<p><strong>Year End review: Ministry of Personnel, Public Grievances and Pensions</strong></p>
<p><strong><em>Following are the highlights of the activities of Ministry of Personnel, Public Grievances and Pensions during the year 2016:</em></strong></p>
<p>Prime Minister confers awards for excellence in implementation of priority programmes on 10th Civil Services Day, 21st April, 2016. For the priority programme Pradhan Mantri Jan Dhan Yojana (PMJSY), Nagaon, Assam was awarded in North East and Hill States category, Chandigarh in UTs and North 24 Parganas, West Bengal in Other States group. Under Swachh Bharat Mission (Gramin), West Sikkim and Bikaner, Rajasthan were awarded in North East &amp; Hill states and Other States category respectively. Under Swachh Vidyalaya programme, Anantnag, Jammu and Kashmir, Dadra and Nagar Haveli and Ananthapuramu, Andhra Pradesh were awarded in North East &amp; Hill states, UTs and Other States group respectively. In the implementation of Soil Health Card Scheme, Hamirpur, Himachal Pradesh and Balrampur, Chhattisgarh were conferred award in North East and Hill states and Other States respectively.</p>
<p><strong>Prime Minister addresses IAS Officers of the 2014 batch, August 02, 2016.</strong> The Prime Minister, Shri Narendra Modi addressed the 2014 batch of IAS officers posted as Assistant Secretaries in the Government of India. He advised the young IAS officers to remain sensitive to their circumstances and surroundings, in order to be able to effectively connect with the people of India. The Prime Minister Shri Narendra Modi chaired the Valedictory Session of Assistant Secretaries on October 27, 2016. Eight selected presentations on various themes of governance were made by the officers, on themes such as DBT, Swachh Bharat, e-Courts, Tourism, Health and Satellite Applications in Governance.</p>
<p><strong>Launching of six major initiatives of DoPT</strong>. On the occasion of ‘Good Governance Day’, coinciding with the birthday of former Prime Minister Shri Atal Bihari Vajpayee on December 25, 2016, Dr. Jitendra Singh launched six major initiatives of the DoPT. The initiatives are: <strong>Recruitment Rules Formation, Amendment Monitoring System (RRFAMS), Immovable Property Return through Property Related Information System (PRISM), announcement of E-Service Book, Mandatory online filing of APAR by all AIS and Central Group ‘A’ Service Officers, EO App on iPhone Operating System (iOS) and launching of redesigned website of DoPT.</strong></p>
<p><strong>Employees Online (EO) Mobile App of DoPT.</strong> Earlier, on October 28, 2016, MoS Dr.Jitendra Singh launched the Employees Online (EO) App. EO App is a mobile application of the Department of Personnel &amp; Training (DoPT), Ministry of Personnel, Public Grievances and Pensions. The application would enable its users, which may include officers, media persons and all stakeholders to stay updated on real time basis with appointments and postings approved by the Appointments Committee of the Cabinet (ACC) and vacancies at senior level in the Government of India.</p>
<p><strong>MoS Dr Jitendra Singh launches the telephonic feedback system for grievance redressal</strong>. Setting a precedence, the MoS (PP) Dr Jitendra Singh initiated a telephone feedback mechanism for grievance redressal of the citizens on March 22, 2016. He personally calls some complainants chosen on random basis weekly, who had registered their grievances in the Department of Administrative Reforms and Public Grievances (DARPG) and their grievances were disposed off. The Minister and senior officers of the DARPG also seek their feedback regarding the response given by the Government to the grievances. Dr Jitendra Singh also awarded Certificates of Appreciation to the Ministries/Departments for their performance in CPGRAMS during the year.</p>
<p><strong>Seeding of Aadhaar numbers in Pensioners&#8217; Accounts.</strong> MoS Dr Jitendra Singh directed that priority should be given to pensioners visiting the bank branches for seeding Aadhaar number in their bank account. Special AADHAAR Seeding Camps were held from May 30, 2016 to June 10, 2016. These camps were organised all over the country in Pension disbursing banks and their branches. Eighty-seven percent of Central Government pensioners of all age categories have seeded their bank accounts with Aadhaar number.</p>
<p><strong>Discontinuation of Interview at Lower Level Posts</strong>. The Central Government has decided to dispense with the interview for all Group C (including Group D) and non-gazetted Group B category in Central Government by 31.12.2015. Accordingly, instructions have been issued to the Staff Selection Commission mandated with the recruitment of mainly Group B (Non-Gazetted) and Group C (Non-technical) posts in the Central Ministries/Departments to discontinue the interview in all mandated recruitments commencing from 1.1.2016.</p>
<p>The Government decided that the issue of appointment letters need not be withheld pending the verification of character and antecedents of the successful candidates. The appointing authorities will issue provisional appointment letters after obtaining the attestation form and self declaration from the candidate.</p>
<p><strong>Procedural requirements for Leave Travel Concession simplified</strong>. The Department of Personnel and Training has eased the difficulties faced by the Government employees in application and settlement of the Leave Travel Concession (LTC) claims. A copy of guidelines, that needs to be followed while availing LTC, is to be provided for the Government servant while applying for LTC.<br />
<strong>19th National Conference on e-governance in Nagpur.</strong> The Union Minister for Road Transport &amp; Highways and Shipping, Shri Nitin Gadkari and the Minister of State for Development of North Eastern Region (I/C), Prime Minister’s Office, Personnel, Public Grievances &amp; Pensions, Department of Atomic Energy, Department of Space, Dr. Jitendra Singh inaugurated the 19th National conference on e-governance in Nagpur on January 21, 2016. The Chief Minister of Maharashtra, Shri Devendra Fadnavis presented the National Awards for e-Governance for the Year 2015-16 in Nagpur on January 22, 2016. The awards were given for exemplary implementation of e-Governance initiatives.</p>
<p><strong>Workshops on pre-retirement counselling on &#8216;Sankalp&#8217; and &#8216;Anubhav&#8217;</strong>. The Department of Pensions and Pensioners&#8217; Welfare, Ministry of Personnel, Public Grievances &amp; Pensions organized workshops on issues related to Pre-Retirement counselling on &#8216;Sankalp&#8217; and &#8216;Anubhav&#8217; during the year. Workshops are organized wherein the retiring employees are counselled on issues regarding steps and precaution to ensure timely payment of their retirement dues, the CGHS/medical facilities available after retirement and other related issues, most important being encouragement to employees to involve themselves in the social activities by using the time and skill available with them.</p>
<p><strong>National Symposium on Excellence in Training focuses on Citizen Centric Governance.</strong> Dr. P. K. Mishra, Additional Principal Secretary to the Prime Minister inaugurated the 2nd National Symposium on Excellence in Training (NSET) on May 27, 2016. The Symposium was attended by more than 375 delegates that included Heads of State ATIs/ Central Training Institutes (CTIs) and the Faculty, Trainers and experts from Government and Private Institutions. Over-arching theme of the Symposium was Citizen Centric Governance and changing the mindset of Civil Servants to service orientation.</p>
<p>Two-day Regional Conference on ‘Path Breaking and High Impact Initiatives in Citizen Centric Services Delivery System’ in Guwahati, Assam (15-16 September, 2016). The conference is being organised by the Department of Administrative Reforms &amp; Public Grievances (DARPG), Ministry of Personnel, Public Grievances &amp; Pensions, Government of India in collaboration with the Government of Assam. Delegates from 8 states of North Eastern Region and 4 states of Eastern Region i.e. West Bengal, Bihar, Odisha and Jharkhand and senior officers of DARPG participated in the conference.</p>
<p>Workshop on e-Office organised by DARPG (September 08, 2016). The workshop was organised in the light of the fact that the e-Office is an important tool of e-Governance for bringing efficiency and quality in public service delivery and the DARPG is the nodal Department for implementation of e-Office in Central Ministries/Departments.</p>
<p>Two-day Regional Conference on ‘Innovations in Citizen Centric Services Delivery&#8217; in Jaipur (December 21-22, 2016). The Department of Administrative Reforms &amp; Public Grievances (DARPG), Ministry of Personnel, Public Grievances &amp; Pensions, Government of India is organising a 2-day Regional Conference on ‘Innovations in Citizen Centric Services Delivery&#8217; in Jaipur, in collaboration with Government of Rajasthan. he Conference at Jaipur is an effort to create a common platform to share experiences in the formulation and implementation of best practises in citizen centric governance, improved public service delivery through e-Governance, transparent, accountable and citizen-friendly effective administration.</p>
<p>Vigilance Awareness Week observed. The Central Vigilance Commission, as part of its efforts to promote probity in public life and to achieve a corruption free society, observes Vigilance Awareness Week every year. The week in which 31st October, the birthday of late Sardar Vallabhbhai Patel falls is observed as Vigilance Awareness Week. “Public participation in promoting integrity and eradicating Corruption” was chosen as the theme for Vigilance Awareness Week this year by the Commission. The Prime Minister Shri Narendra Modi attended the Valedictory Function of Vigilance Awareness Week 2016 on November 07, 2016. Speaking on the occasion, he said that technology has a major role to play in bringing in transparency, and curbing corruption. The National Seminar on the occasion of the Vigilance Awareness Week-2016 was also held.</p>
<p>Annual Convention of the Central Information Commission (CIC). Two-day Annual Convention of the Central Information Commission (CIC) was organised on November 07-08, 2016. The Conference was inaugurated by the Union Home Minister Shri Rajnath Singh. The Annual Convention has contributed immensely in generating awareness about innovative use of RTI provisions for the benefit of the citizenry thereby strengthening public trust in democracy.</p>
<p>Secretary, DARPG attends the Meeting of General Members of CAPAM at Malaysia (22nd August, 2016). An Indian delegation led by the Secretary, DARPG Shri C Viswanath visited Malaysia from August 17-20, 2016 to attend the Meeting of General Members of Commonwealth Association for Public Administration &amp; Management (CAPAM) &amp; CAPAM Biennial Conference at Putrajaya. Shri C. Viswanath was elected on Board of Directors of CAPAM. DARPG is an institutional member of Commonwealth Association for Public Administration and Management (CAPAM) since 1997. CAPAM is an international network of senior public servants, Heads of Governments, academics and researchers from over 50 Commonwealth countries.</p>
<p>Swachhta Pakhwada organised by DoPT. The Department of Personnel and Training (DoPT), Ministry of Personnel, Public Grievances and Pensions organised the Swachhta Pakhwada from December 01 to December 15, 2016. During the Swachhta Pakhwada, various activities were undertaken as a massive cleanliness drive by DoPT. A Poster(s)/Slogan Competition was also organised on the theme of Swachha Bharat during Swachha Bharat Pakhwada.</p>

<p>Subject:- <strong>Recruitment of Staff through Employment Exchanges, regarding</strong>.</p>
<p>In continuation of this Department’s Office Memorandum No. 14024/2/96-Estt. (D) dated 18th May, 1998 and further amended vide OM of even number dated 09th November, 2005 on the above noted subject wherein it has been prescribed that all vacancies to be filled on regular basis, except those which fall within the purview of UPSC/Staff Selection Commission, are to be notified in the local Employment Exchange/Central Employment Exchange as per the provisions of the Employment Exchange (Compulsory Notification of Vacancies) Act, 1959. In addition to the reporting of the vacancies to the local Employment Exchange/Central Employment Exchange, it has been stipulated that the vacancies should be given wide publicity on an all India basis. In this regard, it was advised that the advertisement should be placed in the Employment News/Rozgar Samachar published by the Publication division of Ministry of Information &amp; Broadcasting. Such recruitment notices are also to be displayed on the Office Notice Board.</p>
<p>2. It has been decided that in addition to the above procedure, advertisement of vacancies may also be placed at the National Career Service (NCS) Portal of Ministry of Labour &amp; Employment, which has been developed primarily to connect the opportunities with the aspiration of youth.</p>
<p>3. These instructions shall be applicable to all services/posts. All Ministries/Departments are requested to bring these instructions to the notice of all concerned including attached and subordinate offices.</p>

<p>(2) Shri Venkata Rama Sastry Pidaparthi, IPS (UP:1989) as Joint Secretary, Department of Consumer Affairs from the date of assumption of the charge of the post for a period of overall seven year central deputation upto 19.03.2019 or until further orders, whichever is earlier, vice Shri Manoj Kumar Parida, IAS (UT:1986);</p>
<p>(3) Shri Rajiv Bansal, IAS (NL:1988) as Joint Secretary, Department of Electronics &amp; Information Technology from the date of assumption of the charge of the post for a period of five years or until further orders, whichever is earlier, against a newly created post;</p>
<p>(4) Shri Amit Yadav, IAS (UT:1991) as Joint Secretary, Department of Telecommunications from the date of assumption of the charge of the post for a period of five years or until further orders, whichever is earlier, vice Shri V. Umashankar, lAS (HY:1993);</p>
<p>(5) Shri B Anand, IAS (TN:1987) as Joint Secretary, Ministry of Urban Development from the date of assumption of the charge of the post for a period of five years or until further orders, whichever is earlier, by temporary upgradation of a newly created post of DSIDirector to JS level for two years in the Ministry of Urban Development;</p>

<p>Subject: <strong>Representation from Government servant on service matters &#8211; reiteration of instructions &#8211; regarding.</strong></p>
<p>The undersigned is directed to refer to O.M. of even number dated 6th June, 2013 wherein instructions have been issued on submission of representation by Government servants about their service matters. In spite of these instructions, it has been observed that Government servants including officers/ officials of para military forces and Army personnel continue to represent directly to the Prime Minister, Minister, Secretary (P) and other higher authorities, directly.</p>
<p>2. As per the existing instructions, wherever, in any matter connected with his service rights or conditions, a Government servant wishes to press a claim or to seek redressal of a grievance, the proper course for him is to address his immediate official superior, or Head<br />
of his office, or such other authority at the appropriate level who is competent to deal with the matter in the organisation.</p>
<p>3. Such submission of representations directly to other authorities by- passing the prescribed channel of communication, has to be viewed seriously and appropriate disciplinary action should be taken against those who violate these instructions. This can rightly be treated as an unbecoming conduct attracting the provisions of Rule 3 (1) (iii) of the Central Chill Services (Conduct) Rules, 1964. It is clarified that this would include all forms of communication including through e-mails or public grievances portal etc.</p>
<p>4. Attention in this connection is also invited to the provision of Rule 20 of CCS (Conduct) Rules, 1964 prohibiting Government servants from bringing outside influence in respect of matter pertaining to his service matter. Representation by relatives of Government servant is also treated as outside influence as clarified vide MHA OM No. F. 25/21/63-Estt.(A) dated 19.09.1963</p>
<p>5. It is reiterated that these instructions may be brought to the notice of all Govt servants including officers/ officials of para military forces and member of armed forces and action taken against those who violate these instructions.</p>

<p>Subject: <strong>Travel by Premium Trains on LTC- Clarification reg.</strong></p>
<p>The undersigned is directed to say that several references are received by this Department from various Ministry / Departments seeking clarification regarding admissibility of travel by Premium Trains run by Indian Railways while availing of LTC.</p>
<p>2. The matter has been examined in consultation with Department of Expenditure, Ministry of Finance and it has been decided that travel by Premium Trains is not permissible on LTC. Hence, the fare charged by the Indian Railways for the journey(s) performed by Premium trains shall not be reimbursable for the purpose of LTC. Cases where LTC travel in such Premium Trains has already been undertaken by the Central Government Employees, the train fare may be reimbursed restricting it to the admissible normal fare for the entitled class of train travel or the actual fare paid, whichever is less.</p>

<p>DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.</p>

<p>Subject: – <strong>Inclusion of eligible officers who are due to retire before the likely date of vacancies, in the panel for promotion-Regarding</strong></p>
<p>The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 regarding consideration of retired employees who were within the zone of consideration in the relevant year(s) but are not actually in service when the DPC is being held. The said OM provides as follows:-</p>
<p>“…….There is no specific bar in the aforesaid Office Memorandum dated April 10, 1989 or any other related instructions of the Department of Personnel and Training for consideration of retired employees, while preparing year-wise panel(s), who were within the zone of consideration in the relevant year(s). According to legal opinion also it would not be in order if eligible employees, who were within the zone of consideration for the relevant year(s) but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration/panel and, consequently, their juniors are considered (in their places), who would not have been in the zone of consideration if the DPC(s) had been held in time. This is considered imperative to identify the correct zone of consideration for relevant Year(s). Names of the retired officials may also be included in the panel(s). Such retired officials would, however, have no justify for actual promotion. The DPC(s) may, if need be, prepare extended panel(s) following the principles prescribed in the Department of Personnel and  Training Office Memorandum No.22011/8/87-Estt.(D) dated April 9, 1996.”</p>
<p>Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.</p>
<p>3. All the Ministries/Departments are therefore advised to ensure strict compliance of the instructions of the Department of Personnel &amp; Training issued vide this Department’s OM No. 22011/4/98-Estt(D) dated October 12, 1998.</p>
<p>4. These instructions may please be brought out to the notice of all concerned including attached and subordinate offices.</p>

<blockquote class="tr_bq"><p><b>Subject: Policy guidelines for Extension of tenure of Board level Incumbents where vigilance clearance is not available.</b></p></blockquote>
<div>
<p>As per extant policy, in case the initial term of 05 years of a Board-level appointee come to an end prior to his/her date of superannuation, extension of his/her tenure upto the date of superannuation is considered with the approval of the ACC subject to his/her being free from vigilance angle and meeting the prescribed performance parameters. In terms of existing instructions, services of any Board-level appointee cannot be terminated on completion of his Initial term, if he/she is due for extension, without specific orders of the ACC. There are many cases, however, where vigilance clearance Is not given in time by CVC/concerned administrative Ministry/Department due to complaints/inquiries pending against the concerned officer.</p>

<p>2. The issue of extension of tenure of Board level incumbents has been examined and with the approval of the ACC, It has been decided to henceforth follow the following procedure In this regard :-</p>
</div>
<div>
<p>&nbsp;</p>
<p>(I) As in the case of fresh appointments, in line with CVC’s instructions dated 31.08.2004, no cognizance should be taken of any complaint which Is received within 06 months prior to the terminal date of the approved tenure of Board-level appointees. This is Imperative as it has been frequently observed that there is a spate of allegations and complaints against Board-level officials whose cases become due for extension of tenure.</p>

<p>&nbsp;</p>
<p>(II) The Department should take a conscious decision on whether to extend the term of a Board-level appointee at least one year In advance of the completion of his initial term so that adequate time Is available for the Department to obtain CVC clearance.</p>
</div>

<p>&nbsp;</p>
<p>(III) Taking into account the vigilance status as on the date six months before the terminal date of initial appointment, the CVC may give its clearance within two months of receiving the reference in this regard from the Administrative Ministry, This limit of two months will Include time taken for back references, CBI references/inquiries, etc.</p>

<p>&nbsp;</p>
<p>(IV) Even though complaints received after the cut-off date shall have no bearing upon the process of extension of tenure and would not prejudice the same, such complaints shall be dealt with as per the</p>
</div>
<div>
<p>normal procedure. Disregarding such complaints received after the cutoff date at the time of deciding upon extension of tenure may not be of any serious consequence as the appointment can always be terminated at a later date if the charges are substantiated on the basis of an inquiry.</p>
</div>
<div>
<p>&nbsp;</p>
<p>(V) (a) In respect of the cases where CVC clearance has been delayed beyond the prescribed timelines, merely on account of procedural reasons, and where there is no denial of vigilance clearance, the case of extension could be processed without waiting any further,</p>
</div>
<div>
<p>(b) In respect of the cases where CVC clearance is awaited, and there are cases/complaints pending against the officer, the Ministry shell submit to ACC, a proposal for extension of tenure, at least two months prior to the officer’s approved tenure with:</p>
</div>
<div>
<p>(i) all available information in respect of the complaint;</p>
</div>
<div>
<p>(ii) material received from/sent to CVC, including enquiry report, if any, of the CVO of the Ministry;</p>
</div>
<div>
<p>(iii) the comments of the Ministry thereon.</p>
</div>

<div>
<p> 3. All the Ministries/Departments are requested to strictly adhere to the time-line and procedural guidelines stipulated above for processing the proposals for extension of tenure of Board level appointees.</p>

<div>The undersigned is directed to refer to this Departments OM No.18/2/2007-CS-I dated 20.05.2014 and subsequent clarifications issued vide OM dated 08.07.2014 on the subject mentioned above.</div>
<div></div>
<div>2. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04 1988, 23.02 1994 and 08.10.1996 and where conditions laid down in the OM dated 04.11.1993 are also not fulfilled, may be reviewed and pay re-fixed accordingly. They were further requested that the excess payments made to the employees in the cases of wrong stepping up of pay may be recovered in terms of DOP&amp;Ts OM No.18/26/201 1-Estt(Pay-I) dated 06.02.2014 and a compliance report in this regard furnished to this Department by 31.08.2014. However the compliance reports are still awaited from the Ministries/Departments.</div>

<div>4. The Ministries/Departments are once again requested to furnish the compliance report in this regard immediately.</div>

<p>Sir,<br />
I am directed to refer to the provisions of Rule 9(i) of the AIS (Study Leave) Regulations, 1960, which mandates every member of the Service who has been granted Study Leave or extension of such leave shall be required to execute a bond as given in Appendix ‘A’ or Appendix ‘A.I’.</p>
<p>2. The said Bond executed by member of the Service requires putting in specified period of service after expiry of the Study Leave as prescribed by provisions of rule 9(2) of the said rules.</p>
<p>3. It has come to the notice of this Department that the provisions of the aforesaid bond are being circumvented and officers who have availed Study Leave proceed on prolonged spells of leave due and admissible to them and thus do not put in active service for the requisite period as indicated in the bond executed by them,</p>
<p>4. In view of the above, the provisions of the prescribed format of the Bond have been reviewed and decided to revise the Bond format. A copy of revised Bond is enclosed All the Ministries/Departments/State Governments are requested to ensure that the necessary Bond in respect of grant of Study Leave under the AIS (Study Leave) Regulations, 1960 may henceforth be obtained in the revised formats.</p>
<p>5. The contents of this letter may be brought to the notice of all the members of the All India Services.</p>
