<strong>Implementation of Reservation in Promotion for Employees</strong></p>

<p>The Supreme Court in Special Leave Petition (Civil) No.30621/2011 has passed the following order on 17.5.2018:-</p>
<p>“It is directed that the pendency of this Special Leave Petition shall not stand in the way of Union of India taking steps for the purpose of promotion from ‘reserved to reserved’ and ‘unreserved to unreserved’ and also in the matter of promotion on merits..”.</p>
<p>Further, in the matter related to Special Leave Petition (Civil) No.31288/2017 connected to Special Leave to Appeal (Civil) No.28306/2017, the Supreme Court held as under on 05.06.2018:-</p>
<p>“Heard learned counsel for the parties, Learned ASG has referred to order dated 17.05.2018 in SLP(C) No.30621/2011. It is made clear that the Union of India is not debarred from making promotions in accordance with law, subject to further orders, pending further consideration of the matter. Tag to SLP (C) No.30621 of 2011.”</p>
<p>Based on interim Orders/directions of the Supreme Court dated 17.05.2018 and 05.6.2018, Department of Personnel and Training vide Office Memorandum No. 36012/11/2016- Estt.(Res-I) {Pt-II} dated 15.06.2018 requested all the Ministries/Departments of the Government of India to carry out promotions in accordance with above directions of the Supreme Court on existing seniority / select lists subject to further orders which may be passed by the Supreme Court. The State Governments were advised to take necessary action in accordance with the above-mentioned orders passed by the Supreme Court.</p>
<p>This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Rajya Sabha today.</p>

										<content:encoded><![CDATA[<p><b>7th Pay Commission : Government accepts Proposals on Promotion for Employees. The ministry of personnel, public grievances and pensions issued a notification to the effect on September 28 2016.</b></p>
<p>The central government has accepted the 7th Pay Commission (CPC) recommendations on time-bound promotion for Central government employees that will ensure at least one career progression every 10 years.</p>
<p>The 7th pay commission in its November 2015 report had said that despite demands for increasing the frequency of time bound promotion, it had decided to retain the existing scheme, known as Modified Assured Career Progression Scheme (MACPS).</p>
<p>The ministry of personnel, public grievances and pensions issued a notification to the effect on September 28 2016.</p>
<p>The 7th pay commission report said that <i><b>resentment</b></i> over the existing pay structures that prompted the demand have been addressed by <i>rationalisation of pay levels, abolition of pay band and grade pay Report of the Seventh CPC 82 Index and introduction of a matrix based open pay structure</i>.</p>
<p>Hence, there is no justification for increasing the frequency of MACP and it will continue to be administered at 10, 20 and 30 years as before. In the new Pay matrix, the employees will move to the immediate next level in the hierarchy. Fixation of pay will follow the same principle as that for a regular promotion in the pay matrix, the CPC report had recommended.</p>
<p>This has been accepted by the Central government.</p>
<p><b>The Government has considered the above recommendation and has accepted the same. In the light of the recommendations of the 7th CPC accepted by the Government, the Modified Assured Career Progression Scheme (MACPS) will continue to be administered at 10, 20 and 30 years as before</b>, the September 28 notification read.</p>
<p>The Central government also approved the 7th pay commission recommendations on performance appraisal for employees to qualify under the MACP.</p>
<p><i>There is, however, one significant aspect where this Commission feels that a change is required. This is with regard to the benchmark for performance appraisal for MACP as well as for regular promotion. The Commission recommends that this benchmark, in the interest of improving performance level, be enhanced from <b>Good </b>to <b>Very Good.</b>  In addition, introduction of more stringent criteria such as clearing of departmental examinations or mandatory training before grant of MACP can also be considered by the government</i>, the CPC had proposed.</p>
