<h2 class="wp-block-heading has-text-align-center"><a href="https://centralgovernmentnews.com/latest-dopt-orders-2023/">Latest DOPT Orders 2023</a></h2>



<p><strong>G.S.R. 517(E).</strong> &#8211; Whereas a draft of certain rules to amend sub-rule (1) of rule 15 of the Rights of Persons with Disabilities Rules, 2017 was published, as required by sub-section (1) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016),vide notification of the Government of India the Ministry of Social Justice and Empowerment, Department of Empowerment of Persons with Disabilities number G.S.R. 335(E), dated the 28th April, 2023 in the Gazette of India, Extraordinary, Part-II, section 3, sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public;</p>



<p>And whereas copies of the said notification were made available to the public on the 28th April, 2023;</p>



<p>And whereas the objections and suggestions received from the public in respect of the said notification have been considered by the Central Government;</p>



<p>Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby makes the following rules further to amend the Rights of Persons with Disabilities Rules, 2017, namely:-</p>



<h3 class="wp-block-heading">(1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2023.</h3>



<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>



<p>2. In the Rights of Persons with Disabilities Rules, 2017, in rule (15), in sub-rule (1), after clause (d), the following clause shall be inserted, namely:-</p>



<p>“(e) guidelines on accessible sports complex and residential facilities for sports persons with disabilities, notified by the Government of India in the Ministry of Youth Affairs and Sports (Department of Sports), vide notification number 7-6/MYAS/ MDSD/ 2021 dated 13th October, 2022, as amended from time to time:”</p>

<h3 class="wp-block-heading">Sub: Grant of provisional benefits on death/disability of Railway servants covered under National Pension System (NPS) &#8211; reg.</h3>



<p>Attention is invited to Board’s letter of even number dated 20.01.2020 vide which clarification was issued providing that Railway servant/ family member in the case of death of Railway servant or his discharge from service on account of invalidation/disability is entitled to pension/ family under old pension scheme under <a href="https://centralgovernmentnews.com/indian-railways-latest-news-today/" target="_blank" rel="noreferrer noopener">Railway</a> Services (Pension)/ Rules 1993 if the Railway servant/ family wants to. Also, the entire accumulated pension funds under NPS may be recovered from him/family with interest for the period from the date of receipt of entire accumulated pension wealth to a subscriber under NPS to the date of refund to the Government at the rate and manner applicable to GPF deposits from time to time.</p>



<p>2. Now, references have been received in this office stating that some of the department family members of the deceased employees under NPS are not in a position to surrender the entire accumulated NPS corpus in one go. it has been requested that the dependent family members of the deceased Railway employees may be given option to return the accumulated NPS corpus of the employee in installments and from the arrears of the family pension instead of depositing the entire accumulated NPS corpus with interest.</p>



<p>3. The above issue have been examined in consultation with Department of pension &amp; Pensioners’ Welfare (DOP&amp;PW) the nodal Department of the Government in pensionary matters. It is clarified that in case, the Railway servant or family has already availed benefits from accumulated pension corpus, the same may be recovered from them with interest. The accumulated pension corpus along with interest may be adjusted from the arrears of pension/family pension or any other method while ensuing at the same time that there is no loss to the Railways.</p>

<p><strong>No. 38-16/2020-DD-III.</strong>&#8211; Whereas Section 33 of the repealed Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (hereinafter, after referred to as repealed Act) provided for reservation of not less than 3% for persons with disabilities in the three categories namely, (i) locomotor disability including cerebral palsy, (ii) visual impairment (low vision &amp; blindness) and (iii) hearing impairment.</p>



<p>2. And whereas, section 32 of the repealed Act mandated the appropriate Government to identify posts to be reserved for persons with disabilities and review such list at periodic interval not exceeding three years.</p>



<p>3. And whereas, in pursuance of the above provisions of the repealed Act, the Central Government last notified the list of posts suitable for persons with disabilities through notification No. 16-15/2010-DD-III dated 29th July, 2013.</p>



<p>4. And whereas, the Ministry of Social Justice and Empowerment, Government of India, in pursuance of the provisions of sections 32 and 33 of the repealed Act (since repealed on 15.06.2017) had constituted an Expert Committee on the 19th November, 2015 under the chairpersonship of the Secretary, Department of Empowerment of Persons with Disabilities to review the list of Central Government posts identified suitable for Persons with Disabilities. Copy of the said order is at Annexure-A.</p>



<p>5. And whereas, the Expert Committee met on the 9th December, 2015 and decided that one Sub-Committee should be constituted for each of the category of disabilities which are provided reservation under section 33 of the said repealed Act and accordingly, following three Sub-Committees were constituted, namely:</p>



<p><strong>i. Sub-Committee for locomotor disability<br />ii. Sub-Committee for hearing impaired<br />iii. Sub-Committee for visually impaired</strong></p>



<p>6. And whereas, the Central Government notified the Rights of Persons with Disabilities Act, 2016 (hereinafter referred as “the Act”) which inter-alia under sub-section (1) of section 34 extended the benefit of reservation to persons with benchmark disabilities in th new category of (i) autism, specific learning disability, mental illness and intellectual disabilities and (ii) multiple disabilities amongst the various categories mentioned in the said section of the Act.</p>



<p>7. And whereas, Section 33 of the said Act mandates the appropriate Government to constitute expert committee for identification of posts suitable for persons with benchmark disabilities and accordingly, following two sub-committees were further constituted to take care of identification of posts suitable for new categories included under the Act, namely; (i) Sub-Committee for autism, intellectual disabilities, specific learning disability and mental illness, and (ii) Sub-Committee for multiple disabilities.</p>



<p>8. And whereas, all the Sub-Committees reviewed the posts notified through notification No.16-15/2010-DD-III dated the 29th July 2013, and submitted their reports and the Expert Committee considered the reports of the Sub-Committees in its meeting held on 19th November 2019, finalized its recommendations and submitted its report to the Central Government for consideration.</p>



<p>9. Now, therefore, in exercise of powers conferred upon section 33 of the said Act and based on the recommendations of the Expert Committee, the Central Government hereby notifies the gist of the report, which is at Annexure-B and the list of Central Government posts in Group A, B, C and D identified suitable for persons with benchmark disabilities which is at Annexure-C for information and further necessary action by all cadre controlling authorities in the Central Government.</p>



<p>10. The said list supersedes the list of posts for Groups ‘A’, ‘B’, ‘C’ and ‘D’ notified through notification No. 16-15/2010-DD-III dated 29th July, 2013.</p>



<p><strong><a href="https://centralgovernmentnews.com/list-of-posts-identified-suitable-for-persons-with-benchmark-disabilities-pib/" target="_blank" rel="noreferrer noopener">List of Posts Identified Suitable for Persons with Benchmark Disabilities – PIB</a></strong></p>



<p>Note 1: Persons with benchmark disabilities require aids and assistive devices to overcome their difficulties. The aids and assistive devices may be provided to persons with benchmark disabilities on their appointment keeping in view their requirement as per the instructions of DoPT issued from time to time.</p>



<p>Note 2: The list of posts being notified is only indicative and not an exhaustive list. If a post is not mentioned in the list, it is not to be construed that it has been exempted. Central Ministries, Departments, Autonomous Bodies, Public Sector Undertakings may further supplement the list by adding to the list of posts identified for respective category of disability.</p>



<p>Note 3: If a post is already held by a person with benchmark disability, it shall be deemed to have been identified for that category of benchmark disability.</p>



<p>Note 4: If a post is identified in the feeder grade, all the posts in the promotional grade should also stand identified.</p>



<p>Note 5: If a post having identical nature and place of job with respect to any identified post, the post should be construed to be identified even if the post has a different nomenclature and/or is placed in a different group.</p>



<p>Note 6: This list will be the principal list in respect of the posts identified suitable for persons with benchmark disabilities. However, in case a list of post is separately identified by any Central Government establishment, the list having wider range of identified categories (i.e. having more sub-categories under each category) would prevail.</p>



<p>Note 7: In case a post is identified suitable for more than one sub-category under a broad category, individual Central Ministries or Departments or Public Sector Undertakings or Autonomous Bodies should conduct recruitment for all the sub-categories and cannot suo-moto choose one particular sub-category for appointment.</p>



<p>Note 8: It is for the Central Ministries or Departments or Public Sector Undertakings or Autonomous Bodies to verify the authenticity of the certificate of disability and examine suitability of the candidate in terms of functional requirements before appointment against any identified post.</p>



<p>Note 9: In the event of discrepancies in the English and Hindi versions of this Notification, English version shall prevail over the Hindi version.</p>

<h3 class="wp-block-heading">Government Notifies the List of Posts Identified Suitable for Persons with Benchmark Disabilities</h3>



<p>The Department of Empowerment of Persons with Disabilities on 4th January 2021 notified 3566 posts in Central Government establishments as suitable for persons with benchmark disabilities (disability of 40% and above) under the Rights of Persons with Disabilities Act, 2016.</p>



<p>These posts include 1046 in Group A, 515 in Group B, 1724 in Group C, and 281 in Group D posts. Posts have also been identified suitable for new categories of persons with disabilities such as dwarfism, acid attack victims, muscular dystrophy, autism spectrum disorder, intellectual disability, specific learning disability, mental illness, and multiple disabilities have been added. This list is not an exhaustive one and Central Ministries/ Department/ Autonomous Bodies and Public Sector Undertakings may further supplement. This notification will broaden the scope for employment for persons with benchmark disabilities in Government establishments.</p>



<p>A list of 2973 posts identified suitable for persons with benchmark disabilities was last notified on 29.07.2013 in terms of the repealed Persons with Disabilities (Equal Opportunity, Protection of Rights and Full Participation) Act, 1995. As compared to the earlier notified list, 593 new posts have been added.</p>

<p>The list of posts notified by the Central Government on 04.01.2021 is based on the recommendations of an expert committee constituted under the chairpersonship of the Secretary, Department of Empowerment of Persons with Disabilities and consisting experts, persons with benchmark disabilities, and representatives from various associations of persons with disabilities.</p>

<p><strong>Railway Concessions, Reservation Quota and Other FACILITIES EXTENDED TO PERSONS WITH DISABILITY</strong></p>



<p><strong><em>Facilities extended for the persons with disability by Ministry of Railways include:-</em></strong></p>



<h2 class="wp-block-heading">(A) Concessions:</h2>



<p><strong><em>Concessions in Rail fare have been extended to persons with disability, which are as under:</em></strong></p>



<p style="text-align:center"><strong>CONCESSION FOR PERSONS WITH DISABILITY</strong></p>



<p><strong>Category of persons with disability</strong></p>



<p>1. Orthopedically handicapped/Paraplegic persons who cannot travel without escort &#8211; for any purpose. However, can book ticket with or without escort.  </p>



<p>2. Mentally retarded persons who cannot travel without escort- for any purpose. However, can book ticket with or without escort.</p>



<p>3. Blind persons travelling alone or with an escort &#8211; for any purpose</p>



<p><strong>Percentage of concession </strong></p>



<ul class="wp-block-list"><li>75% in 2nd, SL; 1st Class, 3AC, AC chair car </li><li>50% in 1AC and 2AC, </li><li>25% in 3AC &amp; AC chair Car of Rajdhani/ Shatabdi trains</li><li>50% in MST &amp; QST </li><li>One  escort  is  also  eligible  for same element of concession</li></ul>



<p>4. Deaf &amp; Dumb persons (both afflictions together in the same person) travelling alone or with an escort &#8211; for any purpose.</p>



<p><strong>Percentage of concession</strong></p>



<ul class="wp-block-list"><li>50% in 2nd, SL and 1st Class </li><li>50% in MST &amp; QST </li><li>One  escort  is  also  eligible  for same element of concession.</li></ul>



<p>The procedure for availing concession is (a) Concession tickets are issued directly from Stations on production of copy of prescribed certificate from Govt. Doctor, (b) For Blind persons, certificates issued by RMPs and certain Institutions working of Blind persons (listed in Coaching Tariff) also are accepted. Concessions granted directly at stations on production of . a photocopy of the certificate. The Original certificate will have to be produced for inspection at the time of purchase of concessional ticket and during journey, if demanded. E-ticket are also issued on the basis of Unique ID issued by Indian railways to eligible persons with disability for concession in fare.</p>



<p>Concession is admissible in the basic fares of Mail/ Express/ Rajdhani/ Shatabdi group of trains all other charges like reservation fee, supplementary charges etc. are to be paid in full. .</p>



<p>With a view to facilitate persons with disability to avail concessional tickets online, concessional tickets booking facility including online concessional ticket booking facility for the persons with disability using Photo identity card issue by the Railways has been introduced.</p>



<h2 class="wp-block-heading">(B) Quota in Reservation:</h2>



<p>(i) A reservation quota of four sleeper class berths &amp; 2 berths in 3AC class has been earmarked in all trains running on non-suburban sections for persons with disability performing their journey on handicapped concessional ticket. The persons accompanying the persons with disability as escort is also allotted the berth out of this quota.</p>



<p>(ii) Instructions have also been issued that in the tickets issued through Computerized Passenger Reservation System, to extent feasible, one lower berth should be allotted to the person with disability and the person accompanying the persons with disability as. escort should be allotted middle/upper berths near the persons with disability subject to availability of accommodation.</p>



<p>(iii) After departure of the train, i&#8217;f there are vacant lower berths available in the train and if any person with disability booked on the authority of handicapped concessional ticket, who has been allotted upper/middle berth, approaches for allotment of vacant lower berths, the Conductor/Train Ticket Examiner (TTE) has been authorized to allot the vacant lower berth to them making necessary entries in the Chart.</p>



<h2 class="wp-block-heading">(C) Other facilities:</h2>



<p>(i) Specially designed coaches known as SLRD coaches with wider entrance doors to allow a wheel chair to enter, wider aisles and modified toilet with 4 berths, the lower two for persons with disability and upper berths for attendants have been attached in almost all Mail/Express trains except Rajdhani, Shatabdi, Jan Shatabdi Express Trains and Duronto Express Trains.</p>



<p>(ii) Instructions have been issued that in all Mail/Express Trains, the SLRD coaches should treated as unreserved coaches earmarked for exclusive use of persons with disability. In case of Garib Rath Express Trains which are fully reserved trains, these coaches are treated as reserved for booking by persons with disability travelling on the prescribed certificate on payment of full fare of 3 AC class of Garib Rath Express on first come first served basis.</p>



<p>(iii) Separate counters are earmarked to various Passenger Reservation System (PRS) centres for dealing with the reservation i,requisitions received from persons with disability, Senior Citizens, Ex. MPs, MLAs, accredited journalists and freedom fighters, if the average demand per shift not less than 120 tickets. In case there is no justification for earmarking of an exclusive counter for any of these categories of persons including persons with disability or senior citizens, one or two counters depending upon the total demand are earmarked for dealing with the reservation requests for all these categories of persons.</p>



<p>(iv) Zonal Railways have been authorised to introduce Battery Operated Vehicles (BOVs) at major Railway Stations for persons with disability, elderly and ailing passengers on &#8216;first come first served&#8217; basis through sponsorship from individuals, NGOs, Trusts, Charitable institutions, Corporates and PSUs/Corporate Houses under their Corporate Social Responsibility with no charge to passenger or to the Railway. 80 BOVs have already been provided at 54 major railway stations. Further, instructions have also been issued to Zonal Railways to invite Expression of interest for providing the facility of Battery&#8221; operated Car service on payment basis initially at all Al category stations keeping in view the financial sustainability of the service. This facility can be availed by passengers on &#8216;first come first served&#8217; basis, however, preference shall be given to Sr. Citizens, persons with disability, pregnant women and medically sick passengers.</p>



<p>(v) Persons with disability friendly toilets, water fountains, ticket counters and earmarked parking facility is provided at all A-1, A and B category of stations.</p>



<p>(vi) In allotment of STD/PCO booths at Railway Stations, 25% booths have been reserved for persons with disability (including blind) with disability of 40% and above.</p>



<p>(vii) Zonal railways have also been instructed to provide one wheel chair per platform and in case of island platforms one wheel chair per two platforms at all A-1 and A category stations.</p>



<p>Yatri Mitra Sewa has a!So been introduced at major railway stations for enabling passengers to book wheel chairs services cum porter services free of cost through NGOs, Charitable trust, PSUs etc. under CSR and responsibility of providing this facility has been entrusted with IRCTC. In case of lack of response from NGOs, Charitable trust, PSUs etc. this setvice may be arranged on payment basis through a service provider or on its own.</p>



<p><strong>Short term facilities as detailed below have been planned at all stations:</strong></p>



<ul class="wp-block-list"><li>Standard ramp for barrier free entry. </li><li>Earmarking at least two parking lots. </li><li>Non-slippery walk-way from parking lot to building. </li><li>Signages of appropriate visibility. At least one toilet (on the ground floor). </li><li>At least one drinking water tap suitable for use by persons with disability. &#8216;May I help you&#8217; Booth.</li></ul>



<p><strong>In addition, long term facilities as detailed below have been planned at &#8216;A-1&#8217;, &#8216;A&#8217; &amp; &#8216;B&#8217; category stations:</strong></p>



<ul class="wp-block-list"><li>Provision of facility for inter-platform transfer. </li><li>Engraving on edges of platform.</li></ul>

<p>Clarification has been sought by certain Railways regarding applicability of reservation for  PwBD and Economically Weaker Sections (EWS) employees&#8217; under the scheme of General Departmental Competitive Examination (GDCE).</p>

<p>The government provides three percent reservation in jobs for PWDs. Apart from this reservation at the entry stage, DoPT has issued instructions regarding identification of jobs, post-recruitment and pre-promotion training, providing aids/assistive devices, accessibility and barrier free environment at work place, preference in government accommodation, grievance redressal, and preference in transfer/posting for PWDs. In a recent notification, a provision has been made for ten years’ (fifteen years in case of SC/ST and thirteen years in case of OBC candidates) relaxation in the upper age limit for direct recruitment to civil posts/services under the Central Government.</p>
<p><b>Moreover, there are certain special entitlements as given below:</b></p>
<blockquote class="tr_bq"><p>i. Special Allowance for Child Care for Women with Disabilities at the rate of Rs.1,500 pm;</p>
<p>ii. Transport Allowance at double the normal rate, subject to a minimum of Rs.1,000 pm;</p>
<p>iii. Constant Attendance Allowance for retired employees with 100 percent disablement at the rate of Rs. 4,500 per month;</p>
<p>iv. Special Casual Leave for four days in a calendar year for specific requirements relating to disabilities;</p>
<p>v. Special Casual Leave for ten days in a calendar year for participation in Conferences/Seminars/Trainings/Workshops related to disability and development.</p></blockquote>
<p><b>In case the disability is work related, the following additional provisions are available:</b></p>
<blockquote class="tr_bq"><p>a. Special Disability Leave;</p>
<p>b. Disability Pension;</p>
<p>c. Educational Concession to children of Defence personnel who are disabled in action.</p></blockquote>
<p>For employees with differently abled children, Children Education Allowance and Hostel Subsidy is granted at double rate.</p>
<p><b>Demands</b></p>
<p><i>Associations of employees with disabilities made the following demands before the Commission:</i></p>
<blockquote class="tr_bq"><p>i. Suitable enhancement in the existing provisions</p>
<p>ii. Provision of Common Room in offices with suitable recreational facilities</p>
<p>iii. Additional rebate in House Building Advance and Automobile Advance</p>
<p>iv. Establishment of Welfare Committees in the ministries</p></blockquote>
<p><b>Analysis and Recommendations</b></p>
<p>The National Policy for Persons with Disabilities, 2006, enunciates the measures that need to be taken by the government to ensure equal opportunities, protection of justifys and full participation in society for PWDs, in consonance with the principles enshrined in the Indian Constitution. India is also a signatory to the UN Convention on the justifys for Persons with Disabilities. Thus, provision of appropriate measures for employees with disabilities is the responsibility of the Union Government.</p>
<p>The Commission has made various recommendations regarding PWDs at different places in the report. They are consolidated here for ready reference:</p>
<blockquote class="tr_bq"><p>i. In recognition of the singular responsibility faced by differently abled women in raising their children, the Special Allowance for Child Care for Women with Disabilities has been enhanced from the present rate of Rs.1,500 pm to Rs.3,000 pm</p>
<p>ii. Transport Allowance at double the normal rate has been retained, and the minimum amount has been increased from Rs.1,000 pm to Rs.2,250 pm</p>
<p>iii. Children Education Allowance and Hostel Subsidy have been kept at double rate for differently abled children</p>
<p>iv. Constant Attendance Allowance has been enhanced from Rs.4,500 pm to Rs.6,750 pm</p>
<p>v. Special Disability Leave has been subsumed in Work Related Illness and Injury Leave (WRIIL), with improved provisions</p>
<p>vi. Educational Concession, hitherto available only to the children of Defence personnel killed/missing/disabled in action, has been extended to similarly placed personnel of CAPFs, Indian Coast Guard, RPF and police forces of Union Territories mutatis mutandis.</p></blockquote>
<p><i><b>Besides the above recommendations, there are a few suggestions that can go a long way in improving the working environment for these employees :</b></i></p>
<blockquote class="tr_bq"><p>i. In our interactions, it has been highlighted that easy access, particularly to toilets, remains an issue of concern. Hence, it is suggested that Guidelines and Space Standard for Barrier Free Built Environment for Disabled and Elderly Persons, issued by CPWD, Ministry of Urban Affairs and Employment, should invariably be followed while designing new government premises. Their application in the existing offices may also be explored.</p>
<p>ii. Every ministry should have a Welfare Committee, with due representation of differently abled employees, to address their concerns.</p>
<p>iii. The grievance redressal machinery should be strengthened and made more effective</p></blockquote>

<p><b> Introduction</b></p>
<p><b> </b>9.6.1 As per the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, a “person with disability” means a person suffering from not less than 40 percent of any disability as certified by a medical authority. “Disability” as defined in Section 2(i) of the Act means– (i) blindness (ii) low vision (iii) leprosy cured (iv) hearing impairment (v) locomotor disability (vi) mental retardation (vii) mental illness.</p>

<div>As the Railways are aware, three percent of the vacancies in direct recruitment to non-Gazetted posts are to be reserved for persons with disabilities of which one percent each shall be reserved for persons suffering from (i) blindness or low vision, (ii) hearing impairment and (iii) locomotor disability or cerebral palsy in the posts identified suitable for each disability.  Further, in terms of Board’s instructions as contained in letter No. E(NG)-Il/98/RC-2/8 dated 17/9/1998, in addition to the Employment Notices being supplied to the Employment Exchanges, Special Employment Exchanges, Vocational Rehabilitation Centres &amp; National level Rehabilitation institutes, such notices are also to be published in Employment News. It has now been decided that recruiting agencies whether RRBs/RRCs/ Railway Administrations shall also get the Employment Notices/Advertisements uploaded on the websites of the Department of Empowerment of Persons with Disabilities, Department of Personnel and Training, Office of the Chief Commissioner for Persons with Disabilities and any other Ministry/Department as deemed necessary through NIC or other means for information of all concerned. This will be in addition to, hoisting the same on the websites of the recruiting agencies concerned.</div>
