<p>Ministry of Defence has forwarded the order for payment of Productivity Linked Bonus (PLB) for the year 2020-21 vide letter under reference (copy enclosed). Accordingly, PLB equivalent to <strong>36 (thirty-six) days</strong> wages is payable to the Civilian employees belonging to the Group &#8216;D&#8217;, &#8216;C&#8217; &amp; &#8216;B&#8217;  <strong>(</strong>Non-Gazetted) in Defence Production establishments in<br />accordance with MoD ltr.no.48(4)/98/D(B&amp;C) dated 27/07/2000 (copy enclosed), with the overall ceiling of emoluments as <strong>Rs.7000/-</strong> (Seven thousand only) per month. PLB may be calculated taking average number of days per month as <strong>30.4</strong> days.</p>



<ol class="wp-block-list" start="2"><li>The financial implications on this account would be met from the existing sanctioned budget for the F.Y. 2021-22 without any additionality from the Government. The expenditure will be debited to the respective budget of the DoO(C&amp;S)/DPSUs/ Allied Organisation and to the respective heads to which the Pay and Allowances of employees of<br />Allied Establishments are debited.</li><li>Information on amount claimed and passed by Accounts for number of employees, amount undisbursed and number of employees yet to receive PLB payment fbr the year 2020-21may be furnished duly vetted as per the given table.</li><li>Information as per table (1, 2,3 &amp;.4) furnished below requires to be forwarded after thorough checking at the factory level and duly vetted latest by 30th November, 2021.</li></ol>

<h3 class="wp-block-heading">Sub: Productivity Linked Bonus for the eligible Defence civilians of the Army Ordanance Corps (AOC) for the year 2020-2021.</h3>



<p>Sir,</p>



<p>I am directed to refer to the Productivity Linked Bonus Scheme already circulated vide this Ministry letter No.F-24(9)/80/D(JCM), dated 28th September, 1983 as amended from time to time and to convey the sanction of President to the payment of 40 days(forty days) wages in cash as PLB for the year 2020-2021 to the eligible civilian employees of the AOC/Indian Army.</p>



<p>2. The entitlement has been worked out on the basis of the working results for the year 2020-2021 in accordance with the agreed formula.</p>



<p>3. The PLB shall be paid to all eligible Gp. &#8216;B'(Non-Gazetted) and Gp. ‘C’ civilian employees of Indian Army(AOC) who are covered under PLB Scheme for the accounting year 2020-2021. The calculation ceiling of Rs.7000/-(7000×40/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.</p>



<p>4. Productivity Linked Bonus to the casual labourer will be paid at the assumed wages of Rs.1200/-p.m. (1200×40/30.4) for the accounting year 2020-2021 . However, in cases where the actual wages fall below Rs.1200/- p.m., the amount will be calculated on the actual monthly wages. The other conditions remain unchanged.</p>



<p>5. The expenditure on this account will be debitable to Defence Service Estimates under respective Heads to which the pay and allowances of these employees are debited. The entire expenditure on the payment of PLB is to be met out of the sanctioned budget grant for the year 2021-2022, without any additionality.</p>



<p>6. This issues with the concurrence of the Ministry of Finance,Deptt. of Expenditure vide their l.D. No.11/8/2019-E.lll A(300506031/2021) dated 26.10.2021 and Mod (Fin/AG/PB) vide their Dy. No. 71/AG/PB/2021 dated 01.11.2021.</p>

<p>Please refer to the subject cited above.</p>



<p>The work relating to the assessment of Productivity Linked Bonus for the year 2020- 21 has been taken up. The Productive Linked Bonus (PLB) for the employees of EPFO is assessed on the basis of the productivity achieved and manpower used in respect of field offices separately. For Head Office (including PDUNASS), it is worked out based on average of All India Productivity and Manpower. Information relating to parameters and performance as per the Scheme is to be furnished in the&nbsp;<strong>Annexure A to C</strong>&nbsp;(copies enclosed).</p>



<h4 class="wp-block-heading">ACCOUNTS &amp; CASH</h4>



<ol class="wp-block-list" start="2"><li>The time-limit of 20 days (calendar days) has been notified for settlement of PF, EPS &amp; EDU claims, transfer including advances cases. In case, the job is not completed within 20 days, weightage would be reduced for the work done beyond 20 days. Date of receipt of claim form (complete in all respects) and the date of despatch of cheque/transfer through NEFT would be taken into account for reckoning 20 calendar days.</li><li>As regards issue of “Annual Statement of Accounts”, it has been classified into two groups, Viz. (1) current year’s Accounts slips issued and (2) Previous year’s Accounts slips issued during the current year. Accounts slips relating to the “current Year” and those pertaining to previous years but issued during the current year should be shown separately.</li></ol>



<h4 class="wp-block-heading">ENFORCEMENT &amp; DAMAGES</h4>



<ol class="wp-block-list" start="4"><li>The activities of “Enforcement &amp; Damages” include:</li><li>No. of 7A notices issued.</li><li>No. of Speaking Orders of 7A passed and compliance effected.</li><li>No. of Speaking Orders passed for Levy of Damages.</li><li>No. of Recovery Certificates Executed:-<ol type="a"><li>For default in all the five Accounts (A/c No. 1,2,10,21 &amp; 22)</li><li>For default in 3 or 4 of the five Accounts.</li><li>For default in 1or 2 of the five Accounts.</li></ol></li></ol>



<h4 class="wp-block-heading">7-A NOTICES</h4>



<p>5. Only one notice has to be taken into account for all the three Schemes. In case three separate notices are issued for the three Schemes, it has to be taken as one only. Further, only the initial notice issued has to be taken into account and not the notices issued every time after adjournment of proceedings due to any reason. With the amendment of Section 7A, the RPFCs are required to decide not only the quantum of dues but also to decide the Applicability. In such cases also if more than one notices are issued, it should be taken as one only for the purpose of PLB return.</p>



<h4 class="wp-block-heading">SPEAKING ORDERS OF 7A PASSED AND COMPLIANCE EFFECTED</h4>



<p>6. Against this item all the speaking orders passed under Section 7A should not be shown. Only those orders passed, which have been complied with, should be shown. However, instructions contained in the preceding para as “7A Notices” should also be kept in view.</p>



<h4 class="wp-block-heading">SPEAKING ORDERS FOR LEVY OF DAMAGES</h4>



<p>7. All the speaking orders passed for levy of Damages may be shown against this item. However, if separate orders are passed for all the three schemes, only one order should be taken into account for the purpose of Bonus return.</p>



<h4 class="wp-block-heading">RECOVERY CERD FICATES EXECUTED</h4>



<p>8. Only those Recovery Certificates, which have been duly executed and not merely issued, should only be shown against this item. This item has been classified into three categories namely: –</p>



<ol class="wp-block-list" type="i"><li>For default in all the five Accounts (Bank A/c Nos. 1,2, 10, 21 &amp; 22)</li><li>For default in 3 or 4 of the five Accounts.</li><li>For default in 1or 2 of the five Accounts.</li></ol>



<p>Hence, information may be furnished separately against the three categories.</p>



<h4 class="wp-block-heading">PROSECUDONS</h4>



<p>9. The number of Prosecutions launched against the defaulting establishments I employers under Section 14 of the Act and Section 406/409IPC has to be indicated against the relevant item under this head.</p>



<h4 class="wp-block-heading">MANPOWER</h4>



<p>10. Manpower in position as on&nbsp;<strong>31st August 2020</strong>&nbsp;all over the region has to be furnished. The manpower reckoned for the purpose of assessment of PLB shall be as follows :</p>



<p><strong>(1) Accounts &amp; Cash</strong>&nbsp;– LDCs, DPAs/DEOs, SSAs &amp; Sr. SSAs posted in different Sections/Groups connected with the work of Accounts and Cash.</p>



<p><strong>(2) Enforcement &amp; Damages</strong>&nbsp;– LDCs, SSAs &amp; Sr. SSAs deployed in any of the Sections/Group connected with the work of Enforcement and Damages.</p>

<p><strong>(4) Administration</strong>&nbsp;– LDCs, SSAs &amp; Sr. SSAs in position in all Sections other than those mentioned in (1), (2) and (3) above.</p>



<p>Detailed information of various sections/staff coming under all the above four heads is given in&nbsp;<strong>Annexure-C</strong>. All the Regional offices may forward the consolidated information in respect of the Region.</p>



<p>11. The information relating to Staff in position in respect of the Zone as on&nbsp;<strong>31.08.2020&nbsp;</strong>has to be furnished in&nbsp;<strong>Annexure-B</strong>.</p>



<p>12. It is requested that the aforesaid information in Annexure-A to C may be furnished immediately. n any case the information should reach the Head Office on or before&nbsp;<strong>08 October, 2021</strong>&nbsp;at&nbsp;rc.wsu@epfindia.gov.in.</p>



<p>13. All the ROs may furnish their data to their respective Zonal Offices and subsequently ACC (Zones) after compilation of the same, may forward the same to Head Office.</p>

<h3 class="wp-block-heading">Sub: Payment of Productivity Linked Bonus (PLB) for 2020-21.</h3>



<p>Respected Madam,<br /><strong>Central Government employees are paid the Productivity Linked Bonus (PLB) prior to the festive season of Dussehra every year.</strong></p>



<p>2. Madam, I would like to draw your kind attention towards the ceiling of monthly emoluments for calculation of PLB/Ad-hoc Bonus. GENC has been demanding for enhancing this ceiling.</p>



<p>3. The Ministry of Finance vide it’s OM No. 7/4/2014-E-IIIA dated 29.08.2016, issued orders for enhancing the ceiling of monthly emoluments from Rs.3500/- to Rs.7000/- for calculation of PLB/Ad-hoc Bonus w.e.f the financial year 2014-15. In this regard, I would like to draw your kind attention towards the Secretary to Govt. of India/Ministry of Labour &amp; Employment’s DO No.51040/4/2015-IR(PG) dated 28th August, 2015 (copy enclosed), addressed to the General Secretary/ BMS, whereby it was stated that&nbsp;<em><strong>“… The Government Is considering to revised calculation ceiling from the present level of&nbsp;Rs.3,500/- per month to Rs.7,000/- or the minimum wages for the scheduled employment as fixed&nbsp;by the appropriate Government, whichever is higher’.</strong></em>&nbsp;As per latest guidelines issued by the Ministry of Labour &amp; Employment, the Minimum Wage for a Skilled worker is Rs.20,384/- (in ‘A’ Area). Also, after implementation of 7th Central Pay Commission, the minimum basic pay of a Central Government Employee is Rs.18,000/-. Under these circumstances, the monthly ceiling of Rs.7,000/- for calculation of PLB/Ad-hoc Bonus, is not justified at all and hence needs to be enhanced.</p>



<p>4. Hence, in view of above, I request you to consider revising the calculation ceiling of monthly emolument from Rs.7000/- to the minimum wages, in consultation with the Ministry of Labour &amp; Employment, as per assurance made vide it’s DO letter dated 28th August, 2015.</p>

<h4 class="wp-block-heading">5.10. Item No. NC-48/4/21: Introduction of Productivity Linked Bonus (PLB) in place of ad hoc Bonus: raising the minimum ceiling for the purpose of payment of Bonus to Rs. 18000/- in accordance with 7th CPC.</h4>



<p>The demand, in brief, is that the Bonus be increased to Rs.18000/-.</p>



<p>Addl. Secretary (Pers), DoE, stated that the Payment of Bonus Act, 1965, provides the eligibility ceiling/ limit and calculation ceiling limit. The present eligibility monthly ceiling is Rs.21000 and the calculation monthly ceiling is Rs.7000. The remaining central government employees, not covered by any PLB Scheme, are being authorized ad-hoc Bonus (non-PLB) of Rs. 7000 per year, on the analogy of the relevant provisions of the said Act, wherein the limit is fixed by the M /o Labour and Employment.</p>
