G.S.R. 517(E). – Whereas a draft of certain rules to amend sub-rule (1) of rule 15 of the Rights of Persons with Disabilities Rules, 2017 was published, as required by sub-section (1) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016),vide notification of the Government of India the Ministry of Social Justice and Empowerment, Department of Empowerment of Persons with Disabilities number G.S.R. 335(E), dated the 28th April, 2023 in the Gazette of India, Extraordinary, Part-II, section 3, sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public;

And whereas copies of the said notification were made available to the public on the 28th April, 2023;

And whereas the objections and suggestions received from the public in respect of the said notification have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby makes the following rules further to amend the Rights of Persons with Disabilities Rules, 2017, namely:-

(1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Rights of Persons with Disabilities Rules, 2017, in rule (15), in sub-rule (1), after clause (d), the following clause shall be inserted, namely:-

“(e) guidelines on accessible sports complex and residential facilities for sports persons with disabilities, notified by the Government of India in the Ministry of Youth Affairs and Sports (Department of Sports), vide notification number 7-6/MYAS/ MDSD/ 2021 dated 13th October, 2022, as amended from time to time:”

Office Memorandum

Subject: Reservation for Handicapped (Persons with Disability) in engagement of Gramin Dak sevaks.

Reference this office letter of even number dated 26.02.2019 and 08.03.2019 vide which instructions on reservation for Handicapped (Persons with Disability) in engagement of Gramin Dak Sevaks were circulated.

2. Various references have been received for inclusion of sub-category “Intellectual Disability” of Persons with Disability (PwD). The matter was examined in consultation with Department of Empowerment, Persons with Disabilities (Divyangjan), and Ministry of Social Justice & Empowerment. Accordingly, the Competent Authority has approved the following substitution in the existing guidelines.

3. Further, where in any engagement cycle/schedule/year, any vacancy cannot be filled up due to non-availability of a substitute person with benchmark disability or for any other sufficient reasons, such vacancy shall be carried forward in the succeeding engagement cycle/schedule/year. If in the succeeding engagement cycle/schedule/year also suitable person with benchmark disability is not available, it may first be interchanged among the above categories and only when there is no Person with Disability available for the post in that cycle/ schedule/ year, the engagement authority shall fill up the vacancy by engagement of a person, other than a Person with Disability.

4. The undersigned is, therefore, directed by the Competent Authority to request you to circulate the above changes to all concerned.

5. The rest instructions in this office Memorandum of even number dated 26.02.2019 will hold good.

The University Grants Commission (UGC) has been implementing a number of schemes like (i) National Fellowship for Other Backward Classes (OBC) Candidates (ii)  National Fellowship for Higher Education of Schedule Tribe (ST) Students (iii) Rajiv Gandhi National Fellowship for SC Candidates (iv) Post-Doctoral Fellowship for SC/ST Candidates (v) PG Scholarship for Professional Courses for SC/ST Candidates (vi) Fellowships for Women Candidates for the welfare of women, people from weaker sections, differently abled and financially weaker sections for pursuing Higher Education.

The Women Candidates and Persons with Disability (PWD) (more than 40% disability) are allowed a relaxation of one year for M.Phil and two years for Ph.D in maximum duration of these courses; allowing transfer of research data in case of relocation of an M.Phil/Ph.D woman scholar due to marriage or otherwise; and allowing women candidates maternity leave/child-care leave once in the entire duration of M.Phil./Ph.D for up to 240 days. Further, the UGC is implementing post-doctoral fellowship for women candidates (un-employed); Swami Vivekananda single girl child scholarship for research in social sciences  and PG Indira Gandhi Scholarship for single girl child for postgraduate courses to promote the enrolment of women at post- doctoral, doctoral and its feeder levels.

Further, the UGC is providing funds for Remedial Coaching for SC/ST/OBC (Non-Creamy Layer) and Minority Community Students with a view to (i) improve academic skills and linguistic proficiency of the students in various subjects (ii) raise their level of comprehension of basic subjects to provide a stronger foundation for further academic work; and (iii) strengthen their knowledge, skills and attitudes in such subjects, where quantitative and qualitative techniques and laboratory activities are involved so that proper guidance and training provided under the programme may enable the students to come up to the level necessary for pursuing higher studies efficiently.

It has also been informed that these are ongoing schemes in which the institution ensures proper implementation of the scheme and all payments are made by using Direct Benefit Transfer (DBT) into the bank accounts of beneficiaries. These payments are routed through Public Financial Management Scheme (PFMS), a robust system for ensuring transparency in the system.

Further, the Ministry of Human Resource Development has been operating a Central Sector Interest Subsidy Scheme, 2009 which provides full Interest Subsidy for the period of moratorium (course period + 1 year) on educational loans taken by students from economically weaker sections with annual parental income up to Rs.4.5 lakh, from scheduled banks under the Educational Loan Scheme of the Indian Banks’ Association to pursue Technical/Professional courses in India.

This information was given by the Minister of State (HRD), Dr. Satya Pal Singh today in a written reply to a Lok Sabha question.

OFFICE MEMORANDUM

Subject: Special benefit in cases of death and disability in service – Revision of Disability Pension/Family pension of Pre-2006 disability pensioners/ Family Pensioners -regarding.

The undersigned is directed to say that the pension of pensioners/family pensioners who were drawing pension/family pension as on 1.1.2006 under the CCS(EOP) Rules was to be revised in accordance with Department of Pension & Pensioners’ Welfare OM No.38/37/2008-P&P&W(A) dated 1.9.2008. Accordingly, instructions were issued vide this Department OM of even number dated 30th September, 2010 for extension of benefits of modified parity to past pensioners for revision of disability pension/family pension covered under CCS(EOP) Rules.

2. Orders were issued vide this Departments OM No.38/37/2008-P&PW(A) dated 28th January, 2013 for further stepping up of normal pension/family pension to 50%/30% of the sum of minimum pay in the pay band and grade pay corresponding to the pre-revised pay scales from which the pensioner had retired, as arrived at with reference to the fitment table annexed to the Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30th August 2008. It was decided to extend this benefit to pre-2006 disability pensioner/family pensioner covered under the Central Civil Services (Extraordinary Pension) Rules vide this Departments OM of even number dated 20.11.2014.

3. Orders have been issued vide this Departments OM No.38/37/2008-P&PVV(A) dated 30.7.2015 to revise the pension/family pension of all pre-2006 pensioners/family pensioners in accordance with this Departments OM No.38/37/2008-P&PW(A) dated 28.1.2013 with effect from 1.1.2006 instead of 24.09.2012. Accordingly, it has been decided that the benefit of revision of disability pension/extra-ordinary family pension in terms of this Departments OM of even number dated 20.11.2014 would also be applicable w.e.f. 01.01.2006 instead of 24.09.2012.

4. All other terms and conditions in the O.M. dated 3.2.2000, as amended vide O.M. No.45/3/2008-P&PW (F) dated 18.11. 2008, 30.09.2010 and 20.11.2014 shall remain unchanged.

5. This issues with the concurrence of the Ministry of Finance, Department of Expenditure, vide their I.D Note No.1(5)/EV/2012, dated 23.02.2016.

6. All Ministries/Departments are requested to bring the contents of these orders to the notice of controller of Accounts/Pay and Accounts Officers and Attached and subordinate Offices under them on a top priority basis. All Pension disbursing officers are also advised to prominently display these orders on their notice boards for the benefits of disability pensioners/Family pensioners.
