<p>Ad-hoc appointment/promotion in Group ‘B’ and ‘A’ posts: DoP&amp;T OM dated 15.12.2023 for strict compliance</p>

<h3 class="wp-block-heading"><strong>Subject : Ad-hoc appointments in Group ‘B’ and ‘A’ posts &#8211; regarding.</strong></h3>



<p>The undersigned is directed to invite reference to this Department’s Office Memorandum No. 28036/8/97- Estt(D) dated 30.03.1988 and Office Memorandum No. 28036/1/2012-Estt(D) dated 03.04.2013 regarding ad-hoc appointment/promotion and to draw attention to the following provisions contained in these OMs pertaining to Group ‘B’ and ‘A’ posts:</p>



<ol class="wp-block-list">
<li>Ad-hoc appointments/promotions should be made only in rare cases and for exigencies of work, where the post cannot be kept vacant until regular candidate becomes available. Persons appointed on ad-hoc basis to a grade are to be replaced by persons approved for regular appointment at the earliest opportunity.</li>



<li>The total period for which the appointment/ promotion may be made to these posts, on an ad-hoc basis, keeping in view the exceptionalities anticipated in the aforementioned OMs, by the respective Ministries/ Departments, is to be limited to one year only. In case of compulsions for extending any ad-hoc appointment/promotion beyond one year, the approval of the Department of Personnel and Training is to be sought at least two months in advance before the expiry of the prescribed limit. Also, if the approval of the Department of Personnel &amp; Training to the continuance of&nbsp;the ad-hoc arrangement is not received before the expiry of the prescribed limit, the ad-hoc appointment/ promotion shall automatically cease on the expiry of the current term. It is reiterated that continuation of any ad-hoc arrangement beyond the prescribed limits and release of pay and allowances for the same, without express approval of this Department is not in order.</li>
</ol>



<p>2. Thus, keeping in view the aforementioned extant instructions / guidelines, the primary endeavour should be to fill up posts on regular basis, in terms of the applicable Recruitment / Service Rules, at the earliest. However, where ad-hoc arrangements have been made in unavoidable circumstances, and are required to be extended beyond the prescribed initial period, prior approval of the Department of Personnel &amp; Training (DoPT) should invariably be obtained before the expiry of the current term of ad-hoc appointments/ promotion, by sending proposal at least 2 months before expiry of term. <strong>In case prior approval of DoPT has not been obtained</strong> for extension of ad-hoc promotion beyond the prescribed initial term, except where DoPT has specifically allowed the Ministry/ Department to seek post-facto ratification of the extension of ad-hoc promotion for the intervening period after the post(s) have been filled on regular basis i.e. period beyond the prescribed initial term of one year or period extended beyond one year with DoPT’s approval and upto the date the post is filled on regular basis, <strong>the ad-hoc promotion shall cease automatically on expiry of the initial term / extended period approved by DOPT, and that the officers shall stand reverted to their substantive post without the requirement of any specific order for their reversion.</strong></p>



<p>3. The Office of the Controller General of Accounts (CGA) has separately been requested to issue advisory to all the Controllers of Accounts in various Ministries /Departments to ensure that pay and allowances’ etc. for ad-hoc appointment/ promotion, in cases where ad-hoc appointment/ promotion have continued beyond the permissible limit (i.e. beyond one year or period extended with DoPT’s approval), are to be released only if the arrangement for a particular period has been duly approved by the Department of Personnel and Training. Further, it would be the responsibility of the administrative Ministry/ Department to satisfy the respective Pay and Accounts Officer that the conditions for extension of ad-hoc appointment/ promotion have been met before they release the pay and allowances for the extended period of ad-hoc appointment/ promotion.</p>



<p>4. Ministries / Departments are required to ensure that the above instructions in the context of this Department’s Office Memorandum dated 30.03.1988 and 03.04.2013 are strictly followed by all concerned.</p>



<p>5. No relaxation/exemption from these guidelines will be allowed. Hence proposals seeking ex-post facto approval for extension of ad-hoc appointments/ promotions beyond the permissible period, unless expressly allowed by DoPT as indicated in para 2 above, shall not be considered.</p>

<h3 class="wp-block-heading">Subject: Revised Pay Levels as per recommendations of the Seventh Central Pay Commission &#8211; Issue of instructions on revision in minimum qualifying service required for promotion &#8211; regarding</h3>



<p>The undersigned is directed to refer to this Department’s OM No. AB.14017/ 13/2016-Estt.(RR) dated 9.8.2016, wherein all Ministries/ Departments were advised to amend the Service Rules and Recruitment Rules by substituting the existing Pay Band and Grade Pay with the new pay structure i.e. &#8220;Level in the Pay Matrix”, as per the recommendations of 7th CPC and the CCS (Revised Pay) Rules 2016 issued by Department of Expenditure vide Notification dated 25th July, 2016, straightaway without making a reference to the Department of Personnel and Training (DOP&amp;T)/ Union Public Service Commission (UPSC).</p>



<p>2. Attention is invited to this Department’s OM No AB.14017/61/2008- Estt. (RR) dated 24.3.2009, which was issued following implementation of the recommendation of the 6th CPC, indicating the revised minimum qualifying service required for promotion, to be prescribed in the Service/Recruitment Rules, as per the revised pay structure introduced as per recommendations of the 6th CPC and accepted by the Government. The said OM was issued in the context of earlier instructions issued vide DOPT OM No. AB.14017/2/97-Estt. (RR) dated 25.5.1998, prescribing the minimum qualifying service as per 5th CPC pay scales.</p>



<p>3. Instructions revising the minimum qualifying service required for promotion, as per 7th CPC Pay Matrix/ Pay Levels, have not been issued so far and proposals for framing/ amendment of RRs/Service Rules are still being considered, based on the requirements prescribed in OM dated 24.3.2009. Though the levels in Revised Pay Matrix as per 7th CPC Pay Matrix, generally correspond to the pre-revised Grade Pays/ Pay Scales (6th CPC), however, a need was felt to prescribe minimum qualifying service for promotion as per Pay Levels in the Revised Pay Matrix.</p>



<p>4. Therefore, the instructions issued vide DOPT OM dated 24.3.2009 has been reviewed, in consultation with the UPSC and with the approval of the competent authority it has been decided to revise the norms prescribing minimum eligibility service required for promotion, as per 7th CPC Pay Matrix and Pay Levels. The revised norms for minimum eligibility service for promotion have been indicated in the table at Annexure-I.</p>



<p>5. Therefore, the revised norms prescribing minimum eligibility service required for promotion, as per 7th CPC Pay Matrix and Pay Levels, given in Annexure-I , may be incorporated in the Recruitment Rules/ Service Rules by malting suitable amendments. All the Ministries/ Departments are, therefore, requested to effect necessary amendments to the Recruitment Rules/ Service Rules, in this regard, after following the due procedure.</p>



<p>6. The Recruitment/ Service Rules are of statutory nature. Moreover, any amendment in these Rules generally have prospective effect. Therefore, in terms of para 3.1.3 of DoPT OM No. AB. 14017/48/ 2010-Estt. RR dated 31.12.2010, wherever required, suitable &#8216;protection clause&#8217; may be incorporated in the amendment proposed in the Recruitment/ service Rules, providing for retention of existing eligibility service for existing incumbents holding the feeder posts on regular basis, where the eligibility service for promotion prescribed in the existing rules is being enhanced and where the change is likely to affect the promotion of these incumbents.</p>



<p>7. Ministries/ Departments may initiate action to complete the review in this regard and furnish necessary amendment proposals to the DOPT and the UPSC in the case of Group A and Group B posts within six months from the date of issue of this Office Memorandum.</p>

<h3 class="wp-block-heading"><strong>Sub: Reservation in promotions- Procedure to be followed prior to effecting reservations in the matter of promotions.</strong></h3>



<p><strong>Ref: Railway Board’s letter no.2018. -E(SCT)l/25/9 dated 13.04.22 &amp; 02.05.22.</strong></p>



<p>Clarifications are being sought from some of the Zonal Railways with reference to Board’s instruction issued vide Letter no. No.2018-E(SCT)l/25/9 dated 13.04.2022 &amp; 02.05.2022 in consonance with DOP&amp;T orders No.36012/16/2019-Esttt. (Res.).</p>



<p>Attention is invited to Para 4(b) of Board’s letter no. 95-E(SCT)I/49/5(2) dated 21.08.1997, wherein it has been mentioned that cadre for the purpose of roster shall mean a particular grade and shall comprise the number of the posts to be filled by a particular mode of recruitment in terms of the codal/manual provisions or Railway Board’s instructions issued from time to time.</p>



<p>As regards RBE No.126/2010, it is mentioned that the same had been was held in abeyance vide Railway Board’s letter no.2016-E(SCT)I/25/8 dated 30.09.2016 with immediate effect till further orders. Further in terms of Board’s orders of even number dated 19.06.2018 (copy enclosed), it has been advised to carry out promotions in accordance with the directions of the Hon&#8217;ble Supreme Court orders dated 17.05.2018 and 5.06.2018 based on the existing seniority/select list.</p>



<p>Now fresh instructions had been issued vide Board’s letter no.2018-E(SCT)I/25/9 dated 13.04.2022 &amp; 02.05.2022 in consonance with DOP&amp;T O.M. No.36012/16/2019-Estt.(Res.) dated 12.04.2022, wherein it has been advised to follow instructions/guidelines, laid down in Board’s letter No.95-E(SCT)I/49/5(2) dated 21.08.1997 w.r.t maintenance of roster. In this regard attention is invited to para 10 of Annexure-1, wherein it had been mentioned that while operating the roster, persons belonging to communities for whom reservation has been made, but who are appointed on merit and not owing to reservation, should not be shown against reserved points. They will occupy the unreserved points.</p>



<p>Further it is reiterated that as the Jarnail Singh batch of cases are still pending in the Supreme Court of India, any promotion order issued shall be subject to further orders that may be passed by the Supreme Court in the said batch of cases.</p>

<p>In terms of provision contained in para 204.9 of IREM VOL, formulation of panels for Group ‘B’ posts through Selections should consist of employees who have qualified in the said Selection and it should correspond to the number of vacancies for which the Selection was held. Similarly, in the case of Panels formed through LDCEs, names of candidates are arranged in the order of merit on the basis of total marks secured by them in commensuration with the number of vacancies.</p>



<p>2. Now one of the Federations (N.F.I.R.) has asked for adopting guidelines issued by DOP&amp;T for the formation of ‘extended Panels’ for Group ‘B’ posts. The matter has been considered and it has been decided that ‘Extended Panels (EP)’ may be formed for Selections and <a href="https://centralgovernmentnews.com/tag/ldce/" target="_blank" rel="noreferrer noopener">LDCE</a>s held for promotion to Group ‘B’ posts to the extent of officials getting empanelled to Group ‘B’ posts but retiring in the vacancy cycle itself.</p>

<p><strong>Subject: Date of next increment &#8211; Rule 10 of Army Officers and Air Force Officers Pay Rules, 2017; Regulation 10 of Navy Officers &#8211; Pay Regulations, 2017; Rule 10 of Army, Air Force and Military Nursing Service Pay Rules, 2017; Regulation 10, of Navy Pay Regulations, 2017 and Rule 9 of the Non-Combatants (Enrolled) of Air Force Rules, 2017 &#8211; regarding.</strong></p>



<p>The undersigned is directed to invite attention to MoD O.M.s No.: 1(20)2017/D (Pay/ Services) dated 22.3.2018 and 30.4.2019 and O.M. No. a PC-1(20)2017-D (Pay/ Services) Part- II dated 11.3.2019 on the issue of availability of option for fixation of pay on promotion/ Modified Assured Career Progression Scheme (<strong><a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACPs</a></strong>) from the date of next increment (DNI) in the lower post and method of pay fixation from DNI, if opted for, in context of Army and Air Force Officers Pay Rules, 2017, Navy Officers Regulation, 2017, Army, Air Force and Military Nursing Service Pay Rules, 2017, Navy Pay Regulations, 2017 and Non-Combatants (Enrolled) of Air Force Rules, 2017.</p>

<p>2. Enclosed herewith is the Ministry of Finance, Department of Expenditure OM No. 421/2017-IC /E.IIIA dated 28.11.2019 and to say that the provisions contained therein of the said letter, will mutatis-mutandis be applicable to the Defence Services Officers and JCO/OR and equivalence &#8211; provided all the conditions and stipulations laid down therein are strictly fulfilled.</p>



<p>3. Since there is a material change, the personnel who have been regularly promoted or granted financial up-gradation on or after 1.1.2016 and desire to exercise/ re-exercise option for pay fixation shall be given opportunity to exercise or re-exercise of the option. Such an option shall be exercised within one month of issue of this O.M.</p>

<p>In accordance with MoD OM No. 1(20)/2017/D (Pay/ Services) &#8211; Part -I dated 02.11.2020 read with MoF OM No.4-21/2017 -IC/E/IIIA dated 28.11.2019, the Officers who have been promoted/ upgraded on or after 01.01.2016 in <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7thCPC</a></strong> and have opted for fixation of pay from the DNI in lower grade will be allowed Increment in promotional grade after completion of 6 months qualifying service i.e., on 1st Jan or 1st July as the case maybe.</p>

<p><strong>Accordingly</strong>,</p>



<ul class="wp-block-list"><li>Officers who have already exercised their option for fixation of pay on promotion from DNI will be granted increment in promotional grade on the following 1st Jan or 1st July suo-moto by PCDA(O).</li><li>Officers who have been promoted or granted financial upgradation on or after 01.01.2016 and<strong> <em>desire to exercise/ re-exercise option for pay fixation from <a href="https://centralgovernmentnews.com/tag/dni/" target="_blank" rel="noreferrer noopener">DNI</a> may opt within one month of issue of the OM</em>.</strong> Options so exercised may also be sent through on mail id : ledger-pcdao@nic.in or through AWAN to APAC, PCDA (O) Pune.</li><li>To enable this office to consider the case, the officers are requested to submit their option by 01.12.2020. </li></ul>

<p>Whereas few representations have been received from amongst the officers promoted to Junior Administrative Grade (JAG) vide this office even no. order dated 07.07.2020. The common gist of the representations is that their promotion order should indicate promotion to Junior Administrative Grade in Level-13 of <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> instead of Level-12.</p>

<p>2. The Representations have been examined. It is noted that these officers have been granted promotion to Junior Administrative Grade of the service in Level- 12 of 7 CPC &#8211; on regular basis &#8211; in accordance with the extant Service Rules i.e. P&amp;T Building Works Service Rules 1994 as amended from time to time. This is also in line with the Minutes of Meeting of DPC conveyed by UPSC. The fact that they are already drawing their pay in Level-13 is due to scheme of Non-functional upgradation and is not relevant while considering them for regular promotion to JAG as per statutory RRs.</p>

<p>3. However, it is clarified that the officers already granted NFU in Level-13 of 7th CPC shall continue to draw pay in Level-13, and there will be no pay fixation for officers already drawing their pay in Level-12 or 13 on grant of regular promotion to JAG.</p>
