway servant or family has already availed benefits from accumulated pension corpus, the same may be recovered from them with interest. The accumulated pension corpus along with interest may be adjusted from the arrears of pension/family pension or any other method while ensuing at the same time that there is no loss to the Railways.</p>

<p>A copy of Department of Pension &amp; Pensioners’ Welfare (DOP&amp;PW’s) O.M. No . 12/9/2020-P&amp;PW(C)-6450 dated 17th July , 2020 along with proforma for sanction of provisional pension and provisional gratuity is enclosed herewith for compliance and guidance . These instructions shall apply mutatis mutandis on the <a aria-label="undefined (opens in a new tab)" href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a> also . Rule 64 and Rule 72(5) of the Central Civil Services (Pension) Rules, 1972 correspond to Rule 91 and Rule 16(5) of the Railway Services (Pension) Rules, 1993 respectively . Also , Form 5 and Form 3 of the Central Civil Services (Pension) Rules, 1972, referred to in the aforesaid O .M . dated 17th July, 2020 , correspond to Form 8 and Form 6 of the Railway Services (Pension) Rules , 1993, respectively.</p>



<p>Para 3(f) of the proforma for sanction of provisional pension and provisional gratuity will also include the provision of Rule 16(8) of the Railway Services (<a aria-label="undefined (opens in a new tab)" href="https://centralgovernmentnews.com/category/pension/" target="_blank" rel="noreferrer noopener">Pension</a>) Rules, 1993 in cases of railway servant who have been allotted railway quarters and are in occupation of that at the time of retirement.</p>

<p>Government employees retiring during COVID pandemic will be receiving “provisional” pension till their regular Pension Payment Order (PPO) is issued and other official formalities completed.</p>



<p>Union Minister of State (Independent Charge) Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh said that after the Modi Government took over, the Department of Pensions had upgraded and equipped itself to deliver the PPO to the concerned employee without delay on the day of his or her superannuation. Besides this, in the last few years, taking cue from Prime Minister Narendra Modi’s emphasis on digitalization, the Department of <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">Pension</a> also created a Portal, which could be accessed by any government employee approaching superannuation to find out the status of his or her pension papers, he said.</p>



<p>However, because of the disruption in the official work due to COVID pandemic and lockdown, Dr Jitendra Singh said, some of the employees who had retired during this period may not have been provided with PPO. But, as an evidence of the present government’s sensitivity towards the pensioners and the senior citizens, a decision was taken that in order to avoid a delay in the start of regular pension covered under CCS (Pension Rules) 1972, the rules may be relaxed to enable seamless payment of “Provisional Pension” and “Provisional Gratuity” till the regular PPO is issued.</p>



<p>As per the OM (Office Memorandum) issued by Department of Pensions, affiliated to the Ministry of Personnel, the payment of “Provisional Pension” will initially continue for a period of six months from the date of retirement and the period of “Provisional Pension” may be further extended up to one year in exceptional cases. These instructions shall also be applicable in cases where a government servant retires otherwise than on superannuation i.e. voluntary retirement, retirement under FR 56, etc.</p>

<p>Dr Jitendra Singh said, this decision has been taken considering that because of the constraints of pandemic and lockdown, a government servant may find difficulty in submitting his Pension Forms to the Head of Office or may not be able to forward the Claim Form in hard copy along with Service Book to the concerned Pay &amp; Accounts Office in time, particularly when both the offices are located in different cities. This is very pertinent to Central Armed Police Forces (CAPFs) who are constantly on the move and whose Heads of Offices are located in cities different from where the Pay &amp; Accounts Office is located.</p>

<p style="text-align:center"><em><strong>NPS &#8211; Additional Relief Scheme Beneficiaries FAQ</strong></em></p>



<p><strong>Q.  1. Who is a beneficiary under the NPS &#8211; Additional Relief Scheme (NPS-AR)? What is the benefit under NPS- Additional Relief Scheme?</strong><br /> A.  Provisional Pension is sanctioned in case of death/disability of Government Employees who joined Government of India service on or after 1st January 2004 and were covered under the New Pension Scheme. This is payable to the spouse/family pensioner of the deceased Government employee or to the disabled Government employee. The additional relief is in the form of provisional pension on defined benefit lines and as an interim relief till the finalization of pending issue of Rules&amp; Regulations for the New Pension Scheme.</p>



<p><strong>Q.  2. What is the Provisional Pension Payment Order (PPPO) under NPS- Additional Relief Scheme?</strong><br /> <strong>a.</strong> A PPPO is a Provisional Pension Payment Order for Disbursement of pension provisionally under NPS- Additional Relief Scheme. It is issued in triplicate (three copies) by the pension sanctioning Ministry, Where the Government employee was working:-</p>



<ul class="wp-block-list"><li>Disburser&#8217;s Copy (First) retained in CPAO, as the Disbursing Authority;</li><li>Pensioner&#8217;s Copy (Second); and</li><li>Bank&#8217;s Copy (Third &#8211; not for payment )for information to the pension account holding branch (referred to as &#8216;Pension Account Holding Bank Branch&#8217; below)</li></ul>



<p><strong>b.</strong> PPPO No. contains Alphanumeric number (N+11 digits) starting with &#8216;N&#8217;. This PPPO number is to be quoted in all correspondence as this is the key reference number.</p>



<p><strong>Q. 3. How is the benefit under NPS- Additional Relief Scheme disbursed?</strong><br /> The monthly provisional pension is paid direct to the bank account of pensioner/family pensioner electronically by the Central Pension Accounting Office (CPAO).</p>



<p><strong>Q. 4. How will the pensioner receive copy of the Provisional Pension Payment Order (PPPO)?</strong><br />The Pensioner&#8217;s portion shall be handed over by Pension Account Holding Bank Branch at the time of first time identification process (Please refer to Q.5&amp;6 below).</p>



<p><strong>Q.  5. When and how will provisional pension commence?</strong><br /> a. After Ministry has sanctioned the provisional pension, PPPO will be sent to CPAO.</p>



<p>b. CPAO will scrutinize the same and forward the pensioner&#8217;s copy and the bank&#8217;s copy by Speed Post to Pension Account Holding Bank Branch with an endorsement to pensioner by Speed Post.</p>



<p>c. On receipt of the same, Pension Account Holding Bank Branch will call pensioner for the first time identification and will hand over pensioner&#8217;s copy of the PPPO. They will report back electronically to CPAO to disburse the pension each month thereafter.</p>



<p>d. In case pensioner do not receive a call from the Pension Account Holding Bank Branch for completion of the first time identification process after pensioner receive the endorsement of CPAO&#8217;s letter to bank enclosing PPPOs, pensioners are to present themselves for identification in the bank along with the papers mentioned below.</p>



<p><strong>Q.  6. What is the first time identification process?</strong><br /> a. The beneficiary has to visit the Pension Account Holding Branch for commencement of the provisional pension. The beneficiary would be required to produce his/her copy of the authority letter to the bank received from CPAO sanctioning the pensionary benefits,</p>



<p>b. The Pension Account Holding Bank Branch would verify the beneficiary w.r.t. photographs and specimen signatures available in the PPPO booklet (Bank&#8217;s Copy) and obtain the same specimen signatures once again in the Bank&#8217;s Copy in the space provided for record.</p>



<p>c. On successful verification, the Pension Account Holding Branch must hand over the beneficiary&#8217;s copy of the PPPO booklet.</p>



<p>d. The Pension Account Holding Branch then confirms to CPAO, the completion of the first time identification and for the payment of provisional pension payment to start.</p>



<p>e. The Pension Account Holding Bank Branch will also obtain the signature of the beneficiary on an undertaking authorizing recovery of overpayments as per para 12.3 of the Scheme for Payment of Pensions.</p>



<p><strong>Q. 7. How many days are given to Pension Account Holding Bank Branch to complete the first time identification process of the pensioner?</strong><br /> A.   The Pension Account Holding Bank Branch should invite the pensioner for identification, complete the process and communicate the completion of the identification process to CPAO within seven days from the receipts of the PPPO. The first time identification can also be electronically intimated by banks to CPAO at npsdbs-exp [at] nic.in or fax at 011-26162083.</p>



<p><strong>Q.  8. What are Pensioner&#8217;s responsibilities for facilitating regular payment of Provisional Pension?</strong><br /> a. Pensioner&#8217;s have to collect copy of the PPPO after first time identification and retain it in safe custody.</p>



<p>b. Pensioner&#8217;s have to submit Life Certificate in the month of November every year.</p>



<p>c. Pensioner&#8217;s have to submit certificate/undertaking for recovery of excess payment if any, on account of delay in receipt of any material information or due to any bonafide error at first time identification stage.<br /> d. Pensioner&#8217;s have to ensure that nominations have been provided for the bank account.</p>



<p>e. Pensioner&#8217;s have to submit Re-marriage/Re-employment Certificates, wherever applicable, in the month of November along with the Life Certificate.</p>



<p>f. Pensioners/family pensioners are encouraged to open their pension account with bank branches which are &#8211; Real Time Gross Settlement (RTGS)/National Electronic funds Transfer System (NEFT) &#8211; enabled, and which have Core Banking solutions (CBS) facility.</p>



<p>g. Pensioner&#8217;s have to intimate any change in correspondence address to the pension account holding branch and CPAO at the address given below immediately. h. In case pensioners want to shift their bank accounts to another bank branch of the same bank or another bank, they have to apply to the Branch Manager of present pension account holding branch, with a copy to CPAO.</p>



<p><strong>Q.  9. Whether the pensioner is allowed to open a joint account? If yes, with whom.</strong><br /> a. Yes, Pensioners may open joint account with spouse (husband/wife only) to whom family pension is authorized in the PPPO in the event of death.</p>



<p>b. Family pensioners cannot have a Joint Pension Account.</p>



<p>c. Pensioner&#8217;s have to complete nomination formalities</p>



<p><strong>Q.  10. Who is responsible for the issuance of pension slip, annual statements of income tax deducted and due drawn statements in respect of pension/arrear payment to the pensioner/family pensioner?</strong><br />a. CPAO is responsible for the issuance of pension slip, annual statements of income tax deducted and due-drawn statements. These statements shall be made available to pensioner/family pensioner through their pension account holding branch on request.</p>



<p>b. Annual Statement of Income Tax deducted will be sent by Speed Post annually by CPAO.</p>



<p>c. Pension Slips can also be obtained by post on request to CPAO.</p>



<p><strong>Q.  11. Is the identification of pensioner done by bank one time process i.e. only at the time of commencement of pension?</strong><br /> No, fresh identification is required when the pensioner/family pensioner transfers the pension account from one bank branch to another (within the same bank) or another different bank branch. Pensioners also have to submit Life- Certificate every year in the month of November to the pension account holing branch, which in turn must forward the same to CPAO through e-mail/fax/speed post.</p>



<p><strong>Q.  12.To whom pensioner/family pensioner can contact in CPAO for any query/grievance?</strong><br /> Pensioner may directly write to CPAO at the following address:</p>

<p>Sub: &#8211; <strong>Revision of provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972</strong></p>
<p>The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments&#8217; OM No. 38/37/2016- P&amp;PW(A) (ii) dated 04.08.2016 for revision of pension of pre-20 16 pensioners/family pensionersw.e.f 01.01.20 16 by multiplying the pre-revised pension/ family pension by a factor of 2.57. Subsequently, vide OM No. 38/37/20 16-P&amp;I&#8217;W(A) dated 12.05.2017, it has been decided that the pension/family pension of all Central civil pensioners/ family pensioners, who retired/died prior to 01.01.2016, may be revised w.e.f. 01.01.20 16 by notionally fixing their pay in the pay matrix<br />
recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died.</p>
<p>2. Instructions were issued vide this Department&#8217;s OM of even number dated 30.11.2016 for extending the benefit of OM dated 4.8.2016 to the following categories of pensioners drawing provisional pension under Rule-69 of the CCS (Pension) Rules, 1972.</p>
<blockquote><p>(i) Retired before 1.1.2016 and sanctioned provisional pension under Rule-69 of the CCS (Pension) Rules on account of departmental/ judicial proceedings or suspension.<br />
(ii) Suspended before 1.1.2016 and sanctioned provisional pension, based on their pre revised pay under Rule-69 of the CCS (Pension) Rules on retirement on or after<br />
1. 1.2016.</p></blockquote>
<p>3. It has now been decided that provisional pension sanctioned in the above cases may be revised w.e.f. 1. 1.2016 in accordance with the instructions contained in this Department&#8217;s OM No.38/37/2016-P&amp;PW(A) dated 12th May, 2017. Higher of the two formulations i.e. OM dated 4.8.2016 or OM dated 12.5 .2017 would be the revised provisional pension w.e.r. 1.1.2016 in such cases.</p>
<p>4. This issues with the approval of Department of Expenditure, Ministry of Finance lD No.I(21 )/E-V/2016 dated 15.01.2018</p>

I am directed to refer to the Department of Pension and Pensioner Welfare’s OM No.42/13/2012-P&amp;PW(G) dated 25th October, 2012(copy enclosed) regarding “Grant of Dearness Relief to Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scale of 5th CPC w.e.f. 01/07/2012.”.<br />
2. The applicability of the provisions of the aforesaid OM to All India Service Pensioners who are in receipt of provisional pension or pension in the pre-revised scale of 5th CPC has been considered by this Department and it has been decided to make the provisions of the aforesaid Office Memorandum of Department of Pension and Pensioner Welfare regarding “Grant of Dearness Relief to Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scale of 5 th CPC w.e.f. 01/07/2012” applicable, mutatis-mutandis, to the All India Service Pensioners who are in receipt of provisional pension or pension in the prerevised scales of 5th CPC.</p>

<div>Sub :-<strong> Revision of provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972.</strong></div>
<div></div>
<div>The undersigned is directed to say that in pursuance of Government’s decision on the recommendations of Sixth Pay Commission, orders for revision of pension of pre-2006 pensioners w.e.f. 1.1.2006 have been issued on 1.9.2008.</div>
<div></div>
<div>The following categories of pensioners were entitled to provisional pension as in the pre 2006 pay-scale:-</div>
<div></div>
<p>a) Employees suspended before 2006 and also retired before 1.1.2006</p>
<div></div>
<div>b) Employees suspended before 2006 but retired after 1.1.2006</div>
<div></div>
<div>c) Employees who retired before 1.1.2006 and against whom departmental / judicial proceedings were pending at the lime of retirement.</div>
<div></div>
<div>It has been decided that in all the above cases, the provisional pension sanctioned under Rule 69 of CCS (Pension) Rules, 1972 will be revised in terms of this Department’s OM No.No.38/37/08-P&amp;PW(A) dated 1st September, 2008 as clarified/modified from time to time. An illustration regarding revision of provisional pension sanctioned under Rule 69 of CCS (Pension) Rules 1972 before 1.1.1996 is enclosed.</div>

<div>As regards revision of provisional pension in case of employees who are drawing provisional pension in 4th CPC scales, their provisional pension would be brought over to 5th CPC and thereafter to the 6th Central Pay Commission and their provisional pension would be revised in accordance with the instructions contained in DoP&amp;PW OM No.38/37/08-P&amp;PW(A) dated 1st September, 2008 as clarified/modified from time to time.</div>

<div>This issues with the approval of Department of Expenditure. Ministry of Finance ID No.61/E.V/2013 dated 4th January, 2013 and No.214 /E.V/2013 dated 16th January, 2013.</div>
