<p>Railway Reservation for Physically Challenged made easier</p>
<p>New Delhi: In a much-needed relief to the physically challenged persons availing concessional rail fares, Railways has rationalised provisions for allotment of berths in a sleeper class under such quota by earmarking middle seat for the accompanying passenger.</p>
<p>As per the revised provisions, which are to come into effect from December 22, there will be two types of physically-challenged quota of two berths each — one lower and one middle — in the same cabin.</p>
<p>One will be for physically challenged persons who can utilise concession only when accompanied by an escort and the second for those for whom it is optional to take an escort with them, Railways announced in a release today.</p>
<p>It has also been decided that whenever a physically handicapped person books ticket on concession and if no berth is available in handicapped quota, the system will automatically try to allot the lower berth to the travelling passenger and middle berth to escort, subject to availability of same at the time of booking, the release said.</p>
<p>These changes were necessitated following some cases of the handicapped persons for whom it is optional to take an escort were not allowed to book single berth against this quota on the ground that the second berth will go vacant (as middle berth cannot be allotted to physically handicapped persons) was brought to the notice of the Railway Ministry, it said.</p>
<p>This issue has now been examined by the Ministry of Railways and further rationalisation has been done to ensure optimum allotment and utilisation of handicapped quota, the release said.</p>
<p>According to Railways, the berths for the physically handicapped persons, who can utilise concession only when accompanied by an escort, can be booked on first come first serve basis.</p>
<p>Similarly, for those handicapped persons having option of taking an escort, the berths will be booked together (in the same cabin), it said.</p>
<p>The release also said that at the time of preparation of reservation charts, the untiled lower berths under this quota can be released to physically handicapped passenger(of either category who were kept in general waiting list due to exhaustion of their quota), single senior citizen travelling alone on priority or to waitlisted passengers as per priority.</p>

<p>3% reservation in allotment of the shops/stalls is provided by the Directorate of Estates, Ministry of Urban Development, for physically handicapped persons. As per Delhi Development Authority’s (DDA) policy, 5% shops/stalls are reserved for the persons with disabilities as defined in Section 2 of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) (PwD) Act, 1995. Shops are allotted at Reserve Price through computerized draw of lots by the DDA.</p>
<p>Office of Chief Commissioner for Persons with Disabilities has stated that it has not received any complaint regarding non-formulation of schemes for preferential allotment of land at concessional rates to disabled persons for setting up business, houses, etc., in Delhi during the last three years.</p>
<p>However, in 2003, Chief Commissioner for Persons with Disabilities on the basis of a complaint received in 1999, vide order dated 27/06/2003 directed DDA to frame scheme in favour of Persons with Disabilities for preferential allotment of houses/land at concessional rate. Accordingly on 19.04.2004, DDA framed the existing policy for preferential allotment of houses/land to persons with disabilities.</p>
<p>Further on 09.10.2006, the Ministry of Urban Development (Delhi Division) reviewed the said policy of DDA and framed the existing policy for preferential allotment of houses/land to persons with disabilities in terms of Section 43 of the PwD Act, 1995.</p>
<p>Regarding the details of complaints received by Commissioner (Disability), Delhi, the information is not centrally maintained by this Ministry.</p>
<p>This information was given by the Minister of State for Social Justice and Empowerment, Shri Sudarshan Bhagat in a written reply to a question in Lok Sabha here today.</p>

<p>The Supreme Court on Tuesday directed the Centre and all state governments to provide three per cent job reservation to disabled persons in all their departments, companies and institutions.</p>
<p>A bench headed by Chief Justice P Sathasivam also clarified that the principle of not exceeding more than 50 per cent reservation would not be applicable while granting quota for disabled persons.</p>
<p>The apex court directed the authorities to compile the number of vacancies in all their departments to give jobs to disabled persons under three per cent reserved quota within three months.</p>
<p>The bench said it is an “alarming reality” that disabled persons are not getting jobs because of various social barriers forcing them to live life in poverty and negligence.</p>
<p>It said the government has “categorical obligation” to protect the right of disabled persons and passed a slew of directions for providing jobs to them.</p>

<strong>Welfare Measures for Persons with Disabilities</strong></p>
<p>Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) (PwD) Act, 1995 envisages three percent reservations for persons with disability in identified posts in Government establishments.</p>
<p>Under the Scheme of Incentives to the Private Sector for Employment of Physically Challenged Persons, the Government provides the employer’s contribution for Employees Provident Fund (EPF) and Employees State Insurance (ESI) for 3 years, for employees with disabilities including visually impaired persons employed in the private sector on or after 01.04.2008, with a monthly salary upto Rs.25, 000.</p>
<p>The National Handicapped Finance and Development Corporation provides concessional credit to Persons with Disabilities (PWDs) for taking up income generating activities for self-employment.</p>
<p>The Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) guarantees employment to rural household adults including persons with disabilities. Under National Rural Livelihood Mission(NRLM), a provision of 3% of the total beneficiaries has been made for persons with disabilities.</p>
<p>Indira Gandhi National Disability Pension Scheme (IGNDPS) under the National Social Assistance Programme (NSAP) provides pension to BPL persons with severe or multiple disabilities between the age group of 18 to 79 years @ Rs. 300 p.m. per beneficiary.</p>
<p>Under Deendayal Disabled Rehabilitation Scheme (DDRS), financial assistance is provided through Non Governmental Organizations (NGOs) for various projects for providing education, vocational training and rehabilitation of persons with disabilities.</p>
<p>These schemes are on-going and are reviewed from time to time and to improve their impact.</p>

<td>Whether the clarification given by Board vide letter of even number dated 15.01.2010 will be effective from the date of issue of the letter or the similarly placed past cases will also be covered.</td>
<td>
The past cases as indicated in letter of even number dated 15.01.2010 will also be covered under the said instructions. The financial benefits will accrue from the date the family pensioner becomes entitled to the family pension irrespective of whether the injury/handicap occurred/manifested and whether the same was certified by the competent medical authorities before or after attaining the age of 25 years.</td>

(b) Whether the Boards clarification even number dated 15.01.2010 are also applicable in the case of physically disabled/mentally handicapped son/daughter of CPF/SRPF(C) retirees who are eligible for grant of Ex-gratia payment for life on fulfillment of the same very conditions as specified for such son/daughter of the government servant governed by the Railway Services(Pension) Rules. 1993. If applicable, then from which date the clarification will be effective i.e. whether past cases will also be covered and from which date the financial benefit will accrue in their cases.</td>
<td>(b) The clarification contained in this letter and letter of even number dated 15.01 .2010 will equally apply In the case of similarly placed children of CPF/SRPF(C) beneficiaries .</td>
