<h3 class="wp-block-heading">Sub: Initial/ Continued grant of HRA to staffs working in Departmental offices under the provisions of Para 3(b)(iii) of O.M. No. F. 2(37)/ E.II(B)/ 64 dated 27.11.1965, as amended/ modified from time to time- Issuing general instruction to Circles -Reg.</h3>



<p>Sir/Madam,</p>



<p>This is regarding the proposal for the initial grant / Continued House Rent Allowance to staff working in offices situated in village /Gram Panchayat within 08 KM from the periphery of the municipal limit of the qualified city under Rule 03 b (iii) HRA General Rules and orders.</p>



<p>2 It has been noticed while examining the above proposals that proposals are being received in Directorate with an abnormal delay from the Circle offices. The delay in the submission of proposals is being viewed seriously. The Circle should ensure that the proposal is submitted well in advance.</p>



<p>3. The Circles are further requested to follow the following guidelines while submitting the proposals to the Directorate.</p>

<h3 class="wp-block-heading">(a) Initial Grant of HRA</h3>



<ul class="wp-block-list"><li>(i) The initial order for grant of HRA under para 3(b) (iii) of the OM. dated 27.11.1965 will continue to be issued by the Ministry of Finance (Department of Expenditure).</li><li>(ii) These issues should be examined at the time of opening of the office and submit proposals within 03 months of opening of Offices, which qualify the condition for grant of higher HRA.</li><li>(iii) These proposals should be examined as per instructions issued from time to time and submit a proposal in the prescribed checklist through Circle Office along with the concurrence of CIFA.</li><li>(iv) The original dependency certificate issued by the collector/Dy. Commissioner having jurisdiction over the place should be submitted with the proposal.</li></ul>



<h3 class="wp-block-heading">(b) Continued grant of HRA</h3>



<ul class="wp-block-list"><li>(i) The further extension of grant of continued HRA for next 03 years will be issued by the Directorate in the consultation with Financial adviser as per MF OM No 11023/3/86-E.II (B) dated 01. December, 1989.</li><li>(ii) There is no need for submission of income and cost statement of the concerned offices along with the proposal. Only the original dependency certificate issued by the collector/ Dy Commissioner having the jurisdiction over the place, to be submitted with the prescribed check list by Divisional office to concerned Regional/ Circle office.</li><li>(iii) These proposals should be examined as per instructions issued from time to time and submit proposal in the prescribed check list through Circle Office along with the concurrence of CIFA.</li><li>(iv) The proposal for continued grant of HRA should be submitted at least 03 months before the ending of current period of continued HRA granted by the Directorate.</li><li>(v) A monitoring mechanization to be made in the Division office/ Regional and Circle office so that such proposals should be monitored on periodically, prepare and submit proposals to Directorate within a prescribed time. The proposals received after prescribed time will not be proceeded in the Directorate.</li></ul>



<h3 class="wp-block-heading">(c) Place or places agglomeration of classified city</h3>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-cpc-hra-hike-for-central-government-employees-and-cpse-or-psu-employees-3rd-prc-from-1st-jan-2021/" target="_blank" rel="noreferrer noopener">7th CPC HRA hike for Central Government employees and CPSE or PSU employees (3rd PRC) from 1st Jan 2021</a></strong></h4>



<p>Attention is invited on para 3 (a) of HRA General Rules and these orders may be followed. There is no need for further extension of continued HRA for the area of Gram Panchayat that has been included in the Municipality I Corporation UA and the applicable rate of the qualified city is to be paid from the date of included from the limit of the named qualified city.</p>



<p>4. The Circle is requested to launch a special drive in the matter during the month of April 2021. The Circle is further requested to prepare a list of all such cases to submit it to this Directorate by 30.04.2021 and review the present cases and process/ submit the proposal as per the above guidelines to Directorate so that the further orders may be issued by the concerned offices in time.</p>



<p>These instructions should be followed strictly.</p>

<p>Subject: <b>Probation and / or confirmation of Direct Recruit Postal Assistants / Sorting Assistants in the Department of Posts &#8211; reg.</b></p>
<p>Sir / Madam,</p>
<p>I am directed to refer to the above mentioned subject and to say that the issue of probation and / or confirmation of the Direct Recruit Postal Assistants / Sorting Assistants (PAs/SAs) has been engaging the attention of the Department for some time. It is indicated that presently on their appointment, such PAs/SAs are imparted induction training and they have to pass the prescribed tests during the said training.</p>
<p>2. Currently, such Direct Recruit PAs/SAs undergo institutional training of upto 48 days at the Postal Training Centres (PTCs). They have to obtain at least 60% marks in the tests in order to come out of training successfully. If any PA/ SA fails to obtain 60% marks, he/she is retained in the PTC for re-training for 2 weeks and undergoes two tests (one each week). Despite retraining, if such PA/SA still does not obtain 60% marks, suitable adverse notice is taken against him/her.</p>
<p>3. The matter has been revisited by the Department in consultation with the Department of Personnel&#8221;&amp; Training (DOP&amp;T). At the outset, it is emphasized that the tests, which the Direct Recruit PAs/SAs undergo while on training, need to be closely monitored and it should be ensured that only those PAs/SAs who obtain required marks in the tests may be declared to have satisfactorily completed the probation period and confirmed ‘in service, provided such PA/SA has also performed/acted satisfactorily during the probation period. As per the Recruitment Rules of PA/SA issued by the Department of Posts, the Direct Recruit PAS/SAs are confirmed in service by a Departmental Confirmation Committee (DCC) and pending confirmation, they remain on probation and their services are governed by CCS (Temporary Service), Rules, 1965.</p>
<p>4. Besides above, following points may be kept in view by the PTCs and the Circles while considering the confirmation of such Direct Recruit PAs/SAs, who are on probation:</p>
<p>(1) Direct Recruit PAs/SAs (on probation) who fail in the tests held in PTCs:-</p>
<p>(a) If any Direct Recruit PAs/SAs (on probation) is unable to clear the tests in the first attempt, he/she may be given two more chances to pass the tests. These three chances (including first chance during training) may be held/conducted within the two-year mandatory probation period. In the interregnum, such PA/SA may be posted temporarily to a Post Office/RMS office against a non-sensitive post.</p>
<p>(b) Before the third chance is given to a PA/SA, who has failed in two attempts, he/she may be given a written warning to the effect that his/her failure in mandatory tests does not justify his/her confirmation in the Service and that, unless he/she showed substantial improvement within a specified period and clears the test, the issue of terminating him from service will be considered.</p>
<p>(c) If any PA/SA is still unable to clear the Tests in three attempts within two years, the probation period in his/her case will be extended by six months during which time he/she shall have to mandatorily pass the tests. For such PAS/SAs, whose probation period has been extended by six months due to failure to pass the tests, a qualifying test will also be introduced which will be in addition to the existing tests. The modalities of such qualifying test will be prepared/finalized by the Training Division of the Postal Directorate.</p>
<p>(d) In case he/she passes the required tests and qualifying test and has also acted/performed satisfactorily during the entire period of probation including extension also, he/she may be declared to have successfully completed the probation period and may be confirmed in service by the DCC.</p>
<p>(e) If a PA/SA again fails in the tests and/or does not pass the qualifying test, the services of such temporary Direct Recruit PA/SA shall be terminated.</p>
<p>(II) Direct Recruit PAs/SAs (on probation) who pass the test, but their conduct/ performance is unsatisfactory:</p>
<p>(a) In case conduct/performance of a PA/SA is found unsatisfactory during the probation period irrespective of the fact that he/she has passed the required tests, the probation period of such PA/SA will be extended for six months in order for him/her to improve his/her conduct/performance to a satisfactory level.</p>
<p>(b) Such PA/SA as mentioned in (a) above may be given a written warning that unless his/her conduct/performance improves to a satisfactory level, the issue of terminating his/her services will be considered. In case his/her conduct/performance has improved to a satisfactory level during the extended probation period, he/she may be declared to have successfully completed the probation period and may be confirmed in service. If not, the services of such temporary Direct Recruit PA/SA shall be terminated.</p>
<p>5. The PTCs shall send reports relating to conduct/performance and passing/failing in the tests/qualifying test etc. as the case may be, in respect of each Direct Recruit PA/SA (on probation) to the Divisional Head concerned.</p>
<p>6. In order to ensure that termination cases are decided appropriately, the Divisional Head concerned, the Appointing Authority of PA/SA, will first issue a speaking Show Cause Notice covering reasons in detail for termination to the PA/SA concerned within 15 days after completion of extended six months’ period of probation. The said PA/SA will be given 15 days’ time to make representation, if any. Subsequently, the said Divisional Head, after carefully examining all relevant documents as also the representation, if any, of the official concerned, will decide the case of his/her termination within 45 days from the date of issue of Show Cause Notice.</p>
<p>7. Successful completion of training is a pre-requisite for completion of probation. Therefore, above may be included in the provisional offer of appointment issued to the candidates.</p>
<p>8. This may be brought to the notice of all concerned.</p>

<li>Justice Singhal, Chairman 4th PC stated GDS are Civil Servants and they are Central Govt. Employees.</li>
<li> Justice Charanjit Jalwar stated that GDS are Civil Servants and they are Central Govt. Employees.</li>
<li>Talwar Committee recommended to the Govt. that GDS should be included in Pay Commission and no separate committee should be appointed in future.</li>
<li>Govt. appointed 7th Pay Commission for Central Govt. Employees.</li>
<li>NFPE &amp; AIPEU-GDS (NFPE) says GDS are part of Central Govt. Employees and they should be included in 7th CPC itself.</li>
<li>Confederation of Central Govt. Employees &amp; Workers says that GDS are part of Central Govt. Employees and they should be incuded in 7th CPC itself.</li>
<li>JCM National Council (staff side) orgisastions including Railway &amp; Defence Federations says GDS are part of Central Govt. Employees and they should be included in 7th CPC itself.</li>
<li>BUT RECOGNISED GDS UNION OF SHRI. MAHADEVAIAH ACCEPTED THE GOVT. STAND THAT GDS ARE NOT PART OF CENTRAL GOVT. EMPLOYEES AND HENCE HE IS DEMANDING SEPERATE COMMITTEE FOR GDS.  HE DON’T WANT GDS TO BE INCLUDED IN 7TH CPC.  HIS MAIN DEMAND IN THE CHARTER OF DEMANDS IS SEPERATE COMMITTEE FOR GDS .</li>
<li>NFPE &amp; AIPEU-GDS (NFPE) declared joint indefinite strike under the banner of JCA from 2015 May 6th for inclusion of GDS in 7th CPC.</li>
<li>FNPO &amp; NUGDS also declared joint indefinite strike under the banner of JCA from 2015 May 6th for inclusion of GDS in 7th CPC.</li>

<p>&amp;     Confederation, Railways &amp; Defence Federations organised joint National Convention of entire JCM staff side orgnisations and decided to organise massive Parliament March in April 2015 to declare indefinite strike of entire Central Govt. Employees.  Inclusion of GDS in 7th CPC is included in the charter of demands as number one demand.</p>
<p>RECOGNISED GDS UNION OF SHRI MAHADEVAIAH DON’T WANT JOINT STRIKE OF GDS &amp; REGULAR EMPLOYEES.  HE ALWAYS DECLARES FRAGMENTED STRIKE TO TORPEDO THE UNITY OF GDS AND REGULR EMPLOYEES.  HE IS DESPERATELY TRYING TO RETAIN HIS CONTROL OVER GDS.  HE HAS WRITTEN TO THE GOVT. NOT TO ALLOW NFPE &amp; FNPO TO DISCUSS GDS ISSUES.  GOVT. ALSO WANTS TO DIVIDE GDS AND REGULAR EMPLOYEES SO THAT THEY CAN EASILY DENY THE LEGITIMATE DEMANDS OF THE GDS INCLUDING CIVIL SERVANT STATUS AND ALL BENEFITS OF REGULAR EMPLOYEES.</p>
<p>LET US ORGANISE JOINT INDEFINITE STRIKE OF FIVE LAKHS GDS &amp; REGULAR EMPLOYEES FROM 2015 MAY 6TH UNDER THE BANNER OF POSTAL JOINT COUNCIL OF ACTION (NFPE, FNPO, AIPEU-GDS (NFPE) &amp; NUGDS) DEMANDING INCLUSION OF GDS IN 7TH CPC &amp; GRANT OF ALL BENEFITS OF REGULAR EMPLOYEES TO GDS ALSO.<br />
RECOGNISED GDS UNION OF MAHADEVAIAH IS AGAINST FILING CASE IN SUPREME COURT  for grant of Civil Servant status and all benefits of regular employees to GDS.  NFPE &amp; AIPEU-GDS (NFPE) has filed a Writ Petition in Supreme Court and after the preliminary hearing Supreme Court transferred the case to Delhi High Court.  The next hearing of the case in Delhi High Court is on 4th February, 2015.</p>
<p>But Shri. Mahadevaiah had filed a case in the Karnataka High Court for his own benefit requesting to grant Foreign Service benefits to him.  (Writ Petition No.24106/2005 (S.CAT).</p>
<p>When he has filed Writ Petition in High Court for his own benefit it is perfectly alright, but when NFPE &amp; AIPEU-GDS (NFPE) filed case in Supreme Court for the benefit of 2.76 lakhs GDS he is ridiculing it and opposing it.</p>
